Sections 11 and 12 of the Shimla Road Users and Pedestrians (Public Safety and
Convenience) Act, 2007 provides for on the spot checking by Executive Magistrate or Police
Officer not below the rank of Sub-Inspector. It has been observed that with the increase in the
number of vehicles, particularly, in the tourist season and unavailability of Police Officers it
becomes difficult to check each and every vehicle passing through sealed and restricted roads and
to take action. Thus it has been decided to empower the Assistant-Sub-Inspector of Police also for

THE HIMACHAL PRADESH VILLAGE COMMON LANDS VESTING AND
UTILIZATION (AMENDMENT) BILL, 2015
(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)
A
61
jkti=] fgekpy izns'k] 4 vizSy] 2015@14 pS=] 1937
BILL
further to amend the Himachal Pradesh Village Common Lands Vesting and Utilization
Act, 1974 (Act No. 18 of 1974).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-sixth Year of
the Republic of India as follows :—
1.
Short title.—This Act may be called the Himachal Pradesh Village Common Lands
Vesting and Utilization (Amendment) Act, 2015.
2.
Insertion of new section 8-B.—After section 8-A of the Himachal Pradesh Village
Common Lands Vesting and Utilization Act, 1974, the following section 8-B shall be inserted,
namely :—
“8-B. Conferment of proprietary rights on Chakotadars.—Notwithstanding anything
contained in sections 4 and 5 of this Act, the State Government may, by notification in the
Official Gazette, frame a Scheme providing for conferment of proprietary rights on
Chakotadars, who have been leased out lands on Chakota basis by the Panchayats under the
Punjab Village Common Lands (Regulation) Act, 1961, before the commencement of this
Act.”.
____________
STATEMENT OF OBJECTS AND REASONS
The Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 came into
force with effect from 29-8-1974 which provides for vesting and utilization of village common
lands in the State of Himachal Pradesh. Section 4 of the said Act provides for treatment of leases
made by the Panchayats under the provisions of Punjab Village Common Lands (Regulation) Act,
1961. As per information available with the Government, total 1237 cases (981 in district Solan,
184 in Kangra, 36 in Hamirpur and 36 in district Una) are there in which lands were allotted by the
Panchayats under the Punjab Village Common Lands (Regulation) Act, 1961 on Chakota basis to
Chakotadars. Since, these lessees (Chakotadars) have developed such lands for agricultural/
horticulture purposes and have also made their dwelling houses and cowsheds on such lands. They
are constantly demanding proprietary/ownership rights over such lands, on free hold basis.
Presently, there is no provision in the Himachal Pradesh Village Common Lands Vesting and
Utilization Act, 1974 to provide ownership rights to such Chakotadars and the lands vested in the
State under the said Act can only be utilised as per provisions of section 8 of the said Act. Thus,
keeping in view of above facts and to avoid multiplicity of unnecessary litigation, it has been
decided to finally settle these cases and to confer ownership rights on these Chakotadars by making
enabling provision in the Act ibid. As such, it has been decided to insert a new section 8-B which
may provide for framing of a Scheme by the State Government for this purpose. This has
necessitated amendment in the Act ibid.
This Bill seeks to achieve the above objectives.
(KAUL SINGH THAKUR)
