Notification

The 26th August, 2021

No. 7/8/2011-3AR.— In exercise of the power conferred by Sub-sections (1) and (2) of Section 21 of the

Haryana Right to Service Act, 2014 (4 of 2014), the Governor of Haryana hereby makes the following rules further to

amend the Haryana Right to Service Rules, 2014, namely:-

These rules may be called the Haryana Right to Service (Amendment) Rules, 2021.

In the Haryana Right to Service Rules, 2014 (hereinafter called the said rules), for rule 3, the following rule

shall be substituted, namely:-

“3. Receipt and acknowledgement of application. section 5.- (1) An eligible person shall make an

application for delivery of service to the Designated Officer either personally or through registered post duly

addressed to the aforesaid Designated Officer or through online mode on the Portal(s) developed by the

Government.

(2)

If such an application is found complete in all respects, the Designated Officer shall acknowledge the

receipt thereof in the specified forms/online mode provided by the respective departments for each service:

Provided that if any document is required for the delivery of service has not been enclosed with the

application by the applicant, the same shall be clearly mentioned in the acknowledgement by the Designated

Officer, to enable the applicant to make his application complete in all respects:

Provided further that the time limit specified for delivery of service in such cases shall commence from

the date when the applicant supplies the documents mentioned in the acknowledgement:

Provided further that consent of the applicant shall be presumed at the time of submitting the

application through online mode on the Portal(s) developed by the Government regarding auto appeal/revision

to First/Second Grievance Redressal Authority or Commission as the case may be, in case there is breach of

statutory limit for imparting service. Hence, appeal/revision shall be deemed to have been filed automatically.

A suitable provision shall be made in the software regarding automatic appeal/revision on the Portal(s) on

behalf of applicant. It shall be mandatory for applicant to give his mobile number while submitting the

applications through online mode.”.

In the said rules, in rule 6, for sub-rule (5), the following sub-rule shall be substituted, namely:-

“(5) In the event of award of compensation to the applicant/appellant by the Second Grievance Redressal

Authority, the concerned authority shall make payment of fifty percent or one thousand rupees whichever is

less, to the applicant/appellant out of the penalty imposed by it and deposit the balance amount in the receipt

Head of the State. A copy of receipt of payment by the applicant/appellant shall be forwarded to the Second

Grievance Redressal Authority by the department.”.
