29-01-2014 as required under Clause (3) of Article 348 of the Constitution of India].

Shimla-171002, the 29^th January, 2014

File No. EXN-F(1)-7/2012.—Whereas the draft notification regarding carrying out

amendments in SCHEDULE ‘A’ to the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12

of 2005), was notified in accordance with the provisions of Section 10 of the Act ibid for inviting

objection(s) and suggestion(s) from the person(s) likely to be affected thereby, vide this

Department’s Notification of even number dated 31-12-2013 and published in the e-Gazette,

Himachal Pradesh on 02-01-2014;

And whereas some objections/suggestions were received within the stipulated period which

were duly considered and rejected.

Now, therefore, the Governor, Himachal Pradesh, in exercise of the powers vested in her

under section 10 of the Act ibid is pleased to carry out the following amendments with effect from

01-02-2014, namely:—

1. After PART-I of SCHEDULE ‘A’ to the said Act, the following new PART-I(A)

shall be inserted, namely:-

Shimla-2, the 30^th January, 2014

No.Rev.B.A.(3)-3/2013.—In exercise of the powers conferred by section 122 of the

Himachal Pradesh Tenancy and Land Reforms Act, 1972 (Act No. 8 of 1974), the Governor,

Himachal Pradesh proposes to make the following rules, further to amend the Himachal Pradesh

Tenancy and Land Reforms Rules,1975 as amended from time to time and the same are hereby

published for the information of general public as required under section 123 of the Act ibid;

Any interested person who has any objection(s)/suggestion(s) with regard to the proposed

amendments, may send the same to the Principal Secretary (Revenue) to the Government of

Himachal Pradesh, Shimla-171002, within a period of thirty days from the date of publication of

these rules in the official Gazette (e-Gazette) Himachal Pradesh;

The objection(s) /suggestion(s), if any, received within the period specified above shall be

duly considered by the Government before finalising these rules, namely:—

DRAFT RULES

1.

Short title and commencement.—(1) These rules may be called the Himachal

Pradesh Tenancy and Land Reforms (8^th Amendment) Rules, 2013.

(2) They shall come into force from the date of publication in the official Gazette (e-

Gazette), Himachal Pradesh.

2.

Amendment of rule 38-A.—In clause (b) of sub-rule (2) of rule 38-A of the

Himachal Pradesh Tenancy and Land Reforms Rules, 1975, after figures and words “30 days”

following shall be inserted;—

“.However, in case of setting up of an industrial unit such application shall be considered

and allowed or rejected within 15 days”.

3.

Amendment of the Form LR-XIV.—In Part-II of FORM LR-XIV appended to the

said rules, the existing item No. (VI) shall be renumbered as (V) and thereafter following item shall

be added;—
