Schedule ‘E’ appended to the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005)
were notified in accordance with the provisions of Section 10 of the Act ibid for inviting objections
and suggestions from the person(s) likely to be effected thereby, vide this department Notification
of even number, dated 18th March, 2013 and published in the e-Gazette, Himachal Pradesh on
18th March, 2013;
And whereas, no objection/suggestion has been received within the stipulated period in this
behalf.
Now, therefore, the Governor of Himachal Pradesh, in exercise of the powers vested in her
under section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005) is
pleased to make the following amendments in SCHEDULE-‘A’ and SCHEDULE ‘E’ appended to
the Act ibid, namely:—
AMENDMENTS
1. After entry at Sr. No. 1 of Part-I in SCHEDULE ‘A’, the following new entry at Sr.
No. 2 shall be inserted:—
“2. Aviation Turbine Fuel, as defined under entry (iid) of Section 14 of the Central Sales
Tax Act, 1956 (Act No. 74 of 1956).”
2. The existing entry at Sr. No. 3 of Part-II-‘A’ in SCHEDULE ‘A’ shall stand deleted.
3. After existing Part-II-‘A’ in SCHEDULE ‘A’, the following new Part-II-‘AA’ shall be
inserted:—

No. EXN-F(5)-6/2006-Vol.I .—Whereas, the Governor of Himachal Pradesh, is satisfied
that it is necessary in the public interest so to do.
2. Now, therefore, in exercise of the powers vested in her under clause (b) of sub-section
(5) of Section 8 of the Central Sales Tax Act, 1956 (Act no. 74 of 1956), the Governor of Himachal
Pradesh, is pleased to direct that in respect of the sale in the course of inter-state trade or commerce
of the goods {other than those manufactured by the breweries, distilleries, non-fruits/ vegetables
based wineries and bottling plants (both of country liquor, Indian made foreign liquor) and
industrial units specified in negative list} manufactured by the dealers running any existing
industrial unit in the state of Himachal Pradesh, the tax levied under sub-section (1) of Section 8 of

the Act ibid, shall be calculated and payable at a concessional rate of 1.5% of the taxable turnover
of such goods with effect from 1st April, 2013 for a period of five years or till the implementation
of the Goods and Services Tax, whichever is earlier.
3. The Governor of Himachal Pradesh is further pleased to direct that the concessional
Central Sales Tax at a concessional rate of 1% shall be levied on the new industrial units coming
into operation on or after 1st April, 2013 with effect from the date of commencing the commercial
production or the existing industrial units which carry out substantial expansion on or after 1st
April, 2013 with effect from commencing commercial production of the expanded capacity, for a
period of five years or till the implementation of the Goods and Services Tax, which ever is earlier.
4. The Governor of Himachal Pradesh is further pleased to direct that the concessional
rate of Central Sales Tax specified in para 2 & 3 above of this notification shall be levied only if the
existing industrial unit or the new industrial unit, as the case may be.—
(i)
has been registered as a dealer under the Himachal Pradesh Value Added Tax Act,
2005, for manufacturing of goods for sale;
(ii) complies with the provisions of (a) Himachal Pradesh Value Added Tax Act, 2005, (b)
the Central Sales Tax Act, 1956 and (c) the rules including the scheme, if any made,
the notifications and orders issued under these Acts;
(iii) not only manufacturers but also sells the goods by themselves and it shall not be
opened for finished goods purchased or acquired by concerned industrial units for re-
sale;
(iv) has obtained certificate in Form ‘I’ prescribed under this department notification No.
EXN-F(1)-2/2004 (iii) dated 30th March, 2005 from the General Manager, District
Industry Centre of the Department of the Industries of the Government of Himachal
Pradesh, where the industrial unit is registered or in other case from the Director of
Industries, Himachal Pradesh or his nominee duly authorized in this behalf, and has
furnished the same certificate to Assessing Authority for the grant of certificate in
Form “E” prescribed under notification no. EXN-F(5)-6/2006-I dated 18.06.2009 as
Annexure ‘A’.
Explanation.—For the purpose of this notification, -
(i)
‘new industrial unit’ means an industrial unit located in Himachal Pradesh which
commences commercial production on or after 01st April, 2013, but will not include
any industrial unit which is formed as a result of re-establishment, mere change of
ownership, change in the constitution, re-structuring or revival of an existing industrial
unit;
(ii) ‘existing industrial unit’ means an industrial unit which commenced production before
01st April, 2013;
(iii) ‘substantial expansion’ in respect of the industrial units existing before 01st April,
2013 means substantial expansion undertaken by way of increase in the installed
capacity of the existing unit by not less than 25% of the capacity, which should be the
result of installation of additional plant and machinery subject to fulfillment of
condition that such expansion shall result in additional employment of at least 25%
(excluding employment on contractual/sub-contractual basis) of the existing manpower

employed on regular basis and further the unit will continue to employ at all the levels,
at least 70% of its total manpower whether on regular basis or daily basis or
contractual/sub-contractual basis or by any other mode from amongst the bonafide
Himachalis. Further such industrial units should come into commercial production for
such expanded capacity on or after 01st April, 2013;
(iv) the expression ‘negative list’ shall have the same meaning as assigned in department
notification no. EXN-F(1)-2/2004(iii) dated 30.03.2005 and further amended vide
notification No. EXN-F(1)-2/2004-Part, dated 23-10-2009.

No. Co-op. A(3)-4/2011.— In exercise of the powers conferred by proviso to Article 309 of
the constitution of India, the Governor, Himachal Pradesh in consultation with the H.P. Public
Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh
Co-operation Department Inspector/Inspector (Audit) Co-operative Societies Class-III, (Non-
Gazetted) Recruitment and Promotion Rules,2007 notified vide notification No. Co-op. B(1)-2/99
dated 15-01-2008, namely:—
1. Short title and commencement.—(1) These Rules may be called the Himachal
Pradesh Co-operation Department Inspector/Inspector (Audit) Cooperative Societies, (Class-III,
Non-Gazetted) Recruitment and Promotion (1st Amendment) Rules, 2013.
(2) These Rules shall come into force from the date of publication in the Rajpatra,
Himachal Pradesh.

Amendment of Annexure-“A”.—In Annexure-A to the Himachal Pradesh Co-
operation Department Inspector/Inspector (Audit) Co-operative Societies (Class-III, Non-Gazetted)
Recruitment and Promotion Rules, 2007 following shall be substituted, namely:—
(a) For the existing provisions against Col. No. 4, the “1. Pay scale for regular
incumbents ` 10300-34800 + 3600 Grade Pay.
2. Pay scale for Inspector/Inspector (Audit) Cooperative Societies : ` 13900/-
per month as per details given In Col. No.15-A.”
(b) For the existing provisions against Col. No.10, the following will be substituted,
namely :—

“ (i) 58% by direct recruitment on a regular basis or by Recruitment on contract
basis as the case may be.
(ii) 42% by promotion.”.
(c) For the existing provisions against Col. No.11’ the following will be Substituted,

(a) Clerical cadre (which include Jr.Assistant & Clerks) with 10 years regular
service or regular combined with continuous adhoc service rendered, if any,
in the grade = 30%.
(b) Panchyat Secretary with 10 years regular service or regular combined with
continuous adhoc service rendered if any in the grade = 10%.
(c) Steno-typist with 10 years regular service or regular combined with
continuous adhoc service rendered if any, in the grade = 2%.

The roster will be rotated after every 50th point till the representation to all the categories is
achieved by the given percentage. Thereafter the vacancy is to be filled up from the category which
vacates the post.
(I) Provided that for the purpose of promotion every employee shall have to serve atleast
one term in the Tribal/Difficult areas subject to adequate number of post(s) available in such areas;
Provided further that the proviso (I) supra shall not be applicable in the case of those employees
who have five years or less service, left for superannuation;
Provided further that Officers/Officials who have not served atleast one tenure in
Tribal/difficult area shall be transferred to such area strictly in accordance with his/her seniority in
the respective cadre.
Explanation I :—For the purpose of proviso I supra the “term” in Tribal/Difficult areas shall mean
normally three years or less period of posting in such areas keeping in view the administrative
requirements and performance of the employee;
Explanation II :—For the purpose of proviso I supra the Tribal/Difficult Areas shall be as

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if
any, prior to regular appointment to the post shall be taken into account towards the length of
service as prescribed in these rules for promotion subject to the condition that the adhoc
appointment/promotion in the feeder category had been made after following proper acceptable
process of selection in accordance with the provisions of R&P Rules;
(i) Provided that in all cases where a junior person becomes eligible for consideration
by virtue of his total length of service (including the service rendered on adhoc
basis, followed by regular service/appointment) in the feeder post in view of the
provisions referred to above, all persons senior to him in the respective
category/post/cadre shall be deemed to be eligible for consideration and placed
above the junior person in the field of consideration;
Provided that all incumbents to be considered for promotion shall possess the minimum
qualifying service of at least three years or that prescribed in the Recruitment and Promotion Rules
for the post, whichever is less;
Provided further that where a junior person becomes ineligible to be considered for
promotion on account of the requirements of the preceding proviso, the person(s) junior to him
shall also be deemed to be ineligible for consideration for such promotion.
Explanation:—The last proviso shall not render the junior incumbents ineligible for consideration
for promotion if the senior ineligible persons happened to be ex-servicemen recruited under the
provisions of Rule-3 of The Demobilised Armed Forces Personnel (Reservation of Vacancies in
Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority
thereunder or recruited under the provisions of Rule-3 of the Ex-Servicemen (Reservation of
Vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the
benefit of seniority thereunder.
(2) Similarly, in all cases of confirmation, continuous adhoc service rendered on the
feeder post, if any, prior to the regular appointment against such post shall be taken into account
towards the length of service;
if the adhoc appointment/promotion against such post had been made after proper selection
and in accordance with the provisions of the Recruitment and Promotion rules;
Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc
service rendered as referred to above shall remain unchanged.” And (d) For the existing main
provision against Col. No. 15-A, the following will be substituted, namely:—
Notwithstanding anything contained in these rules, contract appointments to the post
will be made subject to the terms and conditions given below:—
(I) CONCEPT.—(a) Under this policy, the Inspector/Inspector (Audit) Cooperative
Societies in the Co-operation Department will be engaged on contract basis initially for one year
which may be extendable on year to year basis.

Provided that the extension/ renewal of contract period on year to year basis the concerned
HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory
during the year and only then his period of contract is to be renewed/extended.
(b) POST FALLS WITHIN THE PURVIEW OF HPSSSB.—The Registrar,
Co-operative Societies, H.P. after obtaining the approval of the Government to fill up the posts on
contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh
Subordinate Services Selection Board, Hamirpur.
(c) The selection will be made in accordance with the eligibility conditions prescribed in
these Rules.
(II) CONTRACTUAL
EMOLUMENTS.—The
Inspector/Inspector
(Audit),
Co-operative Societies appointed on contract basis will be paid fixed contractual amount @ Rs.
13900/- per month (which shall be equal to initial of the pay band + Grade Pay). An amount of Rs.
17/- (equal to annual increase in the minimum/initial start of the pay scale of the post) as annual
increase in contractual emoluments for the subsequent year(s) will be allowed if contract is
extended beyond one year.
(III) APPOINTING/DISCIPLINARY AUTHORITY.—Registrar, Cooperative Societies
will be appointing and disciplinary authority.
(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of
contract appointment will be made on the basis of viva-voce test or if considered necessary or
expedient by a written test or practical test the standard/syllabus etc. of which will be determined
by the concerned recruiting agency i.e. Himachal Pradesh Subordinate Services Selection Board,
Hamirpur from time to time.
(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—
As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Subordinate
Services Selection Board, Hamirpur.
(VI) AGREEMENT.—After selection of a candidate he/she shall sign an agreement as per
Annexure-B appended to these rules.
(VII) TERMS AND CONDITIONS.—(a) The Contractual appointee will be fixed
contractual amount @ Rs. 13900/- per month (which shall be equal to initial of the pay band +
Grade Pay). The contract appointee will be entitled for increase in contractual amount @ Rs. 420/-
(3% of the minimum of the pay band + Grade pay of the post) for further extended years and no
other allied benefits such as senior/selection scales etc. will be given.
(b) The service of the contractual appointee will be purely on temporary basis. The
appointment is liable to be terminated in case the performance/conduct of the contract appointee is
not found satisfactory.
(c) Contractual appointee will be entitled for one day casual leave after putting one month
service. However, the contract employee will also be entitled for 12 weeks maternity leave and 10
days medical leave. He/She shall not be entitled for Medical Reimbursement and LTC etc. No
leave of any other kind except above is admissible to the contract appointee.
Provided that the un-availed Casual Leave can be accumulated upto the Calendar Year and
will not be carried forward for the next Calendar Year.

(d) Unauthorized absence from the duty without the approval of the Controlling Officer
shall automatically lead to the termination of the contract. Contractual appointee shall not be
entitled for contractual amount for the period of absence from duty.
(e) An official appointed on contract basis who has completed three years tenure at one
place of posting will be eligible for transfer on need based basis wherever required on
administrative grounds.
(f) Selected candidate will have to submit a certificate of his/her fitness from a
Government/Registered Medical Practitioner. In case of women candidates pregnancy beyond
twelve weeks will stand her temporarily unfit till the confinement is over. The women candidate
should be re-examined for fitness from an authorized medical officer/practitioner.
(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection
with his/her official duties at the same rate as applicable to regular officials at the minimum of pay
scale.
(h) Provisions of service rules like FR, SR, Leave Rules, GPF Rules, Pension Rules &
conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of
contract appointees. They will be entitled for emoluments etc. as detailed in this column.

the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the folowing rules
further to amend Rule-56 of the Fundamental Rules, in their application to the State of Himachal
Pradesh, namely:—

Short title and commencement.— (i) These rules may be called the Fundamental (in
their application to the State of Himachal Pradesh) Amendment Rules, 2013.
(ii) These rules shal come into force from the date of publication in the Rajpatra, H.P.
2.
Amendment of Rule 56.— In Rule-56 of the Fundamental Rules after clause (f) the
folowing clause (g) shal be inserted, namely:—
“(g) The teaching faculty members (namely Lecturers, Senior Lecturers, Readers,
Professors and Principal of Rajiv Gandhi Government Post Graduate Ayurvedic Colege,
Paprola) of Ayurveda Department shall retire from service on the afternoon of the last day
of the month in which he /she atains the age 62 years:
