further to amend the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-second Year of

the Republic of India as follows:—

Short title and commencement.—(1) This Act may be called the Himachal Pradesh

Municipal (Amendment) Act, 2011.

(2) It shall come into force on such date as the State Government may, by notification

published in the Official Gazette, appoint.

Amendment of section 2.—In section 2 of the Himachal Pradesh Municipal Act, 1994

(hereinafter referred to as the ‘principal Act’),—

(a) clause (1) shall be omitted .;

(b) after clause (6), the following new clause shall be inserted, namely :-

“(6-a). “cattle” means domestic animals and includes elephants, camels,

buffaloes, cows, oxen, horses, mares, geldings ponies, colts, fillies, mules, asses,

pigs rams, ewes, sheep lambs goats and kids;”; and

“(33-a) “ratable value “ shall mean ,—

(a) In the case of land, the ratable value shall be based upon per square metre of the

actual area of land multiplied by the unit area rate of tax and relevant factors

prescribed for the particular zone and in the case of building, the ratable value

shall be based upon per square metre of plinth area multiplied by unit area rate

of tax and relevant factor prescribed for the particular zone;

(b) for levy of tax on lands and buildings, the entire municipal area shall be divided

into different zones and each zone shall have relevant factors having different

values;

i.e (i) location (ii) occupancy (iii) age of building (iv)use of building and (v) type

structure. Each factor shall have different value for different zone as may

be determined by the municipality, from time to time; and

(d) the mode for levy, calculation and assessment of tax as per provisions of

this Act, which relates to the classification, usages of the buildings, or

apportionment of buildings, or vacant land and open spaces forming part of the

land and building shall be prescribed by bye-laws:

Provided that annual deduction of ten per cent on the ratable value of

building shall be allowed on account of repair and maintenance expenses

necessary for the maintenance of the building and a rebate of ten percent shall

also be allowed on the amount of tax, in case the amount of tax specified in the

bill is paid within fifteen days from the date of receipt of such bill, however, this

rebate shall not be applicable in the case of defaulters who are in arrear of tax.”

Amendment of section 34.—In section 34 of the principal Act, for the words and sign

“State Government may, for all or any of the municipalities” the words and sign “municipality

may” shall be substituted.

4. Amendment of section 57.—In section 57 of the principal Act,-

(a) for sub-section (4), the following sub-sections shall be substituted, namely :—

"(4) The Executive Officer or the Secretary, as the case may be, may, with the

prior approval of the standing committee, constituted under section 49 of this Act,

dispose of, by sale, lease or otherwise, any moveable or immovable properties

belonging to the municipality, by public auction:

Provided that the mode and condition precedent to the transfer of

immovable property, shall be governed by regulations or bye-laws made by the

municipality.

(4-a) The Executive Officer or the Secretary, as the case may be, shall maintain a

annual statement indicating the changes, if any, in the said inventory, in such

manner as may be prescribed by bye-laws, and shall place the same before the

municipality for consideration at the end of the year."; and

(b) in sub-section (5), after the words “Executive Officer”, the words and signs “or the

Secretary, as the case may be,” shall be inserted.

Substitution of section 65.—For section 65 of the principal Act, the following shall

be substituted, namely:—

“65 Rate of tax on lands and buildings.—(1) Save as otherwise provided in this Act,

the unit area rate of tax on lands and buildings within the municipal area shall be

between one per cent to twenty five per cent of the rateable value of land and building,

as may be determined by the municipality from time to time:

Provided that the municipality may exempt wholly or partially or levy lower rate

of tax on the lands and buildings or portion thereof, which is exclusively used for the

purpose of public worship and the area of vacant lands and buildings or portion thereof,

exclusively used for the purpose of public burial or as a cremation ground, or any other

place used for the disposal of dead.

(2) Such other tax, at such rates, as the State Government may, by notification, in each

case direct:

Provided that no tax shall be imposed under sub-section (2) unless an opportunity has been

given in the prescribed manner to the residents of the municipal area or to the affected parties

to file objections and the objections, if any, thus received have been considered.”.

Subsection of section 66.—For section 66 of the principal Act, the following section

shall be substituted, namely:—

“66. Fee, tolls and users charges.—The municipality may impose fee, tolls and user charges

for the services provided by it at such rate and in such manner as may be determined by the

municipality from time to time.”.

Amenment of section 69.—In section 69 of the principal Act, for sub-section (1), the

following sub-section shall be substituted, namely:—

“(1) The tax on consumption of electricity at the rate of one paise for every unit of

electricity consumed by any person with in the limits, of the municipal area shall be

collected by the Himachal Pradesh State Electricity Board set up under the Electricity

(Supply) Act, 1948, or by any other person, as the case may be, supplying electricity for

consumption in municipal limits and paid to the municipality concerned.”.

Omission of section 70 and 71.—Sections 70 and 71 of the principal Act shall be

omitted.

Amendment of section 79.—In section 79 of the principal Act, sub-section (2) shall

be omitted.

10. Insertion of new section 150-A.—After section 150 of the principal Act, the

following new section shall be inserted, namely:-

"150-A. Registration of cattle and maintenance of record thereof.— (1) Head of every

family shall be responsible to give or cause to be given, either orally or in writing, the

details of cattle owned by his family to the municipality within a period one month from the

commencement of the Himachal Pradesh Municipal (Amendment) Act, 2011, and

thereafter, every time as and when any charge in the number of cattle takes place by any

reasons.

(2) On receipt of the details of cattle under sub-section (1), the municipality shall register

cattle and shall maintain records thereof in such form as may be notified by the State Government:

Provided that the municipality may charge registration fee at such rate as may fixed by the

municipality.

(3) It shall be the duty of the municipality to assist the officials or persons engaged by

Animal Husbandry Department for applying appropriate identification mark on each cattle and to

maintain the record of identification.

(4) If any cattle with identification mark is found stray, the owner of the cattle shall be

identified by the municipality from the record maintained by it and such owner shall be liable to a

fine of five hundred rupees for the first offence and seven hundred rupees for subsequent offence

which shall be imposed by the municipality.

(5) If the municipality fails in identifying such stray cattle due to tempering with

identification mark or mutilation thereof, it shall report the matter to the In-charge of the nearest

Animal Husbandry Dispensary who shall lodge the stray cattle to the nearest Goshala.”.

11. Amendment of section 202.—In section 202 of the principal Act, the words "and

shall if so required by the State Government” shall be omitted.

12. Amendment of section 204.—In section 204 of the principal Act, in sub-section (1),

the words “if so required by the State Government shall” shall be omitted.

13. Amendment of section 214.—In section 214 of the principal Act, the words and sign

“and shall, if so required by the State Government” shall be omitted.

14. Amendment of section 216.—In section 216 of the principal Act, for the words “two

hundred rupees” and “ten rupees”, the words “five thousand rupees” and “one hundred rupees”

shall respectively be substituted.

15. Substitution of section 217.—For section 217 of the principal Act, the following

section shall be substituted, namely:—

“217. Supplemental provisions respecting bye-laws.-Any power to make bye-laws

conferred by this Act is conferred subject to the condition that bye- laws being made after

previous publication by the municipality, after having being published in Official Gazette

for inviting public objections:

Provided that State Government may cancel any such bye-law if found to be contrary

to the provisions of this Act or the rules made thereunder and thereupon the bye-law shall

cease to have effect.”.

16. Omission of sections 218 and 219.—Sections 218 and 219 of the principal Act, shall

be omitted.

17. Amendment of section 220.—In section 220 of the principal Act, in sub-section (2),

for the words “ten rupees”, the words “fifty rupees” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

Under Chapter-VI of Himachal Pradesh Municipal Act, 1994, there is substantive right to

levy taxes and fees and also the procedures to be followed in connection with recovery of taxes and

fees from the occupants of the lands and buildings within the limits of the municipality. The

property tax is the main source of revenue to all the Urban Local Bodies. At present the tax is

assessed on gross annual rent and where the gross annual rent of any land or building cannot be

determined the same is assessed on the cost of erection of building and the cost of land. The 13^th

Finance Commission is also of the firm view that all Urban Local Bodies should be enabled to levy

property tax and any hindrance in this regard must be removed. This will enable the Government to

avail the performance linked grants that are to flow w.e.f. 1.4.2011 to 31.3.2015 as per 13^th Finance

Commission dispensation. In order to simplify the procedure for assessment and levy of property

tax, the assessment has been proposed on accepted parameter i.e. location, occupancy, age of

building, use of building and type of structures, by taking into consideration the rateable value

based upon per square metre of the actual area of land and per square metre of plinth area of the

building. Further, penalty for contravention of bye-laws provided under section 216 is very nominal

as compared to the gravity of offence. Therefore, in order to ensure strict compliance of bye-laws,

it has been proposed to enhance the penalty. A new provision regarding registration of cattle and

maintenance of record thereof has also been proposed on the analogy of the Himachal Pradesh

Panchayati Raj Act, 1994. This has necessitated amendments in the Act-ibid.

This Bill seeks to achieve the aforesaid objectives.

(AS ASSENTED TO BY THE GOVERNOR ON 6TH APRIL, 2011)

ACT

to provide for abolition of provision for payment of Haq-Chuharam to Khewatdars,

Lambardars and Rakhas pursuant to the enforcement of the Himachal Pradesh Village Common

Lands (Vesting and Utilization) Act, 1974.

Whereas, under para 61 of the Forest Settlement Report of Kangra, written by Anderson,

the village community (Khewatdars) and servants (Rakha, Patwari and Lambardar) has got the

provision of payment of one-fourth share of the gross income from the sale of trees as voluntary

grant, to be divided among them;

And Whereas, this was not a malikana, paid in recognition of their proprietary rights in the

soil, but was a voluntary grant made to secure their interest and co-operation in forest conservancy;

And Whereas, this Haq-Chuharam system existed in five Forest Divisions of the Himachal

Pradesh i.e. Dharamshala, Dehra, Palampur, Nurpur and Hamirpur falling under the jurisdiction of

Kangra and Hamirpur Districts;

And Whereas, the share of Patwari was scrapped in 1948, when the post of Patwari was

declared as Government post and payment of share of the village communities (Khewatdars) was

scrapped in 1976, with the enforcement of the Himachal Pradesh Village Common Lands (Vesting

and Utilization) Act, 1974, vide which village common lands were vested in the Government free

from all encumbrances;

And Whereas, the payment of Haq-Chuharam to Lambardars was also stopped in 1976,

pending issuance of a policy decision, but due to some misconception in view of letter No.3-61/69-

SF-IV dated 10.07.1981, Rakhas continue to get their share as per Forest Settlement till date, but

this share is also required to be scrapped as they are not rendering any service in forest

conservation or protection or to the Forest Department;

Now, therefore, it has been decided to stop/abolish the share of Khewatdars and Lambardars

retrospectively from the year 1974-75, because they are not rendering any assistance in forest

conservancy.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-second Year of

the Republic of India as follows:—

Short title, commencement and extent.—(1) This Act may be called the Himachal

Pradesh Abolition of Payment of Haq-Chuharam Act, 2011.

(2) It shall and shall always be deemed to have come into force on the 1^st day of

April, 1974.

(3) It shall extend to the Kangra and Hamirpur Districts of Himachal Pradesh.

2. Definitions.—In this Act, unless the context otherwise requires ,—

(a) “Haq-Chuharam” means the one-fourth share of the gross income from the sale of

trees as indicated in para 61 of the Kangra Forest Settlement Report of

Anderson (1887), to be divided among proprietors i.e. Khewatdars and the village

servants i.e. Lambardars, Patwaris and Rakhas; and

(b) The words “Khewatdar”, “Lambardar” and “Rakha” shall have the same

meaning and expression as assigned to them in the Report on Forest Settlement of

the Kangra Valley.

3. Abolition of system of Haq-Chuharam.—With the vestment of shamlat lands with

the State Government under the Himachal Pradesh Village Common Lands (Vesting and

Utilization) Act, 1974, the Khewatdars, Lambardars and Rakhas have been left with no role

in forest conservancy and stand relieved of the duties and obligations towards the forest

conservation. The Khewatdars, Lambardars and Rakhas are not rendering any service to forest

conservation or to the Forest Department after the vestment of shamlat lands with the State

Government under the Himachal Pradesh Village Common Lands (Vesting and Utilization) Act,

1974, and shall not be entitled to any payment of Haq-Chuharam in pursuance of para 61 of

the Forest Settlement Report of Kangra Valley.

4. Vesting of Rights of Rakhas, Lambardars and Khewatdars in the Government.—

(1) All rights, titles and interests of the Khewatdars, Lambardars and Rakhas in respect of

conservancy and management of Forests, prior to the coming into force the Himachal

Pradesh Village Common Lands (Vesting and Utilization) Act, 1974, shall stand vested in

the State Government free from all encumbrances.

(2) The system of payment of Haq-Chuharam to the Rakhas shall stand abolished with

effect from 1^st April, 2010 and they shall stand relieved of the duties and obligations attached to

them and shall have no liability in this behalf.

(3) Notwithstanding anything contained in any law for the time being in force, or

any report or contract, decree or order of any court, the Khewatdars and Lambardars shall

not be entitled to any payment of Haq-Chuharam with effect from 1st April, 1974 and

they shall stand relieved of their duties and obligations attached to them and shall have no

liability in this regard.

5. Protection of action taken in good faith.—No suit, prosecution or other legal

proceeding shall lie against the Government or any employee of the Government, in respect

of anything which is in good faith done or intended to be done in pursuance of this Act.

THE HIMACHAL PRADESH TAX ON ENTRY OF GOODS INTO LOCAL AREA

(AMENDMENT) ACT, 2011

further to amend the Himachal Pradesh Tax on Entry of Goods into Local Area Act, 2010 (Act

No. 9 of 2010).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-second Year

of the Republic of India as follows:—

Short title and commencement.—(1) This Act may be called the Himachal Pradesh

Tax on Entry of Goods into Local Area (Amendment) Act, 2011.

(2) It shall be deemed to have come into force on 22^nd day of January, 2011.

Amendment of section 3.—In section 3 of the Himachal Pradesh Tax on Entry of

Goods into Local Area Act, 2010, (9 of 2010)(hereinafter referred to as the “principal Act”),—

(a) for sub-section (3), the following sub-section shall be substituted, namely:—

“(3) Every dealer who brings any goods into local area for use in manufacturing,

processing, conversion, job-work, assembling or packing of goods and such goods

sold inside the State otherwise than Value Added Tax sales or sent outside the State

otherwise than in the course of inter-state sale or in the course of export out of

territory of India, shall be liable to pay tax under this Act.”; and

(b) in sub-section (4), after clause (iii), the following new clause shall be inserted, namely:—

“(iii-a) in respect of goods specified in Schedule–II, which after entry into local area are

used or consumed in manufacturing, processing, conversion, job-work, assembling or

packing of goods and such goods are sent outside the State by way of sale in the course of

inter-state sale or in the course of export out of territory of India;”.

3. Insertion of new section 6-A.—After section 6 of the principal Act, the following new

section shall be inserted, namely:—

“6-A. Payment of tax and returns.— (1) Every registered dealer shall furnish monthly

return within 15 days from the expiry of such month and in such manner containing such

particular as may be prescribed.

(2) Before filing of return under sub-section (1), a dealer shall deposit full amount of tax due

on fortnightly basis for the period of preceding fortnight and shall furnish the proof of payment of

such tax to the Assessing Authority.

(3) If a dealer fails without sufficient cause to furnish the monthly returns under sub-section (1),

he shall be liable to pay, by way of penalty, a sum equal to Rs. 100 per day for delay in furnishing such

return upto ten days, where after the penalty shall be Rs. 500 per day till the default continues; provided

that where no tax is payable, such penalty shall not exceed Rs. 500 for every return.

(4) If a dealer fails without sufficient cause to comply with the requirements of provisions of

sub-section (2), the Commissioner or any other person appointed to assist him under sub-section (1)

of section 3 of Himachal Pradesh Value Added Tax Act, 2005, may, after giving such dealer a

reasonable opportunity of being heard, direct him to pay, by way of penalty, a sum equal to 50

percentum of the amount of tax due.”.

Amendment of section 7.—In section 7 of the principal Act, in sub-section (1), after

existing clause (c), the following new clause shall be inserted, namely:—

“(cc) the value of goods which after manufacturing, processing, conversion, job-work,

assembling or packing are sent outside the State in the course of inter-state sale or in the

course of export out of the territory of India;”.

5. Amendment of section 8.—In section 8 of the principal Act,—

(a) before the words “Where entry tax”, the signs and figure “(1)” shall be inserted; and

(b) after existing proviso to sub-section (1) as so renumbered, the following new sub-

section shall be inserted, namely:—

“(2) where entry tax has become payable on the value of goods specified in

Schedule-II and such goods are used in manufacture, processing, conversion, job-

work, assembling or packing and sent outside the State by way of inter-state sale or

in the course of export out of territory of India, the dealer shall be entitled to a set

off of tax under this Act proportionate to the turnover of Value Added Tax sales

made within State or inter-state sale or export out of territory of India.”.

Repeal of Ordinanance No. 1 of 2011 and savings.—(1) The Himachal Pradesh Tax

on Entry of Goods into Local Area (Amendment) Ordinance, 2011 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the Ordinance so

repealed shall be deemed to have been done or taken under the corresponding provisions of this Act.

No. Shram (B) 1-3/ 2005-Estt.—The Governor, Himachal Pradesh in exercise of the

powers conferred under section- 8 of the Industrial Disputes Act, 1947 (Act No. 14 of 1947) and in

consultation with the Hon’ble High Court, Himachal Pradesh is pleased to appoint Shri D. K.

Sharma, presently posted as Registrar (Subordinate Judiciary & Judicial), High Court of Himachal

Pradesh, Shimla as Presiding Officer of the Labour Court-cum-Industrial Tribunal, Shimla on

deputation basis with immediate effect. The period of deputation will be two years in the first

instance.

The deputation period will be governed on usual terms and conditions of deputation as

specified by the Hon’ble High Court vide their letter No. HHC/Admn. 28 (27) 80-1530 dated 7th

December, 1989.

The Governor, Himachal Pradesh is further pleased to relieve Sh. D. S. Khenal, Presiding

Officer, Labour Court-cum-Industrial Tribunal, Shimla to enabling him to join his further

assignment.
