मीर्र), व 221/2/3(709.901 वगा मीर्र) कुल भूजम क्षेत्र (1169.093वगा मीर्र), बुजनयािी ढांचा पररयोिना के जलए
गांव नांगली रिापुर के संरचना यानी सराय काले खां से मयूर जवहार, नई दिल्ली तक बारापुल्ला नाले के ऊपर एजलवेर्ेड
रोड के तीसरे चरण जनमााण हेतु पररयोिना के जलए भूजम अजधग्रहण हेतु है िो भूजम अजधग्रहण, पुनवाास और पुनः स्ट््ापन
का उजचत मुआविा और पारिर्िाता अजधकार अजधजनयम, 2013के धारा 16के तहत तैयार दकया गया है। इसे भूजम
अजधग्रहण, पुनवाास और पुनःस्ट््ापन (मुआविा और पुनवाास और पुनःस्ट््ापन एवम जवकास योिना जनयम 2015के जनयम
संख्या 7 (5) के अंतगात प्रकजित दकया िा रहा है।

भूजम अजधग्रहण, पुनवाास और पुनः स्ट््ापन का उजचत मुआविा और पारिर्िाता अजधकार अजधजनयम, 2013की
धारा 11की उपधारा (1) के अनुसार गांव नांगली रिापुर के खसरा संख्या 221/2/1 (459.192 वगा मीर्र), व
221/2/3(709.901 वगा मीर्र) कुल भूजम क्षेत्र (1169.093वगा मीर्र)पर बारापुल्ला नाला के ऊपर सराय काले खान से
मयूर जवहार तक एजलवेर्ेड रोड के तीसरे चरण के जनमााण की प्रा्जमक अजधसूचना संख्या ए.डी.एम./एल.ए.सी./
एस.ई./2023/05/860 दिनांक 21.12.2023 को जिलाजधकारी द्वारा िारी दकया गया ्ा।
उपरोि अजधसूचना के अनुसार, संबंजधत भूजम के अजधग्रहण के जलए अजतररि जिला मजिस्ट्रेर् (िजक्षण पूवा) को
उि अजधजनयम की धारा 43की उपधारा (1) के तहत प्रिासक के रूप में जनयुि दकया गया ्ा।
भूजम अजधग्रहण, पुनवाास और पुनःस्ट््ापन का उजचत मुआविा और पारिर्िाता अजधकार अजधजनयम, 2013की
धारा 16के अनुसार प्रिािक द्वारा “ ड्राफ्र् पुनवाास और पुनःस्ट््ापन योिना ” तैयार की िानी है।
क्लेक्र्र द्वारा धारा 11की उप-धारा (1) के तहत प्रारंजभक अजधसूचना के प्रकािन के पश्चात,प्रिासक
द्वाराधारा16(1) के तहत, प्रभाजवत पररवारों की िनगणना, अचल सम्पजत एवं भूजम, संरचना, पेड, बुजनयािी सुजवधाएं
और उपयोजगताएं आदि के सम्बन्ध खसरा संख्या 221/2/1 व 221/2/3 वाली भूजम में एक सवेक्षण दिनांक 10.01.2024
को दकया गया।
क) प्रत्येक प्रभाजवत पररवारों के अजधग्रहण के जलए भूजम और अचल संपजत्तयों का जववरण।

भूजम हारे और भूजमहीनों के प्रजत आिीजवका का नुकसान जिनकी आिीजवका मुख्य रूप से अजधग्रजहत की िा रही
भूजम पर जनभार है:-
ग्रामीणों ने उत्तर दिया ्ा दक केवल ग्रामीण, िो अपने िेयरों के अनुसार भूजम पर कब्िा और खेती कर रहे हैं,
प्रभाजवत पररवार हैं और कोई भूजमहीन व्यजि नहीं है। भूजम के अजधग्रहण से ग्रामीणों और उनके पररवारों / आजितों की
केवल आिीजवका प्रभाजवत होती है।
तिनुसार, यह स्ट्पष्ट है दक ििा माजलकों के पास गााँव में अन्य भूजम है और उनके पररवार अपनी आिीजवका के जलए
मुख्य रूप से इस भूजम पर जनभार नहीं हैं और उनके पास आय के अन्य स्रोत हैं।
प्रभाजवत क्षेत्र में व्यापार या व्यवसायों की सूची: अजधग्रहण के जलए प्रस्ट्ताजवत भूजम एक कृजष भूजम है जिसका
उपयोग केवल खेती के उद्देश्य के जलए दकया िा सकता है। इसजलए यह लागू नहीं माना िा सकता है।
प्रभाजवत क्षेत्र में अनुसूजचत िाजत / अनुसूजचत िनिाजत के जवकलांग या िारीररक रूप से जवकलांग व्यजियों की
सूची: िून्य
(ग)
सावािजनक उपयोजगताओं और सरकार की एक सूची। ऐसी इमारतें िो प्रभाजवत हैं या प्रभाजवत होने की संभावना
है िहां प्रभाजवत पररवारों का पुनवाास िाजमल है:- िून्य
अजधग्रहण के जलए प्रस्ट्ताजवत भूजम एक सैलाब भूजम है, जिसका उपयोग केवल खेती के उद्देश्य के जलए दकया िाता
है। कोई िीजवत मकान / मानव बजस्ट्तयां प्रभाजवत नहीं हो रही हैं और इसजलए प्रभाजवत पररवार को जवस्ट््ाजपत पररवारों
की िेणी में नहीं माना िा सकता है। इसजलए प्रभाजवत पररवार के जलए पुनवाास लागू नहीं है। इसके अलावा अजधग्रहण
दकसी भी सुजवधाओं और गैर-ढांचागत सुजवधाओं को प्रभाजवत नहीं करता है क्योंदक यह अजस्ट्तत्व में नहीं है। यह लागू नहीं
के रूप में माना िा सकता है।
(घ)
प्रभाजवत और प्रभाजवत होने वाली सुजवधाओं और अवसंरचनात्मक सुजवधाओं का जववरण, िहां प्रभाजवत
पररवारों का पुनवाास िाजमल है:
अजधग्रहण दकसी भी सुजवधाओं और गैर-ढांचागत सुजवधाओं को प्रभाजवत नहीं करता है क्योंदक यह अजस्ट्तत्व में
नहीं है। यह लागू नहीं के रूप में माना िा सकता है
(ड)
प्राप्त दकए िा रहे दकसी भी सामान्य संपजत्त संसाधन का जववरण:- कोई आम संपजत्त नहीं।यह लागू नहीं के रूप में
माना िा सकता है।
पुनवाास और पुनःस्ट््ापन योिना का प्रारूप:
अध्याय VI, पुनवाास और पुनस्ट््ाापन की प्रदक्रया और तरीके, भूजम अजधग्रहण, पुनवाास और पुनस्ट््ाापन में उजचत
मुआविा और पारिर्िाता का अजधकार अजधजनयम, 2013 की धारा 43 के अनुसार पुनवाास और पुनस्ट््ाापन योिना का
मसौिा तैयार करने के जलए अधोहस्ट्ताक्षरी को प्रिासक के रूप में जनयुि दकया गया है। यह मसौिा पुनवाास और
पुनस्ट््ाापन योिना (आरआर योिना) धारा 16, 31, 41, 42 (यदि लागू हो), 43 आरएफसीर्ीएलएआरआर अजधजनयम,
2013 की िूसरी अनुसूची और जनयम 7,9 (यदि लागू हो), 16, फॉमा IV (यदि लागू हो) और
आर.एफ.सी.र्ी.एल.ए.आर.आर. (मुआविा, पुनवाास और पुनवाास और जवकास योिना) जनयम, 2015 का फॉमा VIIके
अनुरूप तैयार दकया िा रहा है।
पुनवाास और पुनस्ट््ाापन योिना का मसौिा िूसरी अनुसूची (पहली अनुसूची में दिए गए प्रावधानों के अलावा
सभी प्रभाजवतों (िोनों भूजम माजलकों और पररवारों जिनकी आिीजवका मुख्य रूप से अर्िात भूजम पर जनभार है) के जलए
पुनवाास और पुनवाास अजधकारों के तत्व) के आधार पर तैयार दकया गया है। पुनवाास और पुनस्ट््ाापन योिना का मसौिा का
प्रारूपण एवम संक्षेपण संलगन प्रारूप में तैयार दकया गया है और भूजम अजधग्रहण, पुनवाास और पुनस्ट््ाापन अजधजनयम,
2013 में उजचत मुआविा और पारिर्िाता का अजधकार की धारा 17 के तहत भूजम अजधग्रहण कलेक्र्र द्वारा समीक्षा के
जलए अनुिंजसत दकया गया है।

Draft Rehabilitation and Resettlement Scheme
F. No. ADM/LAC/SE/2023/05/kh.No.221/Part-II/984.—In the exercise of the powers conferred by
sub section (2) of section 16 of the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013, the
draft Rehabilitation and Resettlement Scheme has been prepared under section 16 of the Right to Fair Compensation
and Transparency in Land Acquisition Act, 2013, for families affected with the proposed acquisition of land bearing
Khasra No. 221/2/1 (459.192 Sqm.) & 221/2/3 (709.901 Sqm.) total land measuring (1169.093Sqm.) of Village
Nangli Razapur for infrastructure Project for Construction of 3rdPhase of Elevated Road on Barapulla Nallah from
Sarai Kale Khan to Mayur Vihar, New Delhi the same is being published under rule 7 (5) of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Compensation Rehabilitation
and Resettlement and Development Plan) Rules 2015,
Preface: -
Vide Preliminary Notification No. F. No .ADM/LAC/SE/2023/05/860 dated 21.12.2023 issued by District
Magistrate (South-East), Govt. of NCT, the land bearing Khasra No. 221/2/1 (459.192 Sqm.) & 221/2/3 (709.901
Sqm.) total land measuring (1169.093 Sqm.) of Revenue Estate of Village Nangli Razapur was notified for acquisition
u/s 11 (1) of Right to Fair Compensation and Transparency in Land Acquisition Act, 2013 for infrastructure project
for Construction of 3rdPhase of Elevated Road on Barapulla Nallah from Sarai Kale Khan to Mayur Vihar, New Delhi.
Vide above notification, Additional District Magistrate (South East) was appointed as the Administrator
under sub section (1) of Section 43 of the said Act for Rehabilitation & Resettlement of affected families due to
acquisition of the said land as mentioned above.
As per section 16 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation &
Resettlement Act, 2013, Draft Rehabilitation & Resettlement Scheme is to be prepared by the Administrator.
Upon the publication of the preliminary notification under sub-section 1 of section 11 by the Collector, South
East, a survey u/s 16(1) was carried out on 10/01/2024 regarding census of the affected families, particular of land and
immovable properties, structures, trees, infrastructure facilities and utilities etc. of land bearing Khasra no. 221/2/1 &
221/2/3.

Livelihoods lost in respect of land losers and landless whose livelihood are primarily dependent on the
lands being acquired: -
The villagers had stated that only the villagers, who are holding and cultivating the land as per their shares,
are the affected families and there is no landless person. Only the livelihood of the villagers and their
families/dependents are affected by the proposed land acquisition.
Accordingly, it is evident that the recorded owners have other land in the village and their families are not
primarily dependent on this land for their livelihood and they have other sources of income.

DRAFT REHABILITATION & RESETTLEMENT SCHEME:
As per chapter VI, Procedure and manner of Rehabilitation & Resettlement, section 43 of Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 the undersigned has
been appointed as the administrator for drafting Rehabilitation & Resettlement Scheme. This draft Rehabilitation &
Resettlement Scheme (RR Scheme) is being drafted in consonance with Section 16,31,41, 42 (if applicable), 43.
Second schedule of RFCTLARR Act, 2013 and Rule 7,9 (if applicable), 16, Form IV (if applicable) and Form VII of
RFCTLARR (Compensation, Rehabilitation and Resettlement and Development Plan) Rules, 2015.
The Draft Rehabilitation and Resettlement Scheme is prepared based on the Second Schedule (Elements of
Rehabilitation and Resettlement Entitlements for all the affected (Both land owners and families whose livelihood is
primarily dependent on land acquired) in addition to those provided in the First Schedule). The Rehabilitation and
Resettlement Scheme is drafted and summarized in the format (enclosed) and recommended for review by Land
Acquisition Collector under section 17 of the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013.
