No. AM-M-2026-1039-JPT-142025-73-GH :- Whereas it appears to the Government of Gujarat that land specified in

the SCHEDULE annexed here to, is likely to be required to (herein after referred to as "The Requiring Body") for the

public purpose of “Radhanpur Bypass Road.” (herein after referred to as "The public purpose Project")

Now whereas, the Government of Gujarat, Revenue Department has, in exercise of the powers conferred, by

section-10(A) [inserted by section 3 of The Right to Fair compensation and Transparency in Land Acquisition

and Rehabilitation and Resettlement (Gujarat Amendment) Act, 2016 (Gujarat Act No.12 of 2016)] of The Right

to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of

2013) (here in after referred to as "The Act") exempted, in public interest, by Notification No. AM-M-2024-63-

JPT-142025-73-GH, Date: 05/02/2025 published in the extraordinary Gazette of Gujarat Government Date:

05/02/2025. The below mentioned Scheduled area of land, to be acquired for the infrastructure project of the

“Radhanpur Bypass Road.”, from the application of the provision of chapter II and III of The Act, and

Now whereas, in exercise of the powers, conferred by sub-section (1) of section-43 of The Act, The State

Government, vide Notification No. AM-M-2025-308-JPT-142025-73-GH, Date: 16/05/2025 is pleased to

designate Deputy Collector, Radhanpur to function and discharge the duties as the Administrator of

Rehabilitation and Resettlement in respect of the scheduled land to be acquired for construction of the captioned

infrastructure project, and

Now whereas, in exercise of the powers conferred by sub-section (1) of section 11 of "The Right to Fair

compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act-2013" (30 of 2013)

(hereinafter referred to as The Act), the Government of Gujarat, has notified, vide their Notification No. AM-M-

2025-308-JPT-142025-73-GH, Date: 16/05/2025 that the said Scheduled land is required for the public purpose

specified here above,

And Whereas, the Government of Gujarat is satisfied after considering the report made by The District Collector,

Patan under sub-section (2) of section 15 of Act, that the said land is needed to be acquired for "The public

purpose project" specified in the scheduled here to, and

Now therefore, in exercise of the power conferred by sub-section (1) of section 19 The Act, the Government of

Gujarat hereby declares that the said scheduled lands are required for the public purpose specified in the

schedule hereto.

In exercise of the power conferred by clause (g) of section-3 of The Act, the Government of Gujarat hereby

appoints Deputy Collector, Radhanpur to perform the function of a Collector, for all proceeding here in after to

be carried out under The Act, in respect of the said scheduled lands.

The plans, of scheduled lands can be inspected at the office of Deputy Collector, Radhanpur.

Now whereas, it appears to the Government of Gujarat, that below mentioned lands indicated serial number of

SHEDULE appended with Government Notification No AM-M-2025-308-JPT-142025-73-GH, Date:

16/05/2025 are not required for the aforesaid Public Purpose Project, The Government of Gujarat hereby,

abandons acquisition of these lands for the aforesaid “Public Purpose Project” and notifies cancellation of the

captioned Notification in Context to the below mentioned serial numbered lands.

ક્રમાુંક: અમ-મ-૨૦૨૬-૧૦૩૯-જપટ-૧૪૨૦૨૫-૭૩-ઘ:- આ સાથે સામેલ અનુસૂચિમાાં દર્ાાવવામાાં આવેલ જમીનોની જાહેર હેતુ માટે

એટલે કે "રાધનપુર બાયપાસની કામગીરી માટે જમીન સાંપાદન કરવા બાબત" (જેનો આમાાં હવે પછી “જાહેર હેતુની યોજના” એમ ઉલ્લેખ

કરવામાાં આવેલ છે તે) ના આાંતરમાળખાકકય પ્રોજેક્ટના બાાંધકામ માટે જરૂર પડવાનો સાંભવ છે એવુ ગુજરાત સરકારને જણાય છે.

૧.

હવે જ્યારે તા.૦૫/૦૨/૨૦૨૫ ના ગુજરાત સરકારના અસાધારણ રાજ્યપત્રમાાં પ્રચસદ્ધ થયેલ મહેસૂલ ચવભાગના જાહેરનામા ક્રમાાંક:

અમ-મ-૨૦૨૪-૬૩-જપટ-૧૪૨૦૨૫-૭૩-ઘ, તા.૦૫/૦૨/૨૦૨૫ થી ગુજરાત સરકારે જમીન સાંપાદન, પુન:સ્થાપન અને પુનવાસનમાાં

વાજબી વળતર અને પારદચર્ાતાનો અચધકાર અચધચનયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) (જેનો આમાાં હવે પછી "સદરહુ અચધચનયમ" તેમ

ઉલ્લેખ કરવામાાં આવેલ છે તે) ની કલમ-૧૦(એ) (૨૦૧૬ના ગુજરાત અચધચનયમ નાં.૧૨ની કલમ-૩ થી દાખલ કરેલ) થી મળેલ

અચધકારો અન્વયે, રાજ્ય સરકારે જાહેર ચહતમાાં "રાધનપુર બાયપાસની કામગીરી માટે જમીન સાંપાદન કરવા બાબત”ના

આાંતરમાળાખાકીય પ્રોજેક્ટ માટે સાંપાદન કરવાની નીિે જણાવેલ અનુસૂચિત ક્ષેત્રફળની જમીનને, "સદરહુ અચધચનયમ" ના પ્રકરણ ૨

અને ૩ની જોગવાઇઓની અમલવારીમાાંથી મુચિ આપેલ છે અને

૨. હવે જ્યારે રાજ્ય સરકારે, "સદરહુ અચધચનયમની કલમ-૪૩(૧)" ની પેટા કલમ-૧ થી મળેલ સત્તાની રૂએ જાહેરનામા ક્રમાાંક: અમ-મ-

૨૦૨૫-૩૦૮-જપટ-૧૪૨૦૨૫-૭૩-ઘ, તા.૧૬/૦૫/૨૦૨૫ થી "રાધનપુર બાયપાસની કામગીરી માટે જમીન સાંપાદન કરવા બાબત"

ના પ્રોજેક્ટને ઉલ્લેચખત આાંતરમાળખાકીય પ્રોજેક્ટના બાાંધકામ માટેની અનુસૂચિત ચવસ્તારની જમીનના સાંપાદનના સાંબાંધમાાં પુન:સ્થાપન

અને પુનવાસનના વહીવટદાર તરીકે નાયબ કલેક્ટરશ્રી-રાધનપુરની ચનમણૂક કરેલ છે, અને

૩. હવે જ્યારે જમીન સાંપાદન, પુન:સ્થાપન અને પુનવાસનમાાં વાજબી વળતર અને પારદચર્ાતાનો અચધકાર અચધચનયમ-૨૦૧૩ (૨૦૧૩નો

૩૦મો) જેનો આમાાં હવે પછી "સદરહુ અચધચનયમ" તેમ ઉલ્લેખ કરવામાાં આવેલ છે તે) ની કલમ-૧૧ ની પેટા કલમ-(૧) થી મળેલ

અચધકાર અન્વયે ગુજરાત સરકારે જાહેરનામા ક્રમાાંક: અમ-મ-૨૦૨૫-૩૦૮-જપટ-૧૪૨૦૨૫-૭૩-ઘ, તા.૧૬/૦૫/૨૦૨૫ થી ઉિ

જમીનો, ઉપરોિ સાવાજચનક હેતુ માટે જરૂરી છે, તેમ જાહેર કરેલ છે, અને

૪. હવે જ્યારે સદરહુ અચધચનયમની કલમ-૧૫ની પેટા કલમ-૨ નીિેના ચજલ્લા કલેક્ટરશ્રી, પાટણના અહેવાલને ચવિારણામાાં લીધા બાદ

રાજ્ય સરકારને એવો સાંતોષ થયેલ છે કે, સદરહુ અનુસૂચિત જમીનો સદરહુ "જાહેર હેતુની યોજના" માટે જરૂરી છે, અને

૫. તેથી હવે, "સદરહુ અચધચનયમ"ની “કલમ-૧૯" થી મળેલ અચધકારો અન્વયે રાજ્ય સરકાર આથી જાહેર કરે છે કે, સદરહુ અનુસૂચિત

જમીનો સદરહુ "જાહેર હેતુની યોજના” માટે જરૂરી છે.

૬. ગુજરાત સરકાર, સદરહુ અચધચનયમની કલમ-૩(જ) થી મળેલ સત્તા અન્વયે, ઉિ જમીનોના સાંબાંધમાાં "સદરહુ અચધચનયમ" નીિે હવે

પછી કલેક્ટર તરીકે કરવાના તમામ કાયો બજાવવા માટે નાયબ કલેક્ટરશ્રી-રાધનપુરની ચનમણૂક કરે છે.

૭. સદરહુ અનુસૂચિત જમીનોના નકર્ા નાયબ કલેક્ટરશ્રી-રાધનપુરની કિેરી ખાતે તપાસ કરી ર્કાર્ે.
