No. Shram (A) 4-1/14-BOCW.—In exercise of powers conferred by section 62 of the
Building and Other Construction Workers (Regulation of Employment and Conditions of Service)
Act,1996, the Governor of Himachal Pradesh, after consultation with the Expert Committee, is
pleased to make the following rules further to amend the Himachal Pradesh Building and Other
Construction Workers (Regulation of Employment and Conditions of Service)Rules, 2008 notified
vide this Department Notification No. Shram (A) 4-6/2007-BOCW,dated 4th December, 2008 and
published in Rajptra Himachal Pradesh on dated 8th December, 2008, namely :—
1. Short title.—These rules may be called the Himachal Pradesh Building and Other
Construction Workers (Regulation of Employment and Conditions of Service) 2nd Amendment
Rules, 2014.
2. Amendment of rule 266.—In rule 266 of the Himachal Pradesh Building and Other
Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, for sub-
rule (3), the following sub-rule shall be substituted, namely:—
“ (3) The application for registration shall be accompanied with a Certificate or wage
slips from the employer or contractor or copy of Muster Roll or Attendance Register to

the effect that the applicant is a construction worker. If such certificate is not available,
a certificate issued either by the registered Construction Workers Union or Executive
Officer of the concerned Local Urban Bodies or Secretary of Gram Panchayat to the
effect that applicant has worked for at least 90 days in the preceding twelve months
may be considered. The certificate issued by agencies other than the employer shall
contain complete details of the employer where the applicant has worked in the
relevant period and such certificate shall be got verified by the authorised officer from
the concerned employer’s.

service in favour of Sh. Rajinder Singh Chandel, Superintendent Grade-I, office of District and
Sessions Judge, Una for a period of one year on and w.e.f. 01.05.2015 beyond the age of
superannuation i.e. 58 years till the attainment of age of 59 years, in public interest, subject to the
following conditions:
(i) The option once exercised will be treated as final and shall not be allowed to be
withdrawn / changed in any circumstances.
(ii) During the extension, Sh. Rajinder Singh Chandel, aforesaid, shall continue to draw
the same pay, which was being drawn by him at the time of attaining the age of
superannuation i.e. 58 years.

Provided that increases in the dearness allowance as may be sanctioned by the
Government from time to time shall be admissible during the extension.
Provided, further that the officer will be considered for promotion in case of
availability of promotional post during the extended service. In case of such promotion, pay
will be fixed from the date of promotion.
(iii) The officer will be entitled to receive pensionary benefits on completion of his
extended service.
(iv) The extension in service will be subject to satisfaction of the High Court and the High
Court may withdraw the extension given at any stage.
As a consequence of the extension in service so granted to Sh. Rajinder Singh Chandel,
Superintendent Grade-I, who is due to retire from service on attaining the age of superannuation on
30.04.2015(A.N.), shall now retire from service on 30.04.2016(A.N.), subject to the aforesaid
conditions.

3. Amendment.—In Item No. 4(A), of the Part-E “Class-IV” of the Schedule annexed

Conditions of Service, Conduct & Appeal) Rules, 2003 the following shall be added after sub
clause (c) below column “Mode of Appointment:
