मुद्रण क नलए मतदान मतीन क साथ भी ज डा जाए जैसा दक भारत ननर्ााचन अय ग द्वारा ननद त ददया जाए; और
3.
यत: अय ग न राष्ट्रीय राजधानी क्ष त्र ददल्ली क नर्धान सभाओं क साधारण ननर्ााचनों क नलए सभी ननर्ााचन क्ष त्रों, अय ग
क ्रक स न िं सं.ECI/PN/4/2020 ददनांक 6 जनर्री, 2020 क द्वारा घ नषत, चुनार्ों क पररनस्थनतयों पर नर्चार दकया है, और
अय ग संतुष्ट है दक राष्ट्रीय राजधानी क्ष त्र ददल्ली क सभी नर्धान सभा ननर्ााचन क्ष त्रों में मतदान करर्ान क नलए पयााप्त संख्या में
आल क्िंॉननक र् टिंग मतीनें तथा प पर ट्र ल [र् िंर र् ररफायबल प पर ऑनडिं ट्र ल (र्ीर्ीपीएिंी)] मुदद्रत करन क नलए प्र्रकिंर ईपलब्ध हैं,
मतदान कार्ममक आल क्िंॉननक र् टिंग मतीनों तथा प पर ट्र ल (आसमें आसक ईपरान्त र्ीर्ीपीएिंी प्र्रकिंर क रूप में ईनल्लनखत) क नलए
प्र्रकिंर का दक्षतापूणा संचालन करन क नलए ्रकनतनक्षत हैं तथा ननर्ााचक भी आल क्ट्रॉननक र् टिंग मतीनों एर्ं र्ीर्ीपीएिंी प्र्रकिंरों क

ऄत:, ऄब भारत ननर्ााचन अय ग ल क ्रकनतनननधत्र् ऄनधननयम, 1951 क ईक्त धारा 61क तथा ननर्ााचनों का संचालन
ननयम, 1961 क ननयम 49क क ऄंतगात ऄपनी तनक्तयों का ्रकय ग करत हुए एतद्द्वारा राष्ट्रीय राजधानी क्ष त्र ददल्ली में ददनांक
14.01.2020 क ऄनधसूनचत साधारण ननर्ााचन में सभी नर्धान सभा ननर्ााचन क्ष त्रों क ऐस ननर्ााचन क्ष त्रों, जहां ननर्ााचनों का
संचालन ननयम, 1961 क ऄधीन ननधााररत रीनत स तथा आस नर्षय पर अय ग द्वारा समय-समय पर जारी दकए गए ऄनुपूरक
ऄनुद तों क ऄंतगात आल क्ट्रॉननक र् टिंग मतीनों तथा र्ीर्ीपीएिंी प्र्रकिंर क माध्यम स डाल और ररकॉडा दकए जाएंग , क रुप में नर्ननर्ददष्ट
करता है।

अय ग भारत आल क्ट्रॉननक्स नलनमिं ड, बंगलौर तथा आल क्ट्रॉननक्स कापोर तन ऑफ आनण्डया नलनमिं ड, हैदराबाद द्वारा यथा-

No.576/3/EVM/2020/SDR-Vol.I.—Whereas, Section 61A of the Representation of the People Act,
1951, provides that the giving and recording of votes by Voting Machines in such manner as may be prescribed,
may be adopted in such constituency or constituencies as the Election Commission of India may, having regard
to the circumstances of each case, specify; and
2.
Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a Printer with a drop
box of such design, as may be approved by the Election Commission of India, may also be attached to voting

machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the
Election Commission of India may direct; and
3.
Whereas, the Commission has considered the circumstances in all the Constituencies for theGeneral
Election to the Legislative Assembly of NCT of Delhi announced by the Commission’s Press Note No.
ECI/PN/4/2020 dated 6th January, 2020 ,and is satisfied that sufficient number of Electronic Voting Machines
and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the
poll in all the Assembly Constituencies of NCT of Delhi, the polling personnel are well trained in efficient
handling of the Electronic Voting Machines and Printers for Paper Trail (hereafter referred to as ‘VVPAT
Printers’) and the electors are also fully conversant with the operation of the Electronic Voting Machines and the
VVPAT Printers;

Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A
of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961, hereby
specifies all the Assembly Constituencies of NCT of Delhi for the general election to the Legislative
Assembly notified on 14-01-2020 as the constituencies in which the votes, shall be given and recorded by
means of Electronic Voting Machines and VVPAT printers in the manner prescribed, under the Conduct of
Elections Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the
subject.

The Commission also hereby approves the design of the Electronic Voting Machine and the Printer
with the drop box (the VVPAT Printers) as developed by the Bharat Electronics Ltd., Bangalore and Electronics
Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving
and recording of votes in all the Constituencies.

यतः, ननर्ााचनों का संचालन ननयम, 1961 क ननयम 49 ज(3) और 49 िं(2) (ख) में यह ईपबंनधत है दक जहााँ दकसी
ननर्ााचन क्ष त्र क ननर्ााचकों क ननर्ााचक रनजनस्ट्रकरण ननयम, 1960, क ननयम 28 क ईक्त ईपबंधों क ऄधीन ननर्ााचक फ िं
पहचान-पत्र ददए गए हैं, र्हां ननर्ााचकों क मतदान क न्द्र में ऄपना ननर्ााचक फ िं पहचान-पत्र ददखाना ह गा तथा ईनक ओर स ईन
ननर्ााचक फ िं पहचान पत्रों क नहीं ददखाए जान या ददखान में ऄसमथा ह न पर ईन्हें मत डालन क ऄनुमनत द न स आन्कार दकया जा
सकता है; तथा
4.
यतः, ईक्त ऄनधननयम, और ननयमों क ईपयुाक्त ईपबंधों क नमलाकर एर्ं सामंजस्यपूणा ढंग स ईनक ऄध्ययन स यह स् पष् िं
ह ता है दक यद्यनप मत द न का ऄनधकार ननर्ााचक नामार्ली में नाम क ह न स ही ह ता हैं, यह ननर्ााचन अय ग द्वारा राज्य क लागत
पर, मतदान क समय ईनक पहचान सुनननित करन क साधन क रुप में ्रकदान करर्ाए गए ननर्ााचक फ िं पहचान पत्र क ्रकय ग पर
भी ननभार करता है, तथा द नों का एक साथ ्रकय ग करना ह ता है; तथा

यतः, ननर्ााचन अय ग न एक समयबद्ध कायाक्रम क ऄनुसार सभी ननर्ााचकों क ननर्ााचक फ िं पहचान-पत्र
इ0पी0अइ0सी0 जारी करन का ननद त द त हुए 28 ऄगस्त, 1993 क एक अद त जारी दकया है; तथा
6.
यतः, राष् ट्रीय राजधानी क्ष त्र ददल् ली में ननर्ााचकों क 100% ननर्ााचक फ िं पहचान पत्र जारी दकए जा चुक हैं, तथा
7.
ऄतः, ऄब, सभी संबद्ध कारकों तथा नर्नधक एर्ं तथ्यात्मक नस्थनतयों क ध्यान में रखत हुए, ननर्ााचन अय ग, एतद्द्वारा, यह
ननद त द ता है दक ददनांक 14.01.2020 क ऄनधसूनचत, राष् ट्रीय राजधानी क्ष त्र ददल् ली नर्धान सभा क साधारण ननर्ााचन क नलए,
सभी ननर्ााचक नजन्हें ननर्ााचक फ िं पहचान पत्र जारी दकए गए हैं, मतदान स्थल पर ऄपना मत डालन स पहल ऄपनी पहचान
सुनननित करन ह तु ऄपना ननर्ााचक फ िं पहचान पत्र ददखाएंग । ऐस ननर्ााचक ज ऄपना ननर्ााचक फ िं पहचान पत्र ्रकस्तुत नहीं
कर पात हैं, ईन्हें ऄपनी पहचान स्थानपत करन क नलए ननम्ननलनखत र्ैकनल्पक फ िं पहचान दस्तार् जों में स क इ एक ्रकस्तुत करना

ORDER
New Delhi, the 16th January, 2020
No.3/4/ID/2020/SDR/VOL.I.— 1. Whereas, Section 61 of the Representation of the People Act, 1951
provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to
vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of
Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and
2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct,
with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the
issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and
3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the
electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of
Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card
at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result
in the denial of permission to vote; and
4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules,
makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also
dependent upon the use of the Electors Photo Identity Card, where provided by the Election Commission at
State cost, as the means of establishing their identity at the time of polling and that both are to be used together;
and
5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors
Photo Identity Card (EPIC) to all electors, according to a time bound programme; and
6. Whereas, Electors Photo Identity Card have been issued to 100% electors in the State of NCT of Delhi;
and
7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election
Commission hereby directs that for the General Election to the State Legislative Assembly of NCT of Delhi
notified on 14-01-2020, all electors who have been issued EPIC shall produce the EPIC for their identification at
the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce
one of the following alternative photo identity documents for establishing their identity: -
(i)
Passport,

(ii) Driving License,
(iii) Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public
Limited Companies,
(iv) Passbooks with photograph issued by Bank/Post Office,
(v) PAN Card,
(vi) Smart Card issued by RGI under NPR,
(vii) MNREGA Job Card,
(viii) Health Insurance Smart Card issued under the scheme of Ministry of Labour,
(ix) Pension document with photograph,
(x) Official identity cards issued to MPs/MLAs/MLCs, and
(xi) Aadhaar Card.
8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the
elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral
Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification
provided the name of that elector finds place in the electoral roll pertaining to the polling station where the
elector has turned up for voting. If it is not possible to establish the identity of the elector on account of
mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents
mentioned in Para 7 above.
9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under
Section 20A of the Representation of the People Act, 1950, based on the particulars in their Passport, shall be
identified on the basis of their original passport only (and no other identity document) in the polling station.
