No. SEC-13-85/2006-I-08-13.—Whereas a vacancy has occurred in ward no. 8 of

Municipal Council Nalagarh District Solan due to removal of Sh. Mahesh Gautam, Member, by

Government of Himachal Pradesh Urban Development Department. vide its Notification No. UD-

A(1)-8/2006 dated 11-12-2009;

Therefore, in pursuance of Rule 5 (1)(e) read with Rule 13 of the Himachal Pradesh

Municipal (Election) Rules, 1994, the State Election Commission hereby orders the special revision

of electoral rolls of Ward No. 8 of Municipal Council Nalagarh District Solan with 1-1-2010 as the

qualifying date for inclusion of name of eligible electors as per programme appended below:

The draft publication of electoral rolls shall be affixed at such places as specified under

Rule 6 of the Rules ibid in addition to the concerned ward in Devnagri script. All claims and

objections with regard to electoral rolls shall be filed and decided at the headquarter of Municipal

Council concerned. After the disposal of the claims and objections supplementary lists shall be

prepared in cyclostyled form and attached to the original electoral rolls. The number of

supplementary lists so prepared shall be the same as of the original electoral rolls already prepared

in the year 2005 and are available in your record.

While preparing aforesaid revised electoral rolls instructions issued vide Commission’s

letter No. SEC-13-82/2005-558-67 dated 7th July, 2005 will be followed, wherever applicable.

Deputy Commissioner Solan will make wide publicity of the aforesaid special revision

programme of electoral rolls in the concerned wards.

NOTIFICATION

Shimla-2, the 24th September 2009

No. GAD-(E)B(2)1/95.—In exercise of the power conferred by proviso to Article 309 of

the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal

Pradesh Public Service Commission is pleased to make the following rules further to amend the

Recruitment and promotion Rules for the post of Director Class-I (Gazetted) in the Sainik Welfare

department Himachal Prdesh notified vide this Department Notification of even No. dated 13th July,

1999 namely :—

Short title and Commencement.—(1) These Rules may be called, the Himachal and

Pradesh Sainik Welfare Department Director Class-I (Gazetted) Recruitment and Promotion

(Second amendment) Rules, 2009.

(2) These rules shall come into force from the date of its publication in the Rajpatra

Himachal Pradesh.

Amendment of-Annexure ‘A’.—(1) In Annexure “A” to the Himachal Pradesh

Sainik Welfare Department, Director Class-I (Gazetted) Recruitment & Promotion Rules, 1999;

(a) For the existing provision against Col. No. 4 the following shall be substituted

namely:

“Pay Scale for regular incumbents.—(i) Rs. 13500-400-15900-450-16800.

(ii) Emoluments for contract employees.—As per detail given in Col. 15-A.”

(b) For the existing provision against Col. No. 6 the following shall be substituted

namely:

“ Should be below the age of 57 years Serving personnel expected to be released from

Army/ Navy/ Air Force within one year are also eligible.”

“Should be a retired/released Ex-Indian Commissioned officer not below the rank of

Brigadier or equivalent status of the Indian Navy/Air Force failing which a retired/released Col

from the Army Or equivalent rank of the Indian Navy/Air Force.”

(d) For the existing provision against Col. No. 10 the following shall be substituted

namely :

100% by direct recruitment on a regular basis or by recruitment on contract basis as the case

may be. The contract employees will get emoluments as given in Column 15-A and will be

governed by the service conditions as specified in the said Column.

(e) After the existing provision against Col. No. 15 new Col. 15- A shall be added

namely:

“15-A Selection for appointment to the post by contract appointment:”.—

“Notwithstanding anything contained in these rules, contract appointments to the post will be made

subject to terms & Conditions given below.—

(I) CONCEPT.—(a) Under this policy, the Director, Sainik Welfare, HP in the

department of Sainik Welfare will be engaged on conctract basis intitialy for one year, which may

be extendable on year to year basis.

(b)

POST FALLS WITHIN THE PURVIEW OF H.P.P.S.C.—The Secretary, Sainik

Welfare Department after obtaining the approval of the Government to fill up the vacant post on

contract basis will place the requisition with the concerned recruiting agency i.e. H.P.P.S.C. (C)

The selection will be made in accordance with the eligibility conditions prescribed in these rules.

(II) CONTRACTUAL EMOLUMENTS.—The Director, Sainik Welfare appointed on

contract basis will be paid consolidated fixed contractual amount @ Rs. 20250/- P.M. (which shall

be equal to initial of the pay scale + Dearness pay) an amount of Rs. 400/- (equal to annual increase

in the minimum/initial start of the pay scale of the post) as annual increase in contractual

(III) APPOINTING/ DISCIPLINARY AUTHORITY.—The chief secretary to the Govt.

of Himachal Pradesh will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

Contract Appointment will be made on the basis of vivavoce test or if considered necessary or

expedient by a written test or practical test the standard/ syllabus etc. of which will be determined

by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—

As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Public Service

Commission from time to time.

(VI) AGREEMENT.—After Selection of a candidate, he/she shall sign an agreement as

per Annexure-B appended to these rules.

(VII) TERMS AND CONDITION S.—(a) The contractual appointee will be paid fixed

contractual amount @ Rs. 20250/-P.M (which shall be equal to initial of the pay scale+ Dearness

pay). The contractual appointee will be entitled for increase in contractual amount @ Rs.400/-

(equal to annual increase in the minimum/initial start of the pay scale of the post) for further

extended years and no other allied benefits such as senior /selection scales etc. shall be given.

The Service of the contract appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance /conduct of the contract appointee is

not found satisfactory.

for contractual amount for the period of absence from duty.

(e) Transfer of a contract appointee will not be permitted from one place to another in any

case.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government/Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will

stand temporarily unfit till the confinement is over. The women candidates will be re-examine for

the fitness from an authorized Medical Officer/ Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his /her Official duties at the same rate as applicable to regular officials at the minimum of pay

scale.

(h) Provisions of service rules like FR, SR, Leave Rules, GPF, Pension Rules and

Conduct Rules etc. as are applicable to regular employees will not be applicable in case of contract

appointees. They will be entitled for emoluments etc. as detailed in this column.”
