further to amend the Shoolini University of Biotechnology and Management Sciences

(Establishment and Regulation) Act, 2009 (Act No. 20 of 2009).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-third Year of

the Republic of India as follows:—

Short title and commencement.—(1) This Act may be called the Shoolini

University of Biotechnology and Management Sciences (Establishment and Regulation) Second

Amendment Act, 2012.

(2)

It shall be deemed to have come into force on 16^th day of October, 2009.

Amendment of section 3.—In section 3 of the Shoolini University of

Biotechnology and Management Sciences (Establishment and Regulation) Act, 2009 (20 of 2009)

(hereinafter referred to as the “principal Act”), after clause (j), the following new clause (k) shall

be inserted, namely:—

to make the University functional within one year from the date of

commencement of this Act.” .

Amendment of section 41.—In section 41 of the principal Act, in sub-section (2),

in the proviso, after the words “assets of the University”, the words “including assets of the

sponsoring body pertaining to the University” shall be inserted.

Amendment of section 42.—In section 42 of the principal Act, in sub-section (9),

for the words, “assets and liabilities of the University shall vest in the sponsoring body”, the words,

“assets of the University including assets of the sponsoring body pertaining to the University shall

vest in the Government free from all encumbrances” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

In order to ensure appropriate standard of admission, teaching, examination, research and

for furtherance of higher education in the State, the State Government has established many private

Universities in the State by enacting independent Private Universities Acts. These Acts however

do not contain provisions for making the University functional within a stipulated period. Thus, it

has been considered essential to make suitable provision in the Act to ensure that every University

is made functional within a specific period. Further, in order to ensure that provisions of the Act

relating to the dissolution of the University by the sponsoring body are not misused against interest

of the students and employees of the University, it has been considered necessary to make the

provisions to this effect more stringent and crystal clear. As such, it has been decided to make

suitable amendments in the Shoolini University of Biotechnology and Management Sciences

(Establishment and Regulation) Act, 2009 (Act No. 20 of 2009) to ensure that University is made

functional within a period of one year from the date of commencement of the Act and that in the

event of dissolution of the University by the sponsoring body in contravention of the provisions of

the Act, all the assets of the University including assets of the sponsoring body pertaining to the

University shall vest in the Government free from all encumbrances. This has necessitated

amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

1969).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-third Year of

the Republic of India as follows:—

Short title.—(1) This Act may be called the Himachal Pradesh Co-operative

Societies (Amendment) Act, 2012.

Substitution of section 34.—For section 34 of the Himachal Pradesh Co-operative

Societies Act, 1968, the following section shall be substituted, namely:—

“34.

Constitution of the Managing Committee.—(1) The management of every society

shall vest in a managing committee constituted in accordance with this Act, rules

and bye-laws, which shall exercise such powers and perform such duties as may be

conferred or imposed respectively, by this Act, rules and bye-laws.

(2)

The managing committee of a co-operative society shall be constituted by,—

(a)

election from amongst the members of the society at the annual or special

general meeting;

(b)

nominees of other co-operative societies or institutions, if any, provided in

the bye-laws; and

(c)

Government nominees, if any, nominated under section 35:

Provided that only elected or nominated members of the managing committee shall be

eligible to be elected as Chairman or Vice-Chairman or President or Vice-President of the

committee:

Provided further that no member of a managing committee shall be eligible to be elected as

the Chairman or President or Vice-Chairman or Vice-President of a co-operative society if such

member is a Minister in the State Government.

The managing committee of a co-operative society shall consist of not less than five

but not more than twenty-one members including Government nominees:

Provided that one seat shall be reserved for the Scheduled Castes or the Scheduled Tribes

on the managing committee of every co-operative society consisting of individuals as members and

having members from such class or category of persons:

Provided further that thirty-three percent seats, to be filled by election, shall be reserved in

such manner as may be prescribed for women on the managing committee of every co-operative

society consisting of individuals as members and having members from such class or category of

persons.

The term of office of the elected members of the managing committee and its office

bearers shall be five years from the date of election and the term of office bearers shall be co-

terminus with the term of the managing committee:

Provided that the managing committee may fill a casual vacancy by nomination out of the

same class of members in respect of which the casual vacancy has arisen, if the term of office of the

managing committee is less than half of its original term.”.

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Co-operative Societies Act, 1968 (Act No. 3 of 1969) was enacted to

consolidate and amend the law relating to Co-operative Societies in Himachal Pradesh. The 97^th

Constitution (Amendment) Act, 2011, seeks reservation to women and Scheduled Castes or

Scheduled Tribes on the Managing Committee of Co-operative Societies to facilitate empowerment

of women and to ensure active participation of Scheduled Castes, Scheduled Tribes and women in

decision-making process of Co-operative Societies. Thus, in order to bring the State Act in

consonance with the Constitution Amendment Act, it has been decided to provide reservation of

33% seats, to be filled by electon, for women and one seat for Scheduled Castes or Scheduled

Tribes on the Managing Committee of a Co-operative Society by making suitable amendments in

the Act ibid. It has further been proposed to specify the constitution of the Managing Committee

of a Co-operative Society, the maximum number of members of the Managing Committee, the

manner of filling of casual vacancy and the term of office of the members of the Managing

Committee. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

THE BAHRA UNIVERSITY (ESTABLISHMENT AND REGULATION) SECOND

AMENDMENT BILL, 2012

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

firther to amend the Bahra University (Establishment and Regulation) Act, 2010 (Act No. 2

of 2012).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-third Year of

the Republic of India as follows :—

Short title and commencement.—(1) This Act may be called the Bahra University

(Establishment and Regulation) Second Amendment Act, 2012.

(2) It shall be deemed to have come into force on 29^th day of September, 2010.

Amendment of section 3.—In section 3 of the Bahra University (Establishment and

Regulation) Act, 2010 (2 of 2011) (hereinafter referred to as the “principal Act”), after clause (j),

the following new clause (k) shall be inserted, namely:—

“(k) to make the University functional within one year from the date of commencement of

this Act.” .

Amendment of section 41.—In section 41of the principal Act, in sub-section (2), in

the proviso, after the words “all the assets of the University”, the words “including assets of the

sponsoring body pertaining to the University” shall be inserted.

Amendment of section 42.—In section 42 of the principal Act, in sub-section (9),

after the words “all the assets of the University”, the words “including assets of the sponsoring

body pertaining to the University” shall be inserted.
