HIGH COURT OF HIMACHAL PRADESH, SHIMLA

NOTIFICATION

Shimla, 26th April, 2011

No. HHC/CJ/Secy/PIL/2011.— In compliance wih the directions issued by the Hon’ble

Supreme Court of India, in Civil Appeal Nos.1134 and 1135 of 2002, titled State of Uttranchal vs.

Balwant Singh Chaufal & others, “The Himachal Pradesh High Court Public Interest

Litigation Rules, 2010” were framed and notified vide Notification No.HHC/Rules/PIL/2010,

dated 08.04.2010. Under Rule 3 of the Rules ibid, the petitions/complaints/ letters of the categories,

mentioned therein can be treated under the Public Interest Litigations and such letters sent to his

Lordship the Hon’ble Chief Justice by the aggrieved persons for redressal of their grievances, after

directions by the Hon’ble Chief Justice, are sent to the concerned authorities viz District Legal

Services Authorities(D.Js.), Heads of Departments to the Government of Himachal Pradesh and

Heads of the Offices in the State of Himachal Pradesh for looking into the matters/redressal of the

grievances of the concerned applicants/petitioners. This process is being done with a view to give

“access to justice” to those people who either are not in a position to approach the courts or in

whose cases the matters can be easily sorted out by the concerned authorities/ Departments. This

will also avoid an unnecessary and expansive litigation and will also reduce the docket expansion

in the Courts.

It has also been observed by his Lordship the Hon’ble Chief Justice that such

communications, sent to the concerned authorities by this High Court, are given secondary/

lackadaisical treatment either by delaying the action or not resorting to the action in the matter.

Therefore, I have been directed by the Hon’ble the Chief Justice to communicate that in

future such matters must be given the required priority and serious attention. In case any intentional

lapse is found, the matter will have to be taken up on judicial side and the Heads of the

Departments, Heads of the Offices, as the case may be, shall be answerable personally apart from

the liability as to costs.

Kindly acknowledge the receipt.

BY ORDER OF THE HCJ

BHAG CHAND SHARMA,

Registrar(Admn.)-cum-Principal,

Private Secretary to Hon’ble CJ.
