NOTIFICATION
Shimla-2, the 28th June, 2014
File No. TPT-F (6) 2197-V-Loose.—Whereas at present, the Government has laid down a
procedure vide its letter no Tpt-F(6)2/97-lV dated 18110107 for the issuance/renewal of
authorization for the establishment of Pollution Check Centers(PCC) to check the emission of all
types of vehicles in the State and;
Whereas it is felt that under current norms, the permission to establish a PCC is granted to
the applicant after consuming considerably long period of time and;

Whereas the state Government is of the view that a more efficient and transparent
mechanism needs to be formulated for issuance/renewal of authorizations for the establishment of
PCC under the provisions of Central Motor Vehicles Rules, 1989.
Now, therefore in exercise of the powers conferred by Rule 115 (7) of Central Motor
Vehicles Rule, 1989, in supersession of all previous orders/instructions, the Governor, Himachal
Pradesh is pleased to notify the following procedure to issue/renew the authorization for the
establishment of pollution check centers in Himachal Pradesh, namely:—
1.
Eligibility/Qualification for Authorization:
(a) No person shall be eligible for being authorized to run a PCC, or, if authorized, to
continue as such, if such person;
i.
is less than 18 Years of age;
ii. is in the employment of Government or local authority;
iii. is of unsound mind;
iv. is an un-discharged insolvent;
v.
has been dismissed from the service of Government or any local authority;
vi. has been convicted of any offence involving moral turpitude;
vii. is not a Bonafide resident of Himachal Pradesh;
viii. is a tax defaulter of the Government;
ix. is not having qualification of Matric or Tenth
(b) Any person already running an authorized PCC under the provisions of taw existing
before the issuance of this notification, shall get renewal of his authorization under this
notification, within one year from the coming into force of this notification.
Provided that while renewing the authorization of such an authorized agency the Regional
Transport Officer (hereinafter referred to as 'RTO') shall make sure that the said authorized agency
complies with all the requirements stipulated under this notification.
2.
How to apply :
The applicant shall apply to the RTO concerned in FORM-1 appended to this notification
along with the applicable fee and security as specified in Rule 40A of the Himachal Pradesh Motor
Vehicle Rules, 1999 (hereinafter referred to as the 'HPMVR').
3.
Accommodation and Infrastructure :
The applicant shall, at his own cost, provide:
(i) An owned/leased/hired room of size not less than ten feet by ten feet for the setting up
of machines and office.
(ii) Adequate space for parking of at least 5 vehicles.
(iii) Pollution check machines as approved by the Director Transport.
(iv) Mini workshop and one mechanic for minor adjustments.
(v) All the hardware, as specified by the Director Transport, along with a working internet
connection for online real time data transmission and approval from the central seryer
of the Department.

(vi) Any other hardware or software as the Director Transport may specify in future for
running the PCC.
4.
Inspection of Premises :
The Motor Vehicles Inspector (MVI) of the department or any other official authorized by
the Director Transport, in this regard, shall inspect the premises and submit the detailed report to
RTO in FORM-2 appended to the Notification.
5.
Authorization – Grant/Renewal/Suspension/Cancellation :
(a) On receipt of inspection report from MVI or authorized official, the concerned
applicant, upon deposition of the applicable fee and security as prescribed under Rule
40A of the HPMVR, in the account of e-Governance Society of Directorate of
Transport and upon his accepting the terms & conditions of this Notification, shall be
granted an authorization to run a PCC under this Notification, in FORM-3, by the RTO
concerned.
(b) Upon grant of such an authorization the applicant shall be called an 'authorized
agency'.
(c) The RTO may issue a duplicate authorization to the authorized agency on payment of
fee as prescribed under Rule 40A of the HPMVR.
(d) The RTO concerned, may for reasons to be recorded in writing, refuse to grant or
renew an authorization or having granted or renewed it, may subsequently cancel,
suspend or revoke it, for contravening any of the conditions of this notification or any
relevant provisions of the Motor Vehicle Act, 1988 and Rules made there under,
without prejudice to any other punishment to which the applicant/authorized agency
may be liable.
(e) Where the RTO refuses to grant or renew or cancels or suspends or revokes any
authorization, he shall before making an order in this behalf, require the applicant or as
the case may be, the authorized agency, to show cause within a specified time why
such order should not be made. lf the applicant or the authorized agency does not show
any cause within the specified time, or show cause, which in the opinion of the RTO is
not satisfactory, the RTO concerned shall make an order accordingly.
(f) If any complaint is received against any authorized agency from any source, the facts
will be enquired by the concerned officers of transport department and the case can be
recommended for cancellation/suspension of the license to the RTO who shall take a
final decision in the matter but not before affording the authorized agency an
opportunity of being heard.
(g) Where a authorization is liable to be cancelled or suspended under clauses (d), (e) & (f)
and the RTO is of opinion that having regard to the circumstances of the case, it would
not be necessary or expedient so to cancet or suspend the permit if the holder of the
permit agrees to pay a certain sum of money, then, notwithstanding anything contained
in this clause, the RTO may, instead of cancelling or suspending the authorization, as
the case may be, recover from the authorized agency the sum of money agreed upon,
which shall not be less than ten thousand rupees in any one instance.

(h) No applicant or authorized agency shall be entifled to the refund of fee paid by him or
any compensation for refusal or canceltation or suspension or revocation of his
authorization.
(i) An applicant or an authorized agency may at any time, by making an application to the
RTO concerned, voluntarity withdraw from the process of authorization or if already
authorized, surrender his authorization voluntarily for which he shall be entitled to a
refund of security deposited after deducting reasonable charges as the RTO may decide
vide a speaking order in this regard.
Provided that before passing any order under this clause the RTO shall afford the applicant
or the authorized agency, as the case may be, an opportunity of being heard.
6.
Authorization- Validity and other issues :
(a) An authorization issued under this notification shall be valid for 5 years and shall be
renewable on payment of a fee as prescribed in the Rule 40 of the HPMVR of this
notification by making an application for the same to the RTO concerned at least60
days before the date of expiry of the authorization.
Provided that the RTO may, if satisfied, that the authorized agency was prevented from
applying for renewal due to sufficient cause' entertain an application for renewal of
authorization made after the expiry of the prescribed period and renew the same,
subject to the penalty provided in the Rule 40 of the HPMVR'
Explanation.—For the purpose of this clause if the authorization is issued in the Calendar
year 2013, it shall deemed to be expiring on 31st December, 2017.
(b) In case the authorized agency fairs to renew its authorization within one year from the
date of its expiry, it shall have to procure a fresh authorization under this notification.
Explanation.—In the scenario mentioned above, in the explanation to sub clause a), if the
agency faits to renew its authorization on or before 31st December, 2018 it shall have to
procure a fresh authorization as per this sub clause.
(c) No authorized agency, the period of validity of whose authorization has expired, shall
be entitled to carry on its business unless:
i.
it has applied for renewal of his authorization and paid the requisite fee before the
expiry of the validity period of his authorization; or
ii. it has applied for the renewal of his authorization and deposited the renewal fee
and penalty within one year after the expiry of the validity period of his
authorization.
7.
Other Powers :
(a) The Director Transport may, from time to time issue specific or general directions to
the RTO or the authorized agency for operationalizing the Provisions of this
notification.
(b) Not withstanding the generality of clause a), the Director Transport may from time to
time:
i.
issue Standard Operating Procedures (SOP) for the authorized agency to follow
while delivering their services.

ii.
These SOPs may, inter alia, include matrix of incentives and disincentives,
whether monetary or othewise, designed to improve the service delivery
efficiency of an authorized agency, in public interest.
(c) Where the Government is of opinion that it is necessary or expedient in the public
interest so to do, it may, by notification in the Official Gazette, and subject to such
conditions as it may specify in the notification, require either totally or partially any
class of businesses or any business belonging to any person or class of persons to
compulsorily get authorized under this notification.
(d) Every authorized agency shall, when sore quired, by general or special directions by
the RTO or Director Transport or the Government, furnish truthfully and to the best of
his knowledge such particulars relating to its activities, as authorized agency, or
dealings thereof, as may be required.
(e) If the authorized agency who has deposited security under the provisions of this
notification contravenes any of the provisions of this notification or conditions of its
authorization then without prejudice to any other action which may be taken against it,
the RTO may direct by order in writing that its security shall be confiscated in whole
or in part and used to make good such losses to such parties as he may determine in the
said order.
8.
Power to inspect and seize :
The Director Transport or RTO or any other person duly authorized by him in this behalf
may, with a view to securing compliance with the provisions of this notification or the Motor
Vehicle Act, 1988 or any Rule made there under may;
(a) enter and inspect any premises on which he has reasons to believe that such provisions
are being violated; and
(b) seize any record or material pertaining to providing Pollution Under Control
Certificate (hereinafter referred to as 'PUCC'), of which he has reasons to believe that
contravention of such provisions has been or is being or is about to be committed; and
(c) every person (including his agents and servants) in charge of a premises which is
searched under the provisions of sub-clause a) shall allow, the authority making the
demand, access to such premises and shall also answer all questions put to him
truthfully and to the best of his knowledge and belief.
9.
Role and Responsibilities of the authorized agency :
The authorized agency shall :
(a) display the authorization and certificate of training of the person who shall be
authorized to put his signatures on PUCC, in a conspicuous place on the premises in
which he carries on his business.
(b) provide adequate parking for the vehicles to avoid traffic jams on the road;
(c) issue PUCC to the vehicles after strict inspection as required under prescribed
pollution norms.

(d) maintain record and submission of statements in the manner prescribed by Director
Transport from time to time.
(e) Apply for the renewal of authorization, 60 days before its expiry and to produce
calibration certificate of machines, duly issued by the authorized representative of the
original manufacturer of the concerned machines at the time of renewal.
(f) get the machines updated as per instructions issued by Director Transport from time to
time.
(g) not charge the fees in excess of those mentioned in the Rule 40A of the Himachal
Pradesh Motor Vehicle Rules, 1999.
(h) realize the e-governance charges and to deposit such amount in the manner prescribed.
(i)
In due course the government or Director Transport may cause to be developed
computer based software applications for delivery of any of the services mentioned in
the Rule 40A of the HPMVR or any other service, which is thereafter included in the
Rule 40A of the HPMVR, in public interest. It shall be the responsibility of the
authorized agency to deliver those services in the manner prescribed, for which he
shall claim no extra monetary or other benefit from the government or Director
Transport.
(j)
The authorized agency will be given a unique login ID & Password for making all
entries in a speciat portal to be designed for data entry into the softwares maintained by
the transport department. By doing so he will again be held accountable to the client as
well as the department for any service he provides and/or fails to provide;
(k) The Director Transport may, in public interest, specify any other responsibility(s) for
the authorized agency, which the authorized agency shall adhere to in future too.
10.
Role and responsibilities of e-governance society:
(a) The e-governance society of the Directorate of Transport shall by itself or otherwise,
cause to be developed and deploy an integrated software for checking the readings
taken by PCC for issuing PUCC.
(b) The e-governance society shall maintain the hardware/server at Headquarter required
for the smooth functioning of software for which a fee shall be charged as prescribed
in Rule 40A of the HPMVR.
(c) The e-governance society shall provide updates of software from time to time to the
PCC and attend to all software operationalization issues.
(d) The Director Transport may, in public interest, specify any other responsibility(s) for
the e-governance society, which it shall adhere to in future too.
(e) The e-governance society may, after deploying and operationalizing the integrated
software, charge such amount of user charges as the Director Transport may authorize
in terms of notification no. TPT-F(1)3/2000-e-Governance dated 03/09/2005.

11.
Provision for trade :
(a) The authorized agency shall not be at liberty to sell or transfer its business or
authorization to anyone, except with the permission of the Director Transport.
Provided that the Director Transport shall give his permission only when the person
taking over the business/authorization fulfills all the formalities as prescribed under
this notification and pays the fee prescribed under the Rule 40A of the HPMVR.
(b) However, in case of the death or dissolution of an authorized agency it may be
transferred in the name of its legal heirs or successors, without taking any permission
or the payment of any fee.
12.
Appeal and its Procedure :
(a) Any person aggrieved by an order of the RTO under this notification, may within 30
days of receipt of any such order, appeal to the Director Transport.
(b) Any person aggrieved by an order of the Director Transport under this notification,
may within 30 days of receipt of any such order, appeal to the Government.
Provided that no appeal shall lie against any order passed under clause 8 of this
notification.
(c) The appeal referred to in Clause (a) or (b) above, shall be preferred in duplicate, in the
form of a memorandum, setting forth the grounds of objections to the order and shall
be accompanied by the prescribed fee mentioned in Rule 40A of the HPMVR.
(d) The Appellate Authority or the Government, after giving an opportunity to the parties
to be heard and after such enquiry, if any, as it deems necessary, pass appropriate
orders within the period of 30 days from the receipt of such an appeal.
13.
Power to remove difficulties :
If any difficulty arises in giving effect to the provisions of this notification the Director
Transport may by notification to be published in the Gazette, make such provisions, not
inconsistent with the provisions of this notification as appear to be necessary or expedient for
removing the difficulty.

Conditions of Authorization
The holder's of the authorization shall :
1.
Abide by all the provisions of CMV Rules, 1989 and Himachal Pradesh Pollution Check
Centre Notification, 2013.
2.
Display the authorization in conspicuous place on the premises in which he carries on his
business.
3.
Maintain any register or record or supply information that the Director Transport or RTO
may by general or special order require him to supply.
4.
Permit the Director Transport or RTO or any other persons authorized by him:—
a.
to inspect the premises in which he carries on his business;
b. to inspect any records which the holder is required by the conditions of his
authorization to keep.
5.
Submit scanned copy of calibration certificates of the pollution check machines, issued by
the company or authorized dealer every year in the office of RTO concerned through e-
mail, failing which the online access shall be denied.
6.
Not issue PUC certificates to the vehicles owned by him/her or owned by his/her relatives
of blood relations.

the undersigned under section 13 (3) of Birth and Death Registration Act, 1969 alongwith affidavits
and other documents stating therein that his daughter and son namely Miss Abhilasha Chadda and
Mr. Ashish Chadda born on 31-3-1997 and 26-1-1995 respectively at Parwanoo, Tehsil Kasauli,
District Solan, Himachal Pradesh but their date of birth could not be registered in the records of
M. C. Parwanoo, Tehsil Kasauli, within stipulated period. Hence he prayed for passing necessary
orders to the Registrar, Birth and Death Registration, M. C. Parwanoo, Tehsil Kasauli, for entering
the same in the birth and death records.
