further to amend the Himachal Pradesh Tax on Luxuries (in Hotels and Lodging Houses)
Act, 1979 (Act No. 15 of 1979).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-fifth Year of
the Republic of India as follows:—
1. Short title.—This Act may be called the Himachal Pradesh Tax on Luxuries (in
Hotels and Lodging Houses) Amendment Act, 2014.
2.
Amendment of section 2.—In section 2 of the Himachal Pradesh Tax on Luxuries (in
Hotels and Lodging Houses) Act, 1979, (15 of 1979) (hereinafter referred to as the “principal
Act”), for clause (gg), the following clause shall be substituted, namely:—
“(gg) "receipt” means the amount of monetary consideration received or receivable by
a proprietor for any luxury provided in a hotel;”.

3. Substitution of section 6-B.—For section 6-B of the principal Act, the following
section shall be substituted, namely:—
"6-B. Lump-sum luxury tax by way of composition.—Notwithstanding anything
contained in this Act, the proprietor shall be liable to pay luxury tax in lump-sum by
way of composition, as the Commissioner or the officer authorized by him in this
behalf may determine, in public interest, on the basis of a simplified formula based on
rates and charges fixed by the prescribed authority for the luxury provided in a hotel
and subject to such conditions, in such manner and to be paid at such intervals as may
be prescribed, and thereupon, during the period such composition remains in force, the
provisions of this Act and the rules made thereunder relating to the filing of returns and
the maintenance of accounts by such proprietor shall not apply to him.”.

STATEMENT OF OBJECTS AND REASONS
In order to prevent leakage of tax and ensure revenue growth, the definition of “receipt”
was re-defined so that tax could be levied on the amount of charges fixed by the Government or
received by the proprietor whichever is higher for the luxury provided in a hotel. After having
detailed discussions with the stakeholders, it is proposed that the definition of “receipt” may remain
same as it was before the above mentioned amendment of the principal Act. However, in order to
prevent leakage of tax and ensure revenue growth, it was felt necessary to make enabling provision
in the Act to introduce a lump-sum scheme compulsory for payment of luxury tax under the
Himachal Pradesh Tax on Luxuries (in Hotels and Lodging Houses) Act, 1979. As such, it has been
decided to substitute section 6-B of the Act ibid accordingly.
This Bill seeks to achieve the aforesaid objectives.

FINANCIAL MEMORANDUM
The provisions of the Bill when enacted may result some reduction in tax collection which
cannot be quantified. The provisions of the Bill when enacted will be enforced by the existing
Government machinery and no additional expenditure will be involved.

MEMORANDUM REGARDING DELEGATED LEGISLATION
Clause (3) of the Bill seeks to empower the State Government to make rules providing for a
simplified formula for the purpose of calculation of lump-sum luxury tax and conditions, manners
and intervals for the payment of such lump-sum luxury tax by the proprietors. The proposed
delegation of power is essential and normal in character.
