petitioner were dispensed with without complying with the provisions of Industrial Disputes Act. It
is also alleged that while dispensing with the services of the petitioner, the principle of last come
first go was also not followed.
3.
The claim is opposed by the respondent on legal objections regarding
maintainability, locus standi and want of notice. On merits, it is stated that the respondent did not
engage the petitioner. Shri Dalip Singh S/o Shri Vijay Singh was not entered as a worker with the
respondent corporation. The respondent did not violate the provisions of section 25F and 25H of
the Industrial Disputes Act, 1947.
4.
On the pleadings of the parties, following issues were framed:-
1.
Whether the termination of services of Shri Dalip Singh petitioner by the
Commissioner, Municipal Corporation, Shimla and the Assistant Engineer (B&R)
Municipal Corporation, Shimla w.e.f. 4.12.2001 without complying the provisions
of the Industrial Disputes Act, 1947 is improper and unjustified as alleged?
. . OPP.
2.
If issue no.1 is proved, to what relief of service benefits and amount of
compensation, the petitioner is entitled to?
. .OPP.
3.
Whether the claim is neither competent nor maintainable in the present form?
. .OPR.
4.
Whether the petitioner has no locus standi to file the present petition as alleged?
. .OPR.
5.
Whether the claim is bad for non issuance of mandatory notice under section 392 of
H.P.M.C Act, 1994 as alleged?

Reasons for findings
Issue No.1.
6.
It is made out from the statement of petitioner Dalip Singh (PW-1) that he had
completed 240 days with the respondent during the period December, 2000 to December, 2001.
Copies of muster rolls Ex. RW-2/2 to Ex. RW-2/9, for the period December, 2000 to July, 2001 and
muster rolls Ex. PRA, Ex. PRB and Ex. PRC for the months of September, 2001 to December,
2001, make it amply clear that the petitioner had worked for 240 days in a calendar year.
7.
The status of the petitioner as having worked per muster rolls Ex. PRA, Ex. PRB
and Ex. PRC is also established from the testimony of the petitioner, his affidavit Ex. PW-1/B and
the evidence of RW-1 Shri N.S Chauhan who was posted as Junior Engineer with the respondent
corporation that the muster rolls were about the engagement of petitioner and clerical mistake about
recording name of his father as Shri Vijal Singh or Ujail Singh does not help the respondent. This
falsifies the case of the respondent that no such person worked with the respondent corporation
during this period. The petitioner has established on record that he had worked for more than 240
days in a calendar year, thus, he was entitled for the protection of section 25F of the Act. However,
since he was not served with one month’s notice, the retrenchment is bad in the eyes of law
entitling him to relief.
8.
Thus, it is evident that the petitioner had completed continuous service of 240 days
in a calendar year. The termination of the services of the petitioner by the respondent, without
notice and payment of compensation, in such circumstances, is in violation of the provisions of
section 25-F, of the Industrial Disputes Act. This issue is answered in favour of the petitioner.
Issue No.2
9.
The termination of services of the petitioner by the respondent as held in findings on
issue no.1 is illegal and unjustified and the petitioner is entitled to reinstatement in service
alongwith seniority and continuity. The petitioner is not entitled to back wages as he has not placed
any material on record to substantiate that he was not gainfully employed. This issue is partly
answered in favour of the petitioner.
Issue No.3.
10.
The petitioner as held on findings on issue no.1 is entitled to reinstatement. The
claim filed by him as such is maintainable. This issue is answered in favour of the petitioner.
Issue No.4.
11.
The petitioner was engaged by the respondent corporation and completed 240 days
in a calendar year. The petitioner, in such circumstances, has locus standi to maintain this petition.
This issue is answered against the respondent.
Issue No.5.
12.
The proceedings in this case have been initiated on a reference made by the State
Government about the termination of the petitioner from service by the respondent, therefore, the
provisions of section 392 of H.P Municipal Corporation Act, 1994 providing for prior notice on
Municipal Corporation is not applicable in this case, hence the petition is not bad for non issuance
of notice. This issue is answered against the respondent.

Relief.
In the result, the reference is answered in affirmative. Consequently, petitioner is held
entitled for reinstatement in service with seniority and continuity with effect from the date of his
termination but without back wages. Let a copy of this award be sent to the appropriate government
for publication in official gazette. File, after completion, be consigned to records.

AWARD
The following reference has been received from appropriate government for adjudication:
“Whether the action of the Management of Vivek International Public School, Housing
Board Colony, Phase-III, Baddi, District Solan H.P to terminate the services of Shri Ram
Lakhan S/o Shri Ram Ajour workman w.e.f. 14.1.2005 without conducting any domestic
enquiry and complying the provisions of the Industrial Disputes Act, 1947 is proper and
justified? If not, what relief of service benefits and amount of compensation the above
aggrieved workman is entitled to?”
2.
It is averred that the petitioner was employed as a gardener with the respondent. The
petitioner had completed 240 days in a calendar year. The services of the petitioner were illegally
terminated with effect from 14.1.2005 in violation of the provisions of section 25F of the Industrial

Disputes Act, 1947. The petitioner raised demand notice on 17.1.2005. The respondent after
termination of services made order of reference levelling unproved charges against the petitioner
and enquiry was initiated illegally.
3.
The claim is opposed by the respondent on legal objections regarding
maintainability and clean hands. . On merits, it is stated that the petitioner remained absent from
duties with effect from 10.5.2004 to 31.5.2004 and again with effect from 24.11.2004 to
14.12.2004 and then with effect from 14.1.2005 after misappropriating Rs. 4400/-. The petitioner
did not resume duties and enquiry was conducted for the misconduct against the petitioner. The
petitioner was dismissed from service after following due procedure.
4.
In rejoinder, the petitioner controverted the assertions made in the reply and
reaffirmed the averments of the petition.
5.
On the pleadings of the parties, following issues were framed:-
1.
Whether the action of the management of Vivek International Public school, Baddi
HP to terminate the services of petitioner w.e.f. 14.1.2005 wihout conducting any
domestic enquiry and complying the provisions of the Industrial Disputes Act, 1947
is improper and unjustified as alleged?

under:

Yes.
Issue No.2
Entitled for reinstatement with seniority and continuity in service but
without back wages.
Issue No.3
No.

Reference answered in affirmative per operative part of award.
Reasons for findings
Issue No.1.
7.
The enquiry conducted against the petitioner stands vitiated. The enquiry per show
cause notice dated 23.2.2005 Ex. R-1 came to be initiated against the petitioner for
misappropriating a sum of Rs. 4400/- and absence from duties for the period from 10.5.2004 to
31.5.2004 and 24.11.2004 to 14.12.2004. The respondent did not examine the accountant nor
produced account books before the enquiry officer to prove the charge of misappropriation of Rs.
4400/-. The misappropriation was not substantiated during the course of enquiry.
8.
On appraisal of Ex. MM-4, extract of working days of the petitioner for the month
of Jan., 2005, it is evident that the petitioner was initially marked present on 10.1.2005 to 12.1.2005
by putting “P” in the column. However, the record appears to have been tempered and the “P” has
been changed to “A” and the presence of the petitioner has not been entered after 13.1.2005. The
3696
jkti=] fgekpy izns'k] 22 vDrwcj] 2011@30 vkf'ou] 1933
tempering of the record by the respondent corroborates the testimony of the petitioner that he was
not allowed to join duties during the period from 14.1.2005 to 17.1.2005. On account of such fact,
the testimony of petitioner Shri Ram Lakhan as PW-1 that he was not allowed to join duties stands
substantiated. The services of the petitioner came to be terminated by the respondent illegally with
effect from 14.1.2005. This also speaks that the respondent wanted to terminate the services of the
petitioner by all means. In such circumstances, the respondent to cover up the fault initiated an
enquiry subsequently illegally and such enquiry does not legalize the illegality done by the
respondent.
9.
The enquiry officer had fixed 2nd July, 2005 as date of enquiry and the petitioner
had made a request for adjournment which request was not entertained and the petitioner was not
afforded any opportunity of being heard by the enquiry officer. On this score, the enquiry is wrong
and illegal. Thus, it is evident that the order terminating the services of the petitioner on all the
scores is illegal and void and against the principles of natural justice. This issue is answered in
favour of the petitioner.
Issue No.2
10.
The termination of services of the petitioner by the respondent is illegal and
unjustified and the petitioner is entitled to reinstatement in service alongwith seniority and
continuity. The petitioner is not entitled to back wages as he has not placed any material on record
to substantiate that he was not gainfully employed. This issue is partly answered in favour of the
petitioner.
Issue No.3.
11.
The petitioner as held on findings on issue no.1 is entitled to reinstatement. The
claim filed by him as such is maintainable. This issue is answered in favour of the petitioner.
