NOTIFICATION

Shimla-2, the 25th March, 2010

No. Fish-A(3)15/1999-II.—In exercise of the powers conferred by proviso to Article 309 of

the Constitution of India, the Governor of Himachal Pradesh, in consultation with the H.P. Public

Service Commission, is pleased to make the following Rules further to amend the Himachal

Pradesh, Fisheries Department, Sub-Inspector, Fisheries, Class-III-(Non-Gazetted), Recruitment

and Promotion, Rules, 2009 notified vide this Department Notification No. Fish-A(3)15/99 dated

26.10.2009, namely:-

Short title and Commencement.—(1) These rules may be called the Himachal

Pradesh, Fisheries Department, Sub-Inspector, Fisheries, Class-III (Non-Gazetted), Recruitment

and Promotion(First amendment) Rules, 2011.

(2) These rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

Amendment of Annexure-A.—In Annexure “A” to the Himachal Pradesh Fisheries

Department, Sub-Inspector, Fisheries, Class-III-(Non-Gazetted), Recruitment and Promotion,

Rules, 2009:—

(a) for the existing provisions against Col. No. 4, the following shall be substituted,

namely:—

“(i) Pay scales for regular incumbents

Pay Band 5910-20200

Grade Pay 2400”

(ii) Emoluments for contract employees Rs. 8310/-

(As per details given in col. 15-A)

(b) For the existing provisions against Col.No.15-A, the following shall be substituted,

namely:-

“Notwithstanding anything contained in these rules, contract appointments to the post will

be made subject to the terms and conditions given below:-

(I) CONCEPT.—(a) Under this policy, the Sub-Inspector, Fisheries in the Department of

Fisheries, H.P. will be engaged on contract basis initially for one year, which may be extendable on

year to year basis.

Provided that for extension /renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPSSSB.—The Director-cum-

Warden of Fisheries, after obtaining the approval of the Government to fill up the vacant posts on

contract basis will place the requisition with the concerned recruiting agency i.e. H.P. Subordinate

Services Selection Board Hamirpur.

(II) CONTRACTUAL EMOLUMENTS.—The Sub-Inspector, Fisheries on contract

basis will be paid consolidated fixed contractual amount @ Rs 8310/- P.M.(which shall be equal to

minimum of pay band+Grade pay). An amount of Rs 250/-(3% of the minimum of pay band +

grade pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will

be allowed if contract is extended beyond one year.

(III) APPOINTING /DISCIPLINARY AUTHORITY.—Director of Fisheries H.P. will

be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

contract appointment will be made on the basis of viva-voce test or if consider necessary or

expedient by a written test or practical test the standard/syllabus etc. of which will be determined

by the concerned recruiting agency i.e. H.P.S.S.S.B.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—

As may be constituted by the concerned recruiting agency i.e. the H.P.S.S.S.B. from time to time.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as

per Annexure-B appended to these Rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid fixed

contractual amount @ Rs. 8310/- per month(which shall be equal to minimum of the pay band +

Grade Pay). The Contract Appointee will be entitled for increase in contractual amount @ Rs. 250/-

(3% minimum of the Pay Band+ Grade Pay of the post) for further extended years and no other

allied benefits such as senior/selection scales etc. shall be given.

(b) The service of the Contract appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract

appointee is not found satisfactory.

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government/ Registered Medical Practitioner. Women candidate pregnant beyond

twelve weeks will stand temporarily unfit till the confinement is over. The women

candidate will be re-examined for the fitness from an authorized Medical

officer/Practitioner.

(g) Contract appointee will be entitled to TA/ DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart

officials at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules &

Conduct Rules etc. as are applicable in case of regular employees will not be

applicable in case of contract appointees. They will be entitled for emoluments etc. as

detailed in this Column.

No. IPH-A-A(3)1/2010.—In exercise of the powers conferred by proviso to Article 309 of

the Constitution of India, the Governor of Himachal Pradesh, in consultation with Himachal

Pradesh Public Service Commission, is pleased to make the following rules further to amend

Himachal Pradesh Department of Irrigation and Public Health, Pump Operator Class-III(Non

Gazetted) Recruitment and Promotion Rules, 2006 , notified vide this Deptt. notification number

IPH-A-C-5(9)-2/95 dated 30.5.2006 namely:—

Short title and Commencement.—(1) These Rules may be called the Himachal

Pradesh Department of Irrigation & Public Health, Pump Operator Class-III(Non-Gazetted),

Recruitment and Promotion (First Amendment) Rules, 2011.

These Rules shall come into force from the date of Publication in the Rajpatra

Himachal Pradesh.

Amendment of Annexure-A.—(1) In ANNEXURE “A” to the Himachal Pradesh

Department of Irrigation and Public Health, Pump Operator Class-III(Non-Gazetted) Recruitment

and Promotion Rules, 2006.

(a)

For the existing provision against Col. No. 4, the following shall be substituted

namely:—

(i.) Scale of pay for regular incumbents:

Rs.5910-20200+Rs.1900 (Grade Pay).

(ii) Emoluments for Contract employees:

As per details given in Col.15- A

(b) For the existing provision against Col. No. 10, the following shall be substituted

namely:—

50% by direct recruitment on a regular basis or by recruitment on contract basis as the

case may be. The contract employees will get emoluments as given in Col. 15-A and will be

governed by service conditions as specified in the said column.

(c)

For the existing provision against Col. 15-A, the following shall be substituted,

namely:—

15–A Selection for appointment to the post by contract appointment.—(Selection for

appointment to the post by contract appointment). Notwithstanding anything contained in these

rules, contract appointments to the post will be made subject to the terms and conditions given

below:-

CONCEPT:—(a) Under this policy the Pump Operator in Department of Irrigation &

Public Health H.P. will be engaged on contract basis initially for one year which may be extendable

on year to year basis.

Provided that for extension/renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS OUT OF THE PURVIEW OF HPSSSB:—The Superintending

Engineer(Designation of the appointing authority) after obtaining the approval of the Government

to fill the vacant posts on contract basis will advertise the details of the vacant posts in atleast two

leading news paper and invite applications from candidates having the prescribed qualification and

fulfilling the other eligibility conditions as prescribed in these Rules.

(II) CONTRACTUAL EMOLUMENTS:—The Pump Operator appointed on contract

basis will be paid consolidated fixed contractual amount @Rs.7810/-per month (which shall be

equal to minimum of the Pay band + Grade pay). An amount of Rs. 240/- (3% of the minimum of

Pay band + grade pay of the post) as annual increase in contractual emoluments for the subsequent

year(s) will be allowed, if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY:—The Superintending Engineer of

the concerned Circle of IPH department will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS:—Selection for appointment to the post in the case of

Contract Appointment will be made on the basis of viva-voce test or if considered necessary or

expedient by a written test or practical test, the standard /syllabus etc. of which will be determined

by the concerned recruiting agency i.e. H.P Subordinate Service Selection Board, Hamirpur.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS: As

may be constituted by the concerned recruiting agency i.e.H.P. Subordinate Services Selection

Board, Hamirpur from time to time.

(VI) AGREEMENT:—After selection of a candidate he/she shall sign an agreement as per

Annexure “B” appended to these Rules.

TERMS AND CONDITIONS:—(a) The contractual appointee will be paid fixed

contractual amount @ Rs. 7810/-per month (which shall be equal to minimum of the pay band +

grade pay).The contract appointee will be entitled for increase in contractual amount @ Rs.240/-

(3% of minimum of the pay band + grade pay of the post) for further extended years and no other

allied benefits such as senior /selection scale etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract appointee is

not found satisfactory.

(c)

Contract appointee will be entitled for one day casual leave after putting one month

service. This leave can be accumulated up to one year. No leave of any other kind is admissible to

the contract appointee. He/she shall not be entitled for medical reimbursement and LTC etc. Only

Maternity leave will be given as per rules.

(d) Unauthorized absence from the duties without the approval of the controlling Officer

shall automatically lead to the termination of the contract. Contract Appointee shall not be entitled

for contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who have completed five years tenure at one

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a

Government/ Registered Medical Practitioner. Women candidates, pregnant beyond 12 weeks will

stand temporarily unfit till the confinement is over. The women candidates will be re-examined for

the fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart official at the

minimum of the pay scale.

(h) Provisions of service rules like FRSR, Leave Rules, GPF Rules, Pension Rules &

conduct rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this column.

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST

PARTY has agreed to serve as a Pump Operator on contract basis on the following terms &

That the FIRST PARTY shall remain in the service of the SECOND PARTY as a

Pump Operator for a period of one year commencing on day of …………….and

ending on the day of……….. It is specifically mentioned and agreed upon by both the

parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto

stand terminated on the last working day i.e. on………….and information notice shall

not be necessary.

Provided that for extension/renewal of contract period on year to year basis the

to make the following rules further to amend the Himachal Pradesh Panchayati Raj (Finance,

Budget, Accounts, Audit, Works, Taxation and Allowances) Rules, 2002, notified vide this

Department notification number PCH-HA (1) 3/98 dated 10th October, 2002 and published in the

Rajpatra, Himachal Pradesh (Extra ordinary) on 16th November, 2002, namely:-

Short title.— 1. These rules may be called the Himachal Pradesh Panchayati Raj

(Finance, Budget, Accounts, Audit, Works, Taxation and Allowances) Amendment Rules, 2011.

Amendment of rule 10.—In rule 10 of the Himachal Pradesh Panchayati Raj

(Finance, Budget, Accounts, Audit, Works, Taxation and Allowances) Rules, 2002 (hereinafter

called the “said rules”), for sub-rule (2), the following shall be substituted, namely:-

"(2) Subject to the provisions of sub-section (4) of section 99 of the Act, the Secretary or

Panchayat Sahayak shall be the cashier of the Gram Panchayat, who shall be competent to

withdraw or deposit the money/payments from or in the accounts of the Gram Panchayat:

Provided that the payments to be made to the supplier for purchase of material shall be

made by crossed cheques only.".

Amendment of rule 31.— 3. For rule 31 of the said rules, the following shall be

substituted, namely:-

"31. Registers, Records, Accounting system and forms to be maintained by the

Panchayats: The Secretary or Panchayat Sahayak of the Gram Panchayat or Secretary of

Panchayat Samiti or Zila Parishad, as the case may be, shall maintain all the records,

registers, forms and accounts as per formats and codes prescribed by the Comptroller and

Auditor General of India and notified by the State Government from time to time.

Amendment of Appendix-D.—In Appendix-D appended to the said rules for serials

number 1 and 2 the following shall be substituted, namely :-

pleased to make the following rules further to amend the Himachal Pradesh Panchayati Raj

(Appointment and conditions of service of Panchayat Sahayaks) Rules, 2008, notified vide

notification number PCH-HA (3) 25/2007 dated 4th September, 2008 and published in the

Rajpatra, Himachal Pradesh on 6th September, 2008, namely:-

Short title.—These rules may be called the Himachal Pradesh Panchayati Raj

(Appointment and conditions of service of Panchayat Sahayaks) Amendment Rules, 2011.

Amendment of rule. 3.—For rule 3 of the Himachal Pradesh Panchayati Raj

(Appointment and conditions of service of Panchayat Sahayaks) Rules, 2008 (hereinafter referred

to as the ‘said rules’), the following shall be substituted, namely : -

"3. Number of posts and their scales of pay.- (1) There shall be one post of Panchayat

Sahayak in every Gram Panchayat excluding such Gram Panchayat where there is already

appointed a Panchayat Secretary:

Provided that the Panchayat Sahayak may be appointed in such Gram Panchayat also where

there is already appointed a Panchayat Secretary, in view of the increased workload.

(2)

The reservation roster, as is applicable in the case of direct recruitment of the

employees of the State Government, shall be applied at the Panchayat Samiti level for providing

reservation to various categories of persons in the cadre of Panchayat Sahayaks.

(3)

The Panchayat Sahayaks shall be the employees of the Panchayat Samiti concerned

and their services shall be transferable, from one Gram Panchayat to another, within the area of the

Panchayat Samiti and the Executive Officer Panchayat Samiti shall be the competent authority to

issue such transfer orders.

(4)

The Panchayat Sahayak shall be paid remuneration at such rates as may be notified

by the State Government from time to time. The monthly remuneration shall be disbursed to the

Panchayat Sahayaks through the Executive Officer of the Panchayat Samiti concerned out of the

Grant-in-Aid provided by the State Government for this purpose:

Provided that the monthly remuneration to the Panchayat Sahayak will be disbursed only

after obtaining certificate of attendance from the Pradhan or Up-Pradhan, as the case may be, of the

concerned Gram Panchayat.".

Amendment of rule 6.—In rule 6 of the said rules,-

(a)

in sub-rule (1),-

(i)

after the words and sign "within the Panchayat Samiti area.", the

words and signs "or by any other mode. In addition, the vacancies

shall also be notified through the appropriate Employment

Exchange." shall be inserted; and

(ii)

the following proviso shall be added, namely:-

"Provided that the details regarding total number of vacancies to be

filled and number of vacancies reserved for various categories of

persons as per roster mentioned in sub-rule(2) of rule 3 shall be given

in the notice for inviting applications.";

(b)

in sub-rule(5),-

(i)

for Part (A), the following shall be substituted, namely:-

"(A) Educational Qualifications

(i) Percentage of marks in Ten plus Two :

to the maximum

(10+2) divided by 2.

(ii) Percentage of marks in BBA, BCA, BA, :

BSc (Non-medical), B-Com, Diploma in

(iii)

Parts (E), (F), (G) and (H) shall be deleted; and

(iv)

Part (I) shall be renumbered as Part (E) and in Part (E) so enumbered,

the following shall besubstituted, namely:-—

"(D) (i) in case candidate has done minimum six months : 3 Marks

diploma in computer.

(ii) in case candidate has done minimum one year : 5 Marks,"

diploma in computer.

and

(c)

in sub-rule (6) for the words "The Executive Officer", the words, brackets,

igures and sign "Subject to the provisions of sub-rule (2) of rule 3, the

Executive Officer" shall be substituted.
