13 I. Removal of an elected President and Member having any disqualification at the time of election:-

The State Election Commission may, after such enquiry, as it may deem fit and after giving an opportunity of

being heard, by an order, remove the President or a member, if he was having any disqualification mentioned

in section 13A or rules framed under this Act at the time of his election. The office of the President or

member so disqualified shall become vacant immediately.

13A. Disqualifications for President and Members.-(1) A person shall be disqualified for being chosen as

and for being President or a member of a municipality.

(3) If any person furnishes a false caste certificate at the time of filing nomination, he shall be disqualified for

a period of six years from contesting the election to the municipality.”

That the undersigned is in receipt of your above referred Show Cause Notice dated 14.03.2024

wherein your esteemed office has sought reply from the undersigned regarding the nomination form

for the post of Member, Ward No. 14, Municipal Committee, Safidon, District Jind, interalia, on the

ground that the Scheduled Caste Certificate produced by the undersigned has been cancelled by the

Naib Tehsildar, Safidon vide its Order dated 24.11.2023 and that as the said Post was reserved for

Scheduled Caste Community so the undersigned is to explain his position about the same.

That the main dispute which revolves around the entire controversy is that whether the undersigned

belongs to Scheduled Caste community or not. In this regard, it is submitted that the undersigned

originally belongs to Samastipur (Bihar) and is of “Tanti” Community which has been declared

Scheduled Caste by the Government of Bhihar. It is pertinent to submit here that the undersigned has

applied for a Scheduled Caste Certificate of his “Tanti” Community which basically is indulged in

making of clothes “Bunkar” which has been the work of “Dhanak Community” in Haryana and

accordingly the undersigned applied for a Scheduled Caste Certificate by way of moving application in

this regard to the then Tehsildar, Safidon upon which requisite reports were called by the Tehsildar,

Safidon from the concerned officials and the said officials after verifying each and every aspect

including that of caste of the undersigned specifically reported that the undersigned belongs to

“Dhanak Community” which has been declared Scheduled Caste by the Government of Haryana and

accordingly they issued S.C. Certificate in the name of the undersigned. It is pertinent to submit here

that the parents of the undersigned have also been issued “Scheduled Caste Certificate” by

Government of Bihar which itself proves that the undersigned is a member of Scheduled Caste

community.

That in this regard statement of Smt. Rajbala, Ex-Parshad, W.No. 13, at present Ward No. 14,

Safidon,District Jind was also recorded on dated 21.03.2023 in which she has specifically mentioned

that the undersigned has been residing at the said address for the last more than 40 years and belongs

to Dhanak community.

That accordingly as the undersigned was fulfilling all the requirements of a valid candidature has

rightly contested the said election of Ward No. 14, Municipal Committee, Safidon and needless to say

that the present matter is a politically motivated matter to somehow dispel the undersigned from his

rightful election by way of entangling him in false and frivolous litigation.

That as regard the filing of the civil suit by the undersigned it is submitted that at the time of filing of

the said civil suit, the Scheduled Caste Certificate of the undersigned was not cancelled, but later on

the same was cancelled and the said suit of the undersigned become infructuous and the same was later

on withdrawn by undersigned vide Order dated 13.12.2023. However, no further appeal or revision

against the said Order has been filed, but the undersigned reserves his right to intiate separate legal

action against the delinquent officials who have illegally cancelled the said Scheduled Caste

Certificate of the undersigned in the competent court of law of jurisdiction.

That some of the private persons/organizations have challenged the validity of “Tanti Community” to

be falling in Scheduled Caste in the Hon’ble High Court as well as Hon’ble Supreme Court of India

vide SLP(Civil) No. 18294 of 2021 and the matter is still sub-judice (Pending) in the Hon’ble Supreme

Court of India and the said community has not been declared to be Non-Scheduled Caste till date and

the next date in the said proceedings is fixed for 18.04.2024.
