Order

The 31st January, 2025

No. 337-44/LFA.— Whereas the General Election of Municipal Council, Gohana was held on 19-06-2022.

And the result of the elected candidates was declared on 22-06-2022.

The Section 13E of the Haryana Municipal Act, 1973, provides that every candidate at an election shall, either

himself or by his election agent, keep a separate and correct account of all expenditure incurred in connection with the

election or authorized by him or by his election agent from the date of filing of nomination papers to the date of

declaration of the result thereof, both dates inclusive. The account shall contain such particulars, as may be notified

by the State Election Commission in this behalf. The Total of the said expenditure shall not exceed such amount as

may be notified by the State Election Commission in this behalf from the time to time.

In pursuance of the above provisions, the State Election Commission, Haryana in exercise of powers vested

under clause Article 243ZA (1) of the Constitution of India, Sub-section 3 of Section 13E of the Haryana Municipal

Act, 1973 and the Haryana Municipal Election expenditure (Maintenance and Submission of Accounts) order, 2020

vide its notification No. SEC/3ME/2022/549, dated 21-03-2022 had prescribed the limit of election expenditure that

may be incurred by the contesting candidate or his authorized agent in connection with election of Municipal Council,

Gohana and also directed that accounts of election expenses shall be maintanded and filed/lodged with the

Deputy Commissioner within 30 days from the date of declaration of result of election.

The Section 13F of the Haryana Municipal Act, 1973 further provides that if the State Election Commission is

satisfied that a person who contested the election but failed to lodge an account of election expenses within the time

and manner, as prescribed by the State Election Commission and has no reason or justification thereof, the State

Election Commission shall by order published in the Official Gazette, declare him/her to be disqualified for

contesting an election for a period of five years from the date of the order under this act.

The State Election Commission, Haryana in exercise of powers contained under Section 9 of Sub-section (1A)

of the Haryana Municipal Corporation Act, 1994 and Section 3B of the Haryana Municipal Act, 1973 vide order No.

SEC/3ME/2023/304-446 dated 07-03-2023 has authorized the undersigned to decide the cases of disqualification of

the candidates of the said Municipal Committee, who failed to lodge their account of election expenses.

As reported by the Executive Officer, Muncipal Council, Gohana vide letter no. 3640 dated 17.01.2025, the

Total 95 numbers of candidates contested the election of Municipal Council, Gohana held on 19.06.2022 and result

was declared on 22.06.2022 out of which 26 contesting candidates failed to submit their election expenditure account.

Accordingly, opportunity of personal hearing was provided to these candidates on 09.01.2025 at 10:30AM.

Smt. Rajni W/o Sh. Pardeep, who has contested the election from the ward no. 02 and not appeared for personal

hearing on 09.01.2025 and also failed to submit her Election Expenditure Account Register. Details of the candidates

along with status of Election Expenditure is submitted as below:-

Since, Smt. Rajni W/o Sh. Pardeep failed to produce any receipts or documents qua expenditure submitted

within prescribed time period as per the provisions of Haryana Municipal Act, 1973 and rules contained therein.

Therefore, as per provision under section 13F of the Haryana Municipal Act, her candidature stands disqualified for

contesting of an election of Municipal Committee for a period of five years with effect from 22.07.2022 (After 30

days of declaration of result i.e. 22.06.2022 and after consideration of all facts and time taken in completion of the

proceedings.)

Executive Officer, Municipal Council, Gohana is directed to send a copy of this order to the candidates

concerned immediately.
