एक अविवनयि दिल्ली राज्य िें लागू सोसायटी पंजीकरण अविवनयि, 1860 िें संिोिन करने हेिु एक अविवनयि।

भारि गणराज्य के सिहत्तरिें िर्य िें दिल्ली वििान सभा द्वारा यह वनम्नवलविि रूप से अविवनयविि हो-

संवक्षप्त िीर्यक एिं

प्रारंभ

1. इस अविवनयि को सोसायटी पंजीकरण (दिल्ली संिोिन) अविवनयि, 2026 कहा जाएगा।

2. यह सरकार द्वारा आविकाररक राजपत्र िें अविसूवचि होने की विवर् से लागू होगा।

पश्चाि् िारा 12डी का

अंिैःस्र्ापन

12डी- िारा 12सी के पश्चाि्, वनम्नवलविि िारा को अंिैःस्र्ावपि दकया जाएगा, अर्ायि्ैः

12डी- कविपय पररवस्र्वियों िें पंजीयक की पंजीकरण को वनरस्ि करने की िवि-(1) इस

अविवनयि िें वनवहि दकसी बाि के होिे हुए भी, पंजीयक वनम्नवलविि आिारों िें से दकसी पर

वलविि आिेि द्वारा दकसी सोसायटी का पंजीकरण वनरस्ि कर सकिा है-

क) दक सोसायटी या उसके नाि का पंजीकरण या नाि पररिियन इस अविवनयि के प्राििानों

या ित्सिय प्रिृत्त दकसी अन्य कानून के प्रविकूल है.

(ि) दक इसकी गविविवियों या प्रस्िाविि गविविवियों सोसायटी के उि्‌िेश्यों को नष्ट करने

िाली या साियजवनक नीवि की विरोिी हो गई है अर्िा है या हो जाएंगी,

(ग) दक पंजीकरण या निीनीकरण का प्रिाण-पत्र गलि बयानी या िोिािडी से प्राप्त दकया

गया है।

बििे दक दकसी भी सोसायटी के पंजीकरण के वनरसन का कोई आिेि िब िक पाररि नहीं

दकया जाएगा जब िक दक सोसायटी को अपना नाि या उद्देश्य बिलने या उसके संबंि िें की

जाने िाली प्रस्िाविि कारयिाई के विरुद्ध कारण बिाने का उवचि अिसर प्रिान न दकया गया

हो।

(2) उप-िारा (1) के अंिगयि दकए गए आिेि के विरुद्ध कोई अपील उस प्रभाग के आयुि को

अवििानिैः ऐसे आिेि की सूचना की विवर् से एक िाह के भीिर की जा सकिी है, वजसके

अविकार क्षेत्र िें सोसायटी का िुख्यालय वस्र्ि है।

(3) उप-िारा (2) के अिगयि आयुि का वनणय अंविि होगा िर्ा दकसी भी न्यायालय िें पश्नगि

नहीं दकया जाएगा।

NOTIFICATION

Delhi, the 24th April, 2026

F. No. 14(108)/LA/2026/ ala1 /44-53.— The following Act of the Legislative Assembly of the National

Capital Territory of Delhi received the assent of the Lt. Governor of Delhi on the 23rd April, 2026 and is hereby

published for general information.

THE SOCIETIES REGISTRATION (DELHI AMENDMENT) BILL, 2026

(DELHI ACT No. 07 OF 2026)

(As passed by the Legislative Assembly of the National capital Territory of Delhi on 27th March, 2026)

(AS APPLICABLE IN THE JURISDICTION OF GOVT. OF NATIONAL CAPITAL TERRITORY OF DELHI)

An Act to amend the Societies Registration Act, 1860, in its application to the State of Delhi.

Be it enacted by the Delhi Legislative Assembly in the Seventy Seventh year of Republic of India as follows:-

Short title and

commencement

1. This Act may be called Societies Registration (Delhi Amendment) Act, 2026.

2. It shall come into force on the date on which it is notified in the official gazette by the

Government.

Insertion of

Section 12D

after Section

12C in Act XXI

of 1860

12D- After section 12C, insert the following section, namely:

12D Registrar's power to cancel registration in certain circumstances.-(1) Notwithstanding

anything contained in this Act, the Registrar may, by order in writing, cancel the

registration of any society on any of the following grounds-

(a) that the registration of the society or of its name or change of name is contrary to the

provisions of this Act or of any other law for the time being in force;

(b) that its activities or proposed activities have been or are or will be subversive of the

objects of the society or opposed to public policy;

or fraud;

Provided that no order of cancellation of registration of any society shall be passed until

the society has been given a reasonable opportunity of altering its name or object or of

showing cause against the action proposed to be taken in regard to it.

(2) An appeal against an order made under sub-section (1) may be preferred to the

Commissioner of the Division in whose jurisdiction the Headquarter of the society lies,

within one month from the date of communication of such order.

(3) The decision of the Commissioner under sub-section (2), shall be final and shall not be

called in question in any court.
