(The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013)

No:- AM-M-2026-20-LSU-142025-3082-GH:- Whereas it appears to the Government of Gujarat, that the land is likely

to be needed for public purpose viz. for the purpose of construction of the infrastructure project of “Construction of

Four Lanning Mahuva Anaval Road Chainage 0/0 to 28/960 km. Existing 0/0 to 15/300 4-Lane from 10.00 meters and

15/300 to 28/960 km 4- Lane from 7.0 meters”.

(1) Now therefore in exercise of the powers conferred by sub-section (1) of section (2) of “The Right to fair

Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013)

(herein after referred to as “The Act”) and the Rules made there-under, it is hereby notified that the Government of

Gujarat intends to acquire the said land for the public purpose of the infrastructure project specified above.

(2) Now whereas a proposal is made for acquisition of the above mentioned proposed project of “Construction of Four

Lanning Mahuva Anaval Road Chainage 0/0 to 28/960 km. Existing 0/0 to 15/300 4-Lane from 10.00 meters and

15/300 to 28/960 km 4- Lane from 7.0 meters” the bare minimum area of land to be acquired, for the Project is

H.A. 09-22-13 Sq.mtr. and is situated within the boundary limit of: Village: Puna, Taluka: Mahuva(Current-

Ambika), Dist. Surat.

(3) Now whereas it appears to the State Government that it is expedient to exempt in public interest such area of H.A.

09-22-13 Sq.mtr. of land to be acquired, for the above stated infrastructure project, from the application of the

provision of chapter II and III of the Act.

(4) Now therefore, in exercise of the powers conferred by section 10(A) of The Act [inserted by section 3 of The

RFCTLARR (Gujarat Amendment) Act, 2016] (Gujarat Act No. 12 of 2016) The Government of Gujarat, hereby

exempt in public interest, the area of H.A. 09-22-13 Sq.mtr. land is situated within the boundary limit of: Village:

Puna, Taluka: Mahuva(Current-Ambika), Dist. Surat to be acquired for the “Construction of Four Lanning

Mahuva Anaval Road Chainage 0/0 to 28/960 km. Existing 0/0 to 15/300 4-Lane from 10.00 meters and 15/300 to

28/960 km 4- Lane from 7.0 meters” from the application of the provision of chapter II and III of The Act.

થી ૧૫/૩૦૦ માાં ૧૦.૦૦ મીટરમાાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ કી.મી.માાં ૭.૦ મીટર માાંથી ૪ લેન”ના જાહેર હેતુના

આાંતરમાળખાકીય પ્રોજેક્ટ માટે જમીનની જરૂર પડવાનો સાંભવ છે, એવુાં ગુજરાત સરકારને જણાય છે.

(૧) તેથી જમીન સાંપાદન, પુન:સ્થાપન અને પુનગવસનમાાં વ્યાજબી વળતર અને પારદર્ગકતા અચધકાર અચધચનયમ-૨૦૧૩) (૨૦૧૩નો ૩૦મો)

(જેનો આમાાં હવે પછી “સદરહુું અચધચનયમ” તેમ ઉલ્લેખ કરવામાાં આવેલ છે તે)ની કલમ-૨(૧) તથા તે અાંગેના ચનયમોથી મળેલ

અચધકાર અન્વયે ગુજરાત સરકાર આથી ઉપરોક્ત આાંતરમાળખાકીય પ્રોજેક્ટના જાહેર હેતુ માટે કાયદાનુસાર સાંપાદન કરવાનો ઈરાદો

જાહેર કરે છે.

(૨) હવે જ્યારે ઉક્ત સૂચિત પ્રોજેક્ટ “મહુવા અનાવલ રોડ િેનેજ ૦/૦ થી ૨૮/૯૬૦ કી.મી. અાંતગગત હયાત ૦/૦ થી ૧૫/૩૦૦ માાં ૧૦.૦૦

મીટર માાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ કી.મી.માાં ૭.૦ મીટર માાંથી ૪ લેન”ના જાહેર હેતુ માટે જમીન સાંપાદન માટેની

દરખાસ્ત રજૂ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સાંપાદન કરવાની થતી ઉપરોક્ત ઓછામાાં ઓછી જમીનનો કુલ ચવસ્તાર હે.આરે. ૦૯-૨૨-

૧૩ િો.મી. છે અને તે મોજે. પુના તા. મહુવા (હાલ-અાંચબકા) ચજ. સુરતની હદમાાં આવેલ છે.

(૩) હવે જ્યારે ઉપરોક્ત આાંતરમાળખાકીય પ્રોજેક્ટ માટે સદરહુું સાંપાદન કરવાની થતી ક્ષેત્રફળ હે.આરે. ૦૯-૨૨-૧૩ િો.મી. જમીનને સદરહુું

અચધચનયમના પ્રકરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાાંથી મુચક્ત આપવાનુાં રાજ્ય સરકારને જાહેર ચહતમાાં આવશ્યક જણાય છે.

(૪) તેથી સદરહુું અચધચનયમની કલમ-૧૦(એ) (જમીન સાંપાદન, પુન:સ્થાપન અને પુનગવસનમાાં વ્યાજબી વળતર અને પારદર્ગકતા (ગુજરાત

સુધારા) અચધચનયમ-૨૦૧૬ (૨૦૧૬નો ગુજરાત અચધચનયમ-નાં.૧૨)ની કલમ-૩થી દાખલ કરેલ)થી મળેલ અચધકારો અન્વયે, રાજ્ય

સરકાર આથી જાહેર ચહતમાાં “મહુવા અનાવલ રોડ િેનેજ ૦/૦ થી ૨૮/૯૬૦ કી.મી. અાંતગગત હયાત ૦/૦ થી ૧૫/૩૦૦ માાં ૧૦.૦૦

મીટરમાાંથી ૪-લેન અને ૧૫/૩૦૦ થી ૨૮/૯૬૦ કી.મી.માાં ૭.૦ મીટર માાંથી ૪ લેન”ના આાંતરમાળખાકીય પ્રોજેક્ટ માટે સાંપાદન થતી

જમીનમાાં સમાચવષ્ટ થયેલ મોજે. પુના તા. મહુવા (હાલ-અાંચબકા) ચજ. સુરતની ક્ષેત્રફળ હે.આરે. ૦૯-૨૨-૧૩ િો.મી. જમીનને સદરહુું

અચધચનયમના પ્રકરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાાંથી મુચક્ત આપે છે.
