The licensee shall be required to deposit a sum equal to 10% of the annual fixed license fee
of his license before 15th April of each financial year as security amount for the strict compliance
of aforementioned provision into the government treasury under Head 0039-State Excise. The
conditional security amount so deposited shall be carry forwardable, adjustable/refundable in case
the licensee qualifies/complies with the condition by lifting minimum prescribed quota
proportionately on monthly basis. In case of his failure to do so for three consecutive months, the
conditional amount/security deposited by the licensee shall be forfeited to the government by the
Asstt.Excise & Taxation Commissioner/Excise & Taxation Officer I/C of the district with the prior
approval of the Excise & Taxation Commissioner, Himachal Pradesh and the licensee shall make
his license liable for cancellation. This shall be in addition to the penalty provision that may be
brought into operation against the said licensee under the Punjab Excise Act, 1914 and rules framed
thereunder.
2.
Sub-Clause (ii) of Sub-rule (31) of Rule 37 shall be substituted by the following,
namely :-

After Sub-Clause (f) of Sub-rule (1) of Rule 38, new Sub-Clause (g) shall be added,
namely :-

The transfer of IMFS from one L-1 to another L-1 within the State may be allowed
after close of every quarter by the 7th day of the subsequent month of such quarter
subject to the condition that both such L-1 licenses/licensed premises are owned by
the same person who shall furnish documentary proof of such ownership to
concerned district I/c and the case shall be sent to the Excise & Taxation
Commissioner, Himachal Pradesh for approval before any permit/pass is issued. The
concerned licensee shall also enclose the stock statements (Quarts, Pints, Nips
brands wise, batch wise with manufacturing date and hologram serial number wise)
relating to both the licensed premises i.e transferor and transferee premises and such
statements shall be duly signed and countersigned by the ETI/AETO I/C of the L-1,
AETC/ETO Incharge of the district as well as by the Collector (Excise) of the Zone
concerned respectively.

4.
Sub-Clause (i) of Sub-rule (1-B) of Rule 38 of the said rules, shall be substituted by
the following, namely:-
(i)
The licensee shall function as a stockist in respect of the brands of liquor
manufactured by his Distillery, Bottling Plant or Brewery only and he shall sell
liquor to the L-1 license holders only:
Provided that the addition of different Distilleries, Bottling Plants or Breweries
owned by a single company is allowed to be made in an already issued first L-1B
license of the said company subject to the condition that license fee in full at par
with other owner shall be payable by the said Company separately for every such
Distillery, Bottling Plant and Brewery and accounts/stock of liquor shall also be
maintained Distillery wise/Bottling Plant wise/ Brewery wise separately by a such
licensee company/by such L-1B licensee.
(ii)
Opening clause of Rule (1-BB) and sub-clause (iii) of Rule 38 shall be
substituted by the following, namely :-
(1-BB).
A license in form L.1-BB shall be granted/renewed as well as for
registration/renewal of BIO brands for the wholesale vend of imported liquor
to other wholesale and retail sale licenses in form L.1, L.2, L.3, L.4, L.5,
L.3A, L.4A, L.5A, L.10-BB, L.12A, L.12B and L.12C only subject to
submission of Certificate of sponsorship from any license holder of a Bond
licensed by the Central Customs and Excise Department anywhere in India
stating therein that he will ensure supply of the BIO brands to such applicant
duly attested by the competent authority:
Provided that any authority while granting transport permit for BIO Brands to any such BIO
licensee should ensure that it is issued only to such source of supply which is holding a Bond
license from Central Customs and Excise Department.
5.
In Schedule “A” appended to the said Rules --
(i)

No.7-434/2011-EXN 9724&43.—In exercise of the powers conferred by section 59 of the
Punjab Excise Act, 1914 (1 of 1914), as in force in the areas comprised in Himachal Pradesh
immediately before 1st November, 1966 and as in force in the Territories transferred to Himachal
Pradesh under section 5 of the Punjab Re-Organization Act, 1966 (31 of 1966) and by virtue of the
powers of the Financial Commissioner (Excise), conferred on me under section 9 of the said Act,
read with the Himachal Pradesh (Excise Power and Appeal) Orders, 1965, I, J.C.Sharma, Excise
and Taxation Commissioner, Himachal Pradesh hereby make the following further amendments in
the Himachal Pradesh Liquor License Rules, 1986 (hereinafter called the ‘said rules’) as amended
from time to time, with effect from 1.4.2012 :-
AMENDMENTS
In the said rules.-

The Rule 18-AA shall be substituted by the following namely, :-
The licenses in form, L-3,L-4,L-5 (combined), L-4, L-5 (combined), L-3A, L-4A,L-
5A (combined), L-4A ,L-5A (combined) shall be renewed subject to the conditions
that the holder of the license during the currency of the preceding year lifts the
following minimum quantity of foreign spirit from the approved source(s) of

The licensee shall be required to deposit a sum equal to 10% of the annual fixed license fee
of his license before 15th April of each financial year as security amount for the strict compliance
of aforementioned provision into the government treasury under Head 0039-State Excise. The
conditional security amount so deposited shall be carry forwardable, adjustable/refundable in case
the licensee qualifies/complies with the condition by lifting minimum prescribed quota
proportionately on monthly basis. In case of his failure to do so for three consecutive months, the
conditional amount/security deposited by the licensee shall be forfeited to the government by the
Asstt.Excise & Taxation Commissioner/Excise & Taxation Officer I/C of the district with the prior
approval of the Excise & Taxation Commissioner, Himachal Pradesh and the licensee shall make
his license liable for cancellation. This shall be in addition to the penalty provision that may be
brought into operation against the said licensee under the Punjab Excise Act, 1914 and rules framed
thereunder.
2.
Sub-Clause (ii) of Sub-rule (31) of Rule 37 shall be substituted by the following,
namely :-

After Sub-Clause (f) of Sub-rule (1) of Rule 38, new Sub-Clause (g) shall be added,
namely :-

The transfer of IMFS from one L-1 to another L-1 within the State may be allowed
after close of every quarter by the 7th day of the subsequent month of such quarter

subject to the condition that both such L-1 licenses/licensed premises are owned by
the same person who shall furnish documentary proof of such ownership to
concerned district I/c and the case shall be sent to the Excise & Taxation
Commissioner, Himachal Pradesh for approval before any permit/pass is issued. The
concerned licensee shall also enclose the stock statements (Quarts, Pints, Nips
brands wise, batch wise with manufacturing date and hologram serial number wise)
relating to both the licensed premises i.e transferor and transferee premises and such
statements shall be duly signed and countersigned by the ETI/AETO I/C of the L-1,
AETC/ETO Incharge of the district as well as by the Collector (Excise) of the Zone
concerned respectively.
4.
Sub-Clause (i) of Sub-rule (1-B) of Rule 38 of the said rules, shall be substituted by
the following, namely:-
(i)
The licensee shall function as a stockist in respect of the brands of liquor
manufactured by his Distillery, Bottling Plant or Brewery only and he shall sell
liquor to the L-1 license holders only:
Provided that the addition of different Distilleries, Bottling Plants or Breweries
owned by a single company is allowed to be made in an already issued first L-1B
license of the said company subject to the condition that license fee in full at par
with other owner shall be payable by the said Company separately for every such
Distillery, Bottling Plant and Brewery and accounts/stock of liquor shall also be
maintained Distillery wise/Bottling Plant wise/ Brewery wise separately by a such
licensee company/by such L-1B licensee.
(ii)
Opening clause of Rule (1-BB) and sub-clause (iii) of Rule 38 shall be
substituted by the following, namely :-
(1-BB).
A license in form L.1-BB shall be granted/renewed as well as for
registration/renewal of BIO brands for the wholesale vend of imported liquor
to other wholesale and retail sale licenses in form L.1, L.2, L.3, L.4, L.5,
L.3A, L.4A, L.5A, L.10-BB, L.12A, L.12B and L.12C only subject to
submission of Certificate of sponsorship from any license holder of a Bond
licensed by the Central Customs and Excise Department anywhere in India
stating therein that he will ensure supply of the BIO brands to such applicant
duly attested by the competent authority:
Provided that any authority while granting transport permit for BIO Brands to any such BIO
licensee should ensure that it is issued only to such source of supply which is holding a Bond
license from Central Customs and Excise Department.
5.
In Schedule “A” appended to the said Rules --
(i)
In column 3 of entry at Sr.No. 1 for the words, sign and figures “ Rs.3.00 lac, the
words, signs and figures “Rs. 4.00 lac shall be substituted.
(ii)
In column 3 of entry at Sr.No. 20 for the words, sign and figures “ Rs.1.00 lac, the

No. 9-60/82-TD-2503.—Whereas Hotel Bijleshwar View, Dhalpur, Kullu, Tehsil and
District Kullu was registered vide registration No. 9-60/82-TD-97, dated 20th February, 1990 under
the H. P. Registration of Hotels and Travel Agents Act, 1970 and further renewed/registered vide
No. 9-60/82-TD-228 dated 20-4-2006 under the H. P. Tourism Development and Registration Act,
2002.
Whereas the Proprietor of the above Tourism Unit vide his application dated 21st February,
2012 has requested to cancel its registration since he has ceased to operate the tourism unit.
Therefore, I, Balbir Thakur, HAS, District Tourism Development Officer, Kullu at Manali,
H. P. (Prescribed Authority declared vide H. P. Government Notification No. TSM-A (3)-1/2002,
dated 15-1-2003) in exercise of the powers vested in me under section 30 (a) of the Himachal
