Order
The 20th February, 2024
No. 2254/LFA.— Whereas the General Elections of Municipal Council, Narnaul; Municipal Committee,
Mahendragarh and Nangal Choudhary were held on 19-06-2022 and the result of the elected candidates was declared
on dated 22-06-2022.

Whereas Section 13E of the Haryana Municipal Act, 1973, provides that every candidate at an election shall,
either himself or by his election agent, keep a separate and correct account of all expenditure in connection with the
election incurred or authorized by him or by his election agent from the date of filling of nomination papers to the
date of declaration of the result there of, both dates inclusive. The account shall contain such particulars, as may be
notified by the State Election Commission in this behalf. The total of the said expenditure shall not exceed such
amount as may be notified by the State Election Commission from time to time.

Whereas Section 13F of the Haryana Municipal Act, 1973 further provides that if the State Election
Commission is satisfied that a person has failed to lodge an account of election expenses within the time and manner,
as prescribed by the State Election Commission and has no reason or justification thereof, the State Election
Commission shall by order published in the Official Gazette, declare him to be disqualified for contesting an election
for a period of five years from the date of the order under this Act.

Whereas in pursuance of the above provisions, the State Election Commission, Haryana vide its notification
No. SEC/3ME/2022/549, dated 21-03-2022 in exercise of powers vested under clause (i) Article 243ZA of the
Constitution of India, sub-section 3 of Section 13E of the Haryana Municipal Act, 1973 had prescribed the limit of
expenditure that may be incurred by the contesting candidate or his authorized agent in connection with election of
Municipal Council/Municipal Committee and the account of election expenses shall be filed/lodged with the Deputy
Commissioner or any other officer prescribed by the Commission within 30 days from the date of declaration of the
result of election.

Whereas the State Election Commissioner, Haryana in exercise of powers contained under Section 3B of the
Haryana Municipal Act, 1973 authorized Deputy Commissioner Concerned, vide order No. SEC/3ME/2023/304-446
dated 07-03-2023 to decide the case of disqualification of the candidates of the concerned municipalities, who failed
to lodge their account of election expenses.

Whereas as reported by the Secretary, Municipal Committee, Mahendragarh and Nangal Choudhary every
contesting candidate submitted their Election Expenditure Registers.
7.
Whereas the Executive Officer, Municipal Council, Narnaul submitted vide his letter No. 7519 dated 04-12-2023
that the following contesting candidates did not submit their election expenditure account for the elections of
Municipal Council, Narnaul held on 19-06-2022:-

Whereas the Executive Officer, Municipal Council, Narnaul was directed vide this office letter No. LFA/2023/
2222 dated 11-01-2024 to deliver the notices, issued in the name of the above candidates to appear before the
undersigned for personal hearing on 29-01-2024 at 11.00AM prior to further necessary action under Section 13F of
the Haryana Municipal Act, 1973.

Whereas out of the above, only eight candidates mentioned at serial No. 2, 3, 10, 11, 12, 21, 25 & 37 appeared
before me on 29-01-2024 for hearing alongwith their reply/statement. They were heard properly but could not justify
the reason for not submitting their election expenditure within the prescribed period. After perusal, their
reply/statements were also found not satisfactory. Sh. Deepak Goyal, Executive Officer, Municipal Council, Narnaul
was present during the hearing and submitted a copy of letter dated 25-01-2024 vide which the notices of personal
hearing were delivered to the said 41 candidates or their family members. Therefore, I have come to the conclusion
that the above 41 candidates are liable for disqualification as they have failed to file the account of election
expenditure within the time and manner prescribed by the State Election Commission and there is no reason or
justification for it.

Now, therefore, I, Monika Gupta, IAS Deputy Commissioner, Mahendragarh in exercise of the powers
conferred by Section 13F of the Haryana Municipal Act, 1973 and authorised by the State Election Commissioner
vide order dated 06-03-2023 hereby declare all the above 41 candidates disqualified for contesting in election for a
period of five years from the date of this order.

The office is directed to send a copy of this order to the candidates concerned through Executive Officer,
Municipal Council, Narnaul immediately.
