and Other Tobacco products (Prohibition of Advertisement and Regulation of Trade and

Commerce, Production, Supply and Distribution) Act, 2003 read with rule-4 of the Cigarettes and

Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce,

Products, Supply and Distributions) Rule, 2004 and the rule there under made by the Government

of India, Ministry of Health and Family Welfare, the Governor, Himachal Pradesh is pleased to

nominate the below mentioned officers/official of the Himachal Road Transport Corporation to act

as a Nodal Officers, to take action regarding violations of the provisions of the Act ibid, as per the

rules notified there under by the Central Government, in their respective office premises.

No.TSM-C (17)-5/2002.—In exercise of the powers conferred by section 9 of the Himachal

Pradesh Tourism Development & Registration Act, 2002, the Governor, Himachal Pradesh is

pleased to make the following rules to govern the release of grant-in-aid to Himachal Pradesh

Tourism Development Board, namely:—

Short Title and Commencement.—(1) These rules may be called The Himachal

Pradesh Grant-in-Aid to the Himachal Pradesh Tourism Development Board, Rules, 2010.

(2) They shall come into force at once.

Definitions.— In these rules, unless there is anything repugnant in the subject or

context:—

(i)

Governor means the Governor of Himachal Pradesh;

(ii)

Government means the Government of Himachal Pradesh;

(iii)

Grant-in-aid means the grant-in-aid given by the Government agency of Himachal

Pradesh Government and Non Government Organization to the Tourism Development

Board;

(iv)

Board means Tourism Development Board established under section 4 of Himachal

Pradesh Tourism Development & Registration Act, 2002;

(v)

Financial year means the year commencing from 1st April, & ending on 31st March of

the next year; and

(v)

State means the State of Himachal Pradesh.

Objects of the Grant.—The grant may be given:—

(1) to Tourism Development Councils, Other Departments in Himachal Pradesh, HPTDC,

NGO’s, Semi Government Organizations in Himachal Pradesh for development and maintenance

of the Tourism related service/activities as per requirement of specific work.

(2) The grant-in-aid shall not be used to meet salary expenses of any staff of the Board.

Besides, no staff shall be hired from the Department/HPTDC. But Department/HPTDC staff should

service the Board.

(3)

Any other tourism related purposes approved by the Board.

Conditions of grant.—The grant shall be given subject to the following conditions:—

(1) That grant–in- aid shall be sanctioned by the State Government in Finance

Department, thereafter; the Administrative Department will issue Administrative Approval and

Expenditure Sanction. Accordingly, the Grant-in-aid will be released after obtaining the approval

from the Chairman of the Tourism Development Board i.e. Chief Minister.

(2) That the Government shall have the right to check the Accounts of the Board at any

time to satisfy that the Grant-in-aid has been utilized by the Himachal Pradesh Tourism

Development Board within a period of one year after its receipt.

(3) The Tourism Development Board shall furnish the Utilization Certificate of the works

executed against the Grant-in-aid to Finance Department through Administrative Department and

the copies of the same shall also be sent to the Office of Pr. Accountant General (Audit), Himachal

Pradesh.

(4) The Board shall maintain separate account of the grant-in-aid sanctioned/utilized.

Mode of sanction of the grant-in-aid.—(1) The grant-in-aid shall be sanctioned by

the Government on the formal request of the Board which shall be routed through the

Commissioner/Director, Tourism, Himachal Pradesh well in time.

(2) The Grant-in-aid shall be sanctioned provided the Board submits an audited statement

along with details of expenditure of the grant–in-aid given during the Previous year, as required

under the Rules.

(3) It shall be the discretion of the Government to release the grant-in-aid of a particular

financial year in lump sum or in installments.

Method of payment.—The payment of grant -in- aid shall be made by the

Commissioner/Director, Tourism & Civil Aviation, Himachal Pradesh or a subordinate Officer

declared as Drawing & Disbursing Officer of the Himachal Pradesh Tourism Development Board.

The Board on receipt of the payment shall issue a printed/stamped receipt in the token of having

received the payment from the Commissioner/Director, Tourism & Civil Aviation,Himachal

Pradesh.

Maintenance of accounts by the board.—(1) The Board shall maintain separate year

wise accounts of the Grant-in-aid.

(2) The Board shall submit the quarterly statement of expenditure to the Commissioner/

Director, Tourism & Civil Aviation within a period of one month.

Accounts and audit of grant-in-aid.—(1) The Board shall maintain proper accounts

and other relevant records and prepare an annual statement of accounts including the profit and loss

accounts and the balance sheet in such form as may be prescribed by the Government.

(2) The accounts of the Board shall be audited annually by the Local Audit Department,

Himachal Pradesh and any expenditure incurred by it in connection with such audit shall be

payable by the Board to the Local Audit Department, Himachal Pradesh.

(3) The Local Audit Department, Himachal Pradesh shall have the same right and

privileges and authority in connection with such audit as Accountant General of Himachal Pradesh

has in connection with the audit of Government accounts and in particular, shall have the right to

demand the production of books, accounts connected vouchers, documents and papers of the Board.

(4) The accounts of the Board as certified by the Local Audit Department, Himachal

Pradesh together with the audit report thereon shall be forwarded annually to the Government.

Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh

Motor Vehicles Rules, 1999, notified vide this department notification No: 5-24/88-TPT-II, dated

12th July, 1999 and published in Rajpatra, Himachal Pradesh (Extra Ordinary), dated 27th July,

1999 and the same are hereby published in the Rajpatra, Himachal Pradesh for general information

of the public and a notice is hereby given that the said rules will be finalized after the expiry of

fifteen days from the date of publication of these rules in the Rajpatra, Himachal Pradesh;

2. If any person, likely to be affected by these rules has any objection (s) or suggestion (s)

to make with regard to these rules he may send the same to the Principal Secretary(Transport) to

the Government of Himachal Pradesh , Armsdale Building, Shimla-2, within the above stipulated

period;

Objection(s) or suggestion (s), if any, received within the stipulated period, shall be

considered by the Government of Himachal Pradesh before finalizing the draft rules, namely:—

DRAFT RULE

1. Short title.— These rules may be called the Himachal Pradesh Motor Vehicles (Second

Amendment) Rules, 2010.

2. Substitution of rule-69-A.—For rule-69-A of the Himachal Pradesh Motor Vehicles

Rules, 1999, the following shall be substituted, namely:0ù

“69-A: Composite fee for All India Permits.—There shall be levied, charged and paid to

the State Government, a composite fee at the following rates, in respect of tourist

vehicles which are authorized to ply in the State of Himachal Pradesh under All

India Permits granted by any State Transport Authority of other State or Union

Territory under sub-section 9of section 88 of the Motor Vehicles Act, 1988,

namely:—

(a)

having seating capacity to carry more

than twelve passengers excluding

driver.

Rs. 10,000/- per month (30 days) for

three trips and Rs. 4,000/- for any

additional trip within the same month.

(b)

having seating capacity to carry more

than six passengers but not more than

twelve passengers excluding driver.

Rs. 6000 per quarter or Rs. 2200 per

month (30 days).

(c)

having seating capacity to carry not

more than six passengers excluding

the driver.

Rs. 600/- per quarter:

Provided that where the aforesaid amount of composite fee remains unpaid, on or after 15th

March, 15th July, 15th September and 15th January of the financial year in case of tourist vehicles

described in clauses (a), (b) and (c), there shall be charged an additional sum of rupees one hundred

per month or part thereof.”.
