और यतः, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 77 (1) के अनुसार, जनर्ााचन लडने र्ाले प्रत्येक अभ्यथी,र्ि जतजथ

िब उसे नाम-जनदेजित दकया गया िै और उसके पररणाम की घोषणा की जतजथ, दोनों तारीखें सजम्मजलत, के बीच अपने द्वारा या अपने

जनर्ााचन एिेंर्ट द्वारा उपगत या अजिकृत जनर्ााचन संबंिी सभी खचों का, या तो स्ट्र्यं या अपने जनर्ााचन एिेंर्ट द्वारा, एक पृथक और सिी

लेखा रखेगा और लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 78 के अनुसार, जनर्ााचन लडने र्ाले प्रत्येक अभ्यथी, जनर्ााजचत अभ्यथी

के जनर्ााचन की तारीख से तीस ददनों के भीतर अपने जनर्ााचन व्यय का लेखा जिला जनर्ााचन अजिकारी को दिा करेगा िो िारा 77 के

अंतगात उसके द्वारा अथर्ा उसके जनर्ााचन एिेंर्ट द्वारा रखे गए लेखे की सत् य प्रजतजलजप िोगी;

और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89(2) के अिीन मुख्य जनर्ााचन अजिकारी के पत्र सं.

CEO/COE/102/(77)DLA-20/Scr.Rep/2020/37927 ददनांक 26.05.2020 के िररए जिला जनर्ााचन अजिकारी, केन्द्रीय जिला,

रा.रा.क्षेत्र, ददल् ली द्वारा प्रस्ट्तुत ररपोर्टा के अनुसार, रा‍ रीय राििानी क्षेत्र, ददल् ली के 22-बल्लीमारन जर्िानसभा जनर्ााचन क्षेत्र से

जनर्ााचन लडने र्ाले (बहुिन समाि पार्टी) के अभ्यथी, श्री ददप चन्द जर्जि द्वारा यथापेजक्षत रीजत से अपने जनर्ााचन व्यय का कोई लेखा

दाजखल करने में असफल रिे िैं;

और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय ददल् ली, रा.रा.क्षे. ददल् ली और मुख् य जनर्ााचन अजिकारी, ददल् ली की ररपोर्टों के

आिार पर भारत जनर्ााचन आयोग द्वारा जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (5) के तित जनर्ााचन व्यय का

लेखा दाजखल न करने पर, श्री ददप चन्द को कारण बताओ नोरर्टस ददनांक 24.09.2020 को िारी दकया गया था;

और यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 89 के उप जनयम (6) के अनुसार, ददनांक 24.09.2020 के उपयुाक्त

कारण बताओ नोरर्टस के माध् यम से, श्री ददप चन्द को जनदेि ददया गया था दक र्े इस नोरर्टस के प्राप्त िोने के 20 ददनों के भीतर लेखे

प्रस्ट्तुत न कर पाने का कारण स्ट्पष्ट करते हुए आयोग को जलजखत में अपना अभ्यार्ेदन प्रस्ट्तुत करें और साथ िी, जनर्ााचन व्यय का अपना

लेखा दाजखल करें/अपने लेखे में त्रुरर्टयों को सिी करें और उसे संबंजित जिला जनर्ााचन अजिकारी को प्रस्ट्तुत करें;

और यतः, श्री ददप चन्द द्वारा उक्त नोरर्टस ददनांक 06.10.2020 को प्राप्त दकया गया था। अभ्यथी से प्राप् त पार्ती

एसडीएम(ई), केन्द्रीय ददल्ली द्वारा ददनांक 13.07.2021 के पत्र सं.DEO/C/75/E.Expenses/DLA-20/1150 द्वारा आयोग को

प्रस्ट् तुत कर दी गई थी।

और यत:, एसडीएम (ई), केन्द्रीय ददल्ली द्वारा ददनांक 04.08.2021 के अपने पत्र सं. DEO/C/75/E.Expenses/DLA-

20/2931 के द्वारा प्रस्ट् तुत अनुपूरक ररपोर्टा में यि किा गया िै दक श्री ददप चन्द जनर्सी-333, ब्लॉक ए, झुग्गी आर-पी-एफ

लाईन,दयाबस्ट्ती, ददल्ली ने न तो कोई अभ् यार्ेदन ददया िै और न िी मूल र्ाउचसा सजित जर्जिर्त प प से िस्ट् ताक्षररत जनर्ााचन ‍ यय के

सिी लेखे प्रस्ट् तुत दकए िैं। इसके अजतररक् त, उन् िोंने भारत जनर्ााचन आयोग के सम् यक् नोरर्टस की प्राजप्त के बाद भी उक् त असफलता िेतु न

तो कोई कारण बताया न िी स्ट् प‍ र्टीकरण ददया िै;

और यत:, भारत जनर्ााचन आयोग का यि समािान िो गया िै दक श्री ददप चन्द जनर्ााचन व्यय का लेखा दाजखल करने में

असफल रिे िैं और असफलता के जलए उनके पास कोई समुजचत कारण या न्यायोजचत्य निीं िै;

और यत:, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क में यि अनुबंजित दकया गया िै दक:-

"यदद जनर्ााचन आयोग का यि समािान िो िाता िै दक कोई व्यजक्त-

(क) जनर्ााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या कानून के अिीन अपेजक्षत

िै, दाजखल करने में असफल रिा िै; तथा

(ख) उसके पास उस असफलता के जलए कोई समुजचत कारण या न्यायोजचत्य निीं िै, तो जनर्ााचन आयोग िासकीय रािपत्र में

प्रकाजित आदेि द्वारा उसको जनरर्िात घोजषत करेगा और ऐसा कोई भी व्यजक्त उस आदेि की तारीख से तीन र्षा की

कालार्जि के जलए जनरर्िात रिेगा;

अब इसीजलए, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क के अनुसरण में भारत जनर्ााचन आयोग एतद्द्वारा रा.रा. क्षेत्र

ददल् ली राज् य के 22- बल्लीमारन जर्िानसभा जनर्ााचन क्षेत्र से जर्िानसभा के सािारण जनर्ााचन, 2020 में जनर्ााचन लडने र्ाले

अभ्यथी, श्री ददप चन्द जनर्ासी-33, ब् लॉक ए, झुग् गी आर-पी-एफ लाईन, दयाबस्ट् ती, ददल् ली को संसद के दकसी भी सदन या राज्य या संघ

राज्य-क्षेत्र की जर्िानसभा अथर्ा जर्िान पररषद के जलए सदस्ट्य चुने िाने या िोने के जलए इस आदेि की तारीख से तीन र्षा की अर्जि

के जलए जनरर्िात घोजषत करता िै।

ORDER

New Delhi, the 3rd September, 2021

No.76/ECI/ORD/TERR/NS-II/DL-LA/22/2020.—WHEREAS, the Commission had declared to hold the

General Election to the Legislative Assembly of NCT of Delhi from 22-Ballimaran Assembly Constituency vide its

Notification dated 14.01.2020 and Shri Deep Chand (Bahujan Samaj Party) had contested the aforesaid election;

AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at

election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in

connection with the election incurred or authorized by him or by his election agent between the date on which he has

been nominated and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the

Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date

of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses

which shall be in a true copy of the account kept by him or by his election agent under Section 77.

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the

District Election Officer, Central District, NCT of Delhi through the Chief Electoral Officer’s letter No.

CEO/COE/102/(77)/DLA-20/Scr.Rep/2020/37927 dated 26-05-2020, Shri Deep Chand (Bahujan Samaj Party),

contesting candidate from 22-Ballimaran Assembly Constituency of NCT of Delhi, failed to lodge an account of his

election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, Central District, NCT of Delhi

and the Chief Electoral Officer, Delhi, a Show Cause notice dated 24-09-2020 was issued by the Election Commission

of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Deep Chand for non submission

of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above

said Show Cause Notice dated 24-09-2020, Shri Deep Chand was directed to submit his representation in writing in

the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election

expenses/rectify the defects in his accounts and submit the same beffore District Election Officer concerned within 20

days from the date of receipt of the notice;

AND WHEREAS, the said notice was made to serve to Shri Deep Chand on 06-10-2020 and

acknowledgment receipt obtained from the candidate was submitted to the Commission by SDM(E), Central vide his

letter No. DEO(C)/75/E. Expenses/DLA-20/1150 dated 13-10-2021.

AND WHEREAS, in the supplementary report submitted by SDM(E), Central Delhi vide letter No.

DEO(C)/75/E. Expenses/DLA-20/2931 dated 04-08-2021 it has been stated that Shri Deep Chand has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original vouchers.

Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice of

the Election Commission of India as well;

AND WHEREAS, the Commission is satisfied that Shri Deep Chand has failed to lodge an account of

election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

“If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or

under this Act; and

(b) Has no good reason or justification for the failure, the Election Commission shall by order published in the

official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of

three years from date of the order;

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the

Election Commission of India hereby declares Shri Deep Chand , r/o House no. 333, Block-A, Jhuggi RPF Line

Dayabasti, Delhi the contesting candidate for the General Election to the Legislative Assembly of NCT of Delhi, 2020

from 22-Ballimaran Assembly Constituency to be disqualified for being chosen as and for being a member of either

कारण बताओ नोरर्टस के माध् यम से, श्री िफर जमिाा को जनदेि ददया गया था दक र्े इस नोरर्टस के प्राप्त िोने के 20 ददनों के भीतर लेखे

और यतः, उक्त नोरर्टस श्री िफर जमिाा के घर के बािर ददनांक 05.10.2020 और 07.10.2021 को ‘चस्ट् पा’ददए गए थे,

क् योंदक ददए गए पते पर न तो र्े स्ट् र्यं न िी उनका पररर्ार रिता जमला। दो पडोजसयों से चस्ट् पा ररपोर्टा की प्राप् त पार्ती एसडीएम(ई),

election;

AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at

election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in

connection with the election incurred or authorized by him or by his election agent between the date on which he has

been nominated and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the

Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date

through ‘CHASPA’ as he himself or his family was not found residing at the given address. The Chaspa report

acknowledgment receipt obtained from the two neighbours was submitted to the Commission by SDM(E), Central

vide his letter No. DEO(C)/75/E. Expenses/DLA-20/1150 dated 13-10-2020.

AND WHEREAS, in the supplementary report submitted by SDM(E), Central Delhi vide letter No.

DEO(C)/75/E. Expenses/DLA-20/2931 dated 04-08-2021, it has been statde that Shri Zafar Mirza has not submitted

any representation or a statement of correct account of his election expenses, duly signed along with original vouchers.

Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice of the

रा.रा.क्षेत्र, ददल् ली द्वारा प्रस्ट्तुत ररपोर्टा के अनुसार, रा‍ रीय राििानी राज्य क्षेत्र, ददल् ली के 22-बल्लीमारन जर्िानसभा जनर्ााचन क्षेत्र से

जनर्ााचन लडने र्ाले (जनदालीय) अभ्यथी, श्री आररफ नबी जर्जि द्वारा यथापेजक्षत रीजत से अपने जनर्ााचन व्यय का कोई लेखा दाजखल

करने में असफल रिे िैं;

और यतः, जिला जनर्ााचन अजिकारी, केन्द्रीय ददल् ली, रा.रा.रा.क्षे. ददल् ली और मुख् य जनर्ााचन अजिकारी, ददल् ली की ररपोर्टों के

लेखा दाजखल न करने पर, श्री आररफ नबी को कारण बताओ नोरर्टस ददनांक 24.09.2020 को िारी दकया गया था;

कारण बताओ नोरर्टस के माध् यम से, श्री आररफ नबी को जनदेि ददया गया था दक र्े इस नोरर्टस के प्राप्त िोने के 20 ददनों के भीतर लेखे

और यतः, श्री आररफ नबी द्वारा उक्त नोरर्टस ददनांक 06.10.2020 को प्राप्त दकया गया था। अभ्यथी से प्राप् त पार्ती

एसडीएम(ई), केन्द्रीय ददल्ली द्वारा ददनांक 13.10.2021 के पत्र सं.DEO/C/75/E.Expenses/DLA-20/1150 द्वारा आयोग को

प्रस्ट् तुत कर दी गई थी।

20/2931 के द्वारा प्रस्ट् तुत अनुपूरक ररपोर्टा में यि किा गया िै दक श्री आररफ नबी जनर्ासी-1238, गली मिल सराय,पंिाबी फार्टक,

बल्लीमारन, ददल्ली-110006 ने न तो कोई अभ् यार्ेदन ददया िै और न िी मूल र्ाउचसा सजित जर्जिर्त प प से िस्ट् ताक्षररत जनर्ााचन ‍ यय

के सिी लेखे प्रस्ट् तुत दकए िैं। इसके अजतररक् त, उन् िोंने भारत जनर्ााचन आयोग के सम् यक् नोरर्टस की प्राजप्त के बाद भी उक् त असफलता िेतु

न तो कोई कारण बताया न िी स्ट् प‍ र्टीकरण ददया िै;

और यत:, भारत जनर्ााचन आयोग का यि समािान िो गया िै दक श्री आररफ नबी जनर्ााचन व्यय का लेखा दाजखल करने में

और यत:, लोक प्रजतजनजित्र् अजिजनयम, 1951 की िारा 10क में यि अनुबंजित दकया गया िै दक:-

"यदद जनर्ााचन आयोग का यि समािान िो िाता िै दक कोई व्यजक्त-

(क)

जनर्ााचन व्ययों का लेखा उस समय के भीतर और उस रीजत में िैसी इस अजिजनयम के द्वारा या कानून के अिीन

अपेजक्षत िै, दाजखल करने में असफल रिा िै; तथा

(ख) उसके पास उस असफलता के जलए कोई समुजचत कारण या न्यायोजचत्य निीं िै, तो जनर्ााचन आयोग िासकीय रािपत्र

में प्रकाजित आदेि द्वारा उसको जनरर्िात घोजषत करेगा और ऐसा कोई भी व्यजक्त उस आदेि की तारीख से तीन र्षा की

कालार्जि के जलए जनरर्िात रिेगा;

अभ्यथी, श्री आररफ नबी जनर्ासी-1238, गली मिल सराय, पंिाबी फार्टक, बल् लीमारन, ददल् ली-110008 को संसद के दकसी भी सदन

या राज्य या संघ राज्य-क्षेत्र की जर्िानसभा अथर्ा जर्िान पररषद के जलए सदस्ट्य चुने िाने या िोने के जलए इस आदेि की तारीख से तीन

र्षा की अर्जि के जलए जनरर्िात घोजषत करता िै।

General Election to the Legislative Assembly of NCT of Delhi from 22-Ballimaran Assembly Constituency vide its

Notification dated 14.01.2020 and Shri Arif Nabi (Independent)had contested the aforesaid election;
