No. Leg. 26/2025.— The following Act of the Legislature of the State of Haryana received

the assent of the Governor of Haryana on the 14th October, 2025 and is hereby published for

general information:-

HARYANA ACT NO. 23 OF 2025

THE HARYANA BACKWARD CLASSES COMMISSION (AMENDMENT) ACT, 2025

AN

ACT

further to amend the Haryana Backward Classes Commission Act, 2016.

Be it enacted by the Legislature of the State of Haryana in the Seventy-sixth Year of the

Republic of India as follows :-

1.

This Act may be called the Haryana Backward Classes Commission (Amendment) Act, 2025.

Short title.

For section 9 of the Haryana Backward Classes Commission Act, 2016 (hereinafter called

the principal Act), the following section shall be substituted, namely:-

“9. Functions of Commission.- The Commission shall perform the following

functions, namely:-

(i)

to examine the request for inclusion or exclusion of any class of citizens as a

backward class and hear complaints of over-inclusion or under- inclusion of

any Backward Class and tender such advice to the State Government as it

deems appropriate;

(ii)

to investigate and examine the working of various safeguards provided in

the Constitution of India or under any other law for the time being in force

or under any order of the State Government for the welfare and protection of

the Backward Classes;

(iii)

to enquire into specific complaints with respect to the deprivation of the

rights and safeguards of the Backward Classes and to take up such matter

with the appropriate authorities;

(iv)

to participate and advice on the planning process of socio-economic

development of the Backward Classes and to evaluate the progress of their

development;

(v)

to make recommendations as to the measures to be taken by the State

Government for the effective implementation of safeguards and other

measures for the protection, welfare and socio-economic development of the

Backward Classes and to made report to the State Government annually and

at such other time, as the Commission deems fit;

(vi)

to discharge such other functions in relation to the protection, welfare

development and advancement of the Backward Classes, as may be

prescribed by the State Government.”.

After section 17 of the principal Act, the following section shall be added, namely:-

“18. Protection of action taken in good faith.- No suit or other legal proceedings

shall lie against Chairman, any member, officer or employee for anything which is done in

good faith or intended to be done in pursuance of any of the provisions of this Act and

rules made thereunder.”.
