(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-12-LTP-172025-3092-GH:- Whereas it appears to the Government of Gujarat, that the land is likely

to be needed for public purpose viz. for the purpose of construction of the infrastructure project of “Constructing the

Ukai Left Bank High Level Canal ch.18448 mtr. To 19050 mtr. At-Vazarda , ta-Songadh , Dist. Tapi”.

Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of “The Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013)

(herein after referred to as “The Act”) and the Rules made there-under, it is hereby notified that the Government

of Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

Now whereas a proposal is made for acquisition of the above mentioned proposed project of “Constructing the

Ukai Left Bank High Level Canal ch.18448 mtr. to 19050 mtr. At-Vazarda , ta-Songadh , Dist. Tapi” the bare

minimum area of land to be acquired, for the Project is H.A. 2-09-25 Sq.mtr. and is situated within the boundary

limit of: Village: Vazarda, Taluka: Songadh, Dist. Tapi.

Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of

H.A. 2-09-25 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of

the provision of chapter II and III of the Act.

Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The

RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby

exempt in public interest, the area of H.A. 2-09-25 Sq.mtr. land is situated within the boundary limit of: Village:

Vazarda, Taluka: Songadh, Dist. Tapi to be acquired for the “Constructing the Ukai Left Bank High Level Canal

ch.18448 mtr. To 19050 mtr. At-Vazarda , ta-Songadh , Dist. Tapi” from the application of the provision of

chapter II and III of The Act.

કંટુર કેનાલ સાાંકળ-૧૮૪૪૮ મી. થી ૧૯૦૫૦ મી.નાાં કામે સાંપાદિત કરવાનાલ”ના જાહેર હેતુના આાંતરમાળખાકીય પ્રોજેક્ટ માટે જમીનની જરૂર

પડવાનો સાંભવ છે, એવુાં ગુજરાત સરકારને જણાય છે.

(૧)

તેથી જમીન સાંપાિન, પુન:સ્થાપન અને પુનનવસનમાાં વ્યાજબી વળતર અને પારિર્નકતા અચધકાર અચધચનયમ-૨૦૧૩ (૨૦૧૩નો

૩૦મો) (જેનો આમાાં હવે પછી “સિરહુ અચધચનયમ” તેમ ઉલ્લેખ કરવામાાં આવેલ છે તે)ની કલમ-૨(૧) તથા તે અાંગેના ચનયમોથી

મળેલ અચધકાર અન્વયે ગુજરાત સરકાર આથી ઉપરોક્ત આાંતરમાળખાકીય પ્રોજેક્ટના જાહેર હેતુ માટે કાયિાનુસાર સાંપાિન કરવાનો

ઈરાિો જાહેર કરે છે.

હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ “મોજે-વાઝરડા, તા-સોનગઢ, ચજ- તાપી ખાતે ઉકાઈ ડાબા કાાંઠા હાઈ લેવલ કંટુર કેનાલ સાાંકળ-

૧૮૪૪૮ મી. થી ૧૯૦૫૦ મી.નાાં કામે સાંપાદિત કરવાનાલ”ના જાહેર હેતુ માટે જમીન સાંપાિન માટેની િરખાસ્ત રજૂ થયેલ છે, ત્યારે

આ પ્રોજેક્ટ માટે સાંપાિન કરવાની થતી ઉપરોક્ત ઓછામાાં ઓછી જમીનનો કુલ ચવસ્તાર હે.આરે. ૨-૦૯-૨૫ િો.મી. છે અને તે મોજે.

વાઝરડા, તા. સોનગઢ, ચજ. તાપીની હિમાાં આવેલ છે.

હવે જ્યારે ઉપરોક્ત આાંતરમાળખાકીય પ્રોજેક્ટ માટે સિરહુ સાંપાિન કરવાની થતી ક્ષેત્રફળ હે.આરે. ૨-૦૯-૨૫ િો.મી. જમીનને સિરહુ

અચધચનયમના પ્રકરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાાંથી મુચક્ત આપવાનુાં રાજ્ય સરકારને જાહેર ચહતમાાં આવશ્યક જણાય

છે.

(૪) તેથી સિરહુ અચધચનયમની કલમ-૧૦(એ) (જમીન સાંપાિન, પુન:સ્થાપન અને પુનનવસનમાાં વ્યાજબી વળતર અને પારિર્નકતા (ગુજરાત

સુધારા) અચધચનયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અચધચનયમ-નાં.૧૨)ની કલમ-૩થી િાખલ કરેલ) થી મળેલ અચધકારો અન્વયે, રાજ્ય

સરકાર આથી જાહેર ચહતમાાં “મોજે-વાઝરડા તા-સોનગઢ, ચજ-તાપી ખાતે ઉકાઈ ડાબા કાાંઠા હાઈ લેવલ કંટુર કેનાલ સાાંકળ-૧૮૪૪૮

મી. થી ૧૯૦૫૦ મી.નાાં કામે સાંપાદિત કરવાનાલ”ના આાંતરમાળખાકીય પ્રોજેક્ટ માટે સાંપાિન થતી જમીનમાાં સમાચવષ્ટ થયેલ મોજે.

વાઝરડા, તા. સોનગઢ, ચજ. તાપીની ક્ષેત્રફળ હે.આરે. ૨-૦૯-૨૫ િો.મી. જમીનને સિરહુ અચધચનયમના પ્રકરણ-૨ અને ૩ની

જોગવાઈઓની અમલવારીમાાંથી મુચક્ત આપે છે.
