Notification

The 22nd November, 2018

No. 12/22/2018-6T(I).— The following draft of the rules further to amend the Haryana Motor Vehicles

Rules, 1993, which the Governor of Haryana proposes to make in exercise of the powers conferred by Sections 28,

65, 96 and 213 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988), is hereby published as required by

Sub-section (1) of Section 212 of the said Act for the information of persons likely to be affected thereby.

Notice is hereby given that the draft of the rules shall be taken into consideration by the Government on or

after the expiry of a period of seven days from the date of publication of this notification in the Official Gazette

together with objections or suggestions, if any, which may be received by Additional Chief Secretary to Government

Haryana, Transport Department, Chandigarh with respect to the draft of rules before the expiry of the period so

specified.

Draft Rules

1.

These rules may be called the Haryana Motor Vehicles (Amendment) Rules, 2018.

2.

In the Haryana Motor Vehicles Rules, 1993 (hereinafter called the said rules), in rule 3, for sub-rule (1), the

following sub-rule shall be substituted, namely:-

“(1)

Each Sub-Divisional Officer (Civil) in the State and such other person who is authorized by the

Government, by notification in the Official Gazette in this behalf shall be the licensing authority to issue

licences under Chapter II within the area of his territorial jurisdiction in respect of a non-transport vehicle.”.

In the said rules, in rule 5, the sub-rules (1) and (2), the following sub-rules shall be substituted, namely:-

“(1)

If the application for grant of a licence is found in order under rule 4, the test for a learner’s licence

specified in rule 11 and for a driving licence specified in rule 15 of the Central Motor Vehicles Rules, 1989

shall be conducted by the licensing authority or such other person who is authorized by the Government, by

notification in the Official Gazette in this behalf.

(2)

For the purpose of test in terms of sub-rule (1), the applicant shall produce himself at such time and

place as may be specified by the licensing authority or such other person who is authorized by the Government

and bring with him a serviceable vehicle of the class to which the application belongs for testing purposes.”.
