Science, RKMV Shimla H.P. was served with a Charge Sheet under Rule-14 of the Central Civil

Services (Classification Control and Appeal) Rules, 1965 vide this Department Memorandum of

even number dated 26th Oct. 2013 on the following charges:—

Article-I of Annexure-I

That the said Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV Shimla, Distt.

Shimla, H.P. while working in the aforesaid college remained willfully absent w.e.f. 15-10-2007 to

till date, which is very unbecoming on the part of the said Lecturer and tantamount to misconduct,

misbehaviour and violation of Rule 3 (1) i, ii & iii of CCS (Conduct) Rules, 1964 in general and

F.R.17-A in particular.

That the said Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV Shimla, Distt.

Shimla, H.P. while working in the aforesaid college during the year 2007 submitted an application

dated:13-10-2007 requesting therein for Casual Leave w.e.f. 15-10-2007 to 22-10-2007 in her favor

with the permission to leave the station which has been sanctioned by the then Principal, RKMV,

Shimla. Thereafter, instead of joining her duties, she send following leave applications for granting

Therefore, said Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV, Shimla

remained willfully absent from the duties w.e.f. 15-10-2007 to date without any prior permission

and sanction of the competent authority, thus she failed to resume her duties resulting loss of

studies of the students, which is very unbecoming being a Government employee and tantamount to

misconduct, misbehavior and violation of Rule 3(1) i, ii & iii of CCS (Conduct) Rules, 1964 in

general and F.R.17-A in particular.

2. AND WHEREAS, under sub-rule (2) of the Rule-14 of the Central Civil Services

(Classification Control & Appeal) Rules, 1965 and Inquiring Authority was appointed vide this

department order of even number dated 18th Nov. 2013 to enquire into the charges framed against

Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV, Shimla, who submitted the Inquiry

Report vide his letter EDN-HPA/JDHE(C-I)2014-Inquiry dated 24th April 2014 in which the

charges leveled against the CO stood unequivocally proved beyond reasonable doubt.

4. AND WHEREAS, the brief facts of the case are that the charged officer applied for casual

leave on 13-10-2007 by submitting an application requesting therein for casual leave w.e.f. 15-10-

2007 to 22-10-2007 alongwith permission to leave the station and thereafter continuously applied

for leave but never got them sanctioned and in effect remained wilfully absent w.e.f. 23-10-2007 to

till date. She applied for Pre-Mature retirement from Government Service on 1-2-2010 with the

three months notice. But the said request was rejected by the Government as her case was not

covered as per the provisions of the H.P. Civil Services (Pre-Mature Retirement) Rules. Thereafter,

she submitted her resignation from Government Service on 5th January 2013 and on 27-9-2013.

5. AND WHEREAS, keeping in view the facts and circumstances of the case as discussed

above and after careful consideration of the whole matter, record, the undersigned does not find any

reason to disagree with the findings given by the Inquiry Officer and the report of inquiry is fully

agreed to and accepted accordingly. I hold that it has been proved beyond reasonable doubt that

Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV, Shimla has remained willfully absent

w.e.f. 23-10- 2007 to till date the date of her resignation i.e. 5-1-2013, which amounts to conduct

unbecoming of a Government servant and violation of the provisions of the CCS (Conduct) Rules,

1964 as well as no interest to continue / towards the Government service.

6. NOW, THEREFORE, the undersigned, in exercise of the powers vested under Rules-15

read with Rule-11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965

hereby accepts the request of Smt. Rupa Dass Gupta, Lecturer in Home Science, RKMV, Shimla

H.P for resignation from 5-1-2013 and orders that the period of absence w.e.f. 23-10-2007 to 5th

309 of the Constitution of lndia, the Governor, Himachal Pradesh in consultation with HP Public

Service Commission is pleased to make the following Rules further to amend the Himachal Pradesh

Public Works Department, Junior Engineer (Civil), Class-Ill (Non-Gazetted) Recruitment and

Promotion Rules, 2012 notified vide this Department Notification of even number dated 25-8-2012,

namely :—

Short title and Commencement.—(i) These rules may be called the Himachal

Pradesh Public Works Department Junior Engineer (Civil), Class-III (Non Gazetted) Recruitment

& Promotion (1^st amendment) Rules, 2015.

(ii) These rules shall come into force from the date of publication in the Rajpatra,

Himachal Pradesh.

Amendment of Annexure-A.—In Annexure-A to the Himachal Pradesh Public works

Department Junior Engineer (Civil), Class-III (Non Gazetted) Recruitment & Promotion Rules,

2012, for the existing provision against Column No. 7, the following shall be substituted:

"Essential Qualifications :

(i)

Should have passed matriculation examination or its equivalent from a recognized

Board/University.
