NOTIFICATION

THE GUJARAT TOWN PLANNING AND URBAN DEVELOPMENT ACT, 1976.

No. GH/V/419 of 2025/UDUHD/MSM/MPMLA/18/2023/4496/L: WHEREAS, under Government Notification

Panchayats, Housing and Urban Development Department No. GHB/20/UDA-1177-646(2)-Q, dated 30.01.1978

Himmatnagar Nagar Panchayat area was declared as Development Area under section-3 of the Gujarat Town Planning

and Urban Development Act, 1976 (President's Act No.27 of 1976) (hereinafter refer to as “the said Act”) and

Himmatnagar Nagar Panchayat was designated as Area Development Authority under section-6 of the said Act as

shown at Sr.No.16 of the schedule to the said notification dated 30.01.1978;

AND WHEREAS, under Government Notification, Urban Development and Urban Housing Department No.GH/V/208

of 2012/UDA-112009-5533-L, dated 03.10.2012, under sub-section (1), (2), (2A), 5 of section 22, sub-section 3 of

section 23 and section 108 of the said Act, Himmatnagar Municipality and eleven surrounding villages area was

declared as Urban Development area and constituted the Himmatnagar Urban Development Authority (hereinafter

referred as "the said Authority") for the said Urban Development Area mentioned in the schedule to the said notification

dated 03.10.2012;

AND WHEREAS, under Government Notification, Urban Development and Urban Housing Department No.GV/49 of

2024/UDUHD/EOM/e-file/18/2022/0004/M, dated 12.03.2024, the State Government extended the area of

Himmatnagar Municipality by including certain areas in the limits of Himmatnagar Municipality as mentioned in the

schedule to the said notification dated 12.03.2024;

AND WHEREAS, the State Government has received various representations for excluding the area of eleven villages

falling outside the Himmatnagar nagarpalika from the Himmatnagar Urban Development Authority area;

AND WHEREAS, the Government of Gujarat is of opinion that it is necessary in the public interest to withdraw from

the operation of certain provisions of the said Act, from part of urban development area declared under Section-22 of

the said Act;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of section 4 and clause (a) of sub-section

(2) of section 4 read with section 25 and clause (x) of sub-section (1) of section 23 of the said Act, the Government of

Gujarat hereby withdraw from the operation of the provision of the said Act with regard to the preparation, publication,

sanction of a development plan and all other matters connected therewith or incidental thereto and all notifications,

rules, regulations, orders, directions and powers issued made or conferred thereunder for the area mentioned in the

SCHEDULE below shall cease to apply to the said area.
