Resettlement Act, 2013) (30 of 2013)

No: AM-M-2026-1025-LBR-172026-1093-GH:- In exercise of the powers conferred by sub-section (1) of Section 11

of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013

(No. 30 of 2013)(hereinafter referred to as “the Act”), the Government of Gujarat hereby declares that the land / lands

mentioned in the Schedule annexed hereto is / are required for the purpose of acquisition for the public purpose of

“Construction of Flood Protection Embankment on left bank of Narmada River for Bhadbhut Barrage project across

river Narmada near Bhadbhut Taluka Bharuch, Dist. Bharuch.”

It is notified that, -

(1)

The area of land / lands required for the above project is H. 01-65-83 Sq.mt. and is at Borbhatha Bet

Village of Ankleshwar Taluka of Bharuch District;

(2)

The public purpose involved in the above project are: For the purpose of construction of the infrastructure

project of “Construction of Flood Protection Embankment on left bank of Narmada River for Bhadbhut

Barrage project across river Narmada near Bhadbhut Taluka Bharuch, Dist. Bharuch.”

The reasons necessitating the displacement of the affected persons are –

Due to acquisition of the Land, specified in the SCHEDULE for public purpose of “Construction of Flood

Protection Embankment on left bank of Narmada River for Bhadbhut Barrage project across river

Narmada near Bhadbhut Taluka Bharuch, Dist. Bharuch.”

The summary of the Social Impact Assessment Report is as under : Under Section 10A of the Gujarat Act

of 12 of 2016, exemption is given under Section 10A of the Act vide Revenue department, Government

Of Gujarat Notification No:- AM-M-2026-727-LBR-172026-1093-GH. Dated:- 27.07.2026 it is not

required for the summary of the Social Impact Assessment Report.

The particulars of the Administrator appointment under section 43 of the Act are as under– Special Land

Acquisition Officer, Bharuch.

All the persons interested in these lands are hereby notified not to obstruct and disturb any Surveyor or other

staff to enter upon and survey the land. Any transaction in respect of whole or part of these lands in whatsoever

manner including by sale, lease, mortgage, change of name, exchange entered into after the date of this

Notification made without permission of the Collector shall not be taken into consideration by the officer

assessing the compensation under section 27 of the Act for a particular portion of the land as may be finally

acquired.

The Government of Gujarat, if satisfied about acquisition of the land for aforesaid public purpose, may publish

final declaration under section 19 of the Act in this regard in the manner and timeframe so prescribed under the

Act. In case the acquisition is dropped partially or entirely, such facts shall be notified in a proper manner as

provided under the Act.

In exercise of the powers under clause (g) of section 3 of the Act the State Government hereby appoints the

Special Land Acquisition Officer, Bharuch to perform the functions of Collector under the provisions of the said

Act in respect of aforesaid lands, except the powers vested under sections 17(1) and 17(2) of the Act.

(6)

Objection to the acquisition, if any, may be find the person interested within 60(Sixty Days) from the date of the

publication of this notification as provided under Section 15 of the ACT before Special Land Acquisition

Officer, Bharuch.

ક્રમાુંક: અમ-મ-૨૦૨૬-૧૦૨૫-જભર-૧૭૨૦૨૬-૧૦૯૩-ઘ:- જમીન સાંપાદન, પુનઃસ્થાપન અને પુનવવસનમાાં વાજબી વળતર અને

પારદચશવતાનો અચધકાર અચધચનયમ, ૨૦૧૩) (૨૦૧૩નો ૩૦મો)ની કલમ-૧૧ની પેટા કલમ-(૧) હેઠળ (હવે પછી તેનો “સદરહું અચધચનયમ”

તેમ ઉલ્લેખ કરવામાાં આવશે.) ગુજરાત સરકાર આથી જાહેર કરે છે કે આ સાથે જોડેલ અનુસૂચિમાાં બતાવવામાાં આવેલ જમીનોની જાહેર હેતુ

માટે એટલે કે “નમવદા નદી પર ભરૂિ ચજલ્લાના ભરૂિ તાલુકાના ભાડભુત ગામ પાસે ભાડભુત બેરેજ યોજનાના બાાંધકામ માટે જરૂરી નમવદા

નદીના ડાબા કાાંઠા પર પૂર સાંરક્ષણ પાળાની પથરેખા”ના પ્રોજેક્ટ માટે જરૂર છે.

આથી જાહેર કરે છે કે:

(૧)

ઉપર જણાવેલ પ્રોજેક્ટ માટે જરૂરી જમીન કુલ ક્ષેત્રફળ હે. ૦૧-૬૫-૮૩ િો.મી. છે અને તે મોજે. બોરભાઠા બેટ, તા. અાંકલેશ્વર,

ચજ. ભરૂિમાાં આવેલ છે.

(૨)

ઉપર જણાવેલ પ્રોજેક્ટમાાં નીિે મુજબના જાહેર ચહતનો સમાવેશ થાય છે. “નમવદા નદી પર ભરૂિ ચજલ્લાના ભરૂિ તાલુકાના

ભાડભુત ગામ પાસે ભાડભુત બેરેજ યોજનાના બાાંધકામ માટે જરૂરી નમવદા નદીના ડાબા કાાંઠા પર પૂર સાંરક્ષણ પાળાની

પથરેખા”ના આાંતરમાળખાકીય પ્રોજેક્ટના બાાંધકામ માટે.

અસરગ્રસ્ત વ્યચિઓને ખસેડવાની જરૂરના કારણો નીિે મુજબ છે. “નમવદા નદી પર ભરૂિ ચજલ્લાના ભરૂિ તાલુકાના ભાડભુત

ગામ પાસે ભાડભુત બેરેજ યોજનાના બાાંધકામ માટે જરૂરી નમવદા નદીના ડાબા કાાંઠા પર પૂર સાંરક્ષણ પાળાની પથરેખા” માટે

અનુસૂચિત ચવસ્તારની જમીન સાંપાદનના કારણે.

સામાચજક અસરોના મૂલયાાંકન અહેવાલ સાંચક્ષપ્તમાાં નીિે મુજબ છે. ગુજરાત અચધચનયમ-૧૨/૨૦૧૬ની કલમ-૧૦(એ) હેઠળ

મહેસૂલ ચવભાગના ગુજરાત સરકારના જાહેરનામા ક્રમાાંક: અમ-મ-૨૦૨૬-૭૨૭-જભર-૧૭૨૦૨૬-૧૦૯૩-ઘ, તા.૨૭.૦૭.૦૨૬

થી મુચિ આપવામાાં આવેલ છે. અચધચનયમની કલમ-૧૦(એ) હેઠળ સામાચજક અસરોના મૂલયાાંકનનો સાંચક્ષપ્ત અહેવાલ આપવો

જરૂરી નથી.

(૫) અચધચનયમની કલમ-૪૩ હેઠળ ચનયુિ કરવામાાં આવેલ વહીવટદારની ચવગતો નીિે મુજબ છે.

ખાસ જમીન સાંપાદન અચધકારીશ્રી, ભરૂિ.

આ જમીનોમાાં ચહત ધરાવતી તમામ વ્યચિઓને આથી જાણ કરવામાાં આવે છે કે કોઇ પણ સવેયરને અથવા અન્ય કમવિારીઓને આ

જમીન પર દાખાલ થવા અને જમીનનો સવે કરવા અટકાવવા નહીં. આ જાહેરનામુાં બહાર પાડ્યા કલેક્ટરની પરવાનગી વગર આ

જમીનની કે તેના કોઇ ભાગની કોઇ પણ સ્વરૂપે તબદીલી જેમાાં વેિાણ, ભાડા પટ્ટે આપવી, ગીરવે મુકવી, નામ બદલવુાં અથવા

નોંધણીમાાં ફેરફાર કરવા નહીં. જો તેમ કરવામાાં આવે તો અચધચનયમની કલમ-૨૭ હેઠળ જમીન સાંપાદનના વળતરનુાં મૂલયાાંકન કરતી

વખતે આવા ફેરફાર પર ચવિારણા કરવામાાં નહીં આવે.

ગુજરાત સરકારને જો ઉપર જણાવેલ જાહેર હેતુ માટે જમીન સાંપાદન કરવા અાંગે સાંતોષ થશે તો સદરહું અચધચનયમની કલમ-૧૯

હેઠળ, અચધચનયમમાાં ચનયત કરેલ સમયમયાવદામાાંની અાંદર આખરી જાહેરનામુાં બહાર પાડશે. જો સાંપાદન કરવાનુાં આાંચશક રીતે અથવા

પૂરેપૂરી રીતે રદ કરવામાાં આવે તો હકીકત અચધચનયમની જોગવાઈ યોગ્ય રીતે જાહેર કરવાની રહેશે. તે મતલબનુાં છેવટનુાં જાહેરનામુાં

યોગ્ય સમયમાાં કાયદાનુસાર પ્રચસદ્ધ કરવામાાં આવશે. સાંપાદન અાંશત: કે પૂણવત: જતુાં કયુવ હોય તો તે હકીકત કાયદાનુસાર યોગ્ય રીતે

જાહેર કરવામાાં આવશે.

૫.

સદરહું અચધચનયમની કલમ- ૩(જ) હેઠળ મળેલ સત્તાની રૂએ ખાસ જમીન સાંપાદન અચધકારીશ્રી, ભરૂિને અચધચનયમની જોગવાઈઓ

હેઠળ આ જમીનો માટે સદરહું અચધચનયમની કલમ-૧૭(૧) અને ૧૭(૨) હેઠળની સત્તાઓ ચસવાય કલેક્ટર તરીકે ફરજો બજાવવા

માટે ચનયુિ કરે છે.

૬. આ જાહેરનામા પ્રચસચદ્ધની તારીખથી ૬૦ દદવસની અાંદર અચધચનયમની કલમ-૧૫ મુજબ જો કોઇને સાંપાદન બાબતે વાાંધો હોય તો

તેઓ કલમ-૧૫ હેઠળ ખાસ જમીન સાંપાદન અચધકારીશ્રી, ભરૂિને રજૂઆત કરી શકશે.
