TDSAT, to this Court and resultantly in case no vacancy of Joint Registrar is available, he shall stand

बनाम ददल्ली ईच्च न्यायालय एर्ं ऄन्य", (iii) एस.एल.पी. (जसजर्ल) सं. 27418/2016 िीर्ाक “ददनेि

मनचंदा र् ऄन्य बनाम ददल्ली ईच्च न्यायालय एर्ं ऄन्य” तथा (iv) एस.एल.पी. (जसजर्ल) सं. 22722/2016

िीर्ाक “प्रजतमा रानी गुप्ता र् ऄन्य बनाम ददल्ली ईच्च न्यायालय एर्ं ऄन्य" के पररणाम के ऄध्यधीन िै तथा

आस िता के भी ऄध्यधीन दक ईपरोि जनणायों के दक्रयान्र्यन के पररणामस्ट्र्रूप यदद ईनकी र्ररष्ठता स्ट्तर

ऄर्नत िोता िै तो र्े ऄपना स्ट्थान ऄपने से उपर असीन ऄजधकारी(गण) िेतु छोड़ने के जलए बाध्य िोंगे एर्ं

यदद कोइ ररजि ईपलब्ध निीं िोती िै तो र्े प्रत्यार्र्ततत िो जाएाँगे।

कजनष्ठतम/जद्वतीय कजनष्ठतम/तृतीय कजनष्ठतम सिायक जनबंधकों की जनयुजियां जनम्न के पररणाम के ऄध्यधीन

की जा सकती िैं (i) श्री जोगगदर कुमार बत्रा, जनबंधक के आस न्यायालय में प्रत्यार्तान की दिा में (ii) जर्िेर्

ऄनुमजत याजचका (जसजर्ल) सं. 20313/2019 िीर्ाक “मनमीत गसि र् ऄन्य बनाम मिाजनबंधक के माध्यम

से ददल्ली ईच्च न्यायालय र् ऄन्य, और (iii) जांच कायार्ािी के पररणाम पर श्री कौिल कुमार सचदेर्ा को

दोर्मुि दकए जाने और ईन्िें पदोन्नजत के जलए ईपयुि पाए जाने की जस्ट्थजत में और दकसी भी पूर्ोि

पररदृश्य की जस्ट्थजत में या जैसा भी मामला िो, संबंजधत पदोन्नत व्यजि को ईसके जपछले पद पर प्रत्यार्र्ततत

दकया जा सकता िै।

समस्ट्त प्रोन्नत व्यजियों की र्ररष्ठता, श्री कौिल कुमार सचदेर्ा (जनलंबनाधीन) के जर्रुद्ध लंजबत जांच

कायार्ाजियों तथा एस.एल.पी. (जसजर्ल) सं 20313/2019 िीर्ाक “मनमीत गसि र् ऄन्य बनाम

मिाजनबंधक के माध्यम से ददल्ली ईच्च न्यायालय र् ऄन्य” के पररणाम के ऄध्यधीन िै।

4. आसके ऄजतररि, ये जनयुजियां सिायक जनबंधक के पद पर जनयुजि िेतु भती जनयमों में ददए गए ऄनुपात में

संिोधन/पररर्तान से संबंजधत लंजबत ऄभ्यार्ेदनों के पररणाम के भी ऄध्यधीन िैं|

& Ors. Vs. High Court of Delhi & Ors.”, (iii) SLP (Civil) No. 27418/2016 titled “Dinesh

Manchanda & Ors. Vs. High Court of Delhi & Ors.”, and (iv) SLP (Civil) No. 22722/2016 titled

“Pratima Rani Gupta & Others Vs High Court of Delhi and Ors.” and also subject to the condition

that in case as a result of implementation of above decisions their seniority position are depressed,

they will be liable to yield their position to the officer(s) placed senior to them and in case no vacancy

2. The appointments of junior most/second junior most/third junior most Assistant Registrars may be

made subject to outcome of (i) in the event of repatriation of Mr. Joginder Kumar Batra, Registrar, to

this Court (ii) SLP (C) No. 20313/2019 titled “Manmeet Singh & Anr. Vs. The Delhi High Court

through Registrar General & Ors.” and (iii) in case of exoneration of Mr. Kaushal Kumar Sachdeva

upon the outcome of the inquiry proceedings and he being found fit for promotion and in the event of

any aforesaid scenario or as the case may be, the concerned promotee will be liable to be reverted to

his previous post.

3. The seniority of all the promotees shall be subject to outcome of the inquiry proceedings pending

against Mr. Kaushal Kumar Sachdeva (under suspension) and subject to outcome of SLP (Civil)

No.20313/2019 titled“Manmeet Singh & Anr.Vs. The Delhi High Court through Registrar General &

Ors.

4. Further, the appointments on pre-page are also subject to outcome of the pending representations with

regard to amendment/ change in the ratio in the recruitment rules for appointment to the post of

Assistant Registrar.
