NOTIFICATION
Shimla-2, 30st January, 2012
No. HFW-B(A)2-8/2003.—Whereas the draft Himachal Pradesh Para Medical Council
(General) rules, 2007 were published in the Rajpatra, Himachal Pradesh (Extra-Ordinary) on
19.9.2007 for inviting objections and suggestions from person likely to be affected thereby vide
notification of even number dated 16.8.2007 as required under section-53 of the Himachal Pradesh
Para Medical Council Act, 2003, within a period of 30 days from the date of publications ;
And, whereas no objection/suggestion has been received in this behalf from general public
on the said draft rules during the stipulated period;
Now, therefore, in exercise of the powers conferred by section-53 of the Himachal Pradesh
Para Medical Council Act, 2003, the Governor of Himachal Pradesh is pleased to make the
following rules, namely:-
“RULES”
1.
Short title.— These rules may be called the Himachal Pradesh Paramedical Council
(General) Rules, 2011.
2.
Definitions.—(1) In these rules, unless the context otherwise requires ,-
(a)
“Act” means the Himachal Pradesh Paramedical Council Act, 2003 (Act No.21 of
2003 );
(b)
“Appendix” means the appendix appended to these rules ;
(c)
“Council” means the Himachal Pradesh Paramedical Council established under
section 3 of the Act ;
(d)
“Form” means the form appended to these rules;
(e)
“rules” means the Himachal Pradesh Paramedical Council (General)Rules,2011 ;
(f)
“Registrar” means the Registrar of the Council; and
(g)
“State Government ” means the Government of Himachal Pradesh.
(2)
All other words and expressions used in these rules but not defined shall have the
same meanings as have been respectively assigned to them in the Act.
3.
Eligibility criteria to establish paramedical institutions.-(1) No diploma in
Medical Laboratory Technology and in Medical Radiology Technology (DMLT/DMRT) Courses
shall be started in Private Sector :
Provided that if the State Government so decides such courses shall be allowed in private
partnership (PPP) mode or in private sector subject to the condition laid down for the purpose
separately .
2.
The following organizations shall be eligible to apply for permission to establish
paramedical institutions within the State of Himachal Pradesh subject to overall policy notified by
the Government in this regard:

(a)
State Government/Union Territories and Universities established by law enacted by
Parliament or State Legislature;
(b)
Autonomous Bodies constituted by Central or State Government;
(c)
Societies registered under the Societies Registration Act,1860 or corresponding Acts
of the State Governments; and
(d)
Public, religious or charitable trusts registered under the Indian Trust Act,1882 or
Wakf Act,1995.
4.
Terms and conditions before issue of a Feasibility Certificate by the State
Government regarding desirability and feasibility to establish paramedical institution.-(1) No
person shall establish a paramedical institution and no paramedical institution shall open a new or
higher course of study or training or increase its admission capacity in any course of study or
training, except with the previous permission of the State Government obtained in accordance with
the provision of section 19 of the Act.
(2)
Every person or paramedical institution shall, for the purpose of obtaining
permission under sub-rule (1), submit to the Council a scheme in accordance with the provisions of
the Act and these rules.
(3)
Every person or paramedical institution shall obtain Feasibility Certificate from the
State Government before submitting a scheme under sub-rule (2) of this rule.
(4)
The Essentiality Certificate shall only be issued by the State Government in case
such person or paramedical institutions fulfils the condition Laid down for the purpose by the
Government of Himachal Pradesh from time to time.
5.
Qualifying criteria to seek permission to establish a paramedical institution in
addition to the terms and conditions laid down under subsection (8) of section 10 of the Act or
these rules,-The eligible organization shall comply with the provisions of the Act, these rules and
regulations made there under and guidelines issued by the Council and shall be eligible to apply for
permission to establish a new paramedical institution only if the following conditions are fulfilled.-
(a)
That the paramedical education shall be one of the main objective of the applicant or
institution ;
(b)
That the area of the plot of land as specified by the Council shall be owned and
possessed by the applicant to set up the proposed paramedical institution;
(c)
That the feasibility certificate regarding the desirability and feasibility of having the
proposed paramedical institution at the proposed location has been obtained from
the State Government and that the adequate clinical material shall be available as per
Council requirements;
(d)
That consent of affiliation to establish the proposed paramedical institution has been
obtained by the applicant from a recognized University or the Council, as the case
may be;
(e)
That the applicant owns and manages a hospital with necessary infrastructural
facilities and capable for being developed into a teaching institution as determined
by the Council in the vicinity of proposed paramedical institution;
(f)
That the applicant has a time bound programme to set up the proposed paramedical
institution along with the required infrastructural facilities including adequate hostel
facilities for boys and girls as determined by the Council commensurate with the
proposed intake of students so as to complete the paramedical education within a
period specified in the guidelines issued by the Council from the date of grant of
permission;

(g)
That the paramedical institution shall admit the students only after the Council has
satisfied itself about the infrastructural and other facilities for starting courses and
after receiving written permission from the State Government ;
(h)
That the applicant has a feasible and time bound expansion programme to provide
additional beds and infrastructural facilities as determined by the Council for the
purpose of upgradation of the existing paramedical institution or establishment of
new paramedical institution or both, so as to collectively provide the minimum bed
strength as determined by the Council within a period of one year from the date of
grant of permission to set up the proposed paramedical institution ;
(i)
That the applicant has the necessary managerial and financial capabilities to
establish and maintain the proposed paramedical institution and its ancillary
facilities including a teaching hospital;
(j)
That the applicant shall submit to the Council three years audit report with regards to
his financial status; and
(k)
That the paramedical institution shall give Bank guarantee to the tunes of Rs. ten
lacs per course in favour of the State Government, to be pledged with the Director
Medical Education and Research, Himachal Pradesh, to be enforced in the case of
the paramedical institution does not provide the required teaching facilities including
man powers and equipments etc.
Exemption .—The aforesaid condition shall not apply to the State Government; provided
that it shall give an undertaking to provide funds in their Plan Budget/Grant-in-aid regularly till the
facilities are fully provided as per the time bound programme indicated by it.
6.
Forms and procedures.-Subject to the fulfillment of the eligibility and qualifying
criteria as laid down in rules 3 and 5 of these rules, a scheme for setting up of a new paramedical
institution shall be submitted by the applicant in the following three parts :-
PART-A
(1)
The scheme shall contain the following particulars about the applicant and
information regarding the desirability and prima-facie feasibility of setting up of a paramedical
institution at the proposed location:-
(a)
Information regarding constitution of the applicant organization within the terms of
reference of eligibility criteria .
(b)
Information regarding basic infrastructural facilities and managerial and financial
capabilities of the applicant .
(c)
Information regarding availability of necessary certificates and consent as proposed
in the qualifying criteria under rule-5.
PART-B
(2)
The scheme shall contain detailed description to establish a new paramedical
institution and shall be submitted in the form of a detailed Techno-Economic Feasibility Report
about the proposed paramedical institution with the following particulars :-
(a)
Name and address of the new paramedical institution.
(b)
Market survey and environment analysis, availability of trained paramedical
manpower, gap analysis, desirability and prima-facie feasibility of establishing a
new paramedical institution at the proposed location .
(c)
Site characteristics and availability of external linkage : including topography, plot
size, permissible floor space index, ground coverage, building height, road access,

availability of public transport, electric supply, water-supply, sewage connection,
telephone lines etc .
(d)
Educational programme :including annual intake of students, admission criteria and
method of admission; reservation, preferential allocation of seats (if any) and
department-wise and year –wise curriculum of studies .
(e)
Functional programme :including department–wise functional requirement and area
distribution and room-wise seating capacity .
(f)
Equipment programme: including room-wise list of medical, scientific and allied
equipments, complete with schedule of quantities and specifications.-
(g)
Manpower programme :including department–wise requirement of teaching staff
(full time),technical, administrative and ancillary staff, category-wise recruitment
criteria and salary structure etc, minimum as per State Government scale .
(h)
Building programme: including building –wise built up area of the paramedical
institutions, faculty and staff housing, staff and students hostel, administrative
office, library auditorium and other infrastructural facilities such as cultural and
recreational center, sport complex etc .
(i)
Planning and layout: including master plan of the paramedical institution complex,
layout plan, sections elevations and floor-wise area calculations of the paramedical
institution and ancillary banking etc .
(j)
Phasing and scheduling: including month-wise schedule of activities, indicating
commencement and completion of building, design, approvals of local body; civil
construction and equipment, recruitment of staff and phased commissioning
commensurate with the proposal to intake of students.
(k)
Project cost : including capital cost of land, building, plant and machinery, medical
scientific and allied equipments, furniture and fixtures, and preliminary and pre-
operative expenses .
(l)
Means of financing the project cost: including contribution of the applicant, grants
and donations, equity, loans and other sources, if any.
(m)
Revenue assumptions: including fee structure and estimated annual revenue from
various sources.
(n)
Expenditure assumptions : including operating expenses and depreciation .
(o)
Operating results: including income statement, cash flow statement and projected
balance sheets.
PART –C
(3)
The scheme shall contain detailed description of existing paramedical institution and
the proposed expansion scheme to upgrade the existing paramedical institution or to set up an
additional paramedical institution or both to coincide with the phased-development of the proposed
paramedical institutions. This part of the scheme shall also be submitted in the form of a detailed
Techno-Economic Feasibility Report about the existing paramedical institution with following
particulars:-
(a)
Name and address of the existing paramedical institution.-
(b)
Details about the existing paramedical institution and its ancillary building,
including bed strength, built-up area of clinical and para-clinical disciplines, bed
distribution, architectural and layout plans, list of medical and allied equipment,
capacity and configuration of hospital services, administrative service, and other
ancillary and sport services, category-wise staff strength etc.
(c)
Details about the additional land for expansion of the existing paramedical
institution or for setting of a new paramedical institution including land particulars,
distance from the proposed educational institutions, plot size, authorized land use,

geography, soil conditions, road access, availability of public transport, electric
supply, water-supply, sewerage connection, telephone lines etc.
(d)
Upgraded medical programme: including the additional clinical and paraclinical
disciplines envisaged under the expansion scheme.
(e)
Upgraded functional programme: including specialty-wise and servicewise
functional requirements and area distribution; and specialty-wise bed distribution.
(f)
Building programme: including details about additional built-up area of the
paramedical institution, staff housing, staff and students hostel and other ancillary
building.
(g)
Planning and layout : including upgraded master plan of the paramedical institution
complex or master plan of the proposed new paramedical institution, as the case may
be, alongwith layout plans, sections elevations and floor-wise area calculation of
paramedical institution and ancillary building.
(h)
Equipment manpower programme : including upgraded room wise list of medical
and allied equipment schedule of quantities and specifications-.
(i)
Upgraded manpower programme :including category-wise distribution of medical,
paramedical and other staff-.
(j)
Phasing and scheduling of the expansion scheme : including month-wise master
schedule of activities indicating commencement and completion of building design,
approval of local body; civil construction, hospital services, provision of medical
and allied equipment, recruitment of staff etc. to commensurate with the
development of the proposed paramedical institution .
(k)
Project cost of the expansion scheme: including additional cost of land, building,
hospital services, medical and allied equipments, furniture and fixtures expenses -.
(l)
Means of financing the cost of expansion scheme: including contribution of the
applicant, grants and donation, equity, loans and other sources, if any-
(m)
Revenue assumptions: including details of income from various sources and service
loads and annual revenue;
(n)
Expenditure assumptions :including operating expenses, financial expenses, and
depreciation.
(o)
Operating results: including income statements, cash flow statement and balance
sheets.
7.
Application form and fee.-The application under section 19 of the Act, to seek
permission to establish a paramedical institution shall be submitted in Form-A, by registered post
only to the Registrar, Himachal Pradesh Paramedical Council, Old Dental College Building, Shimla
171001 and shall be accompanied with a fee of rupees two thousand in the form of a demand draft
drawn on a scheduled Bank in favour of the Himachal Pradesh Para-Medical Council, Shimla. The
fee to inspect the paramedical institutions shall be Rs 25,000/-.The inspection fee shall be sent in
the form of a demand draftdrawn on a Scheduled Bank in favour of the Himachal Pradesh
Paramedical Council, Dental College Building, near IGMC Shimla-171001. Beyond one
inspection, the normal inspection fee shall be as may be determined by the
Council.
8.
Registration.-(1) Application found complete in all respects shall be registered by
the Council for evaluation and recommendations. The registration of the application shall only
signify the acceptance of the application for evaluation. It shall however, under no circumstances,
means approval of the application for grant of permission.
(2)
Incomplete application shall not be registered and shall be returned by the Council
to the applicant along with enclosures and processing fee.

9.
Prescribed period.-In computing the time limit specified under sub section (6) of
section 19 of the Act, the time taken by the authorities and the institutions submitting the scheme in
furnishing any information/clarification or additional documents called for by the Council shall be
excluded.
10.
Evaluation by the Council.-The Council shall evaluate Part-A of the application in
the first instance to establish the desirability and prima-facie feasibility of setting up the
paramedical institution at the proposed location and the capability of the applicant to provide the
necessary resources and infrastructure of the scheme. While evaluating each part of the application,
the Council may seek further information/clarification or additional documents from the applicant
as considered necessary or may carry out physical inspection to verify the information.
11.
Grant of permission.-(1) The Council may, issue a letter of intent to the applicant
to set up a new paramedical institution, with such conditions and modifications in the original
proposal as may be considered necessary. The permission may be granted after the aforesaid
conditions and modifications are accepted and the performance of bank guarantees for the required
sums are furnished by the applicant.
(2)
The formal permission may include time bound programme for the establishment of
the paramedical institution and expansion of the hospital facilities. The permission may include a
clear cut directions of preliminary requirements to be met in respect of building, infrastructural
facilities, medical and allied equipments, faculty and staff etc. before admitting the first batch of
students. The permission may also indicate annual targets to be achieved by the applicant to
commensurate with the intake of students during the following years.
(3)
The permission to establish a new paramedical institutions and admit students may
be granted initially for a period of one year and may be renewed on yearly basis subject to
verification of the achievements of annual targets and revalidation of the performance of bank
guarantees. The process of renewal of permission may continue till such time the establishment of
the paramedical institutions and expansion of the hospital facilities are completed and formal
recognition of the paramedical institution by the Council is granted. Further admissions are liable to
be stopped by the Council at any stage unless the requirements for various steps of development are
taken to its satisfaction.
(4)
The Council may obtain any other information from the proposed paramedical
institutions as it deems fit and necessary.
12.
Application for registration of Para-clinical establishment.-Every person
intending to carry on a para-clinical establishment shall make an application in a form, as may be
prescribed by regulations, to the Council for the registration of clinical establishment within a
period of three months from the date of commencement of the Act and shall be accompanied by a
fee as may be prescribed by regulations made under sub section (2) of section 28 of the Act, in the
form of a demand draft drawn on a______________________ Scheduled Bank in favour of the
Himachal Pradesh Paramedical Council, Old Dental College Building, near Indira Gandhi Medical
College,Shimla-171001.
13.
Certificate of Registration of Para-clinical Establishment.-(1) The certificate of
registration of para-clinical establishment shall be granted by the Registrar in Form-B within period
of three months, from the date of submission of the application to the Council and the period of
three months to grant the certificate of registration of para-clinical establishment, shall
commence from the date of registration of the application by the Council.
(2)
Incomplete application shall not be registered and shall be returned by the Registrar
to the applicant alongwith enclosures.

(3)
The application found complete in all respects shall be entered, in the State Register
of para-clinical establishment, in Form –J by the Registrar in order to grant the certificate of
registration of para-clinical establishment.
(4)
In computing the time limit of three months as specified under sub-rule (1),the time
taken by the authorities and applicant submitting the application, in furnishing any
information/clarification or additional documents called for by the Council shall be excluded.
14.
Terms and conditions for the registration of para-clinical establishment.-Before
the application is registered by the Council in order to grant the certificate of registration of a para-
clinical establishment, every person intending to carry on a para-clinical establishment shall fulfill
the following terms and conditions, namely:-
(a)
He should hold recognized paramedical qualifications.
(b)
He should reside or carry on the para-clinical establishment within the State of
Himachal Pradesh.
(c)
He should not be less than eighteen years of age.
(d)
He should not be an un-discharged insolvent.
(e)
He should not be of an unsound mind.
(f)
He should not have been black-listed by any authority under any law for the time
being in force.
(g)
He should not have been convicted of an offence under the Act or under any law
involving moral turpitude, or, if convicted a period of five years has elapsed since
his conviction.
(h)
He should not have been dismissed from the service of a Government or a State
Government Undertaking or a Local Authority.
(i)
He shall submit a written and signed declaration as provided in Appendix-I to the
Registrar.
(j)
He shall maintain good character and morals and to attain such a standard is a duty
of every practitioner who owes alike to the profession and to the public.
(k)
He shall not abuse his professional position by committing adultery or improper
conduct with a patient or by maintaining improper association with a patient,
otherwise he shall be liable for disciplinary action as provided under the Indian
Medical Council Act,1956(Central Act No.102 of 1956)-.
(l)
He shall comply the norms for running a para-clinical establishment as specified in
Appendix-II.
15.
Maintenance of records.-(1) Every para-clinical establishment shall maintain and
keep the records of all persons,-
(a)
in case attended and treated as outdoor patient in Form-C;(b).
(b)
in case admitted and treated as indoor patient in Form-D;
(c)
in case of specialized investigation is done by a specialist in he reporting of special
investigation shall be made in Form-E;
(d)
in case investigation of routine nature the reporting of such investigation shall be
made in Form-F; and
(e)
if labels for samples are to be collected, the same shall be collected in Form-G.

The lists of specialized investigations have been specified in para 12 of the
Appendix-II,

Every para-clinical establishment shall keep the records of all persons as mentioned
in sub-rule (1), in duplicate. First copy shall be given to the patient and second copy shall be kept
by the para-clinical establishment for at least five years or till the inspection of the para-clinical
establishment is caused to be made by the Council, whichever is earlier.
16.
Registration and renewal fees,-(1) The application by a person under section 38 of
the Act, for being registered as a para-medical practitioner in theState Register of paramedical
practitioners to be maintained under the provisions of sub-section (2) of section 38 of the Act, shall
be made in Form-H, by registered post to the Registrar, Himachal Pradesh Paramedical
Council,Shimla-171001 and shall be accompanied by a fee of one thousandrupees in the form of a
demand draft, drawn on a____________________________ Scheduled Bank, in favour of the
Himachal Pradesh Paramedical Council, Shimla-171001.
(2)
The Certificate of registration as a paramedical practitioner shall be issued by the
Registrar in Form –I and shall be valid for a period of three years from the date of its issue.
(3)
Every paramedical practitioner, registered under this rule, shall renew his certificate
of registration after every three years on payment of fee of five hundred rupees in the form of a
demand draft, drawn on a Scheduled Bank, in favour of the Himachal Pradesh Paramedical
Council,Shimla-171001.
(4)
The application under sub-rule (3) to renew the certificate of registration as a
paramedical practitioner shall be made in Form-K, by a registered postaddressed to the Registrar,
Himachal Pradesh Paramedical Council, Shimla-171001.
17.
Verification of pages of register.-The Registrar shall, before bringing the State
Register of para-clinical establishment into use, add a certificate on the title page specifying the
number of pages it contains. Such certificate shall besigned and dated by the Registrar. Each page
of the register shall be numbered and verified by the Registrar.
18.
Change of name to be intimated to the Registrar.-If a registered paramedical
practitioner or para-clinical establishment changes his/its name, he/it shall immediately inform the
Registrar about the same and satisfy the Registrar that it has already notified the fact of the change
of name in a leading newspaper having wide circulation in the area in which he/it carries on his/its
practice/business. The Registrar shall on being so satisfied and on receipt of a fee of rupees two
hundred and fifty, enter the changed name in the register accordingly. The necessary change in the
registration certificate shall also be made by the Registrar.
19.
Issue of a duplicate Registration Certificate.-If a registration certificate is lost,
destroyed or mutilated, the registered practitioner or registered paraclinical establishment may at
any time during which the certificate is in force, apply to the Registrar for a duplicate certificate
and the Registrar shall, on being satisfied, issue on receipt of fee of rupees two hundred and fifty, a
duplicate certificate. The duplicate certificate shall be inscribed on the top of the certificate.
20.
Fee for supply of certified copy.-(1) The fee for the supply of copy of any, order
passed by the Council or the Registrar or any entry in the register shall be charged at the rate of ten
rupees per page :
Provided that if the applicant applies for a copy urgently, he shall pay double the amount of
fees specified as above.
(2)
In case of urgent application, the copy sought for shall be ready for delivery to the
applicant by the close of office hours of the day following that on which the application is made.

21.
Seal of the Council.-The common seal of the Council shall be kept by the Registrar
in his custody. It shall be affixed on each registration certification and any other documents issued
by the Registrar under the provisions of these rules.

Washing/sterilization room-minimum 25 square feet, with ventilation, proper
electricity and water connection and with running water storage facility.
(2)
WORKING BENCHES :
(i)
Height-
(a)
2.5 feet for sitting jobs; and

(b)
3 feet for standing jobs; and
(ii)
Width-
2 feet with impervious tops, with lighting arrangements and water
supply.
(3)
SITTING PURPOSE- Revolving stool for microcopy/investigations.

MANPOWER:
(i)
Qualified Medical Laboratory Technician, registered with Paramedical Council of
Himachal Pradesh .
(ii)
Medical Graduate by employing a qualified registered medical laboratory
technician. Medical Graduate shall perform blood/urine/CSF routine investigation if
the number of such investigation is less than 20 or in case of emergency.
(iii)
MD/ Medical Post Graduate in any specialty in his specific subject laboratory. Other
laboratory may also be run by employing a registeredmedical laboratory technician.
(iv)
The person signing the reports shall be responsible for any wrong acts or omissions.
(5)
LIST OF INVESTIGATIONS:
The list of investigations to be carried out shall be displayed with rates/charges on a
conspicuous place of the clinical establishment.
(6)
SPECIALIZED INVESTIGTIONS :
Reporting of special investigations shall be done by a specialist in respective field in Form-
E and Para-Medical Establishment doing specialized investigation shall have additional space as
per requirement.
(7)
RECORD KEEPING :
(i)
Separate register for each specialty (investigation) shall be maintained .
(ii)
The record of the tests sent to referral laboratories and reports received thereof shall
be maintained .
(iii)
Accident register shall be maintained for laboratory staff in which date and time of
accident and remedial measures taken shall be maintained.

the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P.Public
Service Commission is pleased to make the Recruitment & Promotion Rules for the post of
Divisional Engineer(Soil Conservation) Class-I (Gazetted) in the Department of Agriculture , HP as
per Annexure-A attached to this notification, namely :-

Short title and Commencement.— (i) These rules may be called the Himachal
Pradesh Department of Agriculture, Divisional Engineer (Soil Conservation), Class-I (Gazetted)
Recruitment & Promotion Rules, 2012.

These rules shall come into force from the date of their publication in Rajpatra, H. P.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF DIVISIONAL ENGINEER(
SOIL CONSERVATION) IN THE DEPARTMENT OF AGRICULTURE
1.
Name of the post.— Divisional Engineer(Soil Conservation).
2.
Numbers of posts.—3 (Three).
3.
Classification.—Class-I (Gazetted).
4.
Scale of Pay .— ` 10300-34800 + ` 5000 Grade Pay.

Minimum Education and other qualification required for direct recruits.—Not

promotion/deputation /transfer is to be made.—By transfer from amongst the incumbents of the
post of Sub-Divisional Soil Conservation Officers/Assistant Soil Conservation Officers( strictly in
order of seniority and subject to fitness) possessing the qualification of B.Sc.(Agr. Engineering)/B.
Tech. (Agriculture Engineering/B.E (Agr. Engineering)/B.E.(Civil Engineering)/AMIE in
Agriculture/Civil Engineering from recognized University with three years regular service or
regular combined with continuous adhoc service rendered if any, in the grade.
Provided that for the purpose of promotion every employee shall have to serve atleast one
term in the Tribal /Difficult areas subject to adequate number of post(s) available in such areas:
Provided further that the proviso (I) supra shall not be applicable in the case of those
employees who have five years or less service, left for superannuation.
Provided further that Officers/Officials who have not served atleast one tenure in
Tribal/difficult area shall be transferred to such area strictly in accordance with his/her seniority in
the respective cadre.
Explanation I— For the purpose of proviso I supra the “term” in Tribal/Difficult areas
shall mean normally three years or less period of posting in such areas keeping in view the
administrative requirements and performance of the employee.

In all cases of promotion, the continuous adhoc services rendered in the feeder post,
if any, prior to regular appointment to the post shall be taken into account towards the length of
service as prescribed in these rules for promotion subject to the condition that the adhoc
appointment /promotion in the feeder category had been made after following proper acceptable
process of selection in accordance with the provisions of R&P rules; provided that in all cases
where a junior person become eligible for consideration by virtue of his total length of service
(including the service rendered on adhoc basis followed by regular service/appointment) in the
feeder post in view of the provision referred to above, all persons senior to him in the respective
category post/cadre shall be deemed to be eligible for consideration and placed above the junior
person in the field of consideration;

Provided further that all incumbents to be considered for promotion shall possess the
minimum qualifying service of atleast three years or that prescribed in the R&P rules for the post,
whichever is less;
Provided further that where a person becomes ineligible to be considered for promotion on
account of the requirements of the preceding proviso, the person(s) junior to him shall also be
deemed to be ineligible for consideration for such promotion.
EXPLANATION.—The last proviso shall not render the junior incumbents ineligible for
consideration for promotion if the senior ineligible person happened to be ex-servicemen recruited
under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservations of
vacancies in Himachal State Non-Technical services) Rules, 1972 and having been given the
benefit of seniority there-under or recruited under the provision of Rule-3 of the Ex-servicemen
(Reservations of vacancies in Himachal Pradesh Technical Services) Rules, 1985 and having been
given the benefit of seniority there-under.

Similarly, in all cases of confirmation continuous adhoc service rendered in the
feeder post, if any, prior to the regular appointment against such posts shall be taken into account
towards the length of service, if the adhoc appointment/promotion had been made after proper
selection and in accordance with the provisions of R&P rules ;
Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc
service rendered as referred to above shall remain unchanged.
12.
If a departmental promotion committee, exists, what is its composition.—Not
applicable.
13.
Circumstances under which the HP PSC is to be consulted in making
recruitments.—As required under the Law.
14.
Essential requirement for a direct recruitment.—Not applicable.
15.
Selection for appointment to post by direct recruitment.—Not applicable.
16.
Reservation.—The appointment to the service shall be subject to orders regarding
reservation in the service for Scheduled Castes/Scheduled Tribes/other Backward Classes/other
categories of persons issued by the Himachal Pradesh Government from time to time.
17.
Departmental Examination.—Every member of the service shall pass
departmental examination as prescribed in the H.P. Departmental Examination Rules,1997 as
amended from time to time.
18.
Power to relax.—Where the State Government is of the opinion that it is necessary
or expedient to do so it may, by order, for reasons, to be recorded in writing and in consultation
with the HP PSC, relax any of the provisions of these rules with respect to any class or category of
persons or posts.
