Himachal Pradesh Government Stock (securities) of 10-year tenure for an aggregate amount of

The proceeds of the State Government Securities will be utilized for the

development programme of the Government of Himachal Pradesh.

(ii)

Consent of Central Government has been obtained to the floatation of this

loan as required by Article 293 (3) of the Constitution of India.

Method of Issue

Government Stock will be sold through the Reserve Bank of India, Mumbai Office

(PDO) Fort, Mumbai-400 001 by auction in the manner as prescribed in paragraph

6.1 of the General Notification No.Fin-2-C(12)-11/2003, dated July 20, 2007 at a

coupon rate to be determined by the Reserve Bank of India at the yield based

auction under multiple price format.

Allotment to Non-Competitive Bidders

The Government Stock upto 10% of the notified amount of the sale will be allotted

to eligible individuals and institutions subject to a maximum limit of 1% of the

notified amount for a single bid as per the Revised Scheme for Non Competitive

Bidding Facility in the Auctions of State Government Securities of the General

Notification (Annexure-II).

Place and Date of Auction

The auction will be conducted by the Reserve Bank of India, at its Mumbai Office,

Fort, Mumbai-400 001 on October 4, 2011. Bids for the auction should be submitted

in electronic format on the Negotiated Dealing System (NDS) as stated below on

October 4, 2011.

(a)

The competitive bids shall be submitted electronically on the Negotiated

Dealing System(NDS) between 10:30AM and 12:30 PM.

(b)

The non-competitive bids shall be submitted electronically on the Negotiated

Dealing System (NDS) between 10:30 AM and 11:30 AM.

Result of the Auction

The result of the auction shall be displayed by the Reserve Bank of India at its

website on the same day. The payment by successful bidders will be on October

5, 2011.

Method of Payment

Successful bidders will make payments on October 5, 2011 before close of banking

hours by means of cash, bankers’ cheque/pay order, demand draft payable at

Reserve Bank of India, Mumbai/New Delhi or a cheque drawn on their account with

Reserve Bank of India, Mumbai(Fort)/New Delhi.

Tenure

The Stock will be of 10-year tenure. The tenure of the Stock will commence on

October 5, 2011.

Date of Repayment

The loan will be repaid at par on October 5, 2021

Rate of Interest

The cut-off yield determined at the auction will be the coupon rate percent per

annum on the stock sold at the auction. The interest will be paid on April 5 and

October 5.

Eligibility of Securities

The investment in Government Stock will be reckoned as an eligible investment in

Government Securities by banks for the purpose of Statutory Liquidity Ratio (SLR)

under Section 24 of the Banking Regulation Act, 1949. The stocks will qualify for

the ready forward facility.

No. EXN-F(10)-7/2011-Loose.—In exercise of the powers conferred by sub-sections (3),

(4) and (5) of section 13 of the Central Sales Tax Act, 1956 (Central Act No. 74 of 1956) and all

other powers enabling her in this behalf, the Governor of Himachal Pradesh is pleased to make the

following rules further to amend the Central Sales Tax (Himachal Pradesh) Rules, 1970, notified

vide this Department notification number 14-31/68-E&T, dated 03rd March, 1970 and published in

the Rajpatra Himachal Pradesh dated 26-03-1970, namely:-

Short title.—These rules may be called the Central Sales Tax (Himachal Pradesh)

First Amendment Rules, 2011

Insertion of Rule 2-A.—After rule 2 of the Central Sales Tax (Himachal Pradesh)

Rules, 1970 (hereinafter referred to as the ‘said rules’), the following rule shall be inserted,

namely:

“2-A. Application for e-Registration.—(1) If a dealer applies for e-registration under sub-

rule (4) of rule 3 of the Himachal Pradesh Value Added Tax Rules, 2005, he may also apply

for registration under sub-section (1) of section 7 and/or sub-section (2) of section 7 of the

Central Sales Tax Act, 1956, to the authority specified thereunder by filing Form-A

appended to the Central Sales Tax (Registration and Turnover) Rules, 1957 through the

official website of the Excise and Taxation Department, Himachal Pradesh.

after sub rule (1), the following sub-rule shall be inserted, namely:-

No. STE-F (4)-2/2008-III.—Whereas the Government of Himachal Pradesh vide

Notification No. STE-F(4)-2/2008-II dated 19.03.2011 has restricted all shopkeepers, vendors,

wholesalers, retailers, hawkers, rehriwala etc. including individual or institution/commercial

establishment to use and trade the plastic items such as disposable plastic cups, plates and glasses

which are made of non-biodegradable material as listed in the schedule to the H.P. Non-

biodegradable Garbage (Control) Act, 1995, with effect from 15.08.2011.

Whereas with reference to aforesaid ban, Shimla Vyopar Mandal and Kangra Polybags

Manufacturers and Sellers Union have in their representation urged the Government that some of

their members are trading in plastic items such as disposable plastic cups, plates and glasses and

that they have enough stocks of such items available. They have also stated that they have not been

able to find out alternative for the said plastic items. Accordingly they have requested to postpone

the enforcement of ban on use and trade of disposable cups, plates and glasses from 15.8.2011.

Whereas there are alternatives available for the said plastic items as environment-friendly

products are available in the market which are being used quite successfully. There is no denying

that in the begining the cost of such environment-friendly products may be higher than plastic

products, but the cost of these products would definitely come down by extensive use of it in large

quantities.

Nevertheless, on the request of Shimla Vyopar Mandal and Kangra Polybags Manufacturers

and Sellers Union, the Government of Himachal Pradesh has considered to postpone the fixed date

of aforesaid ban.

Now, therefore, in consideration of the aforesaid issue, the Governor, Himachal Pradesh, in

partial modification of Notification No. STE-F(4)-2/2008-II dated 19.03.2011 is pleased to notify

that the ban announced on the use and trade of plastic items.

Such as disposable plastic cups, plates and glasses which are made of non-biodegradable

material as listed in the schedule to the H. P. Non- biodegradable Garbage (Control) Act, 1995, will

take effect from 2nd October, 2011. (Gandhi Jayanti) instead of 15th August, 2011.
