No: Mudran (B)2-1/99.—In exercise of the powers conferred by proviso to Article 309 of

the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal

Pradesh Public Service Commission, is pleased to make the following rules further to amend the

Himachal Pradesh Printing and Stationery Department, Senior Assistant, Class-III (Non-Gazetted)

(Ministerial Services), Recruitment & Promotion Rules 2000, notified vide notification of even

number dated 25-9-2000:—

Short title and commencement.—(i) These rules may be called the Himachal

Pradesh Printing and Stationery Department, Senior Assistant Class-III (Non-Gazetted) (Ministerial

Services ), Recruitment & Promotion Rules (3rd amendment ) 2010.

(ii) These Rules shall come into force from the date of publication in the Rajpatra

Himachal Pradesh.

In Annexure “A” to the Himachal Pradesh Printing and Stationery Department, Senior

Assistant Class-III (Non-Gazetted) (Ministerial Services), Recruitment & Promotion Rules, 2000:-

(a)

For the existing provisions against the Col No. 4 following shall be substituted,

namely:-

“(i)

Pay scale for regular incumbent.—Rs.10300-34800+3800 Grade pay.

(ii)

Emoluments for contract employees.—Not applicable.”

No. Shram(B)2-23/97(Estt.)Rules.—In exercise of the powers conferred by the proviso to

Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the

Himachal Pradesh Public Service Commission, is pleased to make the following rules further to

amend the Himachal Pradesh Labour & Employment Department, Driver, Class-III (Non-Gazetted)

(Non-Ministerial Services) Recruitment & Promotion Rules, 2002 notified vide this department

notification of even number dated 15-11-2002 namely:-

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh Labour & Employment Department, Driver, Class-III, (Non-Gazetted) Non-Ministerial

Services, Recruitment & Promotion (First amendment) Rules, 2010.

(2) These rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

Amendments of Annexure-“A”.—In Annexure-“A” of the Himachal Pradesh Labour

& Employment Deptt. Driver, Class-III (Non-Gazetted ) Non-Ministerial Services Recruitment &

Promotion Rules,2002.

(a) For the exiting provisions against Col.No. 2 the following shall be substituted,

namely:-

5 (Five)

(b) For the existing provisions against Col. No. 4 the following shall be substituted,

namely:-

(i)

Pay Scale for regular incumbents is Rs.5910-20200+ Rs. 2000/- Grade pay.

(ii) Emoluments for Contract employee is as per details given in Col. No. 15-A.

namely:-

100% by direct recruitment on a regular basis or by recruitment on contract basis as the case

may be. The contract employees will get emoluments as given in Col. No.15-A and will be

governed by service conditions as specified in the said column.

(d) After Col. No.15, the following Col. No. 15-A shall be inserted, namely:-

Insertion of Rule 15-A in Annexure-“A”.—15-A (Selection for appointment to the

post by Contract appointment ):

Notwithstanding anything contained in these rules, contract appointment to the post will be

made subject to the terms and conditions given below:-

(1)

CONCEPT.—(a) Under this policy the Driver in Department of Labour &

Employment, H.P. will be engaged on contract basis initially for one year, which may be

extendable on year to year basis.

(b) The selection will be made in accordance with the eligibility conditions prescribed in

these Rules.

Commissioner-cum-Director, Employment, H.P. after obtaining the approval of the

Government to fill up the posts on contract basis will advertise the details of the

vacant posts in atleast two leading newspapers and invite applications from candidates

having the prescribed qualifications and fulfilling the other eligibility conditions as

prescribed in these Rules.

(II) CONTRACTUAL EMOLUMENTS.—The Driver appointed on contract basis will

be paid consolidated fixed contractual amount @ Rs. 7910 (which shall be equal to minimum of the

pay band + grade pay). An amount of Rs. 240/- (3% of the minimum of pay band + grade pay of

the post) as an annual increase in contractual emoluments for the subsequent year(s) will be

allowed if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINAY AUTHORITY.—The Labour Commissioner-cum-

Director of Employment, H.P. will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

Contract Appointment will be made on the basis of viva-voce test or if consider necessary or

expedient by a written test or practical test the standard/syllabus etc. of which will be determined

by the concerned recruitment agency i.e. Labour Commissioner-cum-Director of Employment, H.P.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—

As may be constituted by the concerned recruiting agency i.e. the Labour Commissioner-cum-

Director

of Employment, H.P. from time to time.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as

per Annexure-“B” appended to these Rules.

TERMS AND CONDITIONS:

(a) The Contractual appointee will be paid fixed contractual amount @ Rs..7910/-P.M.

(which shall be equal to minimum of the pay band + grade pay). The contract appointee will be

entitled for increase in contractual amount @ Rs.240/- (3% of minimum of the pay band + grade

pay of the post) for further extended years and no other allied benefits such as senior/section scales

etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract appointee is

not found satisfactory.

(c)

Contract Appointee will be entitled for one day casual leave after putting one month

service. This leave can be accumulated up to one year. No leave of any other kind is admissible to

the contract appointee. He/She shall not be entitled for Medical Re-imbursement and LTC etc. only

maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Controlling Officer

shall automatically lead to the termination of contract. Contract Appointee shall not be entitled for

contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who have completed five years tenure at one

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government/Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will

stand temporarily unfit till the confinement is over. The women candidate will be re-examined for

the fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart official at the

minimum of pay scale.

(h) Provisions of service rules like FR,SR, Leave Rules, GPF Rules, Pension Rules &

Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

That the FIRST PARTY shall remain in the service of the SECOND PARTY as a

mentioned and agreed upon by both the parties that the contract of the FIRST PARTY

The Contractual amount of the FIRST PARTY will be Rs.7910/- per month.

The service of FIRST PARTY will be purely on temporary basis. The appointment is

not found good or if a regular incumbent is appointed/posted against the vacancy for

which the first party was engaged on contract.

Shimla-2, the 28th July, 2010

No. FFE-B-F(6) 11/2005.—Whereas, the Governor, Himachal Pradesh, after careful

consideration is of the view that the areas mentioned in the Schedule below are of adequate

ecological, faunal, floral, geomorphological or Zoological significance.

Now therefore, the Governor, Himachal Pradesh in exercise of the powers vested in her

under Section 35 (1) of the Wildlife (Protection) Act, 1972 is pleased to declare her intention to add

the areas as specified in the said Schedule as extension to the Great Himalayan National Park,

notified vide Notification No. FFE-B-F(3)2/99 dated 28-5-1999, by including an area of 151 sq. km

( Sainj WLS 90 sq. km & Tirthan WLS 61 sq. km) to the existing Great Himalayan National

Park having an area of 754.40 sq. km for the purpose of protecting, propagating, or developing

wildlife, or its environment.

NOTIFICATION

Shimla-2, the 28th July, 2010

No. FFE-B-F(6) 11/2005.—Whereas, the Governor, Himachal Pradesh, after careful

consideration is of the view that the areas mentioned in the Schedule below are of adequate

ecological, faunal, floral, geomorphological, natural or Zoological significance.

Now therefore, the Governor, Himachal Pradesh in exercise of the powers vested in her

under Section 18 (1) of the Wildlife (Protection) Act, 1972 is pleased to declare her intention to add

the areas as specified in the said schedule as extension to the Kibber Wildlife Sanctuary notified

vide Notification No. FFE-B-F-(6)-29/99 dated 1-11-1999 by including an area 867 sq. km to the

existing Kibber Wildlife Sanctuary having area 1400 sq. km for the purpose of protecting,

propagating, or developing wildlife, or its environment.

vide Notification No. FFE-B-F-(6)-16/99 dated 23-10-1999 by including an area of 40 sq. km to the

existing Nargu Wildlife Sanctuary having an area of 278 sq. km for the purpose of protecting,

propagating, or developing wildlife, or its environment.

WEST:- Starting from a point at 5685

mtr. height follows Sidhani Dhar up to

Chaliali Ka Sira towards Northern

direction.

Area:- This area of 113.27 sq. km shall constitute extension of the existing 330 sq. km area

of Sech Tuan Nalla Wildlife Sanctuary.

Shimla-2, the 28th July, 2010

No. FFE-B-F(6) 11/2005.—Whereas, the Governor, Himachal Pradesh, after careful

consideration is of the view that the areas mentioned in the Schedule below are of adequate

ecological, faunal, floral, geomorphological or Zoological significance.

Now therefore, the Governor, Himachal Pradesh in exercise of the powers vested in her

under Section 35 (1) of the Wildlife (Protection) Act, 1972 is pleased to declare her intention to

constitute the areas of 104 Sq Km as specified in the said Schedule as new National Park namely

Inderkilla, for the purpose of protecting, propagating, or developing wildlife, or its environment.

East: The boundary starts from near the

SOI benchmark 6632m of the Pin

Valley National Park and moves along

the western boundary of this National

Park upto the SOI 5741m which is also

meeting point of the Great Himalayan

National Park.

South: The boundary begins from the

meeting point SOI 5741m of Pin Valley

NP and the Great Himalayan National

Park and follows the existing northern

boundary of Great Himalayan National

Park upto Survey of India benchmark

5238m at Baskinag.

West:

The

boundary

starts

from

Baskinag 5238m (on Phangchi Dhar)

located on the northern boundary of the

Great Himalayan National Park. It

moves along the forest boundary to the

5405m,

Basunag 5479m. The boundary moves

along with the forest boundary and

touches SOI 5075m, moving further

along the ridge and then joining the top

of the Bakar Kiara Khol. It goes down

along the nalla to meet Parvati river at

SOI 3060m near Nihara Thach. On the

right bank of Parvati river, the boundary

moves from SOI 3060 near Kriri thach

along the nallah to meet the SOI 4935m,

then it crosses the ridge to meet the

tributary of Tos Nal below the SOI

benchmark of 2990. The boundary from

here onwards follows Tos Nal upto

Kotlu thach. The boundary follows a

prominent trek from Kotlu thach to

Umga thach ending at the Sara Umga

Pass on the district boundary of Kullu

and Lahaul & Spiti

Area: This area of 710 sq km. shall constitute a new National Park namely Khirganga.

Simbalbara National Park having total area of 27.88 sq. km for the purpose of protecting,

propagating, or developing wildlife, or its environment.

No. FFE-B-F(6) 11/2005.—Whereas, the Governor, Himachal Pradesh, after careful

consideration is of view that the areas mentioned in the Schedule below are of adequate ecological,

faunal, floral, geomorphological, natural or Zoological significance.

Now therefore, the Governor, Himachal Pradesh in exercise of the powers vested in her

under Section 18 (1) of the Wildlife (Protection) Act, 1972 is pleased to declare her intention to

constitute the areas as specified in the said Schedule as extension to the Daranghati Wildlife

Sanctuary notified vide Notification No. FFEBF(6)22/99 dated 23rd October, 1999, by including

an area of 127.87 sq. km to the existing Daranghati Wildlife Sanctuary having area of 48.25 sq.

km on the ground (Notified area 167 sq. km) for the purpose of protecting, propagating, or

developing wildlife, or its environment.

NOTIFICATION

Shimla-2, the 28th July, 2010

No. FFE-B-F(6) 11/2005.—Whereas, the Governor, Himachal Pradesh, after careful

consideration is of the view that the areas mentioned in the Schedule below are of adequate

ecological, faunal, floral, geomorphological, natural or Zoological significance.

Now therefore, the Governor, Himachal Pradesh in exercise of the powers vested in her

under Section 18 (1) of the Wildlife (Protection) Act, 1972 is pleased to declare her intention to add

the areas as specified in the said Schedule as extension to the Kanawar Wildlife Sanctuary

notified vide Notification No70-GP 53/97 dated 28.02.1954 by including an area 59.30 sq. km to

the existing Kanawar Wildlife Sanctuary having area on ground 62.49 sq. km (notified area 54.27

sq. km) for the purpose of protecting, propagating, or developing wildlife, or its environment.
