further to amend the Himachal Pradesh Co-operative Societies Act, 1968 (Act No.3 of
1969).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of
the Republic of India as follows:—
1. Short title and commencement.— (1) This Act may be called the Himachal Pradesh
Co-operative Societies (Amendment) Act, 2013.
(2) It shall be deemed to have come into force on 14th day of February, 2013.
2.
Amendment of section 34.—In section 34 of the Himachal Pradesh Co-operative
Societies Act, 1968, (3 of 1969) in sub-section (2), the first and second provisos shall be omitted
and thereafter, the following new sub-sections (2-A) and (2-AA) shall be inserted, namely:—
“(2-A). The managing committee shall, as soon as may be, elect from amongst its elected
or nominated members a Chairman, Vice-Chairman; or a President, Vice-President,
as the case may be, of the managing committee.
(2-AA). Notwithstanding anything contained in sub-section (2-A), where the State
Government has—
(i)
subscribed to the share capital of a co-operative society, or
(ii) assisted indirectly in the formation or augmentation of the share capital of a co-
operative society as provided under section 48, or
(iii) guaranteed the repayment of principal amount and payment of interest on loans
and advances to a society,
to the extent of rupees fifty lakhs or more, the State Government may appoint, one of the
members nominated under section 35, as Chairman of the managing committee of such
society:
Provided that no member of a managing committee shall be eligible to be elected or
appointed as Chairman or Vice-Chairman or President or Vice-President of the managing
committee of such society, if such member is a Minister in the State Government.”.
3.
Repeal of Ordiance No. 1 of 2013 and savings.—(1) The Himachal Pradesh Co-
operative Societies (Amendment) Ordinance, 2013 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the Ordinance
so repealed shall be deemed to have been done or taken under the corresponding provisions of this
Act.

STATEMENT OF OBJECTS AND REASONS
Section 34 of the Himachal Pradesh Co-operative Societies Act, 1968 (Act No. 3 of 1969),
as substituted by the H.P. Co-operative Societies (Amendment) Act, 2012, interalia, provides that
elected or nominated members of the managing committee shall be eligible to be elected as
Chairman or Vice-Chairman or President or Vice-President of the managing committee. Whereas
sub-rule (4) of rule 38 of the H.P. Co-operative Societies Rules, 1971 empowers the State
Government to appoint one of its members nominated under section 35 as the Chairman of the
managing committee of a Co-operative Society, where it has subscribed to the share capital or has
given guarantee or financial assistance to the extent of rupees fifty lakhs or more. However, the
amendment carried out in section 34 has rendered the provisions of rule 38(4) as redundant.
Presently, the State Government has contributed substantially to the share capital of Co-operative
Societies in the shape of share capital or guarantee or otherwise. Thus, in order to harmonize the
provisions of section 34 and rule 38(4) and to remove the ambiguity, it was decided to amend
section 34 of the Act ibid suitably and to ensure that the State Government continue to appoint
Chairman on the managing committee of a Co-operative Society where its share capital
contribution or guarantee or financial assistance is rupees fifty lakhs or more.
Since, the Legislative Assembly was not in session and amendment in the Himachal
Pradesh Co-operative Societies Act, 1968 had to be made urgently, therefore, the Himachal
Pradesh Co-operative Societies (Amendment) Ordinance, 2013 (Ordinance No.1 of 2013) was
promulgated under clause (1) of article 213 of the Constitution of India by H.E. the Governor of
Himachal Pradesh on 14th February, 2013, which was published in Rajpatra Himachal Pradesh on
14th February, 2013. Now, the Ordinance is being replaced by a regular legislation without any
modification.
The Bill seeks to achieve the aforesaid objectives.

Regulation) Act, 2007(Act No. 13 of 2007).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of
the Republic of India as follows :—
1.
Short title.—This Act may be called the Himachal Pradesh Private Clinical
Establishments (Registration and Regulation) Repeal Act, 2013.
2. Repeal of Act No. l3 of 2007 and savings.—The Himachal Pradesh Private Clinical
Establishments (Registration and Regulation) Act, 2007 is hereby repealed:
Provided that such repeal shall not affect,—
(a) any right, privilege, obligation or liability acquired, accrued or incurred under the said
Act; or
(b) any penalty, forfeiture or punishment incurred in respect of any offence committed
against the said Act; or
(c) any investigation, legal proceedings or remedy in respect of any such right, privilege,

registration made, license granted, license fee or any other fee imposed, under the Act
so repealed shall, in so far as it is not inconsistent with the provisions of the Clinical

deemed to have been done or taken as if the Himachal Pradesh Private Clinical
Establishments (Registration and Regulation) Act, 2007 (Act No.13 of 2007) had not
been repealed and any such appointment, delegation, notification, order, direction,
rules, registration, license, duty, license fee or other fee shall continue to be in force
accordingly until suspended.

STATEMENT OF OBJECTS AND REASONS
With the enactment of the Clinical Establishments (Registration and Regulation) Act, 2010
(Act No. 23 of 2010), by the Parliament which has been published in the Gazette of India, Extra-
Ordinary, dated 19th August, 2010 and has come into force from the same date is a comprehensive
legislation on the same subject matter. In order to avoid duality of the provisions and other legal
complications, it is considered essential to repeal the State Act on the same subject matter.
Moreover, in terms of article 252 of the Constitution, the provisions of the Central Act will prevail
over the provisions of the State Act if not repealed. As such, it has been decided to repeal the
Himachal Pradesh Private Clinical Establishments (Registration and Regulation) Act, 2007 (Act
No. 13 of 2007) and to ensure strict compliance of the provisions of the Central Act.
This Bill seeks to achieve the aforesaid objectives.
