Notification

The 27th November, 2025

No. 03/58/2019-3HBIII.— In exercise of the powers conferred under sub-sections (1) and (2)

of section 49 of the Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome

(Prevention and Control) Act, 2017 (Central Act 16 of 2017), the Governor of Haryana hereby makes

the following rules, namely:-

Short title and

commencement.

(1)

These rules may be called the Haryana Human Immunodeficiency Virus and

Acquired Immune Deficiency Syndrome Rules, 2025.

(2)

They shall come into force from the date of their publication in the Official Gazette.

Definitions.

(1)

In these rules, unless the context otherwise requires,-

(a)

“Act" means the Human Immunodeficiency Virus And Acquired Immune

Deficiency Syndrome (Prevention and Control) Act, 2017 (Central Act 16 of

2017);

(b)

“Commissioners” means the commissioner of the concerned divisions.

(c)

“Form” mean the forms appended to these rules;

(d)

“State Government” means the Government of the State of Haryana in the

administrative department.

(2)

Words and expressions used but not defined in these rules and defined in the Act

shall have the meanings respectively assigned to them in the Act.

Measures to

provide

diagnostic

facilities and

opportunistic

infection

management.

The State Government shall take following measures for diagnostic facilities and

opportunistic infection management, namely:-

(a)

to provide free diagnostic services in all State Government Health Centres (Sub

Health Centres/ Primary Health Centres/Community Health Centres/Civil

Hospitals/District Hospitals/ Medical College Hospitals);

(b)

to provide free Anti Retroviral Treatment (ART) drugs as per National AIDS

Control Organization guidelines to all HIV Positive persons at all Anti Retroviral

Treatment Centres/Facilitation Link Anti Retroviral Treatment (FLART)/Link Anti

Retroviral Treatment Centres (LART);

(c)

to involve the Private Medical Sector to provide services to HIV positive persons

including diagnostic and treatment services as per National AIDS Control

Organization guidelines without any discrimination and to issue directions to private

medical sector to report all HIV positive persons to nearest Integrated Counseling

and Testing Centres/Government Hospitals for further management and treatment

without transgressing any of his human rights including the right to privacy;

(d)

to direct State AIDS Control Society to make arrangements for opportunistic

infection at all Government health centres as per the guidelines of the Ministry of

Health and Family Welfare, New Delhi.

Appointment and

jurisdiction of

Ombudsman.

(1)

The State Government shall designated the following Commissioners to be the

Ombudsman for the purpose of this Act, namely:-

(1)

The Ombudsman while inquiring into complaints under the Act, shall not be bound

by the Code of Civil Procedure, 1908 (Central Act 45 of 1908) and shall follow principles of

natural justice.

(2)

No cross-examination shall be permitted in inquiries before the Ombudsman.

(3)

The Ombudsman may, in the interests of justice, take the assistance of expert,

including protected persons and persons vulnerable to HIV and persons working in the field of

HIV and AIDS, public health or health delivery systems.

(4)

The Ombudsman shall have the power to pass interim orders in cases of medical

emergency without hearing the parties.

(5)

The Ombudsman shall have the power to pass orders, including, withdrawal and

rectification of the violation, counseling, social service etc.

(6)

The Ombudsman shall inform the complainant of the action taken.

(7)

The Ombudsman shall inform the parties to the complaint of their right to seek

judicial review from his order.

Manner of inquiry

by Ombudsman.

(1)

Any person may file a complaint to the Ombudsman within whose jurisdiction the

alleged violation took place within three months from the date that the person making the

complaint became aware of the alleged violation of the Act:

Provided that the Ombudsman may, for reasons to be recorded in writing, extend the

time limit for filing the complaint by a further period of three months, if he is satisfied that

circumstances prevented the complainant from filing the complaint within the stipulated period.

(2)

All complaints shall be filed to the Ombudsman in writing in form appended to

these rules:

Provided that where a complaint cannot be made in writing, the Ombudsman shall

render all reasonable assistant to the complainant to reduce the complaint in writing.

(3)

In cases of medical emergency, the Ombudsman or his assistant may visit the

complainant at the location of the alleged violation or any other convenient place to enable written

documentation of the complaint.

(4)

The Ombudsman may receive complaints made in person, via post, telephonically,

or through the Ombudsman’s website.

(1)

The Ombudsman shall –

(a)

immediately on receipt of a complaint, record it by assigning a sequential

unique complaint number in a register maintained solely for that purpose in

physical or computerized form;

(b)

on receipt of the complaint, acknowledge it including by sending the unique

complaint number by Short Message Service (SMS) or e-mail to the

complainant where available;

(c)

record the time of the complaint and the action taken on the complaint in the

(d)

maintain the register of complaints in a manner that ensures confidentiality

of data.

(2)

The Ombudsman shall comply with the data protection measures in accordance with

section 11 of the Act.

(1)

The following shall be responsibilities and functions of Ombudsman, namely :

(i)

to protect the rights and entitlement of child affected by HIV or

HIV-affected person or HIV-positive person;

(ii)

to conduct regular inspection visits of healthcare provider and institutions

where child affected by HIV or HIV-affected person or HIV positive person

are living and to recommend action for improvement in quality of services

to the State Government;

(iii)

to take suo motu cognizance of cases and reaching out to child affected by

HIV or HIV-affected person or HIV– positive person are protected;

(iv)

to deal with the cases referred by the State Government;

(v) to provide legal assistance for child affected by HIV or HIV–affected person

or HIV positive person ;

(vi)

to make recommendations to State Government for effective implementation

of the Act and rules;

(vii) to coordinate with the Health, Medical, Police, Social Welfare Department,

Women and Child Development Department and other agencies involved in

the welfare of child affected by HIV or HIV- affected persons or HIV positive

person;

(viii) to issue necessary advisory to authorities for protection of right of the child

affected by HIV or HIV–affected person or HIV positive person;

(ix)

to access the police for registration of first information report (FIR) for

offences committed against any child affected by HIV or HIV affected

person or HIV positive person;

(x)

to take cognizance of complaints and conducting inquiry on all issues relating

to and affecting the child affected by HIV or HIV affected person or HIV

positive person;

(xi)

to act upon a complaint made by any person under section 3 of the Act.

(2)

The ombudsman shall within a period of thirty days of receipt of the complaint under

sub-section (1) of section 24 of the Act and, after giving an opportunity of being heard to the

parties, pass such order as he deems fit, giving reasons thereof. The complaint shall be disposed off

in accordance with the provisions laid down herein:

Provided that in case of emergency of HIV positive persons, the Ombudsman shall

pass such order as soon as possible, preferably within twenty-four hours of the receipt of the

complaint.

(3)

The Ombudsman shall while holding any inquiry invariably protect the identity of

protected person and follow the above mentioned provisions.

(1)

In any legal proceeding where a court, pursuant to clause (a) of sub-section (1) of

section 34 of the Act directs, on an application made by a protected person or any other person,

that in the interests of justice the proceeding or any part thereof be conducted by suppressing the

identity of such protected person, the court shall direct all parties involved to;

(i)

file one copy of the documents bearing the full name, identity and identifying

details of the parties concerned before the court, which shall be kept in a

sealed cover and in safe custody with the Court;

(ii)

serve one copy of documents bearing the full name, identity and identifying

details of the parties concerned upon other parties in the proceeding with a

requirement to ensure that the full name and identity of the parties concerned

are kept confidential.

(2)

The court shall provide pseudonyms to protected persons involved in the legal

proceedings in the documents filed before the court in such manner that the identity and identifying

details of the protected person involved in the legal proceeding are kept confidential;

(3)

The court shall place the sealed covered documents on the first date of the legal

proceedings listed for hearing, if so required by the court.

(4)

The identities of the protected person involved in the legal proceeding and their

identifying details shall be displayed in pseudonym in all documentation generated by the court in

relation to the legal proceeding, including listing of the case on the court Board, interim orders and

final judgments.

(5)

The identity and identifying details of the protected person involved in the legal

proceeding shall not be revealed by any person or their representatives including assistants and

staff:

Provided that where in the interest of justice the name and identity of the protected

person needs to be revealed to a third party, it shall only be allowed by an order of the court.
