No. Per(AR)A(3)-17/2010.—In exercise of the powers conferred by proviso to clause (d) of

sub –section (2) of section 27 of the Right to Information Act, 2005, the Governor, Himachal

Pradesh, is pleased to make the Recruitment and Promotion Rules for the post of Driver, Class –III,

(Non-Gazetted) (Non Ministerial Services) in the Himachal Pradesh State Information

Commission, as per Annexure “A” attached to this notification, namely:-

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh State Information Commission, Driver, Class–III,(Non-Gazetted) (Non Ministerial

Services) Recruitment and Promotion Rules, 2011.

(2) These rules shall come into force from the Date of publication in the Rajpatra,

Himachal Pradesh.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF DRIVER

(NON-GAZETTED) CLASS-III, IN THE HIMACHAL PRADESH

STATE INFORMATION COMMISSION

Name of the post.— Driver

Number of post(s).— 03 (Three)

3. Classification.— Class-III (Non-Gazetted) (Non-Ministerial Services)

Scale of Pay.— (i) Pay scale for regular incumbent:

Pay Band `5910-20200 + `2000/- Grade Pay

(ii) Emoluments for contract employees `7,910/- as per details given

in Column 15-A.

Whether “Selection” post or “Non-Selection” post.—Not applicable

Age for direct recruitment.—Between 18 and 45 years

Provided that that upper age limit for direct recruits will not be applicable to the candidates

already in service of the Government including those who have been appointed on adhoc or on

contract basis;

Provided further that if a candidate appointed on adhoc basis or on contract basis had

become over-age on the date he / she was appointed as such he/she shall not be eligible for any

relaxation in the prescribed age-limit by virtue of his/ her such adhoc or contract appointment;

Provided further that upper age-limit is relaxable for Scheduled Castes/Scheduled

Tribes/Other categories of persons to the extent permissible under the general or special order(s) of

the Himachal Pradesh Government;

Provided further that the employees of all the Public Sector Corporations and Autonomous

Bodies who happened to be Government servants before absorption in Public Sector Corporations/

Autonomous Bodies at the time of initial of such constitutions of such Corporations/Autonomous

Bodies shall be allowed age concession in direct recruitment as admissible to Government servants.

This concession will not, however, be admissible to such staff of the Public Sector

Corporations/Corporations/Autonomous Bodies and who are/were finally absorbed in the service of

such Corporations/Autonomous after initial constitution of the Public Sector Corporations/

Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which

the post(s) is / are advertised for inviting application or notified to the Employment Exchanges or

as the case may be.

(2) Age and experience in the case of direct recruitment, relaxable at the discretion of the

Himachal Pradesh Public Service Commission in case the candidate is otherwise well qualified.

Minimum educational and other qualifications required for direct recruit(s): (a)

Essential Qualifications.—(i) Should be a Matriculate or its equivalent from recognized Board of

School Education / Institution.

(ii) Must possess valid driving license for plying of heavy/light vehicles in Hilly Terrain.

(b) Desirable Qualification(s).—Knowledge of customs, manners and dialects of

Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the

Pradesh.

Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age: Not applicable. Educational Qualification: Not

applicable.

Period of probation, if any.—Two years’ subject to such further extension for a

period not exceeding one year as may be ordered by the competent authority in special

circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion,

deputation, transfer and the percentage of post(s) to be filled in by various methods.—100%

by transfer failing which by direct recruitment on a regular basis or by recruitment on contract

basis, as the case may be. The contract employees will get emoluments as given in Column 15-A

and will be governed by service conditions as specified in the said column.

11. In case of recruitment by promotion, deputation, transfer, grade from which

promotion/deputation/transfer is to be made.—(i) By transfer from amongst the Drivers working

in the identical pay scales from other Himachal Pradesh Government Departments/Public Sector

Undertakings.

(ii) Notwithstanding anything contained in clause (i) of Column 11 supra, the incumbents

already taken on deputation shall be given option for absorption in the office of State Information

Commission, Himachal Pradesh and the incumbent who opts for absorption shall form initial cadre

of the above post and thereafter the method(s) of recruitment shall be resorted to as provided in

Column No.10 above.

12. If a Departmental Promotion Committee exists, what is its composition.—Not

applicable

13. Circumstances under which the H.P.P.S.C. is to be consulted in making

recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to

any service or post must be a citizen of India.

15. Selection for appointment to post by direct recruitment.—Selection for

appointment to the post in the case of direct recruitment shall be made on the basis of viva-voce

and practical test for driving and maintenance skill of the candidate. The Departmental Recruitment

Committee for practical test shall comprise of at least two persons from amongst Motor Vehicle

Inspector, A.E. Mechanical and Manager/Foreman of HRTC in addition to the nominee(s) of

appointing authority. Passing of practical test shall be mandatory.

15-A Selection for appointment to the post by contract appointment.—Notwithstanding

anything contained in these Rules, contract appointments to the post will be made subject to the

terms and conditions given below: -

(I)

CONCEPT.—(a) Under this policy the Driver in State Information Commission,

Himachal Pradesh, will be engaged on contract basis initially for one year; which may be

extendable on year-to-year basis.

Provided that the extension / renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS OUT OF THE PURVIEW OF HPSSSB/HPPSC—The State Chief

Information Commissioner, Himachal Pradesh after obtaining the approval of the Government to

fill up the posts on contract basis will advertise the details of the vacant posts in atleast two leading

newspapers and invite applications from candidates having the prescribed qualifications and

fulfilling the other eligibility conditions as prescribed in these Rules.

(II) CONTRACTUAL EMOLUMENTS.—The Driver appointed on contract basis will

be paid consolidated fixed contractual amount @`7,910/- per month (which shall be equal to

minimum of the pay band+grade pay). An amount of `240/- (3% of the minimum of pay

band+grade pay of the post) as annual increase in contractual emoluments for the subsequent

year(s) will be allowed if contract is extended beyond one year.

(III) APPOINTING / DISCIPLINARY AUTHORITY.—The State Chief Information

Commissioner, Himachal Pradesh, will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

contract appointment shall be made on the basis of viva-voce and practical test for driving and

maintenance skill of the candidate. The Departmental Recruitment Committee for practical test

shall comprise of at least two persons from amongst Motor Vehicle Inspector, A.E. Mechanical and

Manager/Foreman of HRTC in addition to the nominee(s) of appointing authority. Passing of

practical test shall be mandatory.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—

As may be constituted by the concerned recruiting authority i.e. the State Information Commission,

Himachal Pradesh from time to time.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as

per Annexure-B appended to these Rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid fixed

contractual amount @`7,910/- per month (which shall be equal to minimum of pay band+grade

pay). The contract appointee will be entitled for increase in contractual amount @`240/- (3% of the

minimum of the pay band+grade pay of the post) for further extended years and no other allied

benefits such as senior/selection scales etc. will be given.

(b) The service of the contract appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract appointee is

not found satisfactory.

Government/Registered Medical Practitioner. Women candidate pregnant beyond 12 weeks will

stand temporarily unfit till the confinement is over. The women candidate will be reexamined for

the fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart official at the

minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules &

Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this column.

16. Reservation.—The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Castes/Scheduled Tribes / Other Backward Classes/other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental-Examination.—Not applicable.

18. Powers to relax.—Where the State Government is of the opinion that it is necessary

or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with

the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with

respect to any Class or Category of person(s) or post(s).

Form of contract/agreement to be executed between the Driver and the Government of

Himachal Pradesh through State Chief Information Commissioner, H. P.

This agreement is made on this.............day of............in the Year.............Between

Shri/Smt.........S/o/D/o Shri............R/o..........Contract appointee (hereinafter called the FIRST

PARTY), AND The Governor of Himachal Pradesh through State Chief Information

Commissioner, H.P. (here-in- after the SECOND PARTY).

Whereas the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST

PARTY has agreed to serve as a Driver on contract basis on the following terms & conditions:-

That the FIRST PARTY shall remain in the service of the SECOND PARTY as a

Driver for a period of 1 year commencing on day of............... and ending on the day

of.............It is specifically mentioned and agreed upon by both the parties that the

contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand

terminated on the last working day i.e. on..........and information notice shall not be

necessary.

Provided that for extention/renewal of contract period of year to year basis the

concerned HOD shall issue a certificate that the service and conduct of the contract

appointee is satisfactory during the year and only then his/her period of contract is to

be renewed/extended.

The contractual amount of the FIRST PARTY will be Rs.7910/- fixed per month.

which the first party was engaged on contract.

Contractual Driver will be entitled for one day casual leave after putting in one month

admissible to the contractual Driver. He/She will not be entitled for Medical

Department (Elementary & Higher Education Departments) as under with immediate effect:-

OBJECTIVES :

To provide Part Time Water Carriers in Himachal Pradesh Government Schools

against vacancies or specifically created posts.

To empower the SMCs further by decentralization and involving SMCs to the

effective running of Govt. Schools .

To provide an opportunity for the unemployed youth of the Himachal Pradesh to work

in Govt. Schools of their villages located in or adjacent the jurisdiction of the Gram

Panchayats/Urban local bodies and earns a decent honorarium as well.

MODE OF APPOINTMENT :

The Deputy Director, Elementary/Higher Education will identify the schools which have the

vacancies. The Part Time Water Carriers will be recruited for the Govt. Schools so identified by the

Deputy Director, Elementary/Higher Education and approved by the Department and the

Government.

ADVERTISEMENT / NOTIFICATION OF VACANCIES :

School wise and Gram Panchayat/Urban local body wise notification of vacancies will be

done by the Deputy Director, Elementary/Higher Education after obtaining the approval from the

Government through the Directorate of Elementary/Higher Education. Copy of the notification will

be sent to the concerned SDO(C)/Chairman selection committee for inviting applications The

Chairman of selection committee will call applications for the recruitment against the post of Part

Time Water Carriers by advertising through the school notice boards and sending one copy to

Gram Panchayat.

APPLICATIONS :

The candidates will have to apply for appointment as Part Time Water Carriers on plain

paper, along with photocopies of certificates to the Head of concerned School who will compile all

the applications and send them to the Chairman of selection committee on or before the last date of

submitting the applications for the post of PTWC. The documents of the applicant shall be

compared with the originals at the time of interview. The candidates will have to paste one attested

passport size photograph on the application form.

INTERVIEW AND MARKS :

The selection committee shall judge the suitability of the candidates purely on merit.

The Chairman of the committee will keep complete record of the selection process.

ii)

The selection committee shall hold interviews by calling all the eligible candidates.

iii) Preference will be given to candidates who are from families without any member in

Govt. service.

iv) The selection will be purely specific to a particular school only.

In the interview marks shall be awarded to the candidates out of 30.

The distribution of marks shall as under:-

APPLICATION OF RESERVATION ROSTER :

Since this is a contractual engagement by the SMCs for a particular school and that too for a

specific period on a fixed remuneration, therefore, reservation roster is not applicable.

DECLARATION OF RESULT :

Based on all relevant certificates enclosed with the application, a merit list will be drawn up

and the person at the top will be offered appointment subject to the verification of all information

and certificates against the originals. Chairman of the selection committee will send his

recommendation to the President, SMC of the concerned school, for offering appointment to the

person at the top of merit list.

10.

APPOINTMENTS :

The appointment of the selected Part Time Water Carriers will be made on contractual basis

by the employer SMC after executing a proper agreement between the candidate selected for

appointment and the President SMC on the prescribed form of agreement at Annexure-I.

The job profile of the PTWC

The job profile of the PTWC will include:-

Availability of safe drinking water to the students.

ii)

Maintenance of cleanliness and hygienic conditions in the school premises, class

rooms and associated buildings of the school.

iii) Any other school related miscellaneous job assigned by the Incharge of the school,

School Management Committee.

11.

WAITING LIST :

For every selected candidate, a waiting list of two candidates will be prepared on merit. The

waiting list will be valid for one year after the selection process is over. Waiting list candidates may

be appointed if the selected candidate does not join or he/she leaves the job within one year of

appointment.

12.

COMPASSIONATE GROUND APPOINTMENTS :

The Government will have the power to appoint any candidate as Part Time Water Carrier

on compassionate ground without following the selection process if the candidates is below the

Poverty line or has a low income certificate issued by the Naib Tehsildar, Tehisldar, SDO(C) or

Executive Magistrate of the concerned area and if the candidates is a :-

Widow, or

ii)

Member of family living in extreme indigent conditions.

Family includes father, mother and their children. (This certificate will be issued not

below the rank of SDO (C); or

iii) Women deserted by the husband or otherwise destitute, or

iv) Handicapped persons; or

An orphan.

13.

WAGES/HONORARIUM :

The Part Time Water Carriers will be paid an honorarium of Rs. 1200/- per month for ten

months in an academic year, by the respective employer SMCs of the area out of the Grant- in-Aid

allocation made available by the State Government.

14.

AGE :

As prescribed by the Government from time to time. The age limits is to be reckoned on the

first day of the year in which the posts are advertised by the SMCs of the area. The relaxation in the

upper age limit in respect of categories of SCs/STs/OBCs etc. will also be admissible as per the

State Government norms.

15.

APPOINTING/ PUNISHING AUTHORITY :

The Part Time Water Carriers so recruited shall be contractual employees of the SMCs for

all intents and purposes. The appointing /punishing authority in respect of Part Time Water Carriers

will be the executive committee of SMC.

16.

ADMISSIBILITY OF CASUAL OR ANY KINDS OF LEAVE :

One casual leave will be admissible to the Part Time Water Carriers after putting in

one months continuous service. Total casual leave admissible to the Part Time Water

Carriers will not exceed 10 in a year. No other kind of leave will be admissible to the

Part Time Water Carriers.

ii)

Continuous absence beyond a week from the school with out approval of the employer

shall automatically lead to the termination of the services of the Part Time Water

Carriers. The part Time Water Carriers will not be entitled for any wages/ honorarium

for the period of absence.

17.

RIGHT TO CLAIM REGULAR APPOINTMENT :

The candidates appointed as Part Time Water Carriers under the scheme, by the respective

SMCs will have no right to claim regularization /absorption/ appointment as regular Class-IV

employees of the State Government.

The Government of Himachal Pradesh shall have the right to relax / amend any of the terms

& conditions/provisions mentioned in the above scheme in public interest.

18.

Repeal & Savings:

The recruitment scheme for the appointment of Part Time Water Carriers in Education

Department notified vide Notification No. EDN-CB(2)35/2006, dated 09-09-2009&

dated 28-2-2011 are hereby repealed.

ii)

Notwithstanding such repeal any appointment made or anything done or any action

taken under these schemes, so repealed shall be deemed to have been validly made,

done or taken.

ANNEXURE-I

FORM OF AGREEMENT TO THE EXECUTED BETWEEN SMCs AND PART TIME WATER

CARRIERS SELECTED UNDER PART TIME WATER CARRIER SCHEME, 2011

An agreement made this the _______________________________ day of _____________

in the year _________________ between ____________ (hereinafter called ‘the contractual worker

of the FIRST PART’ and the President SMC of the other part.)

Whereas the SMCs has engaged the party of the FIRST PART and the party of the FIRST

PART has agreed to serve as part time water carrier on the terms and conditions hereinafter

contained.

WHEREBY it is agreed as follows

That the PART TIME WATER CARRIER shall remain in the service of the

School/Institution, village_________________ Gram Panchyat_____________ for a period

commencing on the day of _____________ and ending on the day of _____________. It is

specifically mentioned and agreed upon by both the parties that the contract of employment of a

part of the FIRST PART shall ipso-facto stand terminated on the last working day on

____________ No formal notice/order by the party of the Second Part conveying the same shall be

necessary.

That the employee shall submit himself/herself to the order of the SMCs and of the

officers and the authorities under whom he/she may from time to time to be placed by the SMCs

and shall abide by the instruction issued by the SMCs and the Education Department from time to

time.

That he/she shall employ himself/herself efficiently and diligently and to the best of

his/her ability as Part Time Water Carrier and that he/she shall devote his/her time to the duties of

the service and shall not engage directly or indirectly in any trade/business or occupation on his/her

own account and that he/she shall not (except in case of accident or sickness certified by civil

surgeon/authorized medical officer) absent himself/herself from his/her said duties with-out having

obtained prior permission from the immediate officer. The Part Time Water Carrier will not be

entitled for any remuneration for the period of absence.

The service of the party on the FIRST PART shall terminate as follows:-

(i)

Automatically at the end of term given in the appointment letter.

(ii) By the SMC without previous notice, if the SMC is satisfied on medical evidence

before it, that the party of the FIRST PART is unfit and is likely for a considerable

period to continue unfit by reason of ill health for the discharge of his/her duties.

Provided always that the decision of the SMCs that the party of the FIRST PART is

likely to continue unfit shall be conclusively binding on the party of the FIRST PART

and thereupon his/her services shall be terminated.

iii) By the SMCs or its officers having proper authority without any previous notice, if the

part of the FIRST PART is on to be prima-facie guilty of any insubordination,

intemperance moral turpitude or other misconduct or of any branch or non-

performance of any of the provisions of these presents, or is otherwise found

unsuitable for the efficient performance of his/her duties.

iv) By one-month notice in writing given at any time during services under this agreement

either by the Part Time Water Carrier to the SMC or by the competent authority to the

Part Time Water Carrier.

Provided always that the SMC may pay the Part Time Water Carrier one month’s

remuneration in lieu of such notice, and there upon this agreement shall stand

terminated forthwith.

SMCs shall pay the Part Time Water Carriers as long as the employee shall remain on

contract and actually perform the duties assigned to him/her a consolidated remuneration of Rs.

1200/- per month No. other allowances shall be admissible.

In respect of any matter of which no provision has been made in this agreement or in

the Part Time Water Carriers Scheme, 2011 shall be dealt with as per the instruction issued by the

Govt. from time to time.

The Part Time Water Carriers shall have to execute the work assigned to him/her by

the competent authority other than his/her own duties in public interest.

It is expressly stated and agreed to by the part of the FIRST PART that any duration of

service under this agreement shall in no way give him/her any right to claim for absorption in

regular vacancies that exist or may arise in future in particular cadre.

NOTWITHSTANDING anything herein before contained in this agreement the Govt.

shall be free to make departure from the terms and conditions of this agreement in the exigencies of

public service or in public interest if the circumstances so warrant.

10 This offer of appointment is non governmental on a fixed remuneration and it does not

entitled him/her for any governmental scale.

11. FIRST PART shall have to furnish a declaration to the effect that he/she has not more

than one living spouse in case he/she is married.

12. FIRST PART will be required to take the prescribed oath of allegiance to the

constitution of India.

13. FIRST PART engagement is subject to character and antecedent being certified to be

good by two gazetted officers responsible persons not being its relatives.

14. FIRST PART will have to furnish attested copies of certificates in support of date of

birth, academic qualification etc. at the time of joining the contract.

15. FIRST PART will have to produce medical certificate of its fitness from a Govt.

Medical Officer before joining.

16. No TA/DA will be paid to FIRST PARTY for joining the contract. IN WITNESS

sub–section (2) of section 27 of the Right to Information Act, 2005, the Governor, Himachal

Pradesh, is pleased to make the Recruitment and Promotion Rules for the post of Personal

Assistant, Class–II, (Non-Gazetted) (Non Ministerial Services) in the Himachal Pradesh State

Information Commission, as per Annexure “A” attached to this notification, namely:-

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh State Information Commission, Personal Assistant, Class –II, (Non-Gazetted) (Non

Ministerial Services) Recruitment and Promotion Rules, 2011.

(2) These rules shall come into force from the Date of publication in the Rajpatra,

Himachal Pradesh.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF PERSONAL ASSISTANT

(NON-GAZETTED) CLASS-II, IN THE HIMACHAL PRADESH STATE INFORMATION

COMMISSION

Name of the post.—Personal Assistant

Classification.—Class-II (Non-Gazetted) (Non-Ministerial Services)

Period of probation, if any.—Two years’ subject to such further extension for a

period not exceeding one year as may be ordered by the competent authority in special

circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion,

deputation, transfer and the percentage of post(s) to be filled in by various methods.—100%

by promotion failing which on secondment basis.

11. In case of recruitment by promotion, deputation, transfer, grade from which

promotion / deputation /transfer is to be made.—(i) By promotion from amongst the Senior

Scale Stenographers having six years regular service or regular combined with continuous adhoc

service rendered, if any, in the grade failing which by promotion from amongst the Senior Scale

Stenographers having eleven years regular service or regular combined with continuous adhoc

service rendered, if any, in the grade combined as Senior Scale Stenographer and Junior Scale

Stenographer out of which two years essential service as Senior Scale Stenographer failing both on

secondment basis from amongst the incumbents of this post working in the identical pay scale from

other H.P. Government Departments/Public Sector Undertakings.

(ii) Notwithstanding anything contained in clause (i) of Column 11 supra, the incumbents

already taken on deputation shall be given option for absorption in the office of State Information

Commission, Himachal Pradesh and the incumbents who opt for absorption shall form initial cadre

of the above post and thereafter the method(s) of recruitment shall be resorted to as provided in

Column No. 10 above.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if

any, prior to regular appointment to the post shall be taken into account towards the length of

service as prescribed in these Rules for promotion subject to the condition that the adhoc

appointment/promotion in the feeder category had been made after following proper acceptable

process of selection in accordance with the provisions of R&P Rules.

Provided that in all cases where a junior person becomes eligible for consideration by virtue

of his/her total length of service (including the service rendered on adhoc basis, followed by regular

service/appointment) in the feeder post in view of the provision referred to above, all persons senior

to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and

placed above the junior person in the field of consideration;

Provided that all incumbents to be considered for promotion shall possess the minimum

qualifying service of at least three years’ or that prescribed in the R&P Rules for the post,

whichever is less;

Provided further that where a person becomes ineligible to be considered for promotion on

account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be

deemed to be ineligible for consideration for such promotion;

Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for

consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen

recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation

of vacancies in Himachal State Non-Technical Service) Rules, 1972 and having been given the

benefit of seniority there-under or recruited under the provisions of Rule-3 of the Ex-Serviceman

(Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having

been given the benefit of seniority there-under.

(2) Similarly, in all cases of confirmation, adhoc service rendered on the feeder post, if

any, prior to the regular appointment/promotion against such post shall be taken into account

towards the length of service, if the adhoc appointment/promotion had been made after proper

selection and in accordance with the provision of the R&P Rules.

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc

service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition? .—As

may be constituted by the Government from time to time.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making

recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to post by direct recruitment.—Not applicable

16. Reservation.—The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Castes /Scheduled Tribes/Other Backward Classes/other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not applicable

18. Powers to relax.—Where the State Government is of the opinion that it is necessary

or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with

the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with

respect to any Class or Category of person(s) or post(s).

ENTRY OPERATOR (NON-GAZETTED) CLASS-III, IN THE HIMACHAL PRADESH STATE

INFORMATION COMMISSION

Name of the post.—Clerk-cum-Data Entry Operator.

Number of post(s) .—2 (Two).

Classification.—Class-III (Non-Gazetted) Ministerial Services.

Scale of Pay.—i) Pay scale for regular incumbent:

Pay Band ` 5910-20200 + `1900/- Grade Pay.

ii)

Emoluments for contract employees ` 7,810/- PM as per details given in

Column 15-A.

5.—Whether “Selection” post or “Non-Selection” post.—Not applicable.

Age for direct recruitment.—Between 18 and 45 years.

Provided that that upper age limit for direct recruits will not be applicable to the candidates

already in service of the Government including those who have been appointed on adhoc or on

contract basis;

Provided further that if a candidate appointed on adhoc basis or on contract basis had

become over-age on the date he/she was appointed as such he/she shall not be eligible for any

Bodies who happened to be Government servants before absorption in Public Sector Corporations/

Autonomous Bodies at the time of initial of such constitutions of such Corporations/Autonomous

Bodies shall be allowed age concession in direct recruitment as admissible to Government servants.

This concession will not, however, be admissible to such staff of the Public Sector Corporations/

Corporations/Autonomous Bodies and who are/were finally absorbed in the service of such

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which

the post(s) is/are advertised for inviting application or notified to the Employment Exchanges or as

the case may be.

(2) Age and experience in the case of direct recruitment, relaxable at the discretion of the

Himachal Pradesh Public Service Commission in case the candidate is otherwise well qualified.

Minimum educational and other qualifications required for direct recruit(s) .—

(a) Essential Qualifications: i) Should have passed 10+2 Examination or its equivalent from a

recognized Board of School Education /University.

ii)

Diploma of atleast 06 months duration in Computer or its equivalent from a

recognized University or from an Institution duly recognized by the H.P. / Central Government.

(b) Desirable Qualification(s): Knowledge of customs, manners and dialects of Himachal

Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s) .—Age: Not applicable. Educational Qualification: Not

applicable.

Period of probation, if any.—Two years’ subject to such further extension for a

period not exceeding one year as may be ordered by the competent authority in special

circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion,

deputation, transfer and the percentage of post(s) to be filled in by various methods.—100%

by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be,

failing which on secondment basis. The contract employees will get emoluments as given in

Column 15-A and will be governed by service conditions as specified in the said column.

11 In case of recruitment by promotion, deputation, transfer, grade from which

promotion/deputation /transfer is to be made.—i) On secondment basis from amongst the Clerk-

cum-Data Entry Operators working in the identical pay scale from other H.P. Government

Departments /Public Sector Undertakings.

ii)

Notwithstanding anything contained in clause (i) of Column 11 supra, the incumbents

already taken on deputation shall be given option for absorption in the office of State Information

Commission, Himachal Pradesh and the incumbent who opts for absorption shall form initial cadre

of the above post and thereafter the method(s) of recruitment shall be resorted to as provided in

Column No.10 above.

12. If a Departmental Promotion Committee exists, what is its composition? .—Not

applicable.

13. Circumstances under which the H.P.P.S.C. is to be consulted in making

recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to

any service or post must be a citizen of India.

15. Selection for appointment to post by direct recruitment.—Selection for

appointment to the post in the case of direct recruitment shall be made on the basis of viva-voce test

if the Himachal Pradesh Public Service Commission or other recruiting authority, as the case may

be, so consider necessary or expedient by a written test or practical test, the standard/syllabus etc.

15-A Selection for appointment to the post by contract appointment.—Notwithstanding

anything contained in these Rules, contract appointments to the post will be made subject to the

terms and conditions given below: -

(I) CONCEPT.—(a) Under this policy the Clerk-cum-Data Entry Operator in State

Information Commission, Himachal Pradesh, will be engaged on contract basis initially for one

year; which may be extendable on year-to-year basis.

Provided that the extension/renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be renewed /extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPSSSB.—The State Chief Information

Commissioner, Himachal Pradesh after obtaining the approval of the Government to fill up the

posts on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal

Pradesh Subordinate Services Selection Board, Hamirpur.

Commissioner, Himachal Pradesh, will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of

contract appointment shall be made on the basis of viva-voce test or if considered necessary or

expedient by a written test or practical test the standard /syllabus etc. of which will be determined

by the concerned recruiting agency i.e. Himachal Pradesh Subordinate Services Selection Board,

Hamirpur.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—As

may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Subordinate Services

Selection Board, Hamirpur from time to time.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as per

Annexure-B appended to these Rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid fixed

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular counterpart official at the

minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules &

Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this column.

16. Reservation.—The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes / other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not applicable.

18. Powers to relax.—Where the State Government is of the opinion that it is necessary

or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with

the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with

respect to any Class or Category of person(s) or post(s).

Whereas the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST

PARTY has agreed to serve as a Clerk-cum-Data Entry Operator on contract basis on the following

terms & conditions:-

That the FIRST PARTY shall remain in the service of the SECOND PARTY as a

Clerk-cum-Data Entry Operator for a period of 1 year commencing on day of ______________ and

ending on the day of _______________. It is specifically mentioned and agreed upon by both the

parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand
