No. Per(AR)B(15)-1/2010-Vol-I.—Whereas the draft Himachal Pradesh Public Services

Guarantee Rules, 2011 were published in the Rajpatra, Himachal Pradesh dated 19/10/2011 vide

this Department notification of even number dated 17/10/2011 for inviting objection(s) or

suggestion(s) from the person(s) likely to be affected thereby within a period of 30 days from the

date of their publication;

And whereas the objection(s) or suggestion(s) received within the stipulated period have

been duly considered by the Government;

Now therefore, in exercise of the powers conferred by sub-section (1) of section 11 of the

Himachal Pradesh Public Services Guarantee Act, 2011, the Governor, Himachal Pradesh is

pleased to make the following rules, namely:-

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh Public Services Guarantee Rules, 2011.

(2)

They shall come into force from the date of their final publication in the Official

Gazette.

Definitions.— (1) In these rules, unless the context otherwise requires,—

(a)

“Act” means the Himachal Pradesh Public Services Guarantee Act, 2011;

(b)

“Form” means a form appended to these rules; and

(c)

“ section” means the section of the Act.

(2)

The words and expressions used in these rules but not defined shall have the same

meanings as respectively assigned to them in the Act.

Issuing of acknowledgement to the applicant.—(1) The designated officer or the

person authorized by him under sub-section (1) of section 5 shall acknowledge the receipt of the

application and if necessary documents have not been attached, the person receiving the application

shall mention the same in the acknowledgement in Form-I without any time limit:

Provided that where the application is complete in all respects, the person receiving the

application shall mention the time limit within which the application for providing service(s) shall

be disposed of.

(2)

The public holidays falling within the stipulated time limit to dispose of the

application for providing of service(s) shall be excluded for the computation of time.

Display of information on the notice board and official website.—The designated

officer shall cause to exhibit the information of the services to be provided on the official website

of his office as well as on the notice board of the office installed at a conspicuous place in Form-II

for the convenience of the general public.

Procedure in appeals before appellate authorities.—(1) The Memorandum to the

appellate authorities shall be filed in duplicate in respect of appeals to be filed before the first

appellate authority and in triplicate for appeals before the second appellate authority on a plain

paper without any fee and shall contain the following information, namely:—

(i)

name and address of the appellant;

(ii)

name and address of the designated officer against whose refusal to

acknowledge the application, or rejection of application, or non-providing of

services within the stipulated time limit the first appeal has been filed;

(iii)

name and address of the first appellate authority against whose decision the

second appeal has been filed;

(iv)

if the appeal has been filed against the non- issuance of acknowledgement by

the designated officer the date of making application and the name and

address of the designated officer to whom the application was made;

(v)

Copy of order if any, against which the appeal is filed;

(vi)

the grounds for appeal;

(vii) prayer or relief sought;

(viii) verification by the appellant; and

(ix)

any other relevant information which the appellant may like to furnish.

(2)

The following documents shall be annexed with every application for appeal,

namely:—

(a)

self attested copy of the order against which appeal is filed;

(b)

the copies of the documents mentioned in the application for appeal; and

( c)

the index of the documents annexed with the appeal.

Procedure for hearing and disposal of appeal(s).—(1) The first and second

appellate authorities for the disposal of appeal:—

(a)

shall examine the relevant documents, public records or their copies;

(b)

if need be, may authorize any officer to inquire into the matter and to submit

to it a report in relation to the findings thereon; and

(c)

may examine the appellant or / and the designated officer or first appellate

authority as it deems fit.

(2)

Where the first or second appellate authority calls for any official record from the

designated officer or the first appellate authority in case of second appeal, it shall return the original

record within ten days to the concerned officer or authority after retaining the requisite copies of

the same.

Service of notice of hearing by the appellate authorities.—(1) The appellate

authority may cause service of notice of hearing to the parties in any of the following manners,

namely:—

(i)

by issuing directions to appellant personally ; or

(ii)

by registered post with acknowledgement due; or

(iii)

through the concerned designated officer.

(2)

The parties shall be given prior notice of at least seven days before the date of

hearing.

(3)

The parties may appear in person or may depute their representatives to argue their

case at the time of hearing before the appellate authorities.

Where either of the parties fails to appear in person or through their representative at

the date of hearing the appellate authorities shall decide the matter purely on merit exparte.

Orders in appeal.—In deciding the appeals the following procedure shall be

adopted, namely:—

(a)

the orders shall be made publically and shall be recorded in writing and duly signed

by the first appellate authority or the second appellate authority, as the case may be;

(b)

the copies of the orders passed by the first appellate authority shall be supplied to

the designated officer and the appellant free of cost;

(c)

the copies of the orders passed in second appeal shall be supplied to the appellant,

designated officer and the first appellate authority; and

(d)

in case the second appellate authority imposes a penalty under section 8, it shall

endorse a copy of the order to the concerned:—

(i)

Drawing and Disbursing Officer with the direction to effect recovery of the

Amount of penalty imposed on the designated officer or any other officer as

per directions contained in the said order.

(ii)

Appointing/Disciplinary Authority if a disciplinary action has been proposed

in the order under the applicable service rules.

Deposit of the penalty amount.—(1) If compensation has been ordered to be paid

to the appellant, the amount of penalty shall firstly be utilized for the payment of compensation to

the appellant and if there remains any residue amount of penalty after the payment of

compensation, it shall be dealt with as per sub-rule (2).

(2)

The amount of penalty imposed under section 8 shall be deposited in the appropriate

Government treasury under the Head of account “0070-Other Administrative Services, 60-Other

Services, 800-Other receipts, 13-Penalty and fine under HP Public Services Guarantee Act, 2011”.

Records to be maintained by the designated officer and the appellate

authorities.—The designated officer and first and second appellate authorities shall maintain the

records of application received and the appeal filed in registers maintained in Forms-III, IV and V

Education & Research, Himachal Pradesh on the following terms and conditions :-

That the post is temporary but likely to continue/become permanent.

(b)

she will be on probation for a period of two years and during the period of

probation her services can be terminated at any time without giving any

notice. After completion of the probation period, the appointment can be

terminated at any time by giving one month’s notice or pay in lieu thereof by

the appointing authority without giving any reasons.

(c)

Other conditions of service will be governed by the relevant rules and orders

in force from time to time.

(d)

The appointment carries liability to serve in any part of India/Himachal

Pradesh including the Defence at the time of emergency.

allowance as admissible under the rules will be paid to him.

(g)

The appointment is also subject to the verification of character antecedents,

which will be got verified later on. In case the character antecedents are not

found satisfactory, the services shall be liable to be terminated without

giving any notice.

(h)

If the above doctor is in regular service of State Government, her pay shall

be fixed as per provision of the relevant rules and regulations in force.

(i)

It shall be mandatory to become member of HPGIS w.e.f. 1.4.2012.

The appointment will also be further subject to the production of the following

certificates/declarations:-

(i)

Certificate of fitness by the Medical Board of CMO, DDU Hospital,

Shimla-1, if not already produced ( only in case of in service candidates).

The fresh appointee is required to furnish this certificate.

(ii)

Declaration that she/he has only one living wife.

(iii)

Taking of an oath of allegiance/faithfulness to the Constitution of India on

making a solemn affirmation to that effect.

If the appointee accept the offer of appointment on the above terms and conditions,

he/she after having been declared medically fit by a Medical Board should report for

duty to the Principal, IGMC, Shimla within a period of 15 days, failing which the

offer of appointment shall be treated as cancelled.

No traveling allowance shall be allowed for joining the appointment.

Shimla-2, the 22nd September, 2011

No. Health-A-A(3)-84/96.—In exercise of the powers conferred by proviso to Article 309

of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal

Pradesh Public Service Commission, is pleased to make the following Rules further to amend the

H.P. Department of Health & Family Drug Inspector, Class II (Gazetted) Recruitment and

Promotion Rules, 2001 notified vide this Department Notification of even number dated 18.3.2001,

namely :-

Short title and commencement.—(1) These Rules may be called the Himachal

Pradesh, Department of Health and Family Welfare Drug Inspector Class II (Gazetted),

Recruitment and Promotion(2nd Amendment) Rules, 2011.

These Rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

Amendment of Annexure-A.—In Annexure-A to the Himachal Pradesh,

Department of Health & Family Welfare, Drug Inspector Class-II (Gazetted) Recruitment and

Promotion Rules, 2001:-

(a)

For the existing provision against column No. 2 the following shall be substituted,

namely:-

“16 ( Sixteen)”

(b)

For the existing provision against column No. 4 the following shall be substituted,

namely:-

“ (i)

Scale of Pay for regular incumbents:

Pay Band Rs.10300-34800+Rs 4200 Grade Pay

(ii)

Emoluments for contract employees

Rs.14500/- P.M. as per details given in Col. No.15-A”

(c)

For the existing title of Column No.10 the following shall be substituted, namely:-

“Method of recruitment”-whether by direct recruitment or by promotion ,deputation,

transfer and the percentage of posts to be filled in by various methods;”

(d)

For the existing provision against column No. 10, the following shall be substituted,

namely:-

“ 100% by direct recruitment on a regular basis or by recruitment on contract basis

as the case may be. The contract employee(s)will get emoluments as given in Col.

15-A and will be governed by service conditions as specified in the said column”

(e)

After Column No.15, a new column No.15-A shall be inserted as under :-

Notwithstanding anything contained in these rules, contract appointments to the post

will be made subject to the terms and conditions given below :-

Concept.—(a) Under this policy, the Drug Inspector in the Health department will

be engaged on contract basis initially for one year, which may be extendable on year to year –basis:

Provided that for extension/ renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his period of contract is to be extended /renewed.

(b)

POST FALLS WITHIN PURVIEW OF HPPSC.—The Secretary (Health) to the

Govt. of H.P. after obtaining the approval of the Government to fill up the vacant posts on contract

basis will place the requisition with the concerned recruiting agency i.e. H.P. Public Service

Commission.

(c)

The Selection will be made in accordance with the eligibility conditions prescribed

in these Rules.

II.

CONTRACTUAL EMOLUMENTS.—The Drug Inspector appointed on contract

basis will be paid consolidated contractual amount @ Rs.14500/- P.M. (which shall be equal to

minimum of the pay band +Grade pay). An amount of Rs.440 /- (3% of the minimum Pay Band+

Grade Pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will

be allowed if contract is extended beyond one year.

III.

Appointing /Disciplinary authority.—The Secretary (Health) to the Govt. of

Himachal Pradesh will be appointing and disciplinary authority.

IV.

Selection process.—Selection for appointment to the post in the case of Contract

Appointment will be made on the basis of viva-voce test or if considered necessary or expedient by

a written test or practical test the standard/syllabus etc. of which will be determined by the

concerned recruiting agency i.e. H.P. Public Service Commission Shimla.

COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.-

As may be constituted by the concerned recruiting agency i.e. H.P. Public Service Commission

from time to time.

VI.

Agreement.—After selection of a candidate he/she shall have to sign an agreement

as per Annexure-B appended to these Rules.

VII. Terms and Conditions.—(a) The contractual appointee will be paid fixed

contractual amount @ 14500/- per month (which shall be equal to minimum of the pay band +

grade pay). The contract appointee will be entitled for increase in contractual amount @ Rs.440/-

(3% of minimum of the pay band+grade pay of the post) for further extended years and no other

allied benefits such as senior/ selection scales etc. will be given.

(b)

The service of the Contract appointee will be purely on temporary basis. The

appointment is liable to be terminated in case the performance/conduct of the contract appointee is

not found satisfactory.

(c)

Contractual appointee will be entitled for one day casual leave after putting one

month service. This leave can be accumulated upto one year. No leave of any other kind is

admissible to the contract appointee. He/she will not be entitled for Medical Reimbursement and

LTC etc., only maternity leave will be given as per Rules.

(d)

Unauthorized absence from the duty without the approval of the controlling Officers

shall automatically lead to the termination of the contract. Contract appointee shall not be entitled

for contractual amount for the period of absence from duty.

(e)

An official appointed on contract basis who has completed five years tenure at one

place of posting will be eligible for transfer on need based basis wherever required on

administrative grounds.

(f)

Selected candidate will have to submit a certificate of his/her fitness from a

Government /Registered Medical Practitioner. The women candidate pregnant beyond twelve

weeks will stand temporarily unfit till the confinement is over. The women candidate will be re-

examined for the fitness from an authorized medical officer/ practitioner.

(g)

Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular official at the minimum of pay

scale.

(h)

Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules &

Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointee. They will be entitled for emoluments etc. as detailed in this Column.

the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal

Pradesh Public Service Commission, is pleased to make the Recruitment & Promotion Rules for the

post of Radiographer Class III (Non-Gazetted), in the Department of Health & Family Welfare,

Himachal Pradesh as per Annexure –A attached to this notification, namely :—

1. Short title and commencement.—(1) These Rules may be called the Himachal

Pradesh, Department of Health & Family Welfare, Radiographer Class III (Non-Gazetted),

Recruitment and Promotion, Rules, 2011.

(2) These Rules shall come into force from the date of publication in the Rajpatra, Himachal

Pradesh.

repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action

taken under the rules, so repealed under sub-rule(i) supra shall be deemed to have been validly

made or done or taken under these rules.

Provided that the upper age limit for direct recruits will not be applicable to the candidates

already in service of the Government including those who have been appointed on adhoc or on

contract basis;

Provided further that if a candidate appointed on adhoc basis or contract basis had become

overage on the date when he was appointed as such he shall not be eligible for any relaxation in the

prescribed age limit by virtue of his such adhoc or contract appointment ;

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/

other categories of persons to the extent permissible under the general or special order(s) of the

Himachal Pradesh Government;

Provided further that the employees of all the Public Sector Corporations and Autonomous

Bodies who happened to be Government Servants before absorption in Public Sector

Corporations/Autonomous Bodies at the time of initial constitutions/of such Corporations/

Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to

Government servants. This concession will not, however, be admissible to such staff of the Public

Sector Corporations/Autonomous Bodies who were/are subsequently appointed by such

Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such

Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/

Autonomous Bodies;

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which

the post(s) is/are advertised for inviting applications or notified to the Employment Exchanges or as

the case may be.

(2) Age and experience in the case of direct recruitment relaxable at the discretion of the

Himachal Public Service Commission in case the candidate is otherwise well qualified.

7. Minimum educational and other qualifications required for direct recruits.—

(a) Essential Qualification.—(i) 10+2 in Science or its equivalent from a recognized

University / Board.

(ii) One year Diploma in Radiology from an Institution recognized by State Government.

B.Sc. Degree in Radiology from Himachal Pradesh University or equivalent.

Preference will be given to person holding graduate degree in Radiology.

(b) Desirable Qualifications.—Knowledge of customs, manners and dialects of Himachal

Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualifications prescribed for direct recruits will

apply in the case of the promotee(s).—Age.—Not applicable.

Educational-Qualification.—Not applicable.

9. Period of probation, if any.—Two years’ subject to such further extension for a

Period not exceeding one year as may be ordered by the competent authority in special

circumstances and reasons to be recorded in writing.

10. Method of recruitment, whether by direct recruitment or by promotion,

deputation, transfer and the percentage of posts to be filled in by various methods.—100% by

direct recruitment on a regular basis or by recruitment on contract basis as the case may be. The

contract employees will get emoluments as given in Col. 15-A and will be governed by service

conditions as specified in the said column.

11. In case of recruitment by promotion, deputation, transfer, grades from which

promotion/deputation transfer is to be made.—Not Applicable.

12. If a Departmental Promotion Committee exists, what is its composition? .—Not

Applicable.

13. Circumstances under which the Himachal Pradesh Public Service Commission is

to be consulted in making recruitment.—As required under the law.

14. Essential requirement for direct recruitment.—A candidate for appointment to any

service or post must be a citizen of India.

15. Selection for appointment to post by direct recruitment.—Selection for

appointment to the post in the case of direct recruitment shall be made on the basis of vivavoce test

if the Himachal Pradesh Public Service Commission or other recruitment authority so consider

necessary or expedient by a written test or practical test, the standard /syllabus etc. of which, will

be determined by the Commission/other recruiting authority, as the case may be.

15-A.

Selection for appointment to the post by contract appointment.—

Notwithstanding anything contained in these rules, contract appointments to the post will be made

subject to the terms and conditions given below:—

(I) CONCEPT.—(a) Under this policy, the Radiographer in the Health & Family Welfare

Department will be engaged on contract basis initially for one year, which may be extendable on

year to year basis:

Provided that for extension/ renewal of contract period on year to year basis the concerned

HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory

during the year and only then his/her period of contract is to be renewed/extended .

(b) Post falls within purview of HPSSB.—The Director of Health Services after obtaining

the approval of the Govt. to fill up the vacant posts on contract basis will place the requisition with

the concerned recruiting agency i.e. H.P. Subordinate Services Selection Board, Hamirpur.

CONTRACTUAL EMOLUMENTS.—The Radiographer appointed on contract basis

will be paid consolidated contractual amount @ ` 8910/- P.M. (which shall be equal to minimum

the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed if

contract is extended beyond one year.

IV. SELECTION PROCESS.—Selection for appointment to the post in the case of Contract

appointment will be made on the basis of viva-voce test or if consider necessary or expedient by a

written test or practical test the standard/syllabus etc. of which will be determined by the concerned

recruiting agency i.e. H.P. Subordinate Services Selection Board, Hamirpur.

V. COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—As

may be constituted by the concerned recruiting agency i.e. H.P. Subordinate Services Selection

Board, Hamirpur.

VI. AGREEMENT.—After selection of a candidate he/she shall have to sign an agreement

as per Annexure-“B” appended to these Rules.

VII. Terms and Conditions.—(a) The contractual appointee will be paid fixed contractual

amount @ ` 8910/- per month (which shall be equal to minimum of the pay band + grade pay). The

for the fitness from an authorized medical officer/practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection

with his/her official duties at the same rate as applicable to regular official at the minimum of pay

scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules &

Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of

contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

16. Reservation.—The appointment to the service shall be subject to orders regarding

reservation in the service for Scheduled Castes/Scheduled Tribes/Others Backward Classes/ other

categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not Applicable.

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or

expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with

the Himachal Pradesh Public Service Commission, relax any of the provisions of these Rules with

respect to any class or category of persons or posts.

Panchayat Sarkaghat, specified in Schedule ’A’ of this Department notification of even number

dated 18-8-2010 was published in the Rajpatra, Himachal Pradesh (ordinary), dated 20-8-2010 for

inviting objections of the affected persons through Deputy Commissioner, Mandi within six weeks

from the date of publication of the said notification;

And whereas the objections received with-in the specified period alongwith the

recommendations of the Deputy Commissioner, Mandi have been considered and decided by the

State Government;
