Notification

The 28th August, 2023

No. HPPA/Reg.-01.— In exercise of the powers conferred by Section 46 read with Section 20 of the Haryana

Parivar Pehchan Act, 2021, the Haryana Parivar Pehchan Authority hereby makes the following regulations to provide

for engagement of experts, namely:

Part I

General

Short title and

commencement.

Definitions.

1.

(1)

These regulations may be called the Haryana Parivar Pehchan Authority

(Engagement of Experts) Regulations, 2023.

(2)

They shall come into force from the date of their notification by the Haryana

Parivar Pehchan Authority.

2.

(1)

In these regulations, unless the context otherwise requires, -

(a)

―Act‖ means the Haryana Parivar Pehchan Act, 2021 (20 of 2021);

(b)

―Authority‖ means the Haryana Parivar Pehchan Authority or HPPA;

(c)

―Chief Executive Officer‖ means Chief Executive Officer of Authority;

(d)

―Experts‖ means a person of integrity having special knowledge and

experience in information, communications & technology infrastructure;

policy and management; solution architect; artificial intelligence;

technology law; financial management; accountancy or any other relevant

field as may be required by Chief Executive Officer for efficient discharge

of its power and functions under the Act;

(e)

―Government ― means the Government of Haryana;

(f)

―Institution‖ means, -

(i)

any institution established by law in force in the State of Haryana; or

(ii)

any other institution recognized by the Government for the purpose of these

regulations;

(g)

―Post‖ means various positions considered by the Authority for engagement

of experts in the Authority;

(h)

―Recognised university‖ means, -

(i)

any university incorporated by law in India; or

(ii) any other university which is declared by the Government to be a

recognized university for the purpose of these regulations;

(i)

―Schedule‖ means the Schedule appended to these regulations;

(j)

―Service‖ means the Haryana Parivar Pehchan Authority Service.

(2)

Words and expressions used but not defined in these regulations, shall have the

same meanings respectively assigned to them in the Act.

Part II

Recruitment to Service

Number and

character of

posts.

3.

(1)

The Service shall comprise the post/designation shown in Schedule I to these

regulations.

(2)

The Chief Executive Officer may, if in his opinion circumstances so exist and for

reasons to be recorded in writing, specify post, along with duties and qualifications thereof, in

addition to those listed in Schedule I to these Regulations.

(3)

The Chief Executive Officer shall report any action taken under sub-regulation

(2) for ratification to the Executive Committee constituted under sub-section (1) of section 17 of

the Act.

Where the Executive Committee declines to ratify the action taken by the Chief

Executive Officer under sub regulation (2), then the Chief Executive Officer shall forthwith

disengage any person or persons appointed to such post.

Age.

4.

No person shall be engaged to any post in the Service by Authority or any Other

recruiting Agency who is less than Eighteen years on the last date of submission of applications

to the Authority/other recruiting agency as the case may be. Further, the maximum age limit for

engagement against various posts shall be as such as given in Schedule III of these regulations,

which shall be computed on the last day of the year in which the applications for selection are

invited.

Appointing

authority.

5.

The Chief Executive Officer, or such officer as the Chief Executive officer shall, by a

general or special order, authorize, shall be the appointing authority for all experts.

Qualifications

experience and

6.

(1)

No person shall be engaged to any post in the Service, unless he is in the

possession of qualifications and experience specified in Schedule I of these regulations.

(2)

In case of exigencies, Chief Executive Officer at its own may relax the

qualification and experience for the services of experts as may be required for efficient

discharge of its powers and functions under the Act.

(3)

The

Chief

Executive

Officer

shall

report

any

action

taken

under

sub- regulation (2) for ratification to the Executive Committee constituted under sub-section (1)

of section 17 of the Act.

(4)

Where the Executive Committee declines to ratify the action taken by the Chief

Executive Officer under sub regulation (2), then the Chief Executive Officer shall forthwith

disengage any person or persons appointed to such post.

Procedure for

engagement of

Expert

7.

(1)

Experts in Authority shall be engaged by the Chief Executive Officer through

following modes:

i)

Inviting applications from intending candidates with substantial experience

in the relevant field through public notice on websites and newspapers or;

ii)

Nomination by the Deputy Chairperson of the Authority or;

iii)

From placement agencies in the information technology sector owned or

controlled by the Central Government or any State Government.

(2)

The Chief Executive Officer may engage such number of experts and at such

times, as the Chief Executive Officer deems necessary, in discharge of the functions of the

Authority.

(3)

The Expert shall ordinarily be engaged by the Chief Executive Officer for a

period of not more than 5 years subject to satisfactory performance of the expert evaluated in

terms of Regulation 9 of these Regulations. The period of engagement shall be further

extendable

for

another 3 years after an assessment of the performance by the Chief Executive Officer with the

approval of Deputy Chairperson.

(4)

The Chief Executive Officer shall constitute a suitable committee comprising of

Deputy Chairperson, Members of authority, Officers of the Authority and eminent experts

having special knowledge and experience in the relevant field for conducting the interview and

making recommendations for engagement.

(5)

The committee may determine its procedure for making recommendations and the

recommendations of committee for each category shall be placed before the Chief Executive

Officer for decision.

(6)

The Chief Executive Officer may, on the recommendations of the committee,

issue letter of engagement to the expert or experts recommended by the committee.

Terms and

conditions of

engagement of

expert

8.

(1)

The expert on having accepted the offer of engagement from Authority, shall

enter into a contract specifying the terms and conditions and detailing duties and deliverables,

with confidentiality clause, before being assigned or commencing any work. Besides above, all

experts engaged by the Authority shall enter into the Non-Disclosure Agreement with Authority

duly approved by the Chief Executive Officer.

(2)

The terms and conditions of engagement may, at any later stage and in any

specific case, be modified where the Chief Executive Officer of Authority deems it necessary.

(3)

Without prejudice and in addition to the legal remedies available in terms of the

contract, the breach of the terms and conditions of the contract executed under sub regulation

(1) by any expert shall be considered a sufficient ground for termination of the engagement

made under contract and may further debar such expert from any future engagement by the

Authority.

Evaluation of

performance

9.

(1)

The performance of each expert engaged under these Regulations, with reference

to the tasks assigned and output delivered, shall be reviewed periodically, within such time and

manner as may be specified, by general or special order, by the Chief Executive Officer or such

officer as may be authorized by the Chief Executive Officer at the time of appointment of the

expert.

(2)

The performance of the expert engaged shall be done by the Reporting Officer by

assigning marks on a scale of 1-100, in whole numbers, with 1 (One) referring to the lowest

grade/marks and 100 to the best grade.

Liability to

Service

10.

An ‗Expert‘ so engaged by Authority against post shall be liable to serve at any place,

whether within or outside the State of Haryana, on being ordered so to do by the appointing

authority/Reporting Officer.

11.

(1)

Remuneration payable for the experts shall be as such as mentioned in Schedule

II of these regulations. In addition to above, Experts so engaged by the Authority will be paid

any other allowances as notified by the Authority from time to time.

(2)

In additional to the above, subject to the recommendation of the reporting officer

based on the work performance, the Chief Executive Officer shall be competent authority to

allow annual increment, which will include a variable component of 0-3% and fixed component

of 75% of the enhanced Dearness Allowance notified by the State Government in previous year.

(3)

Entry level remuneration for experts as mentioned in Schedule II (Col. No.2) of

these regulations shall be increased annually by the Chief Executive Officer to the extent of

75% of the enhanced Dearness Allowance notified by the State Government during previous

year.

12.

Travelling Allowance/ Daily Allowance payable to the experts shall be as such as

notified by the Authority from time to time.

Leave and other

matters.

13.

(1)

The expert engaged under these regulations shall, in addition to the public

holidays, will be entitled to avail 12 days casual leave and 10 days medical leave during a

calendar year. In case of engagement of expert during the mid of a calendar year, casual leave

and medical leave shall be prorated.

(2)

The Authority may insure persons appointed as experts for medical exigencies on

such terms and conditions as determined by the Chief Executive Officer from time to time.

Acceptance of

resignation

14.

(1)

An experts engaged under these regulations may resign from service by giving

notice of not less than two month in writing duly signed direct to the appointing authority with a

copy marked to his superior officer or by paying two month‘s remuneration to authority in lieu

thereof. The period of two months notice shall be reckoned from the date of receipt of such

notice by the appointing authority.

(2)

An experts engaged under these regulations may withdraw the notice of his

resignation before its acceptance and withdrawal of resignation shall not be permitted after its

acceptance by the appointing authority.

(3)

In case, resignation has been accepted by the appointing authority and the expert

is to be relieved from a future date, and if any request for withdrawing the resignation is made

by the expert before he is actually relieved of his duties, the appointing authority may consider

the request of the expert tendering resignation.

The appointing authority shall issue orders on the notice of resignation before the

date of expiry of notice, either accepting the resignation from date not later than the date of the

notice or rejecting the same, giving the reasons thereof. If no such order is passed, the

resignation shall be deemed to have been accepted on the expiry of the period of notice.

Termination of

contractual

engagement of

Expert

15.

Services of ‗Expert‘ engaged by the Authority may be terminated by serving a notice of

two month or by paying two month‘s remuneration to expert in lieu thereof, if services are no

longer needed/required or the services may be terminated without notice, if work and conduct of

the expert so engaged is not found satisfactory at any stage of the engagement.

Repeal and

savings

16.

Any regulation applicable to the service and corresponding to any of these regulations

which is in force immediately before the commencement of these regulations is hereby

repealed;

Provided that any order made or action taken under the regulation so repealed shall be

deemed to have been made or taken under the corresponding provisions of these regulations.
