Notification

The 11th December, 2018

No. 2/107/2017-1IW.— Whereas, Dadupur Nalvi Irrigation Scheme (hereinafter referred to as the “Scheme”)

was conceptualized in the Nineteen Eighties for irrigating lands of district Yamuna Nagar, Kurukshetra and Ambala,

by releasing 590 cusec water throughout the year from river Yamuna into a lined channel taking off from Dadupur.

The consequent shortfall in Yamuna waters was to be compensated at Karnal from surplus Ravi Beas waters which

were to be received by the State through Satluj Yamuna Link Canal.

Whereas, due to non-completion of Satluj Yamuna Link Canal, in the year 2004, it was decided to keep the

entire canal system unlined and to feed it during Kharif period only to serve the purpose of Kharif irrigation and

recharging of the water table. After reconsideration of the Scheme during October, 2005, it required a total of 2247.5

acres land including 190.085 acres already acquired in the late Nineteen Eighties and early Nineties.

Whereas, a total of 830.10225 acres land was acquired for this Scheme from the year 2004 onwards, which

was meant for construction of only the main channels namely Shahbad Feeder, Shahbad Distributary and Nalvi

Distributary. Rest of the land, nearly 1227.3427 acres, meant for construction of distributaries and minors, could not

be acquired due to resistance by land owner farmers since they were not interested to give their land for construction

of channels which would bring water only during Kharif period (rainy season), when they did not require the same.

Whereas, due to non-acquisition of more than half of the total project land, the Scheme was rendered totally

unfruitful as the area proposed to be irrigated could not be supplied water due to non acquisition of land for

distributaries and minors;

And whereas, the Comptroller and Auditor General of India in his Report No. 3 of 2013 on Social, General

and Economic Sectors observed that the project was conceived without survey of the area about the usefulness of the

project and without ascertaining the views of the villagers, as a result of which, the entire expenditure incurred on the

scheme was rendered unfruitful;

And whereas, on the other hand, the land owner farmers, whose land was acquired after the year 2004 and who

were not satisfied with award of the Land Acquisition Officer and that of the court of Ld. Additional District Judge,

filed RFAs in the Hon’ble Punjab and Haryana High Court. The Hon’ble Punjab and Haryana High Court awarded

compensation @ ₹ 2887/- per square meter, which works out as₹116.83 lacs per acre plus incidental charges. After

taking interest and other charges into account, it comes out to roughly ₹ 3.39 crore per acre. In addition to the fact

thatthe Scheme has already been rendered unfruitful due to non acquisition of balance land, it has further been

rendered unviable since the total financial out go for the Government would be several times higher than the present

day market value of the land.

And whereas 824.71 acres land was denotified by Haryana Government vide notification dated the

3rdAugust, 2018, No. 2/107/2017-IIW.

And whereas regarding the balance landmeasuring 5.39225 acres a conscious decision has been taken that the

said land could not be denotified along with 824.71 acres because this land stands utilized by the Government for the

public purpose of construction of road which is being used to connect Jagadhri Ambala Road with Jagadhri

Chhachhroli road and the Government needs to prepare a scheme to offer alternative land to the land owners in terms

of the proviso to section 101-A of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013(Central Act 30 of 2013).

And whereas now a scheme has been prepared to offer alternative land in village Kail, to the land owners

owning aforesaid 5.39225 acres. The offered land is quite closely located just across the Ambala Jagadhri Road and in

the opinion in the state Government, the said alternative land has the same value, utility and market value and rate as

on the date, at par with the land mentioned in Table-1 above, already acquired and utilized.

The Khasra no./partly khasra no. (Kanal-Marla ) of the said alternative offered land of village Kail are given as

Now therefore in exercise of powers conferred by proviso to section 101-A of the Right to Fair Compensation

and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013(Central Act 30 of 2013),the

Governor of Haryana, hereby orders that the land owner [s] of the land mentioned in Table 1, above, stand

compensated in lieu of their acquired and utilized land, by providing the ownership of alternative land mentioned in

Table 2, located in village Kail, which is located in close proximity to the acquired land and is of the same value,

utility and market rate as on the date, which land now stands vested free from all encumbrances in the land owners of

the acquired land and in lieu of the land mentioned in Table-1, and in full and final settlement of all or any claims of

the landowners, towards all or any kind of compensation or claims whatsoever for the acquired land.

For better appreciation, the scheme may be seen in the office of Land Acquisition Officer, Ambala and Water

Services Division, Dadupur on any working day. Any person interested or land owners to whom land is to be given,

may within period of thirty days of publication of this notification in the Gazette, submit his claim in writing before

Land Acquisition Officer, Ambala so as to complete the process of delivery of alternative land and decide their claims

as per the law.

This shall however, be subject to the return of the total amount already paid by the Government to the land

owners, which shall have to be returned along with such interest, if any, as decided by the Government before

delivery of the possession. The land owners shall, however, be entitled for payment of compensation on account of

damages sustained by them as a result of aforesaid land acquisition, at such rates as fixed by Government, for which,

any person interested or land owners to whom land is to be given, may within a period of thirty days of publication of

this notification in the Gazette, submit his claim in writing before Land Acquisition Officer, Ambala.
