BILL NO. 10 OF 2013

THE APG (ALAKH PRAKASH GOYAL) SHIMLA UNIVERSITY ESTABLISHMENT

AND REGULATION AMENDMENT BILL, 2013

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

A

BILL

to amend the APG (Alakh Prakash Goyal) Shimla University Establishment and Regulation

Act, 2012 (Act No. 20 of 2013).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of

the Republic of India as follows:—

1.

Short title and commencement.—(1) This Act may be called the APG (Alakh

Prakash Goyal) Shimla University Establishment and Regulation Amendment Act, 2013.

(2) It shall be deemed to have come into force on 19th day of June, 2012.

2.

Amendment of section 41.—In section 41 of the APG (Alakh Prakash Goyal) Shimla

University Establishment and Regulation Act, 2012, (20 of 2013) in sub-section (2), in the proviso,

for the words “twenty five years”, the words “forty years” shall be substituted.

__________

STATEMENT OF OBJECTS AND REASONS

In order to ensure appropriate standard of admission, teaching, examination, research and

for furtherance of higher education in the State, the State Government has established many private

Universities in the State by enactment of independent Act for each University. However, section

41 of the APG (Alakh Prakash Goyal) Shimla University Establishment and Regulation Act, 2012

contains the provision for dissolution of the University by the sponsoring body on completion of

twenty five years of its establishment, but it has been felt that the time period for such dissolution

of the University by the sponsoring body may not serve the interest of students in particular and the

State of Himachal Pradesh in general, because such Universities have been established keeping in

view the educational needs of the public at large and especially for the people of State of Himachal

Pradesh. Thus, in order to ensure that every private University may remain functional for a

considerable period and to achieve the desired objectives, it has been decided to make suitable

amendment in section 41 of the Act ibid to ensure that the sponsoring body of the University may

not dissolve the University before forty years of its establishment. This has necessitated amendment

in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

(VIRBHADRA SINGH)

Chief Minister.

BILL NO. 8 OF 2013

THE BAHRA UNIVERSITY (ESTABLISHMENT AND REGULATION) AMENDMENT

BILL, 2013

ARRANGEMENT OF CLAUSES

Clauses:

1.

Short title and commencement.

2.

Amendment of section 41.

_________

1. Short title and commencement.—(1) This Act may be called the Bahra University

(Establishment and Regulation) Amendment Act, 2013.

(2) It shall be deemed to have come into force on 29th day of September, 2010.

2.

Amendment of section 41.—In section 41 of the Bahra University (Establishment and

Regulation) Act, 2010, (2 of 2011) in sub-section (2), in the proviso, for the words “twenty five

years”, the words “forty years” shall be substituted.

93

jkti=] fgekpy izns'k] 04 vizSy] 2013@14 pS=] 1934

STATEMENT OF OBJECTS AND REASONS

In order to ensure appropriate standard of admission, teaching, examination, research and for

furtherance of higher education in the State, the State Government has established many private

Universities in the State by enactment of independent Act for each University. However, section

41 of the Bahra University (Establishment and Regulation) Act, 2010 contains the provision for

dissolution of the University by the sponsoring body on completion of twenty five years of its

establishment, but it has been felt that the time period for such dissolution of the University by the

sponsoring body may not serve the interest of students in particular and the State of Himachal

Pradesh in general, because such Universities have been established keeping in view the

educational needs of the public at large and especially for the people of State of Himachal Pradesh.

Thus, in order to ensure that every private University may remain functional for a considerable

period and to achieve the desired objectives, it has been decided to make suitable amendment in

section 41 of the Act ibid to ensure that the sponsoring body of the University may not dissolve the

University before forty years of its establishment. This has necessitated amendment in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.
