की उप धारा (3) और धारा 2 की धारा (41) के साथ प्रदत्त िजियों का प्रयोग करते हुए और मोटर वाहन एग्रीगेटर
ददिाजनदेि, 2020 के अनुसरण और अनुपालन में जारी की गई अजधसूचना सड़क, पररवहन और राजमागग मंत्रालय, भारत
सरकार के ददनांक 26 नवंबर, 2020 के क्रमांक एस.ओ.4251 (ई), राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार के लेजटटनेंट
गवनगर एतदद्वारा मसौदा योजना प्रकाजित करते हैं, जजसका नाम है, '(द ददल्ली मोटर व्हीकल लाइसेंससग ऑफ एग्रीगेटर)
(प्रीजमयम बसें) योजना, 2023 से प्रभाजवत होने वाले सभी व्यजियों की जानकारी के जलए और इसके द्वारा नोरटस ददया
जाता है दक ददल्ली राजपत्र में इसके प्रकािन की तारीख से 30 ददनों की समाजि पर या उसके बाद उि मसौदा योजना पर
जवचार दकया जाएगा।
इस संबंध में आपजत्तयां या सुझाव प्रमुख सजचव-सह-आयुि (पररवहन), राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार, को

मसौदा योजना:
1. संजक्षि िीर्गक, आवेदन और प्रारंभ:
(क) इसे "ददल्ली मोटर वाहन लाइसेंससग एग्रीगेटर (प्रीजमयम बसें) योजना, 2023" कहा जाएगा।
(ख) यह राष्ट्रीय राजधानी क्षेत्र ददल्ली के पररवहन जवभाग, राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार द्वारा प्रदान दकए
गए वैध एग्रीगेटर लाइसेंस के तहत संचाजलत सभी प्रीजमयम बसों पर लागू होगा, जो राष्ट्रीय राजधानी क्षेत्र
ददल्ली के भीतर संचाजलत होती हैं।
(ग) यह आजधकाररक राजपत्र में इसके प्रकािन की तारीख से प्रभावी होगा।
2. पररभार्ाएँ:
(1) इस योजना में, जब तक दक संदभग से अन्यथा अपेजक्षत न हो:
(क) अजधजनयम" का अथग है मोटर वाहन अजधजनयम, 1988 (1988 का केंद्रीय अजधजनयम 59).
(ख) "अपीलीय प्राजधकारी" का अथग सजचव, राज्य पररवहन प्राजधकरण, पररवहन जवभाग, राष्ट्रीय राजधानी क्षेत्र
ददल्ली सरकार, कजथत योजना के तहत लाइसेंस के अनुदान और नवीनीकरण के संबंध में अपील पर जवचार
करने के उद्देश्य से है;
(ग) "ऐप" का अथग लाइसेंस धारक या लाइसेंस धारक की ओर से दकसी तीसरे पक्ष द्वारा संचाजलत एक
इलेक्ट्रॉजनक इंटरफेस है जजसे कंप्यूटर संसाधन या संचार उपकरण के माध्यम से एक्ट्सेस दकया जा सकता है;
(घ) "सक्षम प्राजधकारी" का अथग उप सजचव, राज्य पररवहन प्राजधकरण, पररवहन जवभाग, राष्ट्रीय राजधानी क्षेत्र
ददल्ली सरकार उि योजना के प्रावधानों के तहत लाइसेंस प्रदान/नवीनीकृत/ जनलंजबत/रद्द करेगा;
(ङ) "लाइसेंस धारक" का अथग एक व्यजि या संस्ट्था है जो इस योजना के तहत बसों के संचालन के जलए पररवहन
जवभाग, राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार द्वारा जारी लाइसेंस रखता है;
(च) "पैसेंजर मैजनफेस्ट्ट" का अथग है उन व्यजियों का जडजजटल ररकॉडग जो यात्रा के दौरान प्रीजमयम बस में यात्रा
करने की संभावना रखते हैं और जजनकी ओर से लाइसेंस धारक बस के माजलक के साथ व्यि या जनजहत
अनुबंध में प्रवेि करता है, या इस योजना के अनुसार संपूणग रूप से वाहन दकराए पर लेने के जलए उसके द्वारा
अजधकृत कोई व्यजि;
(छ) "परजमट" का अथग मोटर वाहन अजधजनयम -1988 की धारा -74 के तहत पररवहन जवभाग, राष्ट्रीय राजधानी
क्षेत्र ददल्ली सरकार द्वारा जारी एक वैध अनुबंध कैररज परजमट है;
(ज) "प्रीजमयम बस" का अथग जनम्नजलजखत सुजवधाओं के साथ 12 से अजधक याजत्रयों की बैठने की क्षमता वाला एक
लक्ट्जरी सावगजजनक सेवा वाहन है
एयर कंडीिनर, वाई-फाई, जीपीएस, सीसीटीवी, पैजनक बटन, 2 x 2 सीटें, ररक्ट्लाइसनग सीटें या समय-समय पर
योजना में िाजमल कोई अन्य जवजनदेि / सुजवधा।
जववि पररजस्ट्थजतयों में उजचत समझी जाने वाली अन्य जवजिष्टताओं/ितों को पररवहन जवभाग द्वारा समय-
समय पर िाजमल दकया जाएगा;
(झ) "स्ट्टैंड फीस" का अथग पररवहन जवभाग, राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार द्वारा याजत्रयों को लेने और
छोड़ने के जलए बस कतार आश्रयों का उपयोग करने के जलए जनधागररत िुल्क है;
(2) इस योजना में प्रयुि िब्द और अजभव्यजियां, लेदकन यहां पररभाजर्त नहीं हैं, का वही अथग होगा जो उन्हें
अजधजनयम में जनर्ददष्ट दकया गया है।
3. एग्रीगेटर लाइसेंस प्रदान करने की पात्रता:
(1) लाइसेंस धारक न्यूनतम 50 प्रीजमयम बसों के एक बेड़े का संचालन और रखरखाव करेगा, जजसे लाइसेंस प्रदान
करने के ददन से 90 ददनों के भीतर चालू दकया जाना है।

(2) आवश्यकता पड़ने पर समय-समय पर सक्षम प्राजधकारी द्वारा प्रीजमयम बसों की न्यूनतम और अजधकतम संख्या
की आवश्यकता को संिोजधत दकया जा सकता है।
(3) लाइसेंस धारक, याजत्रयों के जलए और उनकी ओर से, संभाजवत मागग जनधागररत कर सकता है, जजस पर उसके
द्वारा संचाजलत वाहन चलेंगे।
बिते दक यातायात पुजलस द्वारा यातायात को जनयंजत्रत करने के जलए अजधकृत एजेंसी या मागग को जनयंजत्रत
करने और बनाए रखने के जलए दकसी अन्य स्ट्थानीय जनकाय द्वारा स्ट्व-जनधागररत संभाजवत मागों पर आपजत्त नहीं
की जा सकती है, यदद आपजत्त है, तो स्ट्व-जनधागररत मागग समाि हो जाएंगे।
(4) आम जनता की जानकारी के जलए ऐसे मागों का जववरण मोबाइल या वेब आधाररत एजप्लकेिन पर अजधसूजचत
दकया जाएगा।
(5) जजस मागग पर बस का संचालन हो रहा है उसमें दकसी भी प्रकार का संिोधन/समाजि लाइसेंसधारी द्वारा दकसी
भी जस्ट्थजत में जबना सक्षम प्राजधकारी को सात ददन पूवग सूचना ददये जबना पररवर्ततत नहीं दकया जायेगा। मागग
पररवतगन के प्रभाव की सूचना अनुज्ञजिधारी द्वारा मोबाइल या वेब आधाररत एजप्लकेिन के माध्यम से आम
जनता को भी दी जाएगी।
(6) लाइसेंस धारक द्वारा इस तरह के दकसी भी मागग को समाि नहीं दकया जाएगा, यदद उस मागग के जलए अजग्रम
बुककग/पुजष्ट की जाती है, सेवा समाि करने की दकसी अत्यावश्यकता के मामले में प्रदान की गई बुककग राजि यदद
अजग्रम में प्राि की जाती है तो उसी ददन यात्री को वापस कर दी जाएगी।
(7) लाइसेंस दकसी भी फमग या संस्ट्था को, जो या तो ददवाजलया, या दकसी राज्य पररवहन प्राजधकरण या भारत के
दकसी भी राज्य या केंद्र िाजसत प्रदेि के क्षेत्रीय पररवहन प्राजधकरण द्वारा काली सूची में सूचीबद्ध हो, नहीं ददया
जाएगा।
(8) लाइसेंस धारक के पास सक्षम प्राजधकारी को सूचना के तहत जवजधवत अजधकृत प्रजतजनजध द्वारा प्रबंजधत राष्ट्रीय
राजधानी क्षेत्र (एनसीआर) के भीतर कॉपोरेट या िाखा कायागलय होगा।
(9) इस योजना के तहत लाइसेंस के जलए आवेदन करते समय लाइसेंस धारक को जनम्नजलजखत अजनवायग
आवश्यकताओं के साथ सावगजजनक पररवहन/साझा पररवहन में वाहनों के संचालन/प्रबंधन/वाहनों का कम से कम
03 वर्ग का अजनवायग अनुभव होना चाजहए:-
(क)
जपछले तीन जवत्तीय वर्ों (प्रत्येक वर्ग) के दौरान न्यूनतम 100 यात्री बसों का बेड़ा; या
(ख)
जपछले तीन जवत्तीय वर्ों (प्रत्येक वर्ग) के दौरान न्यूनतम 1000 यात्री कारों का बेड़ा; या
(ग)
यात्री कारों और बसों के जमजश्रत बेड़े के मामले में, कुल न्यूनतम बेड़े कम से कम 100 बसों के बराबर
होना चाजहए। इस उद्देश्य के जलए 10 कारों को 1 बस के बराबर माना जाएगा।
(10) लाइसेंस धारक इस योजना के तहत लाइसेंस जारी करने के अनुरोध के साथ गैर न्याजयक स्ट्टाम्प पेपर पर एक
वचनबद्धत्ता देगा दक वह केंद्रीय मोटर वाहन जनयम -1989 या ददल्ली मोटर वाहन जनयम -1993 या सूचना
प्रौद्योजगकी अजधजनयम, 2000 में जनधागररत सभी लागू प्रावधानों का पालन करेगा।
(11) लाइसेंस धारक के पास संचालन को जनयजमत करने के जलए और सड़क पर अनुिासन बनाए रखने के जलए एक
अनुबंध कैररज परजमट होना चाजहए जो दक केंद्रीय मोटर वाहन अजधजनयम -1988 के अध्याय-VIII & XIII
और ददल्ली मोटर वाहन अजधजनयम 1993 जनयमों के अध्याय-VIII में उल्लेजखत प्रावधानों के अनुसार, लागू
होगा।
(12) लाइसेंस धारक इस योजना के प्रावधानों के अनुसार ऐसे परजमट धारक के वाहन के उपयोग के जलए एक
परजमट धारक के साथ एक अनुबंध करेगा और ऐसा अनुबंध पूरे वाहन के उपयोग के जलए होगा न दक एक भाग
के जलए उसके बाद।
(13) बसों की जनयुजि बस कोड अजखल भारतीय मानक (एआईएस) 052 के अनुसार अपने बेड़े (जमनी / जमडी /
मानक आकार) में बसों के आकार को तय करने के जलए सीजमत लाइसेंस धारक की स्ट्वतंत्रता पर होगी।

4. लाइसेंस देने/नवीनीकरण की प्रदक्रया:
(1) कोई भी व्यजि इस योजना के संलग्न प्रपत्र 1 में लाइसेंस प्रदान करने के जलए जनधागररत िुल्क के साथ भुगतान के
प्रमाण और इस योजना के खंड-5 में उजल्लजखत सुरक्षा जमा के साथ जनम्नजलजखत दस्ट्तावेजों के साथ आवेदन कर
सकता है:-
(क)
वैध परजमट की एक सच्ची प्रजत के साथ संलग्न होने का प्रस्ट्ताव करने वाले सभी वाहनों की सूची।
(ख)
सभी वाहनों के जलए पयागि पार्ककग स्ट्थान उपलब्ध होने का प्रमाण।
(ग)
लीज समझौते में एक बार में कम से कम एक वर्ग की अवजध के जलए लाइसेंस धारक के पक्ष में ऐसे वाहनों
के प्रभावी जनयंत्रण और कब्जे के हस्ट्तांतरण का जवजिष्ट प्रावधान होना चाजहए।
(घ)
प्रत्येक बस के पंजीकरण प्रमाणपत्र और बीमा की प्रजत।
(ङ)
वाहन की दफटनेस जजसमें यह दिागया गया हो दक बस में सीसीटीवी और अन्य अजनवायग आवश्यकताएं
ठीक से स्ट्थाजपत हैं।
(च)
संचालन को जवजनयजमत करने और सड़क पर अनुिासन बनाए रखने के संबंध में गैर-न्याजयक स्ट्टांप पेपर
में अंडरटेककग और मोटर वाहन अजधजनयम 1988 के अध्याय-VIII और XIII के प्रावधानों के दायरे में लाने
के जलए ददल्ली मोटर वाहन अजधजनयम 1993 के अध्याय-VIII के अनुसार अनुबंध कैररज परजमट का
कब्जा आवश्यक है।
(2) ऐसे आवेदन प्राि होने पर, पावती ऑनलाइन जारी की जाएगी।
(3) सक्षम प्राजधकारी स्ट्वयं को संतुष्ट करने के बाद दक सभी आवश्यक आवश्यकताएं और दस्ट्तावेज सही पाए गए हैं,
या तो आवेदन प्राि होने की तारीख से तीस ददनों की अवजध के भीतर लाइसेंस प्रदान करेगा या दकसी जवसंगजत
के मामले में इस संबंध में पूर्तत के जलए आवेदक को जानकारी देगा।
(4) लाइसेंस प्रदान करने/नवीनीकरण के जलए कोई भी आवेदन आवेदक को सुनवाई का उजचत अवसर ददए जबना
अस्ट्वीकार नहीं दकया जाएगा।
(5) लाइसेंस पांच साल की अवजध के जलए वैध होगा।
(6) लाइसेंस का नवीनीकरण स्ट्वचाजलत नहीं है और लाइसेंस धारक के अजधकार के रूप में उपलब्ध नहीं है और यह
योजना के संतोर्जनक अनुपालन और सुरक्षा ररकॉडग, उपभोिा संतुजष्ट और सेवा की समग्र गुणवत्ता को ध्यान में
रखते हुए होगा। लाइसेंस धारक, दकसी अन्य पैरामीटर (एस) के साथ जो सक्षम प्राजधकारी द्वारा प्रासंजगक माना
जा सकता है।
(7) लाइसेंस धारक को लाइसेंस के नवीनीकरण के जलए प्रवतगन िाखा और ददल्ली रैदफक पुजलस से क्ट्लॉज-5 चालान
जनकासी प्रमाण पत्र में उजल्लजखत िुल्क के साथ संलग्न फॉमग 1 में एक आवेदन प्रस्ट्तुत करना होगा।
(8) अनुज्ञजि के नवीनीकरण के जलए आवेदन इसकी समाजि की तारीख से कम से कम 90 ददन पहले दकया जाएगा।
हालांदक, सक्षम प्राजधकारी अंजतम जतजथ के बाद लाइसेंस के नवीनीकरण के जलए आवेदन पर जवचार कर सकता
है, अगर यह संतुष्ट है दक आवेदक को जनधागररत समय के भीतर आवेदन करने से अच्छे और पयागि कारण से रोका
गया था, जो योजना के खंड 10 (4) में जनधागररत िुल्क के भुगतान के अधीन है। ।
(9) लाइसेंस की समाजि की तारीख से पांच साल की अवजध के जलए लाइसेंस का नवीनीकरण दकया जाएगा।
5. िुल्क और सुरक्षा जमा:
(1) लाइसेंस देने के जलए नीचे उजल्लजखत िुल्क और सुरक्षा जमा के साथ आवेदनों पर जवचार दकया जाएगा:

(2) स्ट्वच्छ पररवहन जवकल्पों को बढावा देने के जलए इलेजक्ट्रक बसों पर कोई लाइसेंस िुल्क नहीं लगाया जाएगा।
(3) बस कतार आश्रयों के उपयोग के जलए एक अजतररि स्ट्टैंड िुल्क का भुगतान पररवहन जवभाग, जी राष्ट्रीय राजधानी
क्षेत्र ददल्ली सरकार द्वारा समय-समय पर अजधसूजचत दकया जाएगा।
6. दकराया और रटकटटग:
(1) लाइसेंस धारक दकसी भी मागग/गंतव्य के जलए उपयुि दकराया संरचना जनधागररत करने के जलए स्ट्वतंत्र होगा। दकराया
आम जनता की जानकारी के जलए मोबाइल और वेब आधाररत एजप्लकेिन पर प्रदर्तित दकया जाएगा।
(2) डायनेजमक प्राइससग की अनुमजत होगी, बिते दक बेस फेयर डीटीसी एसी बसों के पीक फेयर से कम न हो।
(3) लाइसेंस धारक याजत्रयों को केवल मोबाइल और वेब-आधाररत एजप्लकेिन सुजवधा के माध्यम से संलग्न करेगा और कोई
भौजतक रटकट जारी नहीं दकया जाएगा।
(4) याजत्रयों से िुल्क केवल इलेक्ट्रॉजनक/जडजजटल भुगतान माध्यम से वसूल दकया जाएगा।
7. लाइसेंस धारक के दाजयत्व:
(1) लाइसेंस धारक इस योजना के तहत लगाए गए प्रत्येक वाहन के जलए और उसके संबंध में जनम्नजलजखत ितों का पालन
करने के जलए जजम्मेदार होगा, अथागत्:
(क) लाइसेंस धारक, वाहन की प्रत्येक यात्रा िुरू करने से पहले, अपने मोबाइल और वेब-आधाररत एजप्लकेिन पर,
ऐसी यात्रा का मागग, वाहन, प्रीजमयम बस चालक और/या अन्य कमगचाररयों और एक का जववरण देगा। उस
यात्रा के जलए यात्री प्रकट। यात्रा के दकसी भी पड़ाव से याजत्रयों की आगे की बुककग जनष्पाददत की जा सकती है
और यात्री सूची में िाजमल की जा सकती है, बिते ऐसी बुककग बोर्डडग समय से कम से कम 10 जमनट पहले की
जाए। बिते आगे, दक मोबाइल और वेब-आधाररत एजप्लकेिन पर प्रदर्तित यात्री मेजनफेस्ट्ट याजत्रयों के नामों का
खुलासा नहीं करेगा और केवल उनके अंजतम नाम, आयु और सलग का वणगन करेगा, जैसा भी मामला हो;
(ख) कोई भी लाइसेंस सबदु (क) के प्रावधान के संबंध में ऐसे वाहन में दकसी भी व्यजि को यात्रा की अनुमजत नहीं
देगा, जब तक दक उनका नाम यात्री सूची में िाजमल न हो।
(ग) लाइसेंस धारक जिकायत दजग करने की सुजवधा के उद्देश्य से अपने मोबाइल और वेब-आधाररत एजप्लकेिन पर
एक सुजवधा िाजमल करेगा, यदद कोई हो। इसके अलावा लाइसेंस धारक बस के अंदर एक इलेक्ट्रॉजनक जडस्ट्प्ले
बोडग भी लगाएगा जजसमें लाइसेंस धारक द्वारा प्राि तंत्र पर जिकायत दजग कराने के संबंध में जानकारी होगी।
लाइसेंस धारक माजसक आधार पर सक्षम प्राजधकारी को स्ट्पष्टीकरण/स्ट्पष्टीकरण के साथ जिकायत का सारांि
प्रस्ट्तुत करेगा;
(घ) लाइसेंस धारक मजहला याजत्रयों की सुरक्षा सुजनजित करने के जलए उपाय करेगा और मजहला याजत्रयों द्वारा
जिकायतों के त्वररत जनवारण के जलए अपने मोबाइल और वेब-आधाररत एजप्लकेिन पर पैजनक बटन सजहत एक
त्वररत प्रजतदक्रया तंत्र प्रदान करेगा;
(ङ) लाइसेंस धारक दकसी यात्री से दकराया िुल्क स्ट्वीकार करने के बाद दकसी भी यात्रा को रद्द नहीं करेगा, जसवाय
इसके दक कोई अप्रत्याजित घटना हो, जजसके बाद वह एक वैकजल्पक वाहन प्रदान करने या याजत्रयों द्वारा
भुगतान दकए गए दकराए को तुरंत वापस करने का सवोत्तम प्रयास करेगा। ;

(च) खराब होने की जस्ट्थजत में या दकसी अन्य कारण से वैकजल्पक वाहन प्रदान करने में जवफल रहने पर लाइसेंस
धारक, जसवाय अप्रत्याजित घटना के, वह तत्काल धनवापसी करेगा जो प्रत्येक से प्राि राजि के बराबर होगी।
प्रभाजवत याजत्रयों और पूवग-जनधागररत पररसमापन हजागने के माध्यम से उसके आधे के बराबर राजि, और लाइसेंस
धारक की प्रत्येक यात्री के जलए और प्रत्येक यात्री के संबंध में ऐसा भुगतान करने में जवफलता के कारण उसे खंड
11 के तहत जुमागना के भुगतान के जलए उत्तरदायी बनाया जाएगा। ;
(छ) चालक की तस्ट्वीर, लाइसेंस संख्या, यात्री सेवा वाहन बैज संख्या और वाहन के पंजीकरण जचह्न के साथ-साथ
पररवहन हेल्पलाइन नंबर और पुजलस हेल्पलाइन नंबर का जववरण बस के अंदर प्रमुखता से प्रदर्तित दकया
जाएगा, तादक यह याजत्र को सीधे ददखाई दे।
(ज) लाइसेंस धारक यह सुजनजित करेगा दक केवल अजखल भारतीय मानक (एआईएस) 052 (बस कोड), अजखल
भारतीय मानक (एआईएस) 140 (वाहन रैककग प्रणाली, कैमरा जनगरानी प्रणाली, और आपातकालीन अनुरोध)
का अनुपालन करने वाली प्रीजमयम वातानुकूजलत बसें बटन) और अजखल भारतीय मानक 153 मानक (फायर
जडटेक्ट्िन एंड अलामग जसस्ट्टम (FDAS) पररवहन जवभाग द्वारा जनधागररत अन्य जवजिष्टताओं के साथ बेड़े में
िाजमल दकए जाएंगे। एग्रीगेटर अपने बेड़े में बसों के आकार को (जमनी / जमडी / मानक आकार) बस कोड अजखल
भारतीय मानक (एआईएस) 052 के अनुसार तय करने के जलए स्ट्वतंत्र होगा
(झ) लाइसेंस धारक यह सुजनजित करेगा दक प्रत्येक यात्रा के दौरान याजत्रयों की गजतजवजधयों को ररकॉडग करने के
जलए प्रत्येक वाहन में कम से कम दो सीसीटीवी कैमरे स्ट्थाजपत दकए जाने चाजहए और जजसकी ररकॉर्डडग लाइसेंस
धारक द्वारा कम से कम पंद्रह ददनों के जलए संग्रहीत की जाएगी। प्रत्येक यात्रा की तारीख और दकसी भी कानून
लागू करने वाली एजेंसी द्वारा मांगे जाने पर उसे प्रस्ट्तुत करना;
(ञ) बसों/रूटों की खोज, बुककग सवारी और जडजजटल भुगतान करने के जलए पररवहन जवभाग द्वारा तैनात वतगमान
जडजजटल समाधान वन ददल्ली ऐप के साथ प्रस्ट्ताजवत सेवा का सलक प्रदान करने के जलए लाइसेंस धारक
जजम्मेदार होगा।
(ट) लाइसेंस धारक यह सुजनजित करेगा दक मोटर वाहन अजधजनयम -1988 के अध्याय-XI अजधजनयम के
प्रावधानों को सुजवधाजनक बनाने के जलए वाहन में रहने वालों (चालक और कंडक्ट्टर सजहत) के जलए वाहन को
बीमा की पॉजलसी द्वारा कवर दकया जाना चाजहए जो कम से कम 10 लाख रुपये का आकजस्ट्मक कवरेज प्रदान
करेगा।
(ठ) लाइसेंस धारक यह सुजनजित करेगा दक योजना के तहत तैनात प्रत्येक वाहन के पास हर समय केंद्रीय मोटर
वाहन जनयमावली 1989 के जनयम 62 के साथ परठत मोटर वाहन अजधजनयम-1988 की धारा-56 के तहत
दफटनेस का वैध प्रमाण पत्र होगा।
(ड) लाइसेंस धारक यह सुजनजित करेगा दक वैध वैधता वाले अजग्निामक प्रत्येक बस में स्ट्थाजपत दकए जाएंगे और
केंद्रीय मोटर वाहन जनयम, 1989 के प्रावधानों के तहत प्राथजमक जचदकत्सा दकट ले जाएंगे;
(ढ) लाइसेंस धारक यह सुजनजित करेगा दक संचाजलत करने के जलए योजना के तहत तैनात प्रत्येक बस के पास
ददल्ली मोटर वाहन जनयम-1993 राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार के जनयम 35 के तहत एक वैध प्रदूर्ण
प्रमाण पत्र होगा;
(ण) लाइसेंस यह सुजनजित करेगा दक याजत्रयों की संख्या पंजीकरण प्राजधकरण द्वारा जवजधवत प्रदान दकए गए
पंजीकरण प्रमाण पत्र में उजल्लजखत अनुसार से अजधक नहीं होगी;
(त) लाइसेंस धारक एक यात्री वाहन के उपयोग के संबंध में सभी लागू ितों का पालन करेगा जैसा दक अनुबंध कैररज
बसों के मामले में होता है और इसके दकसी भी उल्लंघन को प्रवतगन एजेंजसयों द्वारा उपयुि कारगवाई करने के
उद्देश्य से उल्लंघन के रूप में माना जाएगा। अध्याय-VIII: मोटर वाहन अजधजनयम -1988 के यातायात का
जनयंत्रण और उसके तहत बनाए गए जनयम और ददल्ली मोटर वाहन जनयम -1993 में जनधागररत जवजभन्न
प्रावधान;
(थ) लाइसेंस धारक जैसा भी मामला हो, यह सुजनजित करेगा दक वाहन के चालक के पास सावगजजनक सेवा वाहन
बैज के साथ बस चलाने के जलए आवश्यक ड्राइसवग लाइसेंस की श्रेणी होनी चाजहए।

(द) लाइसेंस धारक जैसा भी मामला हो, यह सुजनजित करेगा दक इस तरह लगे चालक मोटर वाहन अजधजनयम -
1988 और उसके तहत बनाए गए जनयमों और ददल्ली मोटर वाहन जनयम -1993 में जनर्ददष्ट सभी आवश्यक
प्रावधानों का पालन करेंगे। आगे वाहन चालक के जवरुद्ध कोई आपराजधक कृत्य पाया जाता है तो अनुज्ञजिधारी
के जवरुद्ध धारा-53, 54 एवं 55 के प्रावधानों के तहत अपराध करने की गंभीरता को देखते हुए कायगवाही की
जायेगी। मोटर व्हीकल एक्ट्ट-1988 की धारा-19 के तहत चालक का लाइसेंस रद्द करना।
(ध) लाइसेंस धारक यह सुजनजित करेगा दक उत्सजगन मानदंड सीएनजी वाली बसों का अजधग्रहण योजना की
अजधसूचना की तारीख से तीन साल पुराना नहीं होगा। इसके बाद दकसी भी नई बस को िाजमल करना, प्रचजलत
उत्सजगन मानदंड, BS-VI का अनुपालन करना चाजहए, या तो वातानुकूजलत CNG/इलेजक्ट्रक बसें। 1 जनवरी,
2024 के बाद केवल इलेजक्ट्रक बसों को िाजमल करने की अनुमजत दी जाएगी, इस योजना के तहत बीएस-VI
अनुपालन होने पर भी सीएनजी संचाजलत बसों को िाजमल करने की अनुमजत नहीं दी जाएगी।
(न) लाइसेंस धारक सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का केंद्रीय अजधजनयम 21) और उसके तहत बनाए
गए जनयमों और जवजनयमों के प्रावधानों का पालन करेगा।
(ऩ) लाइसेंस धारक कायगस्ट्थल पर मजहलाओं के यौन उत्पीड़न (रोकथाम, जनर्ेध और जनवारण) अजधजनयम, 2013 के
अनुसार मजहला कमगचाररयों के अजधकारों की रक्षा के जलए जनधागररत तंत्र को सुजनजित करेगा और जविाखा
ददिा-जनदेिों के तहत मजहला कमगचाररयों की जिकायत को दूर करने के जलए सजमजत के गठन के संबंध में
माननीय सवोच्च न्यायालय के आदेि का अनुपालन भी सुजनजित करेगा।
(प) लाइसेंस धारक एनसीआर क्षेत्र में अपनी सभी बसों के जलए पयागि रात भर की पार्ककग की उपलब्धता सुजनजित
करेगा, दकसी भी पररजस्ट्थजत में, राष्ट्रीय राजधानी क्षेत्र ददल्ली के भीतर सड़कों, गजलयों आदद सजहत दकसी भी
सावगजजनक स्ट्थान पर पार्ककग की अनुमजत नहीं दी जाएगी।
8. डीटीसी बस कतार आश्रयों का उपयोग:
(1) अनुज्ञजिधारी एवं चालक को अजधसूजचत बस क्ट्यू िेल्टरों पर ही याजत्रयों को चढाना एवं उतारना होगा। बस क्ट्यू
िेल्टरों के उपयोग के जलए िुल्क का भुगतान सीधे ददल्ली रांसपोटग इंफ्रास्ट्रक्ट्चर डेवलपमेंट कंपनी जलजमटेड को
अलग से दकया जाएगा।
(2) ददल्ली रांसपोटग इंफ्रास्ट्रक्ट्चर डेवलपमेंट कंपनी जलजमटेड द्वारा स्ट्थाजपत एकल जखड़की तंत्र के माध्यम से दकसी भी
अजतररि हॉसल्टग स्ट्टेिनों का अनुरोध दकया जाएगा।
9. ब्ांसडग और जवज्ञापन:
(1) इस योजना के तहत िाजमल की जाने वाली सभी प्रीजमयम बसें एक समान रंग और लोगो का पालन करेंगी जैसा
दक पररवहन जवभाग, राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार द्वारा जनधागररत दकया गया है।
(2) लाइसेंस धारक को लागू कानूनों के अनुपालन में गैर-वाजणजज्यक आधार पर बसों के अंदर जवज्ञापन देने का
अजधकार होगा तादक प्रीजमयम बस योजना के बारे में जागरूकता पैदा की जा सके।
(3) अनुज्ञजिधारी को संबंजधत प्राजधकाररयों का अनुमोदन प्राि करने के पिात् अजतररि राजस्ट्व अर्तजत करने के जलए
पररजनयोजजत बसों के भीतर जवज्ञापन स्ट्थान बेचने का अजधकार होगा।
(4) दकसी भी पररजस्ट्थजत में इसे लाइसेंस धारक द्वारा सरकारी उपक्रम होने के रूप में घोजर्त नहीं दकया जाएगा।
10. ितों/दाजयत्वों के उल्लंघन के जलए दंड:
(1) ददल्ली मोटर वाहन लाइसेंससग ऑफ एग्रीगेटर (प्रीजमयम बसें) योजना, 2023 में जनधागररत दकसी भी दाजयत्व या
ितों के दकसी भी उल्लंघन की जस्ट्थजत में, लाइसेंस धारक मोटर वाहन अजधजनयम 1988 की धारा 193 के
प्रावधानों के अनुसार दंड के जलए उत्तरदायी होगा। ।
(2) यह योजना अजधजनयम के तहत प्रदान दकए गए अनुपालन और दंड के अलावा लागू / लागू करने योग्य होगी और
अजधजनयम के मौजूदा प्रावधानों और उसके तहत बनाए गए जनयमों के साथ पढी जाएगी।

(3) अनुज्ञजि प्रदान करने की जतजथ से 90 ददनों के भीतर योजनान्तगगत आवश्यक न्यूनतम संख्या में बसों के
संचालन/अनुरक्षण में जवफल रहने की जस्ट्थजत में सुनवाई का उजचत अवसर देते हुए जमा की गई समस्ट्त जमानत
राजि जब्त कर ली जायेगी।
(4) लाइसेंस के नवीनीकरण के जलए आवेदन जमा करने की अंजतम जतजथ लाइसेंस की समाजि की जतजथ से नब्बे ददन
पहले होगी। उदाहरण के जलए, यदद जनयत तारीख तक आवेदन जमा नहीं दकया जाता है, तो जनम्नजलजखत जवलंब
िुल्क देय होगा:-

1000/- (एक हजार मात्र) रु.
रु. एक हजार से अजधक रु. 100/- प्रजत ददन
(5) मोटर वाहन अजधजनयम 1988 के अध्याय VIII और अध्याय XIII और ददल्ली मोटर वाहन जनयम 1993 के
अध्याय-VIII और मोटर-वाहन-ड्राइसवग-जवजनयमन अजधजनयम 2017 के प्रावधान इस योजना और कारगवाई के
तहत संचाजलत वाहनों पर लागू होंगे। जैसा जनधागररत है, उनके जखलाफ कारगवाई की जाएगी।
11. जुमागने की वसूली:
जुमागना लगाने और नोरटस की तारीख से पंद्रह ददनों की अवजध के भीतर भुगतान करने में जवफल रहने की जस्ट्थजत में, सक्षम
प्राजधकारी लाइसेंस धारक को सुनवाई का उजचत अवसर प्रदान करने के बाद लाइसेंस को जनलंजबत या रद्द कर सकता है।
12. लाइसेंस का जनलंबन और रद्दीकरण:
(1) लाइसेंस धारक को सुनवाई का अवसर देने के बाद, सक्षम प्राजधकारी 6 महीने से अजधक की जनर्ददष्ट अवजध के जलए
लाइसेंस को जनलंजबत कर सकता है, यदद यह राय है दक-
(क) लाइसेंस धारक से जुड़ी कोई भी बस, मोटर वाहन अजधजनयम 1988 के तहत कानूनी अनुपालन के जडफॉल्ट में
है;
(ख) दकसी भी बस को लेन ड्राइसवग की ितों का उल्लंघन करते हुए, तेज गजत और रैि ड्राइसवग में पाया जाता है।
(ग) लाइसेंस धारक मोटर वाहन अजधजनयम 1988 और उसके तहत बनाए गए जनयमों के प्रावधानों के अनुपालन में
बस को बनाए रखने में जवफल रहा है; या इस योजना के प्रावधान के साथ; या खंड -7 में उजल्लजखत दाजयत्वों।
(घ) कोई भी बस चालक मजहलाओं/जवकलांगों/वररष्ठ नागररक जविेर् रूप के साथ दकसी भी दुव्यगवहार या दुराचार
का दोर्ी पाया जाता है।
(2) जहां कोई परजमट रद्द या जनलंजबत होने के जलए उत्तरदायी है और यदद पररजस्ट्थजतयां उत्पन्न होती हैं, तो सक्षम
प्राजधकारी, परजमट को रद्द या जनलंजबत करने के बजाय, लाइसेंस धारक से सुरक्षा जमा के आधे के बराबर राजि की वसूली
कर सकता है। जो दक धारा 5(बी) में वर्तणत सुरक्षा राजि जमा कर लाइसेंस धारक द्वारा लगायी गयी बसों की संख्या के
संबंध में पररवतगन।
13. अपील:
(1) सक्षम प्राजधकारी के दकसी भी आदेि से व्यजथत कोई व्यजि आदेि की प्राजि के तीस ददनों के भीतर अपीलकताग
प्राजधकारी को अपील कर सकता है।
(2) अपीलकताग प्राजधकरण के आदेि पर आपजत्तयों के आधार को जनधागररत करते हुए एक ज्ञापन के रूप में एक अपील
को दो प्रजतयों में प्रस्ट्तुत दकया जाएगा और ददल्ली मोटर वाहन जनयम 1993 में जनर्ददष्ट 500 / - रुपये की फीस के
साथ होगा। पंजीकरण प्राजधकरण के आदेि के जखलाफ अपील के जलए भुगतान की जाने वाली फीस के बराबर
होगा।
(3) अपीलकताग प्राजधकारी, पक्षों को सुनवाई का उजचत अवसर देने के बाद और ऐसी जांच के बाद उजचत आदेि
पाररत कर सकता है।
14. राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार की िजियां और उत्तरदाजयत्व।
(1) राष्ट्रीय राजधानी क्षेत्र ददल्ली की सरकार को एग्रीगेटर से ऐसी जानकारी और दस्ट्तावेजों की मांग करने का
अजधकार होगा, जैसा दक एग्रीगेटर द्वारा पूवग जलजखत सूचना के अनुसार योजना के अनुपालन को सुजनजित करने
के जलए उपयुि समझा जाता है।

(2) राष्ट्रीय राजधानी क्षेत्र ददल्ली की सरकार के पास योजना के प्रभावी कायागन्वयन के जलए योजना के फॉमग 1 में
जनर्ददष्ट एग्रीगेटर के पररसर की खोज और जांच करने की िजि होगी;
(3) राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार सड़क पररवहन और राजमागग मंत्रालय, भारत सरकार द्वारा संचाजलत
वाहन और सारथी पोटगल तक पहुंच प्रदान करेगी तादक एग्रीगेटर को ऐप के साथ एकीकृत वाहनों और ड्राइवरों
के जववरण को अपडेट करने में सक्षम बनाया जा सके।
(4) राष्ट्रीय राजधानी क्षेत्र ददल्ली की सरकार खंड 14(1) के तहत एग्रीगेटर से प्राि दस्ट्तावेजों और सूचनाओं की पूरी
गोपनीयता सुजनजित करेगी ।

Section 67read with Section 93 and clause (41) of Section 2 of the Motor Vehicle Act, 1988 and in pursuance and
compliance of the Motor Vehicle Aggregator Guidelines, 2020 issued vide Notification No. S.O.4251 ( E) dated 26th
Nov, 2020 of Ministry of Road, Transport and Highways, Government of India, the Lieutenant Governor of National
Capital territory of Delhi hereby publish the draft scheme namely,„(TheDelhi Motor Vehicles Licensing of
Aggregator (Premium Buses) Scheme, 2023 for information to all persons likely to be affected thereby and notice is
hereby given that said draft scheme will be taken into consideration on or after expiry of 30 days from the date of its
publication in Delhi Gazette.

DRAFT SCHEME:
1.
Short title,application and commencement:
(a)
It shall be called the “The Delhi Motor Vehicles Licensing of Aggregator (Premium Buses)
Scheme, 2023”.
(b)
It shall, apply to all premium buses operated under a valid Aggregator license granted by the
Transport Department, Government of National Capital Territory of Delhi , to operate within the
National Capital Territory of Delhi.
(c)
It shall come into force with effect from the date of its publication in the official gazette.

2.
Definitions:
(1)
In this Scheme, unless the context otherwise requires:
(a) “Act” means the Motor Vehicles Act, 1988 (Central Act 59 of 1988):
(b) “Appellate Authority” means Secretary, State Transport Authority, Department of
Transport, Government of National Capital Territory of Delhi, for the purpose of
entertaining appeal in respect of grant and renewal of license under the said scheme;
(c) "App" means an electronic interface operated by the License holder or any third party on
behalf of the License holder which may be accessed either through a computer resource or
a communication device;
(d) "Competent Authority” means theDeputy Secretary, State Transport Authority,
Department of Transport, Government of National Capital Territory of Delhi shall
grant/renew/suspend/cancel the license,under the provisions of said scheme;
(e) "License Holder" means a person or entity that holds a license for operation of buses
under this scheme as issued by the Transport Department, Government of National Capital
Territory of Delhi;
(f) “Passenger Manifest” means a digital record of persons who are likely to travel in a
premium bus during the course of a trip and on whose behalf the license holder enters into
a contract, express or implied, with the owner of bus, or any person authorized by him for
hiring a vehicle as a whole in accordance with this scheme;
(g) “Permit” means a valid contract carriage permit issued by the Transport Department,
Government of National Capital Territory of Delhi under Section-74 of Motor Vehicle
Act-1988;
(h) “Premium Bus” means a luxury public service vehicle having seating capacity of more
than 12 passengers with the following features:
Air Conditioner, Wi-Fi, GPS, CCTV, Panic Button, 2 x 2 seats, reclining seats or any
other specification / feature as incorporated in the scheme from time to time.
Any other specifications / conditions as deemed fit under the constrained circumstances
will be incorporated time to time by the Transport Department;
(i) “Stand Fee” means the fee, as prescribed by Transport Department, Government of
National Capital Territory of Delhi for using bus queue shelters to pick up and drop
passengers;
2) Words and expressions used in this scheme, but not defined herein, shall have the same meaning as
assigned to them in the Act.
3. Eligibility for grant of aggregator license:
(1)
License holder shall operate and maintain a fleet of minimum 50 premium buses, to be made
operational within 90 days from the day of grant of license.
(2)
The requirement for minimum and maximum number of premium buses may be modified by the
Competent Authority from time to time, if need arises.
(3)
The license holder may, for and on behalf of the passengers, determine potential routes on which the
vehicles operated by it shall ply.
Provided that the self-determined potential routes may not be objected by the Traffic Police
being the agency authorized to control the Traffic or any other Local Bodies controlling and
maintaining the route, if object, the self-determined routes shall stand terminated.
(4)
The details of such routes shall be notified on the mobile or web-based application for information to
the general public.
(5)
No modification/ termination of any route on which the bus is operated shall not be changed by
license holder in any case without intimation to the Competent Authority after giving a notice of
seven days in advance. The effect of the change of route shall also be informed to the general public
by the license holder, through mobile or web-based application.
(6)
No such route shall be terminated by the license holder, if an advance booking/confirmation is made
for that route provided in case of any exigency to terminate the service the booking amount if
obtained in advance shall be returned on the same day to the commuter.

(7)
The license shall not be granted to any firm or entityeither insolvent, or a blacklisted by any State
Transport Authority or Regional Transport Authority of any State or Union Territory of India.
(8)
The license holder shall have the corporate or branch office within National Capital Region (NCR)
managed by duly authorized representative under intimation to Competent Authority.
(9)
The license holder at the time of applying for the license under this scheme shall have the
mandatory experience for at least 03 years for operating/managing/ the vehicles in public
transport/shared transportation along with following mandatory requirements:-
(a) a fleet of minimum 100 passenger buses during the last three financial years (each year); or
(b) a fleet of minimum 1000 passenger cars during the last three financial years (each year); or
(c) In case of a mixed fleet of passenger cars and buses, the total minimum fleet must be equal to
at least 100 buses. For this purpose, 10 cars would be deemed to be equal to 1 bus.
(10)
The license holder shall comply with all the applicable provisions prescribed under the Act and
Rules framed thereunder either as Central Motor Vehicle Rules-1989 or The DelhiMotor
Vehicle Rules -1993 or of the Information Technology Act, 2000 by submitting an undertaking
on non-judicial stamp paper along with the request for issuance of license under this scheme.
(11)
The License holder shall possess a Contract Carriage permit in order to regulate the operation
and to maintain the discipline on road and in the provisions of Chapter-VIII& XIII of Motor
Vehicle Act-1988 read with Chapter-VIII of Delhi Motor Vehicle Rules-1993,shall be applicable
on them.
(12)
The License holder shall entered into a contract with a permit holder for use of the vehicle of
such permit holder in accordance with the provisions of this scheme and such contract shall be
for use of the vehicle as a whole and not for a part thereof.
(13)
The engagement of the buses shall be at the liberty of the license holder confined to decide the
size of the buses in its fleet (Mini / Midi / Standard Size) as per Bus Code All India Standard
(AIS) 052.
4.
Procedure for grant/renewal of the license:
(1) Any person may make an application for grant of license in the Form 1 appended to thisscheme,
accompanied by proof of payment with prescribed fee and security deposit as mentioned in
Clause- 5 of this scheme, along with following documents:-
(a) List of all vehicles that propose to engage along with a true copy of valid permit.
(b) Proof of adequate parking spaces available for all the vehicles.
(c) The lease agreement must contain specific provision of transfer of effective control and
possession of such vehicles in favor of the license holder for a term, at least one year, at a
time.
(d) Copy of Registration Certificate and Insurance of each bus.
(e) Fitness of the vehicle indicating therein that the CCTV and other mandatory requirements
are properly installed in the bus.
(f) Undertaking in non-judicial stamp paper with regard to regulate the operation and to
maintain the discipline on road and to bring within the ambit of provisions of Chapter-
VIII& XIII of Motor Vehicle Act 1988 read with Chapter-VIII of The Delhi Motor Vehicle
Rules 1993, the possession of the Contract Carriage permit is required.
(2)
Upon receipt of such application, the acknowledgement shall be issued online.
(3)
The Competent Authority after satisfying himself that all the necessary requirements and
documents found in order, shall either grant the license within a period of thirty days from the
date of receipt of application or in case of any discrepancy the information in this regard shall be
conveyed to the applicant for fulfillment.
(4)
No application for grant/renewal of license shall be rejected without giving a reasonable
opportunity of being heard to the applicant.
(5)
The licence shall be valid for a period of five years.
(6)
The renewal of the license is not automatic and not available as a matter of right of the license
holder and would be subject to satisfactory compliances with the Scheme and taking into
account the safety records, consumer satisfaction, and overall quality of service of the license

holder, along with any other parameter(s) that may be considered relevant by the Competent
Authority.
(7)
The license holder shall submit an application for renewal of the licence in Form 1 appended
with the fee as mentioned in the Clause-5 challan clearance certificate from Enforcement Branch
and Delhi Traffic Police.
(8)
The application for renewal of license shall be made not less than 90 days before the date of its
expiry. However, Competent Authority may entertain and application for the renewal of the
license after the last date, if it is satisfied that the applicant was prevented by good and sufficient
cause from making an application within the time specified, subject to payment of fees as
prescribed in clause 10 (4) of the Scheme.
(9)
The license shall be renewed for a period of five years from the date of expiry of the license.

(2)
No license fee shall be levied on electric buses to promote the clean transport options.
(3)
An additional stand fee for use of bus queue shelters shall be paid as notified from time to time
by the Transport Department, GNCTD.
6. Fare and Ticketing:
(1)
The license holder shall be at liberty to prescribe a suitable fare structure for any route/
destination. The fare shall be displayed on the mobile and web-based application for the
information of the general public.
(2)
Dynamic pricing shall be permissible provided that the base fare shall not be less than the peak
fare of DTC AC buses.
(3)
The license holder shall engage passengers only through mobile and web-based application
facility and no physical tickets shall be issued.
(4)
The charges from the passengers shall be collected only through electronic/ digital payment mode.
7.
Obligations of license holder:
(1) The license holder shall be responsible for complying with the following conditions for and in
respect of every vehicle deployed under this scheme, namely:
(a) The license holder shall, prior to commencement of each trip of a vehicle, convey on its mobile
and web-based application, the route of such trip, the particulars of the vehicle, premium bus
driver and/or other staff and a passenger manifest for that trip. Further booking of passengers
from any stop in the trip may be executed and included in the passenger manifest provided such
booking shall be executed at least 10 minutes before the boarding time. Provided further, that
the passenger manifest displayed on the mobile and web-based application shall not disclose the
names of the passengers and shall only describe their last name, age and gender, as the case
may be;
(b) License holder shall not allow any person in such a vehicle on any trip with respect to

provision of Clause-(a), unless their name is included in the passenger manifest.
(c) The license holdershall incorporate a feature on its mobile and web-based application for the
purpose of facilitating to lodge complaint if any. Further the license holder shall also affix an
electronic display board inside the bus wherein the information with regard to lodging
complaint on the mechanism derived by the license holder. The license holder shall submit a
summary of complaint along with clarification/explanation to the Competent Authority on
monthly basis;
(d) Thelicense holder shall take measures to ensure the safety and security of women passengers
and shall provide a rapid response mechanism, including a panic button on its mobile and web-
based application, for prompt redressal of complaints by women passengers;
(e) The license holder shall not cancel any trip after accepting the hire charges from a passenger,
save and except upon occurrence of a force majeure, whereupon it shall make best endeavors to
provide an alternative vehicle or to refund the fare paid by passengers forthwith;
(f) The license holder upon failure to provide an alternative vehicle in case of a break-down or
for any other reason, save and except force majeure, he shall make a refund forthwith which
shall be equal to the amount received from each of the affected passengers and an amount
equal to one half thereof by way of pre-determined liquidated damages, and each failure of
the license holder to make such payment for and in respect of each passenger shall make him
liable to payment of a fine under Clause 11thereof;
(g) The details containing the photograph of the driver, license number, Passenger Service
Vehicle Badge number and registration mark of the vehicle, along with Transport Helpline
number and Police Helpline number shall be displayed prominently inside the bus such that it
is directly visible to the passengers.
(h) The license holder shall ensure that only premium air-conditioned buses having compliance
of with All India Standard (AIS) 052 (Bus Code), All India Standard (AIS) 140 (vehicle
tracking system, camera surveillance system, and emergency request button) and All India
Standard 153 standards (Fire Detection and Alarm System (FDAS) with other specifications
as prescribed by the Transport department shall be inducted into the fleet. The aggregator
shall be at liberty to decide the size of the buses in its fleet (Mini / Midi / Standard Size) as
per Bus Code All India Standard (AIS) 052;
(i) The license holder shall ensure that there shall be at least two CCTV cameras must be
installed in each vehicle for recording the movements of passengers during each tripand
recording of which shall be stored by the license holder for at least fifteen days from the date
of each trip and produce the same on demand by any law enforcing agency;
(j) The license holder shall be responsible for providing a link of the proposed service with the
current digital solutionONE DELHI app deployed by Transport Department, for discovering
buses/routes, booking rides and making digital payments.
(k) The license holder shall ensure that the vehicle must be covered by a policy of insurance
which shall provide accidental coverage of not less Rs. 10 lakhs for the occupants of the
vehicle (including driver and conductor) to facilitate the provisions as stipulate in Chapter-XI
of Motor Vehicle Act-1988;
(l) The license holder shall ensure that each and every vehicle deployed under the scheme shall
possess, at all times, a valid certificate of fitness under Section-56 of Motor Vehicle Act-
1988 read with Rule 62 of the Central Motor Vehicle Rules, 1989;
(m) The license holder shall ensure that the fire extinguisher having valid validity shall be
installed in each bus and carry first aid kit as stipulate under the provisions Central Motor
Vehicles Rules, 1989;
(n) The license holder shall ensure that each bus deployed under the scheme to operate shall
possess and carry a valid pollution certificate under rule 35 of NCT of The Delhi Motor
Vehicle Rules-1993;
(o) The license shall ensure that number of passengers shall not exceed over and above as
mentioned in registration certificate duly granted by the registering authority;
(p) The license holder shall comply with all applicable conditions in respect of the use of a
passenger vehicle as in the case of Contract Carriage buses and any violation thereof shall be
treated as violation for the purpose of taking appropriate action by Enforcement Agencies
under the Chapter-VIII : Control of Traffic of Motor Vehicle Act-1988 and Rules framed
thereunder and the various provisions as stipulate in The Delhi Motor Vehicle Rules-1993;

(q) Thelicense holder as the case may be, shall ensure that the driver of the vehicle must possess
the category of the driving license required to operate a bus along with Public Service
Vehicle Badge.
(r) The license holder as the case may be shall ensure that the driver so engaged shall comply all
the necessary provision referred to inMotor Vehicle Act-1988and Rules framed thereunder
and The Delhi Motor Vehicle Rules-1993. Further any act of criminal offence if found
against the driver of the vehicle, the action against the license holder shall be taken under the
provisions of Section-53, 54 & 55 in view of the gravity of the commission of offence in
addition to process of revocation of license of the driver under Section-19 of Motor Vehicle
Act-1988.
(s) The license holder shall ensure that the acquisitionof buses having emission norms CNG shall
not be three years old from the date of notification of the scheme. Subsequently induction of
any new bus, the prevailing emission norms, BS-VI must be compliant, either Air-
Conditioned CNG / electric buses. After January 1, 2024 the induction of electric buses only
shall be allowed, no CNG operated bus even if having BS-VI compliance shall not be
allowed to induct under this scheme.
(t) The license holder shall comply with the provisions of the Information Technology Act, 2000
(Central Act 21 of 2000) and the rules and regulations made thereunder.
(u) The license holder shall ensure stipulated mechanism for protecting the rights of women
employees as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition
and Redressal) Act, 2013 and also ensure to compliance the order of the Hon‟ble Supreme
Court with regard to constitution of committee to address the women employees complaint
under VISHAKHA guidelines.
(v) The license holdershall ensure availability of adequate overnight parking space for all its
buses in NCR region, under no circumstances, parking on any public space including roads,
streets, etc., within National Capital Territory of Delhi would be allowed.
8.
Use of DTC Bus Queue Shelters:
(1) The license holder and driver shall have to pick up and drop passengers at the notified bus queue
shelters only. The fee for usage of bus queue shelters shall be paid separately to Delhi Transport
Infrastructure Development Company Ltd. directly.
(2) Any additional halting stations shall be requested through a single window mechanism established
by the Delhi Transport Infrastructure Development Company Ltd.
9.
Branding and advertising:
(1)
All premium buses inducted under this scheme shall follow a uniform color and logo as prescribed
by Transport Department, Government of National Capital Territory of Delhi.
(2)
The license holdershall have the right to advertise inside the buses, on a non-commercial basis, in
compliance with applicable laws so as to create awareness about the premium bus scheme.
(3)
The license holder shall have the right to sell advertising space inside the deployed buses to earn
additional revenue, after obtaining the approval of concerned authorities.
(4)
Under no circumstances it shall be proclaimed by license holder as being Govt. undertaking.
10. Penalty for Violation of conditions/obligations:
(1) In the event of any violation of any obligations or conditions prescribed in TheDelhi Motor
Vehicles Licensing of Aggregator (Premium Buses) Scheme, 2023, the license holder shall be
liable for penalty in accordance with the provisions of Section 193 of the Motor Vehicle Act 1988.
(2) This scheme shall be applicable/enforceable in addition to the compliances and penalties provided
under the Act and shall be read in conjunction with the existing provisions of the Act& Rules
made thereunder.
(3) In case of failure to operate/maintain, the minimum number of buses requiredunder the scheme
within 90 days from the date of grant of license, the entire security deposited shall be forfeited
after giving reasonable opportunity of being heard.
(4)
The last date for submitting application for renewal of license shall be Ninety days prior to the date
of expiry of the license. In instance if the application is not submitted by the due date, the
following late fee shall be payable:

(5)
The provisions of Chapter VIII & ChapterXIII of Motor Vehicle Act 1988 and Chapter-VIII of
The Delhi Motor Vehicles Rules 1993 and Motor-Vehicle-Driving-Regulation Act 2017 shall be
applicable to the vehicles operated, under this scheme and action as prescribed shall be initiated
against them.
11. Recovery of Penalty:
In case of failure of payment of fine within a period of fifteen days from the date of imposition and
notice, the Competent Authority may, suspend or cancel the licence after providing a reasonable
opportunity of being heard to the License holder.
12. Suspension and cancellation of license:
(1)
The competent authority may suspend the license for a specified period not exceeding 6 months,
after giving the license holder an opportunity of being heard, if it is of the opinion that-
(a)
Any bus associated with the license holder, is in default of legal compliances under theMotor
Vehicle Act 1988 ;
(b)
Any bus is found to be in violation of lane driving conditions, over speeding and rash driving.
(c)
The license holder has failed to maintain the bus in compliance with the provisions of
theMotor Vehicles Act 1988 and or Rules framed thereunder; or with the provision of this
scheme; or the obligations as enumerated in Clause-7.
(d)
Any bus driver is found to be guilty of any misbehavior or misconduct with
women/handicapped/sr. citizens specifically or any other commuter.
(2) Where a permit is liable to be cancelled or suspended and if circumstances so arise, the competent
authority may, instead of cancelling or suspending the permit, recover from the license holder an
amount equivalent to one half of the security deposit that may be varied with respect to the number
of buses engaged by the license holder by depositing the security money as mentioned in clause
5(b).
13. Appeal:
(1)
Any person aggrieved by any order of the Competent Authority may within thirty days of the
receipt of the order, make an appeal to the Appellant Authority.
(2)
An appeal shall be preferred in duplicate in the form of a memorandum setting forth the grounds of
objections to the order of the Appellant Authority and shall be accompanied by fees of Rs 500/- as
specified in The Delhi Motor Vehicle Rules 1993 at par with the fee to be paid for appeal against
the order of Registering Authority.
(3)
The Appellant Authority may, after giving a reasonable opportunity of hearing to the parties and
after such enquiry as it may deem fit pass an appropriate order.
14. Powers & Responsibilities of Government of National Capital Territory of Delhi.
(1)
The Government of National Capital Territory of Delhi shall be empowered to call for such
information and documents from the Aggregator, as deemed fit to ensure compliance by the
Aggregator with the Scheme pursuant to prior written notice.
(2)
The Government of National Capital Territory of Delhi shall have the power to conduct search
and investigation of the Aggregator‟s premises, as specified in Form 1 of the Scheme, for the
effective implementation of the Scheme;
(3)
The Government of National Capital Territory of Delhi shall provide access to the VAHAN and
SARATHI portal operated by the Ministry of Road Transport and Highways, Government of lndia
to enable the Aggregator to update the details of vehicles and Drivers integrated with the App.
(4)
The Government of National Capital Territory of Delhi shall ensure complete confidentiality and
secrecy of the documents and information obtained from the Aggregator under Clause 14(1) and
any such other information which it may call for.
