Notification

The 24th January, 2024

No. 10/69/2016-5Lab.— Whereas a separate Directorate ESI Health Care Haryana was created vide

notification dated 16.05.2007, which earlier was a part of Health Department Haryana.

Whereas the notification dated 16.05.2007 contained the provision regarding the service rules to be followed

by the ESI Health Care Haryana which reads as:-

“4. Service Rules

The service rules, standing orders on the files applicable to service conditions in the Health Department,

Haryana shall continue to be applicable in the staff of the Directorate of Employees State Insurance

Healthcare, Haryana till the new department formulates its own service rules.”

Whereas a committee was constituted to frame the service rules of the HCMS (A) service of the ESI Health

Care Haryana. The committee framed the draft service rules of the HCMS (A) cadre which contained a specific

provision regarding the specialist cadre of the doctors.

Whereas the proposal to create post of specialists by upgrading the existing post of Junior Specialist which are

equivalent to Medical Officer, was sent to Finance Department Haryana so as to constitute a separate specialist cadre.

However, the said proposal did not get the approval of the Finance Department Haryana with the advice that when

any cadre for specialist doctors will be considered by the Health Department then the proposal of ESI Department can

be considered to maintain the uniformity.

Whereas without the provision of the specialist cadre of the doctors the draft service rules proposed by the

committee remains largely the same as are already being followed by the ESI Health Care Haryana.

Whereas, therefore in view of the above, the Government of Haryana has decided that the terms and conditions

of the service of the HCMS (A) employees of the Directorate ESI Health Care Haryana shall continue to be governed

by the service rules as applicable to the HCMS (A) service of the Health Department Haryana, which are already

being followed in the ESI Health Care Haryana vide notification dated 16.05.2007.

This notification shall be in force till the time ESI Health Care Haryana frames its own service rules after

taking into consideration the constitution of specialist cadre in Health Department Haryana.
