STATE ELECTION COMMISSION

ORDER

Delhi, the 23rd July, 2026

No. F.1(268)/SEC/Admn.(E.E)/2025/1033.—WHEREAS, the Bye-Elections to elect Councillors to fill up

vacancies in 12 vacant Wards of Municipal Corporation of Delhi were announced by this Commission vide Press Note

No. F. 4(BYE)/(5)/SEC/LAW/2025/21215 dated 28.10.2025;

AND WHEREAS, Rule 103 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012

(hereinafter called the Rules) prescribes that every candidate at an election to a ward shall, either by himself or by his

election agent, keep a separate and correct account of all expenditure in connection with the election, incurred or

authorized by him or by his election agent between the date on which he/she has been nominated and the date of

declaration of the result;

AND WHEREAS, Rule 104 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012

provides that;

Lodging of accounts with the Returning Officer: - (1) Every contesting candidate

at an election of a ward shall, within ten days from the date of election of the returned candidate, lodge

with the Returning Officer an account of his election expenses which shall be a true copy of the account

kept by him or by his election agent.

(2) Every contesting candidate at an election to a ward shall also file an affidavit in Form-20

in token of authenticity of the account of election expenses as maintained & submitted by him.

AND WHEREAS, the Bye Elections for 12 vacant Wards of Municipal Corporation of Delhi were held on

30.11.2025 and the result was declared by this Commission on 03.12.2025. Hence the last date for lodging the account

of Election Expenses was13.12.2025;

AND WHEREAS, as per the report submitted by the Returning Officer, Ward-65 vide letter dated

15.12.2025, Smt. Vishakharani, W/o Sh. Vinod Kumar, a contesting candidate from Ward-65 of Municipal

Corporation of Delhi has failed to lodge account of election expenses, as per aforesaid Rules;

AND WHEREAS, on the basis of the said report of the Returning Officer, Ward-65, Show Cause notices

dated 17.02.2026 and 21.04.2026 were issued under Rule 108(5) of the aforesaid Rules by this Commission to Smt.

Vishakharani, W/o Sh. Vinod Kumar, through Returning Officer, Ward-65 for not lodging of account of Election

Expenses;

AND WHEREAS, through the above said Show Cause Notices and as per provisions of Rule 108(5) of the

aforesaid Rules, Smt. Vishakharani, W/o Sh. Vinod Kumar, was directed to submit representation in writing to the

Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the

Returning Officer, Ward-65 within 20 days from the date of receipt of the notices;

AND WHEREAS, the Returning Officer, Ward-65, has reported that the said notices were served upon Smt.

Vishakharani, W/o Sh. Vinod Kumar, on 28.02.2026 and 27.04.2026;

9.

AND WHEREAS, the Returning Officer, Ward-65 in his reports dated 13.04.2026 and 18.05.2026 reported

that Smt. Vishakharani, W/o Sh. Vinod Kumar, has not submitted account of election expenses;

AND WHEREAS, after receipt of the said notices, Smt. Vishakharani, W/o Sh. Vinod Kumar, has failed to

furnish any reason or explanation to this Commission, for failure tolodge the account as prescribed in the aforesaid

Rules;

11.

AND WHEREAS, Rule 110 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012

provides that:-

If the Commission is satisfied that a person:-

(a) has failed to lodge an account of Election expenses within the time and in the manner required by these rules, and

(b) has no good reason or justification for the failure, the Commission shall, by order published in the Official

Gazette, declare him to be disqualified and any such person shall be disqualified for a period of six years from the

date of the order.

AND WHEREAS, on the basis of facts and available records, the Commission is satisfied that Smt.

Vishakharani, W/o Sh. Vinod Kumar, has failed to lodge account of election expenses and has no good reason or

justification for the failure to do so;

13.

NOW, THEREFORE, in pursuance of the provisions of Rule 110 of the Delhi Municipal Corporation

(Election of Councillors) Rules, 2012, the State Election Commission, NCT of Delhi hereby declares Smt.

Vishakharani, W/o Sh. Vinod Kumar, resident of R/o N-28/D-180, D Block, Wazirpur Industrial Area, Ashok Vihar,

Delhi-110052, a contesting candidate from Ward-65, Ashok Vihar in the Bye-Elections 2025 to the Municipal

Corporation of Delhi, to be disqualified for being chosen as and for being a Councillor of Municipal Corporation of

Delhi for a period of six years from the date of this order.

with the Returning Officer an account of his election expenses which shall be a true copy of the account

kept by him or by his election agent.

(2) Every contesting candidate at an election to a ward shall also file an affidavit in Form-20

in token of authenticity of the account of election expenses as maintained & submitted by him.

AND WHEREAS, the Bye Elections for 12 vacant Wards of Municipal Corporation of Delhi were held on

30.11.2025 and the result was declared by this Commission on 03.12.2025.Hence the last date for lodging the account

of Election Expenses was 13.12.2025;

AND WHEREAS, as per the report submitted by the Returning Officer, Ward-163vide letter dated

23.12.2025,Sh. Dal Chand Kapil,S/o Sh. Hari Singh, a contesting candidate from Ward-163 of Municipal Corporation

of Delhi has failed to lodge account of election expenses, as per aforesaid Rules;

AND WHEREAS, on the basis of the said report of the Returning Officer, Ward-163, Show Cause notices

dated 17.02.2026 and 21.04.2026 were issued under Rule 108(5) of the aforesaid Rules by this Commission to Sh. Dal

Chand Kapil, S/o Sh. Hari Singh, through Returning Officer, Ward-163 for not lodging of account of Election

Expenses;

AND WHEREAS, through the above said Show Cause Notices and as per provisions of Rule 108(5) of the

aforesaid Rules, Sh. Dal Chand Kapil, S/o Sh. Hari Singh, was directed to submit representation in writing to the

Commission explaining the reason for not lodging the account and also to lodge account of election expenses with the

Returning Officer, Ward-163 within 20 days from the date of receipt of the notices;

AND WHEREAS, the Returning Officer, Ward-163, has reported that the said notices were served upon

Sh. Dal Chand Kapil, S/o Sh. Hari Singh, on 06.03.2026 and 15.05.2026;

AND WHEREAS, the Returning Officer, Ward-163 in his reports dated 16.04.2026 and 06.06.2026 reported

that Sh. Dal Chand Kapil, S/o Sh. Hari Singh, has not submitted account of election expenses;

AND WHEREAS, after receipt of the said notices, Sh. Dal Chand Kapil, S/o Sh. Hari Singh, has failed to

furnish any reason or explanation to this Commission, for failure to lodge the account as prescribed in the aforesaid

Rules;

AND WHEREAS, Rule 110 of the Delhi Municipal Corporation (Election of Councillors) Rules, 2012

provides that:-

If the Commission is satisfied that a person:-

(a) has failed to lodge an account of Election expenses within the time and in the manner required by these rules, and

(b) has no good reason or justification for the failure, the Commission shall, by order published in the Official

Gazette, declare him to be disqualified and any such person shall be disqualified for a period of six years from the

date of the order.

AND WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Dal Chand

Kapil, S/o Sh. Hari Singh, has failed to lodge account of election expenses and has no good reason or justification for

the failure to do so;

13.

NOW, THEREFORE, in pursuance of the provisions of Rule 110 of the Delhi Municipal Corporation

(Election of Councillors) Rules, 2012, the State Election Commission, NCT of Delhi hereby declares Sh. Dal Chand

Kapil, S/o Sh. Hari Singh, resident of R/o H. No. 49/3, Deoli Village, New Delhi-110080, a contesting candidate from

Ward-163, Sangam Vihar-A in the Bye-Elections 2025 to the Municipal Corporation of Delhi, to be disqualified for

being chosen as and for being a Councillor of Municipal Corporation of Delhi for a period of six years from the date

of this order.
