Notification

The 17th August, 2026

No. CFMS-1870-R-2-2026/5018 .— In exercise of the powers conferred by section 29 of

the Haryana Abadi Deh (Vesting, Recording and Resolving of Ownership Rights) Act, 2025

(Haryana Act No. 4 of 2026) and all other powers enabling him in this behalf, the Governor of

Haryana is pleased to make the following rules for carrying out the purposes of the said Act,

namely: -

RULES

Short title, commencement and application.- (1) These rules may be called the

Haryana Abadi Deh (Vesting, Recording and Resolving of Ownership Rights) Rules, 2026.

(2)

They shall come into force on and with effect from the date of their publication in

the Official Gazette.

Definitions. -In these rules, unless the context otherwise requires,-

(1)

"Act" means the Haryana Abadi Deh (Vesting, Recording and Resolving of

Ownership Rights) Act, 2025 (Haryana Act No. 4 of 2026);

(2)

"field book" means the book maintained in the form prescribed in Schedule I of

the Act and shall form part of the standing record of rights;

(3)

"publish" means an order, proceedings or record under the Act or rules made

available for the general public by way of proclamation, or placing of copies at prominent places

in the Abadi Deh, or publication in newspaper, or display on the official website of the

Government;

(4)

"section" means the section of the Act;

(5)

"sub-divided survey unit" means a part of a survey unit which forms a separate

unit and has been numbered by a fraction of the principal number; and

(6)

words, expressions and phrases used in these rules and not defined, but defined in

the Act shall carry the meanings respectively assigned to them in the Act.

Measurement.- (1) The base unit of measurement for the purposes of the Act and the

rules shall be both in feet and inches as well as meter and centimeter. Further, the area of the

survey unit shall be mentioned in square yards and square meters.

(2)

In the field book provided in Schedule-1 of the Act, there shall be complete

mention of the dimensions on all the four sides including type and use of the each survey unit i.e.

residential, commercial, institutional i.e. school, anganwadi, waterworks, hospital/dispensary

and animal hospital/ livestock centre etc., public utility i.e. street, dharamshala and chopal etc..

Such details shall be mentioned in the field book by the survey officer.

Notice to the occupier:- The Survey Officer, the Assistant Collector 2^nd grade, and

persons authorized for the purpose of demarcation and preparation of the standing record of

rights may enter upon –

(i)

the dwelling or inhabited units between sunrise and sunset with prior intimation to

the occupants.

(ii)

notice shall be served on the person to whom it is addressed or failing him an adult

male or female member of the family usually residing with him/ her.

Functions of the Survey Officer.-

(1)

The Survey Officer by,-

(i)

proclamation in the village;

(ii)

pasting a notice at conspicuous places in the abadi deh of a revenue estate;

and

(iii)

informing the Sarpanch of the village panchayat, give due intimation and

publicity of the date of his visit to the abadi deh area for the purpose of

identifying the boundaries, demarcation, taking measurements and

numbering of the survey units.

The Survey Officer shall for the purpose of survey –

(i)

explain the procedure to be followed to the inhabitants in a general

gathering;

(ii)

take measurements, demarcate the boundary and record the area of each

survey unit on the map prepared under subsection (2) of section 6 of the

Act and record these in the field book in Schedule 1 of the Act;

(iii)

number consecutively in serial order the dwelling and habitable areas of the

survey units in the abadi deh in numerals commencing from number 1;

(iv)

assign numbers to the common areas and building or area which houses an

institution under the Central Government or the State Government in the

manner as notified; and

(v)

mention the type of the survey unit such as house, street, shop, institutional

building, open area, common area and path.

(3)

In determining the area, boundary and type of survey unit, the Survey Officer may

take into consideration such document or writing submitted by a person interested, which shows

or determines boundary, area or type of the survey unit, and take measurements and prepare the

record on its basis.

(4)

The Survey Officer shall compile and submit the record prepared under sub-rule (2)

alongwith the field book in the form prescribed in Schedule 1 of the Act to the Assistant

Collector 2^nd grade for preparing the standing record of rights.

Recording of rights of proprietors & method of informing the proposal of preparing

standing records-of-rights.- The Assistant Collector 2^nd grade with the assistance of the village

committee and after hearing the parties interested shall –

(1)

(i)

take into consideration such relevant and material document or writing,

considered just and proper, submitted by a proprietor or person interested,

in support of his claim in the survey unit;

(ii)

in case a survey unit is found to be sub-divided, mark the sub-divided part

of the survey unit as 1/1, 1/2, 1/3, 1/4; 2/1, 2/2, 2/3, 2/4; or 1/1/1, 1/1/2,

1/1/3, 1/1/4 and so on as may be considered suitable and proper, and record

the area of each sub-divided survey unit; and

(iii)

proceed to record in a summary manner and publish in the form prescribed

in Schedule II of the Act, the proposed entries of the proprietors and their

proprietary rights in the survey units and sub-divided survey units as on the

appointed day.

(2)

The inhabitants of the Abadi Deh shall be informed about the proposal of

preparation of standing records-of-rights by:-

(i)

Proclamation in the village;

(ii)

Pasting a notice at conspicuous places in the Abadi Deh in the revenue

estate;

(iii)

Informing the Sarpanch of the Village Panchayat to give due intimation and

publicity regarding the proposal of preparation of standing records-of-rights

and convening Gram Sabha meeting by Sarpanch/ member of Panchayats

for information; and

(iv)

By way of notice through electronics mode on e-mail etc. of Gram

Panchayats.

Informing the Gram Panchayat of Schedule-II.- The copies of the record prepared in

Schedule-II shall be given to the Sarpanch of the village panchayat through an official

functionary against receipt.

Issuance of SVAMITVA Rights Certificate.- The Assistant Collector 2nd Grade shall

Application for partition.- An application for the partition of survey unit shall contain

following details:-

(i)

Particulars of land comprising khewat, khatauni, khasra number etc. under

partition;

(ii)

Name, address and mobile number of co-owners in khewat(s) under partition as

mentioned in the final record-of-rights;

(iii)

Status of possession of the co-owners in the survey unit;

(iv)

Requirement regarding rasta, Nala and estimated value of survey unit; and

(v)

Any other particular required for fair and reasonable partition of survey unit.

(vi)

The partition application shall be decided in summary manner after hearing the

objections of the co-owners and considering the valuation of land, Rasta, Nala or

other easementry rights, if any and any other relevant matters, which is required to

be considered for fair partition between the co-owners. The application shall be

decided by Assistant Collector 2nd Grade within a period of 90 days after issuance

of summons/ notices to the co-owners or such other further period with written

reasons justifying the delay.

Recovery of amount of fine.- The fine shall be recovered by issuing a notice by

Assistant Collector 1st Grade to the person who willfully destroyed, dismantled or removed

survey or demarcation mark lawfully erected or put, stating the particulars of the act committed

by the responsible person/ persons. The person(s) responsible shall be bound to a pay the fine

within a period of one month from the date of receipt of notice in cash/ electronic mode/ bank

draft as may be directed by the Assistant Collector 1st Grade in the notice.

11.

Supply of copies.- The procedure as applicable for inspection of record of cases, and

issuance of copies of documents in respect of proceedings under the Haryana Land Revenue

Act, 1887 (Punjab Act No. XVII of 1887) shall apply mutatis mutandis to proceedings in respect

of the standing record of rights under the Act and these rules.
