THE HIMACHAL PRADESH TAX ON LUXURIES (IN HOTELS AND LODGING
HOUSES) AMENDMENT ACT, 2013
(AS ASSENTED TO BY THE GOVERNOR ON 13TH JANUARY, 2014)

further to amend the Himachal Pradesh Tax on Luxuries (in Hotels and Lodging Houses)
Act, 1979 (Act No. 15 of 1979).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fourth Year of
the Republic of India as follows:—
1.
Short title and commencement.—(1) This Act may be called the Himachal Pradesh
Tax on Luxuries (in Hotels and Lodging Houses) Amendment Act, 2013.
(2) It shall be deemed to have come into force on 6th day of August, 2013.
2.
Amendment of section 2.—(1) In section 2 of the Himachal Pradesh Tax on Luxuries
(in Hotels and Lodging Houses) Act, 1979 (hereinafter referred to as the “principal Act”), for
clauses(d) and (gg), the following clauses shall be substituted, namely:—
“(d) “hotel” means any premises or part of premises including a house-boat, restaurant, bar
or a tent where lodging with or without board or any kind of eatables or beverages or other
services are by way of business provided for a monetary consideration, and includes any
such other premises such as banquet hall, marriage palace, garden or lawn etc. let out for a
monetary consideration during any part of the financial year;
(gg) “receipt” means the amount of charges fixed by the Government or received by the
proprietor whichever is higher for any luxury provided in a hotel;”.
3.
Amendment of section 5-A.—In section 5-A of the principal Act, in sub-section (3),
for the words and sign “in accordance with such rules and on payment of such fee, as may be
prescribed”, the words “in prescribed manner” shall be substituted.
4. Amendment of section 6-E.—In section 6-E of the principal Act,—
(a) in the heading, after the words “tribal and hard areas”, the words “or in backward
Panchayats” shall be inserted.;
(b) for sub-section (1), the following sub-section shall be substituted, namely:—
“(1) Notwithstanding anything contained in this Act, if the Government is of
the opinion that in order to promote tourism in the tribal or hard areas or in
backward Panchayats in the State, it is necessary and expedient in the public
interest so to do, it may notify a scheme and exempt the registered proprietors of
new hotels in such tribal or hard areas which came into operation after 1st April,
2012, and in such backward Panchayats which came into operation after 1st April,
2013, from the payment of luxury tax for a period of ten years from the date the
hotel commences operation, subject to such restrictions and conditions as may be
specified in the said scheme.”; and
(c) the existing explanation appearing after sub-section (2) shall be numbered as
“Explanation-I”, and thereafter, the following Explanation-II shall be inserted,
namely:—
“Explanation-II.—For the purpose of this section the backward Panchayats means such
Panchayats as may be notified backward Panchayats by the Government.”.
5. Repeal of Ordinance No.4 of 2013 and savings.—(1) The Himachal Pradesh Tax on
Luxuries (in Hotels and Lodging Houses) Amendment Ordinance, 2013 is hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken under the Ordinance so
repealed shall be deemed to have been done or taken under the corresponding provisions of this
Act.

Draft Development Plan for Baddi Barotiwala Nalagarh Special Area was prepared by this
Authority and public objections and suggestions on the same were invited by the Authority vide
notification no. BBNDA/TCP/Objections & Suggestions on D.D.P./08-13464-13500 dated 30th
July, 2008.
Whereas the Development Plan was finalised in the light of various objections and
suggestions received on the draft development plan and was further submitted to the State
Government for its approval.
Whereas the State Government has issued directions to the Authority to revise the
Development Plan keeping in view the fresh requirements of the Industries Department.
Whereas the needful has been done.
Therefore in pursuance to the powers conferred under sub-section (1) of section-19 of the
Himachal Pradesh Town & Country Planning Act, 1977 (Act No. 12 of 1977), the Development
Plan for Baddi Barotiwala Nalagarh Special Area (Hindi Version) is hereby republished and the
notice is given that a copy of the said Development Plan is available for inspection in the official
website of the Authority. The English version of Development Plan has already been published by
this office for Public Objections/Suggestions vide this office letter No. BBNDA/TCP/Objections &
Suggestions on D.D.P./13-47198-205 dated 18th June, 2013 and Objections/Suggestions have been

the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor

Beas river following the north boundary of Mohal Gagla hadbast No. 55/18, Matyal 55/12,
Darla 55/19, Balla Ghirthan 55/32, Sujanpur 55/43 and Tihra 55/36 upto the northern-
eastern boundary meeting point of Mohal Tihra.
East: Starting from the meeting point of northern-eastern boundary of mohal Tihra towards
southern side following the eastern boundary of mohal Tihra Hadbast No. 55/36, Badola
Hadbast No. 55/22 and Charot Hadbast No. 55/44 upto the meeting point of eastern-
southern boundary of Mohal Charot.
South: Starting from the meeting point of eastern-southern boundary of Mohal Charot towards

No. TCP-F(5)-8/2013.—Whereas, the limits of “Sujanpur Planning Area” has been
altered under sub-section (2) of Section-13 of the Himachal Pradesh Town and Country Planning
Act, 1977 vide this Department Notification No. TCP-F(5)-8/2013 Dated 15-01-2014.
And whereas existing land use map of the said Planning Area has not yet been published as
required under sub-section (1) of Section-15 of the aforesaid Act;
And whereas the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning
Area the change of land use or any building operation therein is likely to cause injurious
disturbance of the surface or any land or soil, or is considered detrimental to the preservation of
soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan
and develop the said area in accordance with the provisions of the aforesaid Act;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of
the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor
of Himachal Pradesh is pleased to freeze the existing land use map of the “Sujanpur Planning
Area” for a period of three years from the date of publication of this Notification in the Official
Gazette, Himachal Pradesh.

No. TCP- F(5)-7/2013.—In exercise of powers conferred by sub-section (3) of Section1 of
the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor
of Himachal Pradesh is pleased to appoint the 15th day of January month, of the year, 2014 as the
day on which the provisions of aforesaid Act shall come into force in the following Revenue
villages of Tehsil Nadaun, District Hamirpur, Himachal Pradesh as per the specifications below:—

Shimla-2, 15th January, 2014
No. TCP-F(5)-7/2013.—Whereas, the limits of “Naudan Planning Area” has been altered
under sub-section (2) of Section-13 of the Himachal Pradesh Town and Country Planning Act,
1977 vide this Department Notification No. TCP-F(5)-8/2013 Dated 15-01-2014.
And whereas existing land use map of the said Planning Area has not yet been published as
required under sub-section (1) of Section-15 of the aforesaid Act;
And whereas the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning
Area the change of land use or any building operation therein is likely to cause injurious
disturbance of the surface or any land or soil, or is considered detrimental to the preservation of
soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan
and develop the said area in accordance with the provisions of the aforesaid Act;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of
the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor
of Himachal Pradesh is pleased to freeze the existing land use map of the “Naudan Planning
Area” for a period of three years from the date of publication of this Notification in the Official
Gazette, Himachal Pradesh.
