Notification

The 11th January, 2019

No. 965.— The following draft of rules further to amend the Haryana Development and Regulation of Urban

Areas Rules, 1976, which the Governor of Haryana proposes to make in exercise of the powers conferred by

sub-section (1) read with sub-section (2) of Section–24 of the Haryana Development and Regulation of Urban Areas

Act, 1975 (8 of 1975), is hereby published as required under sub-section (1) of the said section, for the information of

persons likely to be affected thereby.

Notice is hereby given that the following draft of the rules shall be taken into consideration by the Government

on or after the expiry of a period of thirty days from the date of publication of this notification in the Official Gazette,

together with objections or suggestions, if any, which may be received in writing by the Principal Secretary to

Government, Haryana, Town and Country Planning Department, Chandigarh from any person in respect to the draft

of the rules before the expiry of the period so specified.

Draft Rules

1.

These rules may be called the Haryana Development and Regulation of Urban Areas (Amendment) Rules,

2019.

2.

In the Haryana Development and Regulation of Urban Areas Rules, 1976, in rule 13, for clause (i) the

following clause shall be substituted namely:-

(i)

Online deposit of licence renewal fees in favour of Director, for a sum calculated at the rates

prescribed as follows:-

A

For plotted colony

(a)

Licence where completion certificate

for part of the licenced area has not

been issued under rule 16

10% of the licence fee prescribed in rule 3 as

prevailing on the date of application for renewal.

(b)

Licence where completion certificate

for part of the licenced area has been

issued under rule 16

2.5% of the fee prescribed in rule 3 as per the prevailing

rates at the time of grant of part completion certificate,

shall be levied on area for which the part completion

certificate is granted, whereas for remaining area the

prescribed fee as mentioned sub-clause (a) shall be levied.

For Group Housing, Commercial, IT/ITes, Mixed Land Use Colonies

(a)

Licence where Occupation certificate

for part of the licenced area has not

been issued as per code 4.1 of

HBC-2017

10% of the licence fee prescribed in rule 3 as

prevailing on the date of application for renewal

(b)

Licence where occupation certificate

for part of the licenced area has been

issued as per code 4.1 of HBC-2017

2.5% of the fee prescribed in rule 3 as per the

prevailing rates at the time of grant of part occupation

certificate, shall be levied on such proportionate land

area against the FAR for which the part occupation

certificate is granted vis-à-vis maximum permissible

FAR in the colony, whereas for remaining area the

prescribed fee as mentioned in sub-clause (a) shall be

levied.
