एफ.12(2)/माप एवं तोल/प्रवततन/2026/261-69.— जवजधक मापजवज्ञान अजधजनयम, 2009 की धारा 2 के खंड

(q) के साथ पठित धारा 53 की उपधारा (4) द्वारा प्रित्त िजियों का प्रयोग करते हुए, राष्ट्रीय रािधानी क्षेत्र दिल्ली के

उपराज्यपाल एतत द्वारा दिल्ली जवजधक मापजवज्ञान (प्रवततन) जनयमावली, 2011 में और संिोधन करने के जलए प्रस्ट्ताजवत

जनम्नजलजखत प्रारूप जनयम, उन व्यजियों की िानकारी हेतु प्रकाजित दकए िाते हैं, िो इससे प्रभाजवत हो सकते हैं।

सूजित दकया िाता है दक दिल्ली जवजधक माप-जवज्ञान (प्रवततन) जनयमावली, 2011 में और संिोधन करने हेतु

जनयमों के प्रारूप पर, दिल्ली के रािपत्र में तथा 02 हहंिी और 02 अंग्रेिी राष्ट्रीय समािार-पत्रों में इस अजधसूिना के

प्रकािन की तारीख से तीस दिनों की अवजध समाप्त होने पर या उसके बाि, दिल्ली राष्ट्रीय रािधानी क्षेत्र के उप-राज्यपाल

द्वारा जविार दकया िाएगा।

प्रारूप जनयम

दिल्ली जवजधक मापजवज्ञान (प्रवततन) संिोधन जनयम, 2026

1. संजक्षप्त िीर्तक एवं प्रारंभ:-

(1) इन जनयमों को दिल्ली जवजधक मापजवज्ञान (प्रवततन) संिोधन जनयम, 2026 कहा िाएगा।

(2) ये दिल्ली के आजधकाठरक रािपत्र में इनके प्रकािन की जतजथ से प्रभावी होंगे।

2. जनयम 11 में संिोधन:- दिल्ली जवजधक मापजवज्ञान (प्रवततन) जनयम, 2011 (जिसे आगे “उि जनयम” कहा गया है) के

जनयम 11 में जनम्नानुसार संिोजधत दकया िाएगा:

(1) उप-जनयम (1) के स्ट्थान पर, जनम्नजलजखत उप-जनयम प्रजतस्ट् थाजपत दकया िाएगा:

“(1) प्रत्येक माप या तोल से संबंजधत जनमाता या मरम्मतकतात या जवक्रेता, लाइसेंस िारी करवाने हेतु, जनयंत्रक या उनके

द्वारा अजधकृत अजधकारी को, अनुसूिी II-A में जनर्ितष्ट उपयुि प्रपत्र में आवेिन करना होगा। ऐसा लाइसेंस, लाइसेंस िारी

होने से पहले दकसी भी जनरीक्षण के जबना, स्ट्व-घोर्णा के आधार पर िारी दकया िाएगा:

परंतु यह दक, दकसी जनमाता को अपने द्वारा जनर्मत माप या तोल की मरम्मत के जलए, िो उसके जनमातण राज्य के अजतठरि

दकसी अन्य राज्य में उपयोग हो रहा हो, मरम्मत लाइसेंस की आवश्यकता नहीं होगी; दकन्तु जनमाता को संबंजधत जवजधक

मापजवज्ञान अजधकारी को मरम्मत के संबंध में पूवत सूिना िेनी होगी:

यह भी दक, कोई व्यजि यदि सद्भावपूवतक अपने स्ट्वाजमत्व या अजधकार में रखे गए माप या तोल की मरम्मत करता है, तो

उसे मरम्मतकतात लाइसेंस की आवश्यकता नहीं होगी;”

(2) उप-जनयम (2) को हटाया िाएगा;

(3) उप-जनयम (4) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“(4) दकसी जनमाता, मरम्मत करने वाले या डीलर को कंरोलर या उसकी ओर से इस संबंध में अजधकृत दकसी

अजधकारी द्वारा, अनुसूिी IV में जनर्ितष्ट िुल्क के भुगतान पर िारी दकया गया प्रत्येक लाइसेंस तब तक वैध रहेगा

िब तक दक उसे जनयंत्रक या उनके द्वारा अजधकृत अजधकारी द्वारा जनलंजबत या जनरस्ट्त नहीं दकया िाता।”

(5) उप-जनयम (5) में दिए गए परन् तुक को हटाया िाएगा;

(6) उप-जनयम (9) में “या नवीनीकृत” िब्ि हटाए िाएंगे;

(7) उप-जनयम (10) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“(10) इन जनयमों के अंतगत प्रिान दकया गया लाइसेंस हस्ट्तांतरणीय, जवक्रेय या वंिानुगत नहीं होगा।”

3. जनयम 12 में संिोधन. उि जनयमों के जनयम 12 के उप-जनयम (1) में, िहााँ भी “नवीनीकृत” और “नवीनीकरण” िब्ि

आते हैं, उन्हें हटाया िाएगा।

4. अनुसूजियों में संिोधन

उि जनयमों से संलग्न अनुसूजियों में जनम्नजलजखत संिोधन दकए िाएंगे:

अनुसूिी II-A के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“अनुसूिी II-A (िैसा दक इन जनयमों के साथ संलग्न है)”

अनुसूिी II-B को हटाया िाएगा;

(3)

अनुसूिी III के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“अनुसूिी III (िैसा दक इन जनयमों के साथ संलग्न है)”

(4)

अनुसूिी IV के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“अनुसूिी IV (िैसा दक इन जनयमों के साथ संलग्न है)”

(5)

अनुसूिी V की ताजलका के कॉलम (2) में “नवीनीकरण” िब्ि हटाया िाएगा;

(6)

अनुसूिी VI के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“अनुसूिी VI (िैसा दक इन जनयमों के साथ संलग्न है)”

(7)

अनुसूिी VII के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया िाएगा:

“अनुसूिी VII (िैसा दक इन जनयमों के साथ संलग्न है)”

5. इन जनयमों द्वारा संिोजधत उि जनयमों में दकसी भी बात के जनजहत होते हुए भी, इन जनयमों के प्रारंभ से पूवत िारी कोई

भी लाइसेंस उसमें जनर्ितष्ट अवजध की समाजप्त तक वैध रहेगा, और उसके पश्चात संिोजधत जनयमों के अनुसार नया लाइसेंस

प्राप्त दकया िाएगा।

लाइसेंस की ितें

जिस व्यजि के पक्ष में यह लाइसेंस िारी दकया गया है, वह -

(क)

अजधजनयम और जनयमों के उन सभी प्रासंजगक प्रावधानों का पालन करेगा िो उस समय लागू हैं;

(ख)

अजधजनयम के प्रावधानों, या समय-समय पर संिोजधत जनयमों के दकसी भी उल्लंघन को न तो प्रोत्साजहत

करेगा और न ही उसकी अनिेखी करेगा;

(ग)

इस लाइसेंस को उस पठरसर के दकसी ऐसे प्रमुख स्ट्थान पर प्रिर्ित करेगा जिससे यह संबंजधत है;

(घ)

जवजधक माप-जवज्ञान जनयंत्रक द्वारा दिए गए दकसी भी सामान्य या जविेर् जनिेि का पालन करेगा;

विन, माप, तौलने या मापने के उपकरण (िैसा भी मामला हो) - िो राज्य के भीतर उपयोग के जलए

जनर्मत और अजभप्रेत हैं - उन्हें जबक्री से पहले सत्यापन और मुहर लगवाने हेतु जवजधक माप-जवज्ञान

अजधकारी के समक्ष प्रस्ट्तुत करेगा;

इस लाइसेंस के िारी होने के बाि जनधातठरत की गई प्रत्येक ितत, यदि उसे रािपत्र में अजधसूजित दकया िाता है, तो

उन व्यजियों पर बाध्यकारी होगी जिन्हें यह लाइसेंस प्रिान दकया गया है।

लाइसेंस की ितें

जिस व्यजि के पक्ष में यह लाइसेंस िारी दकया गया है, वह -

(क)

अजधजनयम और जनयमों के सभी प्रासंजगक प्रावधानों का पालन करेगा, िो उस समय लागू हों;

(ख)

अजधजनयम या जनयमों के प्रावधानों के दकसी भी उल्लंघन को न तो बढ़ावा िेगा और न ही उसे सहन

करेगा, िो उस समय लागू हों;

(ग)

इस लाइसेंस को उस पठरसर के दकसी ऐसे प्रमुख जहस्ट्से में प्रिर्ित करेगा, जिससे यह संबंजधत है;

(घ)

(ङ)

व्यवसाय बंि होने और/या लाइसेंस रद्द होने की जस्ट्थजत में लाइसेंस को वापस (सरेंडर) कर िेगा;

(ि)

(i) बाट, माप, तौलने या मापने वाले उपकरणों को (िैसा भी मामला हो) जवजधवत मरम्मत करके,

उपयोगकतात को सौंपने से पहले, जनयम 14(1) में जनर्ितष्ट अनुसार सत्यापन और मुहर लगाने के जलए

जवजधक माप-जवज्ञान अजधकारी के समक्ष प्रस्ट्तुत करेगा।

(ii) बाट, माप, तौलने या मापने वाले उपकरणों के मामले में, यदि उनका सत्यापन होने की जनयत जतजथ

से पहले उनकी सर्वतहसंग/मरम्मत की िाती है, और इस प्रदक्रया के िौरान जवजधक माप-जवज्ञान अजधकारी

की सत्यापन मुहर खराब हो िाती है, हट िाती है या टूट िाती है, तो उन्हें जवजधवत मरम्मत करके,

उपयोगकतात को सौंपने से पहले, पुनः सत्यापन और मुहर लगाने के जलए जवजधक माप-जवज्ञान अजधकारी

के समक्ष प्रस्ट्तुत दकया िाएगा।

इस लाइसेंस के िारी होने के बाि जनधातठरत की गई प्रत्येक ितत, यदि उसे 'सरकारी रािपत्र' में अजधसूजित दकया

िाता है, तो वह उन व्यजियों पर बाध्यकारी होगी, जिन्हें यह लाइसेंस प्रिान दकया गया है।

Delhi, the 8th May, 2026

F. 12(2)/W&M/Enforcement/2026/261-69.— The following draft of the rules, to further

amend the Delhi Legal Metrology (Enforcement) Rules, 2011, which the Lt. Governor of National

Capital Territory of Delhi proposes to make in exercise of the powers conferred by sub-section (4)

of Section 53 read with clause (q) of section 2 of the Legal Metrology Act 2009, is published for

the information of the persons likely to be affected thereby.

Notice is hereby given that the draft rules, to further amend the Delhi Legal Metrology

(Enforcement) Rules, 2011 will be taken into consideration by the Lieutenant Governor of National

Capital Territory of Delhi on or after the expiry of a period of thirty days from the date of

publication of this notification in the Official Gazette of Delhi as well as in 02 Hindi & 02 English

National Newspapers.

The objections or suggestions in this behalf shall be received by the Controller, Legal

Metrology Department, Government of National Capital Territory of Delhi, in his office at Weights

& Measures Department (Department Of Legal Metrology), Plot No-17, Institutional Area,

Vishwas Nagar, New Delhi-110032 and/or on email IDs: [email protected]/or

DRAFT RULES

DELHI LEGAL METROLOGY (ENFORCEMENT) AMENDMENT RULES, 2026

1. Short title and commencement:-

(1) These rules may be called the Delhi Legal Metrology (Enforcement) Amendment Rules,

2026.

(2) They shall come into force on the date of their publication in the Official Gazette of

Delhi.

Amendment of rule 11:- In the Delhi Legal Metrology (Enforcement) Rules 2011

(hereinafter referred to as the said rules), in rule 11:- shall be amended as under:

(1) for sub-rule (1),the following sub-rule shall be substituted, namely:-:—

“(1) Every manufacturer or repairer of, or dealer in, weight or measure shall make an

application for the issue of a licence to the Controller or such other officer as may be

authorized by him in this behalf, in the appropriate form set out in Schedule II-A. Such

licence shall be issued on self-declaration basis without any inspection prior to issue of the

licence:

Provided that, no licence to repair shall be required by a manufacturer to repair any weight or

measure manufactured by him and used in a State other than the State of manufacture of the

same, but the manufacturer has to inform in advance the concerned legal metrology officer

about the repairing:

Provided further that a person who bonafide repairs any weight or measure owned or

possessed by him shall not require a repairer’s licence; ”

(2) sub-rule (2) shall be omitted;

(3) for sub-rule (4), the following sub-rule shall be substituted, namely:—

“(4) Every licence issued to a manufacturer, repairer or dealer by the Controller or any

officer authorised by him in this behalf, on payment of the fee specified in Schedule IV,

shall remain valid unless it is suspended or cancelled by the Controller or any officer

authorised by him in this behalf.”

(5) in sub-rule (5), the proviso shall be omitted;

(6) in sub-rule (9), the words “or renewed” shall be omitted;

(7) for sub-rule (10), the following sub-rule shall be substituted, namely:—

“(10) A licence granted under these rules shall not be transferable, saleable or

inheritable.”

3. Amendment of rule 12. In rule 12 of the said rules, in sub-rule (1), the words “renewed” and

“renewal”, where they occur, shall be omitted.

4. Amendment of Schedules. In the Schedule appended to the rules,—

(1) for Schedule II-A, the following Schedule shall be substituted, namely:—

“Schedule II-A (as appended to these rules)”;

(2) Schedule II-B shall be omitted;

(3) for Schedule III, the following Schedule shall be substituted, namely:—

“Schedule III (as appended to these rules)”;

(4) for Schedule IV, the following Schedule shall be substituted, namely:—

“Schedule IV (as appended to these rules)”;

(5) in Schedule V, in the Table, in column (2), the word “renewal” shall be omitted;

(6) for Schedule VI, the following Schedule shall be substituted, namely:—

“Schedule VI (as appended to these rules)”;

(7) for Schedule VII, the following Schedule shall be substituted, namely:—

“Schedule VII (as appended to these rules)”.

5. Notwithstanding anything contained in the said rules as amended by these rules, any licence

issued prior to the commencement of these rules shall continue to remain valid till the expiry of the

period specified therein, and thereafter, a fresh licence shall be obtained in accordance with the

provisions of the said rules as amended by these rules.

Not encourage or countenance any infringement of the provisions of the Act. or the Rules

amended from time to time;

Exhibit this licence in some conspicuous part of the premises to which it relates;

Comply with any general or special directions that may be given by the Controller of legal

metrology;

(e)

Surrender the licence in the event of closure of business and/ or cancellation of Licence;

Conditions of Licence

The person in whose favour this licence is issued shall. -

(a)

Comply with all the relevant provisions of the Act and Rules for the time being in force;

(b)

Not encourage or countenance any infringement of the provisions of the Act or the Rules for

the time being in force;

(c)

Exhibit this licence in some conspicuous part of the premises to which it relates;

(d)

Comply with any general or special directions that may be given by the Controller of legal

metrology;

(e)

Surrender the licence in the event of closure of business and/or cancellation of Licence;

(f)

(i) Present the weights, measures, weighing or measuring instruments as the case may be duly

repaired to the legal metrology officer for under taking verification and stamping as specified

in rule 14(1), before delivery to the user.

(ii) In the case of weights, measures weighing or measuring instruments, if they are

serviced/repaired before the date on which the verification falls due and where, in the process

and the verification stamp of the legal metrology officer is defaced, removed or broken, they

shall be presented duly repaired to the legal metrology officer for re-verification and stamping

before delivery to the user.

Every condition prescribed after the issue of this licence shall, if notified in the Official Gazette, be

binding on the persons to whom the licence has been granted."
