No. AHY-A(3)-1/2009-Part-I.—In exercise of the powers conferred by section 53 of the

Himachal Pradesh Para-veterinary Council Act, 2010 (Act No. 21 of 2010), the Governor of

Himachal Pradesh proposes to make the following rules for carrying out the purposes of the

aforesaid Act and the same are hereby published in the Rajpatra (Extra-Ordinary), Himachal

Pradesh, for the information of the general public, as required under sub-section (1) of section 53 of

the said Act.

If any person likely to be affected by these draft rules has any objection or suggestion to

make with regard to these draft rules, he may send the same to the Secretary (Animal Husbandry)

to the Government of Himachal Pradesh, Shimla-171002, within 30 days from the date of

publication of the same in the Rajpatra, Himachal Pradesh.

The objection (s) or suggestion (s), if any, received within the period specified above shall

be taken into consideration by the Government before finalizing the said rules, namely:-

DRAFT RULE

Short title.-These rules may be called the Himachal Pradesh Para-veterinary

Council Rules 2011.

Definitions.- (1) In these rules, unless the context otherwise requires,-

(a)

“Act” means the Himachal Pradesh Para-veterinary Council Act, 2010 (Act

No. 16 of 2011);

(b)

“Appendix” means the appendix appended to these rules;

(c)

“Form” means the form appended to these rules; and

(d)

“section” means a section of the Act.

(2)

All other words and expressions used in these rules but not defined shall have the

same meanings as have been respectively assigned to them in Act.

Terms and conditions before issue of a Essentiality Certificate by the State

Government regarding desirability and feasibility to establish Paraveterinary institution.—

(1) Every person or Para-veterinary institution shall for the purpose of obtaining permission under

section 19 submit to the Council a scheme in accordance with the provisions of the Act and these

rules.

(2)

Every person or Para-veterinary institution before submitting a scheme under sub-

rule (1) shall apply to the Government to obtain Essentiality Certificate accompanied by a non-

refundable processing fee to the tune of Rupees Ten Thousand in the shape of demand draft in

favour of Director Animal Husbandry, Himachal Pradesh payable at any bank at SHIMLA.

(3)

The Essentiality Certificate shall only be issued by the State Government in case

such person or Para-veterinary institution fulfills the following conditions, namely:-

(i)

the Para-veterinary institution shall own land either by in-heritance, purchase

or lease from the Government and construct building at its own cost within a

period of one year. However the course may be started on rental premises

conforming to other norms for the Paraveterinary institutions;

(ii)

no financial assistance/grant shall be given to the institution by the State

Government;

(iii)

the institution shall get affiliation from the Chaudhary Sarwan Kumar

Himachal Pradesh Krishi Viswavidyalaya, Palampur District Kangra;

(iv)

the institution shall get recognition from the Council;

(v)

the institution shall be established in accordance with the regulations and

guidelines laid down by the Council;

(vi)

the reservation of seats shall be as per State Government instructions issued

from time to time;

(vii) a minimum 70% staff of the institution shall be employed from amongst the

Himachali Bonafide candidates and in case it is not feasible to employ the

staff from amongst the HImachali Bonafide candidates, the prior approval of

the State Government shall have to be obtained;

(viii) all Class-III and IV staff of the institution shall be recruited from amongst

the Himachali Bonafide candidates ;

(ix)

after the recognition of the institution, its inspection shall be conducted

periodically after three years by the Council; provided in the case of

complaint, such inspections may be conducted at any time;

(x)

the admissions for all seats shall be regulated by the Council; (xi) the fee

structure for each institution shall be such as may be approved by the State

Government from time to time;

(xii)

admission of the students shall be made only after the fulfillment of all terms

and conditions laid down in this rule; and

(xiii) atleast 25% of the seats shall be reserved to the candidates belonging to

Himachal Pradesh.

Qualifying criteria to seek permission to establish a Para-veterinary

institution.-In addition to the terms and conditions laid down under rule 3, the eligible persons

shall comply with the provisions of the Act , rules and regulations made there-under and guidelines,

if any, issued by the Council and shall be eligible to apply for permission to establish a new

institution only if the following conditions are fulfilled:-

(i)

that the Para-veterinary education shall be one of the main objectives of the

applicant or institution;

(ii)

that the area of the plot of land as specified by the Council shall be owned by

the applicant or taken on lease from the State Government or from any other

person to set up the proposed institution. However the course may be started

initially on rental premises conforming to other norms for the institutions;

(iii)

that the essentiality certificate regarding the desirability and feasibility of

establishing the proposed institution at the proposed location has been

obtained from the State Government and that the adequate infrastructure

shall be available as per requirements of the Council;

(iv)

that consent of affiliation has been obtained by the applicant as required

under clause(iii) of rule 3;

(v)

that the applicant owns and manages necessary infrastructural facilities

capable of being developed into a teaching institution as determined by the

Council;

(vi)

that the institution shall admit the students only after the Council has

satisfied itself about the infrastructural and other facilities for starting

courses after receiving written permission from the State Government;

(vii) that the applicant has a feasible and time bound expansion programme to

provide additional infrastructural facilities as determined by the Council for the

purpose of up-gradation of the existing institution or establishment of new

institution or both, (viii) that the applicant has the necessary managerial and

financial capabilities to establish and maintain the proposed institution and its

ancillary facilities including a teaching veterinary hospital;

(ix)

that the applicant shall submit to the Council three years audit report with

regards to his/her financial status; and

(x)

that the institution shall give Bank guarantee to the tune of rupees five lakhs

in favour of the State Government, to be pledged with the Director, Animal

Husbandry Himachal Pradesh and to be enforced in case the institution has

not provided the required teaching facilities including man power and

equipments etc.

Forms and procedures.-Subject to the fulfilment of the eligibility and qualifying

criteria as laid down in rules 3 and 4 of these rules, a scheme for setting up of new institution shall

be submitted by the applicant in the following three parts:-

PART-A

This part of the scheme shall contain the following particulars about the applicant and

information regarding the desirability and prima-facie feasibility of setting up of a Para-veterinary

institution at the proposed location:-

(i)

Information regarding constitution of the institution within the terms of

reference of eligibility criteria;

(ii)

Information regarding basic infrastructural facilities and managerial and

financial capabilities of the applicant; and

(iii)

Information regarding availability of necessary certificates and consent as

proposed in the qualifying criteria.

PART-B

It shall contain detailed description of the proposed institution and shall be submitted in the

form of a detailed Techno-Economic Feasibility Report about the same with the following

particulars:-

(i)

name and address of the new institution;

(ii)

availability of trained manpower, desirability and prima-facie feasibility of

the institution at the proposed location;

(iii)

site characteristics and availability of external linkage; including topography,

plot size, permissible floor space index, ground coverage, building height,

road access, availability of public transport, electric and water supply,

sewage connection, telephone lines etc;

(iv)

educational programme; including annual intake of students, admission

criteria and method of admission; reservation and year-wise curriculum of

studies;

(v)

functional programme; including department-wise functional requirement

and room wise seating capacity;

(vi)

equipment Programme; including room-wise list of veterinary, scientific and

allied equipments, complete with schedule of quantities and specifications;

(vii) manpower Programme; including department-wise requirement of teaching

staff (full time), technical, administrative and ancillary staff, category-wise

recruitment criteria and salary structure etc. minimum as per State

Government scale;

(viii) building Programme; including building wise built up area of the institution,

staff and students hostel, administrative office, library, auditorium and other

infrastructural facilities such as cultural and recreational center, sports

complex etc.;

(ix)

planning and layout; including master plan of the institution complex, layout

plan, sections elevations and floor wise area calculations of the institution

etc.;

(x)

phasing and scheduling; including month-wise schedule of activities,

indicating commencement and completion of building, design, approvals of

local body; civil construction and equipment, recruitment of staff and phased

commissioning commensurate with the proposal to intake of students;

(xi)

project cost; including capital cost of land, building, plant and machinery,

veterinary, scientific and allied equipments, furniture, fixtures and

preliminary pre-operative expenses;

(xii) means of financing the project cost; including contribution of the applicant,

grants and donations, equity, loans and other sources, if any;

(xiii) revenue assumptions; including fee structure and estimated annual revenue

from various sources; and

(xiv) expenditure assumptions: including operating expenses and depreciation.

PART-C

This part shall contain detailed description of existing institution and the proposed

expansion scheme to upgrade the existing institution or to set up an additional institution or both to

coincide with the phased development of the proposed institutions. This part of the scheme shall

also be submitted in the form of a detailed Techno-Economic Feasibility Report about the existing

institution with following particulars:-

(i)

name and address of the existing institution;

(ii)

details about the existing institution and its ancillary building, including built

up area, architectural and layout plans, list of veterinary and allied

equipments, capacity and configuration of administrative services, and other

ancillary and sports services, category-wise staff strength etc.;

(iii)

details about the additional land for expansion of the existing Para-veterinary

institution or for setting up of a new institution including land particulars,

distance from the proposed educational institutions, plot size, authorized land

use, geography, soil conditions, road access, availability of public transport,

electric supply, water-supply, sewage connection, telephone lines etc.;

(iv)

building Programme; including details about addition of space, built-up area

of the institution, staff housing, staff and students hostel and other ancillary

building;

(v)

planning and layout; including upgraded master plan of the institution

complex or master plan of the proposed new institution, as the case may be

along with layout plans, sections, elevations and floor-wise area;

(vi)

equipment manpower Programme; including upgraded room-wise list of

veterinary and allied equipments, schedule of quantities and specifications:

(vii) upgraded manpower Programme; including category-wise distribution of

veterinary, Para-veterinary and other staff;

(viii) phasing and scheduling of the expansion scheme; including month-wise

master schedule of activities indicating commencement and completion of

building design, approval of local body; civil construction, hospital services,

provision of veterinary and allied equipments, recruitment of staff etc. to

commensurate with the development of the proposed institution;

(ix)

project cost of the expansion scheme; including additional cost of land,

building, veterinary and allied equipments, furniture and fixtures expenses:

(x)

means of financing the cost of expansion scheme; including contribution of

the applicant, grant and donation, equity, loans and other sources, if any;

(xi)

revenue assumptions; including details of income from various sources and

annual revenue; and

(xii) expenditure assumption; including operating expenses, financial expenses,

and depreciation.

Application form and fee.-The application under section 19 to seek permission to

establish an institution shall be submitted in Form-A either by registered post or in person to the

Registrar, and shall be accompanied with a fee of rupees five thousand in the form of a demand

draft drawn on a scheduled bank in favour of the Registrar. The fee to inspect the institution shall

be rupees twenty five thousand. The inspection fee shall be sent in the form of a demand draft

drawn on a Scheduled Bank in favour of the Registrar. Beyond one inspection, the normal

inspection fee shall be such as may be determined by the Council.

Registration.-(1) Application submitted under rule 6 if found complete in all

respects shall be registered by the Council for evaluation and recommendations. The registration of

the application shall only signify the acceptance of the application for evaluation. It shall however,

under no circumstances, mean approval of the application for grant of permission.

(2)

The period of one year specified under sub- section(6)of section 19 for processing of

an application for setting up of an institution shall commence from the date of registration of the

application by the Council.

(3)

Incomplete application shall not be registered and shall be returned by the Council

to the applicant.

Evaluation by the Council.-The Council shall evaluate Part-A of the application in

the first instance to establish the desirability and prima-facie feasibility of setting up the institution

at the proposed location and the capability of the applicant to provide the necessary sources and

infrastructure of the scheme.While evaluating financial status of the applicant, the Council may

seek further information/clarification or conduct additional inspection to verify the information.

Grant of permission.- (1) The Council may, issue a letter of intent to set up a new

institution with such conditions and modifications in the original proposal as may be considered

necessary. The formal permission may be granted after the aforesaid conditions and modifications

are accepted and the performance of bank guarantees of the bank of the required sum is furnished

by the applicant.

(2)

The formal permission may include time bound programme for the establishment of

the institution and expansion of the facilities. The permission may include a clear cut directions of

preliminary requirements to be met in respect of building, infrastructural facilities, veterinary and

allied equipment, facility and staff etc. before admitting the first batch of students. The permission

may also indicate annual targets to be achieved by the applicant to commensurate with the intake of

students during the following years.

(3)

The permission to establish a new institution and admit students may be granted

initially for a period of one year and may be renewed on yearly basis subject to verification of the

achievements of annual targets and revalidation of the performance of bank guarantees. The

process of renewal of permission may continue till such time the establishment of the institution

and expansion of the facilities are completed and formal recognition of the institution by the

Council is granted. Further admissions are liable to be stopped at any stage unless the requirements

for various steps of development are taken to the satisfaction of the Council.

(4)

The Council may obtain any other information from the proposed institution as it

deems fit and necessary.

10.

Application for registration of Para-veterinary establishment.-Every person

intending to run a Para-veterinary establishment under section 27 to render veterinary services

under the supervision and directions of registered veterinary practitioner shall make an application

in such form and accompanied by such fee as may be specified by the regulations made under the

Act for the registration of Para-veterinary establishment.

11.

Certificate of Registration of Para-veterinary Establishment.-(1) The certificate

of registration of Para-veterinary establishment shall be granted by the Registrar in Form-B, within

a period of three months from the date of submission of the application to the Council and the

period of three months to grant the certificate of registration of Para-veterinary establishment, shall

commence from the date of registration of the application by the Council. The certificate of

registration so granted shall be valid for a period of three years from the date of its issue are shall

be renewable on payment of such fee as may be specified by the regulations made under the Act.

(2)

Incomplete application shall not be registered and shall be returned by the Registrar

to the applicant.

(3)

Registration Certificate issued under sub-rule (1) shall be entered in the State

In computing the time limit of three months as specified under sub-rule (1), the time

taken by the authorities and applicant submitting the application, in furnishing any information/

clarification or additional documents called for by the Council shall be excluded.

12.

Terms and conditions for the registration of Para-veterinary Establishment.-

Every person intending to run a Para-veterinary establishment shall fulfill the following terms and

conditions for registration namely:-

(i)

he holds a recognized Para-veterinary qualification as provided in Schedule

to the Act;

(ii)

he resides or runs the Para-veterinary establishment within the State of

Himachal Pradesh;

(iii)

he is not less than twenty years of age;

(iv)

he is not an undischarged insolvent;

(v)

he is not of unsound mind;

(vi)

he has not been black-listed by any authority under any law for the time

being in force;

(vii) he has not been convicted of an offence under the Act or under any law

involving moral turpitude, or , if convicted a period of six years has elapsed

since his conviction;

(viii) he has not been dismissed from the service of a State Government or a State

undertaking or a local authority;

(ix)

he has submitted a written declaration as provided in Appendix-I to the

Registrar; and

(x)

he shall maintain the highest type of character and moral.

13.

Maintenance of Records.-(1) Every Para-veterinary Establishment shall maintain

and keep the records of all services provided under the supervision and direction of Registered

Veterinary Practitioner.

(2)

Every Para-veterinary Establishment shall keep the records of all services provided

as mentioned in sub-rule (1) in duplicate. First copy shall be given to the owner of the animal and

second copy shall be kept by the Para-veterinary establishment for at least five years or till the

inspection of the Para-veterinary establishment is caused to be made by the Council, which-ever is

earlier.

14.

Registration of Para-Veterinary Practitioner and renewal fees.-(1) Any person

who has qualified the course as approved by the State Government from time to time in Para-

veterinary subjects from the Training Centers of Animal Husbandry Department whether

temporarily or permanently established, from Private Institutions and Universities recognized by

the State Government shall be eligible for registration in the Council. The private Institutions and

Universities imparting this training shall have to be got registered with the Council.

(2)

The application under section 38 to register the Para-veterinary practitioner in a

State Register of Para-veterinary practitioners maintained under sub-section (2) of section 38 shall

be submitted in Form-D, either by registered post or in person to the Registrar and shall be

accompanied by a fees of rupees two hundred fifty only in the form of a bank draft drawn on any

Scheduled bank in the favour of the Registrar and attested copies of Certificate of Training issued

by the Animal Husbandry Department or Choudhary Sarwan Kumar, Himachal Pradesh Krishi

Vishwavidyala Palampur.

(3)

Certificate of Registration as Para-veterinary practitioner shall be issued by the

Registrar in Form-E and shall be valid for a period of three years from the date of its issue. No

person without registration shall either hold any office with the State Government, autonomous

bodies or practise anywhere in the State.

(4)

Every Para-veterinary practitioner registered under this rule shall renew his

certificate of registration after every three years on payment of fees of rupees one hundred only in

the form of bank draft drawn on scheduled bank in favour of the Registrar.

(5)

The application under sub- rule (4) to renew the certificate of Registration as a Para-

veterinary practitioner shall be submitted in Form-F either by registered post or in person.

also to answer all queries that be sent to him by the Registrar in regard thereto, in
