further to amend the Himachal Pradesh Co-operative Societies Act, 1968 (Act No. 3 of
1969).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-sixth Year of
the Republic of India as follows :—
1. Short title and commencement.—(1) This Act may be called the Himachal Pradesh
Co-operative Societies (Amendment) Act, 2015.
(2) It shall be deemed to have come into force on 1st day of April, 2014.
2. Amendment of section 34.—In section 34 of the Himachal Pradesh Co-operative
Societies Act, 1968 (hereinafter referred to as the “principal Act”),—

(a) in sub-section (2), after clause (c), the following new clause (d) shall be inserted,
namely :—
“(d) appointment made by the Registrar under section 34-A.”; and
(b) in sub-section (3), the first and second provisos shall be omitted.
3.
Insertion of new section 34-A.—After section 34 of the principal Act, the following
section shall be inserted, namely :—
“34-A. Appointment of managing committee member by the Registrar.—(1)
Notwithstanding any limits specified in the bye-laws, in order to represent appropriate
interests, the Registrar shall appoint an additional number of members for the managing
committee, not exceeding one-third of the number of elected members:
Provided that the total number of committee members so elected, nominated and appointed
under sections 34, 35 and sub-section (1) of this section, shall not exceed the maximum limit
specified under sub-section (3) of section 34.
(2) Out of the members appointed under sub-section (1), one shall be a person belonging
to Scheduled Castes, one belonging to Scheduled Tribes and the remaining, if any, representing
other appropriate interests including the interests of women, unless a member each belonging to the
Scheduled Castes and Scheduled Tribes and representing other interests has already been elected on
such committee.
(3) The members so appointed under sub-sections (1) and (2) shall hold office till the next
election of the managing committee or till other persons are appointed in their place, whichever is
earlier, and shall have the right to vote.
(4) The managing committee members appointed under this section may or may not be the
members of the society but should possess all the qualifications prescribed for membership of a co-
operative society and the managing committee.
(5) If a vacancy occurs in the office of an appointed member in the managing committee,
the Registrar shall fill up such vacancy by an appointment from amongst the same class of persons
in respect of which the vacancy has arisen.”.
4.
Repeal of H. P. Ordinance No. 1 of 2015.—The Himachal Pradesh Co-operative
Societies (Amendment) Ordinance, 2015 is hereby repealed.

STATEMENT OF OBJECTS AND REASONS
Section 34 of the Himachal Pradesh Co-operative Societies Act, 1968 (Act No. 3 of 1969)
provides for constitution of managing committee of every society and further provides for
reservation of 33 % seats to women on the managing committee and one seat reserved for the
Scheduled Castes and Scheduled Tribes on such committee. This provision is not in consonance
with rule 38 and 39 of the Himachal Pradesh Co-operative Societies Rules, 1971, because rules 38
and 39 of the said rules empowers the Registrar of the Co-operative Societies to appoint
additional number of members on the managing committee to represent appropriate interests
including the interests of women. Thus, in order to remove the ambiguity and to make the

provisions of section 34 more clear and unambiguous, it was decided to amend this section
suitably.
Keeping in view the urgency of the matter, it was also decided to bring an Ordinance
because the State Legislative Assembly was not in session. As such, the Himachal Pradesh Co-
operative Societies(Amendment) Ordinance, 2015 (Ordinance No. 1 of 2015) was signed by the
Governor on 26-2-2015, but in the meanwhile the notification of the Budget Session of the
Legislative Assembly was issued, therefore, the matter was reconsidered by the Cabinet in its
meeting held on 26-2-2015 and it was decided to not to promulgate the Ordinance and to bring
amendment Bill before the Legislative Assembly. Thus, in order to achieve the above objectives,
it has been proposed to insert section 34-A and also to amend section 34 suitably so as to remove
the ambiguity.
This Bill seeks to achieve the aforesaid objectives.

further to amend the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994).
BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-sixth Year of
the Republic of India as follows:—
1.
Short title.—This Act may be called the Himachal Pradesh Panchayati Raj
(Amendment) Act, 2015.
2.
Amendment of section 2.—In section 2 of the Himachal Pradesh Panchayati Raj Act,
1994 (hereinafter referred to as the ‘principal Act’),—
(a) after clause (19), the following new clause (19-A) shall be inserted, namely:—
“(19-A) “Mahila Gram Sabha” means a Mahila Gram Sabha constituted under section
5-B of this Act;”; and
(b) after clause 21, the following new clause (21-A) shall be inserted, namely:—
“(21-A) “near relative” means any person who is related to the office-bearer of the
Panchayat which includes father, mother, grand-father, grand-mother, wife, husband,
father-in-law, mother-in-law, maternal or paternal uncle, son, grand-son, daughter,
grand-daughter, son-in-law, daughter-in-law, brother, brother-in-law, nephew, niece,
sister or sister’s husband;”.
3.
Amendment of section 5.—In section 5 of the principal Act, in sub-section (1), for the
words and signs “on the first Sunday of January, April, July and on second October”, the words
and signs “in the months of January, April, July and October” shall be substituted, and after sub-
section (1) as so amended, the following new proviso shall be inserted, namely:—

“Provided that the general meetings of Gram Sabha shall be held in such a manner that all
the Gram Panchayats are covered in a District in each of such months. The District Panchayat
Officer concerned shall notify Gram Panchayat-wise dates for the Gram Sabha meetings within the
District:”.
4.
Insertion of new section 5-B.—After section 5-A of the principal Act, the following
section shall be inserted, namely:—
“5-B. Constitution of Mahila Gram Sabha.- (1) There shall be a Mahila Gram Sabha in
every Gram Sabha. The Mahila Gram Sabha shall hold two meetings, first on 8th March
and second on first Sunday of September in each year which shall be convened by the
Mahila Pradhan or in her absence by the Mahila Up-Pradhan and in the absence of both, by
the senior Mahila Member of the Gram Panchayat.
(2) The meeting of Mahila Gram Sabha shall be presided over by the Mahila Pradhan or in
her absence by the Mahila Up-Pradhan and in the absence of both, by the senior Mahila Member of
the Gram Panchayat. In the meeting, the issues relating to women and children and issues
pertaining to overall development of Gram Panchayat shall be discussed and decision taken in the
meeting shall be placed in the meeting of the Gram Sabha for further appropriate action.”.
5.
Amendment of section 7.—In section 7 of the principal Act, after sub-section (4), the
following proviso shall be inserted, namely:—
“Provided that no person shall be chosen as member of the vigilance committee who is a
near relative of the office-bearer of Gram Panchayat:”.
6.
Amendment of section 8.—In section 8 of the principal Act, in sub-section (2), for the
existing first, second and third provisos, the following proviso shall be substituted, namely:—
“Provided that where there is no eligible candidate belonging to the Scheduled Castes or
Scheduled Tribes to be elected as member of the Gram Panchayat, no seat shall be reserved for
Scheduled Castes or Scheduled Tribes.”.
7.
Amendment of section 11-A.—In section 11-A of the principal Act, in sub-section
(5), for the words “three hundred” and “five hundred”, the words “five hundred” and “seven
hundred” shall respectively be substituted.
8.
Amendment of section 99.—In section 99 of the principal Act, in sub-section (5), for
the words “Executive Officer”, the word “Secretary” shall be substituted.
9.
Amendment of section 122.—In section 122 of the principal Act, in sub-section (1),
in clause (c), for the Explanation, the following Explanation shall be substituted, namely:—
“Explanation.—For the purpose of this clause the expression “family member” shall mean
grand-father, grand-mother, father, mother, spouse, son(s), unmarried daughter (s): or” .

10. Amendment of section 131.—In section 131 of the principal Act, in sub-section (4),
after the words “occurred in his office”, the words “for which a formal order shall be issued
accordingly by the District Panchayat Officer” shall be inserted.
11. Amendment of section 144.—In section 144 of the principal Act,—
(a) in sub-section (1), the words “or paid” shall be omitted; and
(b) in sub-section (2), the words “or pay the money” shall be omitted.

STATEMENT OF OBJECTS AND REASONS
Presently there is no provision in the Himachal Pradesh Panchayati Raj Act, 1994 which
may empower the women in the rural areas to exclusively discuss the issues relating to the women
and children and issues concerning overall development of the Panchayat. This matter has been
considered and it has been decided to make a provision for the constitution of Mahila Gram Sabha
under the Act ibid in each Gram Panchayat for the purpose of redressal of issues relating to them.
In order to ensure that the village level functionaries of various Department of the State
Government attend the meeting of the Gram Sabha, it has also been decided to empower the
District Panchayat Officer to notify different dates for the meetings of Gram Sabha in each Gram
Panchayat. Futher, there are complaints that the office-bearers of the Panchayats are nominating
their close kiths and kins as members in the Vigilance Committee of the Gram Sabha which leads
to a deep nexus between the office-bearers and the members of the Vigilance Committee resulting
in misutilization of Government funds. Thus, in order to curb this malpractice, it has also been
decided to define the expression “near relatives” and to make provision for their exclusion for
being appointed as members of Vigilance Committee and also to ensure transparency and quality
of works executed by the Panchayats. Further, section 122 deals with disqualifications of an office-
bearer of a Panchayat. There are complaints that family members of the office-bearers are
encroachers of the Government land and the office bearers are indirectly beneficiary thereof. Thus,
the explanation below sub-section (1) of section 122 is being made more exhaustive. This has
necessitated amendments in the Act ibid.
This Bill seeks to achieve the aforesaid objectives.

Whereas, Ministry of Defence, Government of India has issued a declaration under sub
section 1 of service 3 of the Works of Defence Act, 1903, published in the gazette of India dated

Indian Air Force Station and Installations in India.

No variation shall be made in the ground-level, and no building, wall, bank or other
construction above within 100 mts. without the permission of General Officer
Commanding and on such condition as he may prescribe.
(ii) No wood, earth, stone, brick, gravel, sand or other material shall be stacked, stored or
otherwise accumulated within 100 mts. Without the permission of General Officer
Commanding and such condition as he may prescribe.
(iii) No surveying operation shall be conducted otherwise than by or under the personal
supervision of a public servant duly authorized in this behalf, in the case of land under
the control of military authority, by the Commanding Officer and, in other cases, by
the Collector with the concerrence of the Commanding Officer within 100mts; and
(iv) Where any building, wall, bank or other construction above the ground has been
permitted under clause(i) of this sub-section to be maintained, erected, added to or
altered, repairs shall not, without the written approval of the General Officer
Commanding the District, be made with materials different in kind from those

Provided that with the written approval of the General Officer Commanding the

Shimla-2, the 9th April, 2015
No.Fin-2-C-(12)-1/2015.—Government of Himachal Pradesh hereby notifies the sale of
Himachal Pradesh Government Stock (securities) of 10-year tenure for an aggregate amount of
` 650.00 crore (Nominal). The sale will be subject to the terms and conditions spelt out in this
notification (called Specific Notification) as also the terms and conditions specified in the General
Notification No.Fin-2-C(12)-11/2003 dated July 20, 2007 of Government of Himachal Pradesh.
Object of the loan
1.
(i) The proceeds of the State Government Securities will be utilized for the
development programme of the Government of Himachal Pradesh.
(ii) Consent of Central Government has been obtained to the floatation of this loan as
required by Article 293 (3) of the Constitution of India.
Method of Issue
2. Government Stock will be sold through the Reserve Bank of India, Mumbai Office
(PDO) Fort, Mumbai-400 001 by auction in the manner as prescribed in paragraph 6.1 of the
General Notification No.Fin-2-C(12)-11/2003, dated July 20, 2007 at a coupon rate to be
determined by the Reserve Bank of India at the yield based auction under multiple price formats.
Allotment to Non-Competitive Bidders
3. The Government Stock upto 10% of the notified amount of the sale will be allotted to
eligible individuals and institutions subject to a maximum limit of 1% of the notified amount for a
single bid as per the Revised Scheme for Non-Competitive Bidding Facility in the Auctions of
State Government Securities of the General Notification (Annexure-II).
Place and Date of Auction
4. The auction will be conducted by the Reserve Bank of India, at its Mumbai Office,
Fort, Mumbai-400 001 on April 13, 2015. Bids for the auction should be submitted in electronic
format on the Reserve Bank of India Core Banking Solution (E-Kuber) System as stated below on
April 13, 2015.
(a) The competitive bids shall be submitted electronically on the Reserve Bank of India
Core Banking Solution (E-Kuber) System between 10:30AM and 12:00 PM.
(b) The non-competitive bids shall be submitted electronically on the Reserve Bank of
India Core Banking Solution (E-Kuber) System between 10:30 AM and 11:30 AM.
Result of the Auction
5. The result of the auction shall be displayed by the Reserve Bank of India on its website
on the same day. The payment by successful bidders will be on April 15, 2015.

Method of Payment
6. Successful bidders will make payments on April 15, 2015 before close of banking
hours by means of cash, bankers’ cheque/pay order, demand draft payable at Reserve Bank of
India, Mumbai/New Delhi or a cheque drawn on their account with Reserve Bank of India,
Mumbai (Fort)/New Delhi.
Tenure
7. The Stock will be of 10-year tenure. The tenure of the Stock will commence on April
15, 2015.
Date of Repayment
8.
The loan will be repaid at par on April 15, 2025.
Rate of Interest
9. The cut-off yield determined at the auction will be the coupon rate percent per annum
on the Stock sold at the auction. The interest will be paid on October 15 and April 15.
Eligibility of Securities
10. The investment in Government Stock will be reckoned as an eligible investment in
Government Securities by banks for the purpose of Statutory Liquidity Ratio (SLR) under Section
24 of the Banking Regulation Act, 1949. The stocks will qualify for the ready forward facility.
